CONCLUSIONS AND ORDER RECEIVED OCT 271913 SPOKANE COUNTY ENGINEER This matter has come before the Hearing Examiner Committee on October 21, 1993. The members of the Committee present are Phil Hams, Chairperson, Verona Southern and Frank Yuse. The sponsor, George Paras, requests approval of a Change of Conditions to allow bonus density, File No. ZE- 130B -78, to existing Urban Residential -22 (UR -22) zone and within the Aquifer Sensitive Area (ASA) Overlay Zone. FINDINGS OF FACT AND CONCLUSIONS 1. The property is generally located south of and adjacent to Third Avenue, approximately 600 feet east of University Road in the NW 1/4 of Section 21, Township 25 North, Range 44 EWM, Spokane County, Washington. 2. The committee adopts the Planning Department Report as a part of this record. 3. The existing land uses in the area include single family residences, apartments, Valley Transit Center and commercial uses. 4. The proposed use is compatible with existing uses in the area. 5. The Comprehensive Plan designates this site as Urban. The Urban category is intended to provide the opportunity for development of a "city -like" environment which includes various land uses and intensive residential development. 6. The existing zoning does implement and conform to the Comprehensive Plan. 7. The Arterial Road Plan designates Third Avenue as a Local Access Street, with a recommended right of way width of 60 feet. 8. The existing zoning of the property described in the application is Urban Residential - 22 (UR -22), previously established as Multiple Family Suburban (MFS) zoning in 1978 and redesignated to Urban Residential -22 (UR -22) on January 1, 1991 pursuant to the Program to Implement the Spokane County Zoning Code. 9. The provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with and a Determination of Nonsignificance was issued. The owners of adjacent lands expressed neither approval nor disapproval of the proposed use. 12. The applicant has demonstrated that the bonus density request is justified. Specifically, a public sewer system will serve the proposal and shopping and public transit are within walking distance as required per Chapter 14.820 of the Spokane County Zoning Code. 13. The proposed use will not be detrimental to the public health, safety, morals or welfare especially in light of the conditions recommended by the reviewing agencies. 14. The Committee additionally finds /concludes: a. The applicant should continue negotiations with Central Valley School District No. 356 to mitigate impacts of the proposal on the Central Valley School District. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Department. The agreement shall provide a written description of the subject property to which the agreement applies and also state the dollar amount and any other agreed to mitigating measures. Voluntary agreements between the Owner and the School District shall conform to the requirements of the Revised Code of Washington Chapter. Use of private wells and water systems is prohibited. SPOKANE COUNTY DIVISION OF BUILDINGS 1. The applicant shall contact the Department of Buildings at the earliest possible stage of design/development in order to be informed of code requirements administered/enforced by the department, e.g., State Building Code Act regulations, such as requirements for fire hydrant/flow, fire apparatus access roads, street address assignment, barrier -free regulations, energy code regulations and general coordination with other aspects of project implementation. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprinklers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction- related activities. 3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. Debris generated as a result of this project must be disposed of by means other than burning (construction waste, etc.) 6. All solid fuel burning devices (wood stoves, pellet stoves, etc..) must comply with local, state, and federal rules. CENTRAL VALLEY SCHOOL DISTRICT See Planning Department condition No. 7. Castle Park is located approximately 2 miles south of the site at University and 33 rd Avenue. Balfour Park is located northwest of the proposal at Balfour and Main. D. Neighborhood Characteristics: The surrounding area consists of multi- family, single family, and commercial uses. The Valley Transit Center is also located west of the proposal at the University Road and Fourth Avenue intersection. University City Mall is located northwest of the site along Sprague Avenue and University Road. E. Zoning Analysis: This site and the surrounding area comprising approximately 11 acres was originally zoned Multiple Family Suburban (MFS) for apartments in 1978 (ZE- 130 -78). This area has developed for multi - family use since that time and the subject property is a portion of what remains to be developed. The average density of existing multi- family uses in the area is approximately 22 units per acre which is lower than the proposed density of 26 units per acre. Although the project proposes a higher density than those established in the area, multi - family uses at various densities may be found compatible. The area west of the proposal along University Road is zoned for commercial uses and the areas to the north, east and south are generally zoned for residential uses including single family, duplexes and multi- family. West: Urban Residential -22 (UR -22) established in 1991, previously classified as Multiple Family Suburban (MFS) (ZE- 148 -78C) F. Land Use Analysis: The existing land uses in the area are residential, nonresidential and commercial. Residential uses are primarily apartments and condominiums. Single family residences are also located south of the proposal along Fourth Avenue. The Valley Transit Center is located west of the site and commercial uses including the University City Mall are located northwest of the site. Nonresidential uses in the area include professional offices and a retirement home. Site: Vacant and undeveloped North: University East Apartments South: Single family residences Fast: Apartments and condominiums West: Vacant land and apartments G . Circulation: Third Avenue will provide direct access to the site. Two ingress /egress approaches from Third Avenue are illustrated on the proposed site plan. All internal travel ways and parking areas will be paved. H . Design: The site plan illustrates two (2) structures of approximately 2,000 square feet each. The proposed structure height is 2 1/2 stories. The structures will be located in the interior of the lot and carports and parking areas will be located along the east and west property lines. Landscaping will be installed along all property lines and a berm will also be planted around the perimeter of the structures. (See Landscaping section of report.) Proposed Buffering/Landscaping Techniques: The proposed landscaping meets the requirements of the Zoning Code with a twenty (20) foot wide strip of Type III landscaping along Third Avenue and five (5) feet of Type III landscaping along the east, west and south property lines. The site plan also illustrates a six (6) foot high sight obscuring fence along that portion of the south property line which abuts the parking area. Other Site Plan Considerations: The site plan submitted generally conforms to the development standards of the existing Urban Residential -22 (UR -22) zone. The site plan submitted for review by the Hearing Examiner Committee is general in nature. Detailed review to determine compliance with all Code regulations and conditions of approval is recommended to be administrative and to occur at the Building Permit stage. I. Density: The proposed density is approximately 26 units per acre. The Urban Residential -22 (UR -22) zone allows 22 units per acre which may be increased through bonus densities as permitted under Chapter 14.820 of the Spokane County Zoning Code. Pursuant to Chapter 14.820, additional units per acre may be permitted for: 1) direct hookup to a sanitary sewer ( 3.5 units /acre) 2) availability of public transit within 1/4 mile walking distance (.5 units /acre) ; 3) shopping facilities within walking distance (.5 units/ acre). The maximum density permitted for this proposal is 17 units. A public sewer will be made available to the project and the Valley Transit Center and University City Mall are within 1/4 mile walking distance as required by Chapter 14.820: Bonus Density for Sewer Hookup. Summary Under the existing Urban Residential -22 (UR -22) density guidelines, the site - could be developed with 14 units per acre. The proposed 17 units per acre is consistent with the bonus density provisions of Chapter 14.820. J. Drainage: A drainage plan is required. This plan must be reviewed and approved by the County Engineers Department prior to development. K. Power Transmission Lines /Other Known Easements: The site plan submitted does not illustrate any easements. Any required or recorded easements will be disclosed during the building permits process. L. Water Supply: -The proposal is within the Modern Electric Water District. Sewage Disposal: The project will be served by a public sewer system. Plans and specifications shall be approved by the Spokane County Utilities Department prior to the issuance of building permits. N . School: The proposal is in the Central Valley School District No. 346. The Central Valley School District has responded to the proposal and is requesting that the applicant enter into a voluntary agreement to mitigate the impact of the proposal on the school district. This request is included as a condition of approval. O. Fire Protection: The proposal is within Fire District No. 1 . The Fire District and the Division of Buildings Department (Fire Marshall) are required to approve fire protection provisions prior to the issuance of building permits. P . Wetlands: Spokane County Wetland Inventory Maps do not indicate the presence of wetlands on the site. Q. Cultural Resources: None have been identified. R . Transit: The proposal is located within the Public Transit Benefit Area (PTBA) boundary. The Valley Transit Center is located west of the site at University Road and Fourth Avenue. III. ENVIRONMENTAL REVIEW: An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Planning Department has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Nonsienificance ( "DNS "). The "DNS" was circulated to 12 other agencies of jurisdiction and other agencies/ departments' affected by the future development for review and comment. The "DNS" comment period ends October 19, 1993 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional environmental related testimony at the public hearing. IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION The proposed Change of Conditions is consistent with the development standards of the Urban Residential -22 (UR -22) zone and the Goals, Objectives, and Decision Guidelines of the Urban category of the Comprehensive Plan. Public services available to the proposal support the increase in density pursuant to Chapter 14.820; Bonus Density for Sewer Hookup. The proposed density could be considered compatible with developments in the area and provide "fill -in development. Applicant will make connection to a Public Sewer System. Sewer Connection Permit is required. Plans and Specifications are to be reviewed and approved by the Utilities Department. That this proposal is in conflict with the provisions of adopted regulation or intent of adopted policies. 7. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 8. That the proposed use is compatible with existing uses in the area. (f 9. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. C. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Minor variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, building materials, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. c. SP- 636 -90 ) CONCLUSIONS AND DECISION THIS MATTER, an application for subdivision of land, from Robert Payne has been rece ved and decided upon, pursuant to Spokane County Subdivision regulations, on the ZOtkday of July, 1990. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to divide .9 acres into 3 lots for the development of one additional single family residence. 3. The proposal is located south of and adjacent to 3rd Avenue and north of and adjacent to 4th Avenue approximately 500 ft. east of University Road. 4. The current zoning of the property is Multiple Family Suburban. The proposed lot sizes, frontage and intended uses are allowed within this zone. 5. The Spokane County Comprehensive Plan designates this area as Urban. The development and uses proposed are generally in accord with this category/designation. 6. The Spokane County Arterial Road Plan designates 4th Avenue as a Collector Arterial with a planned right of way widtkof 70 feet. 7. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 8. No one in the area commented on the proposal. 9. The width of improved roadway along the frontage of 3rd Avenue is 40 ft. of asphalt from curb to curb and a sidewalk is constructed. The functional classification of 3rd Avenue is Local Access, and is improved beyond local access requirements. 10. Recognizing the recommended conditions and Spokane County development standards, the proposed subdivision makes appropriate provisions for the public health, safety and general welfare and that the public use and interest will be served by platting the subdivision. 11. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197 -11 -800 (6) (a). DECISION Based upon the above noted Findings of Fact and Conclusions, Short Plat Application SP- 636-90 is hereby APPROVED until August 1, 1990, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the applicant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed in writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors -in- interest to property. PLANNING DEPARTMENT CONDITIONS C 1. The preliminary plat of record approval is for the property legally described in the application for this proposal. SP- 636 -90 2 The final plat shall be designed substantially in conformance with the preliminary plat of record as legally described and advertised. No increase of density or lot number shall occur without a new application submittal and approval. 1 3.1 The Spokane County Planning Director /designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. The preliminary plat is given conditional approval for three (3) years, specifically to August 1, 1993. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expiration date. r •r 5. A final plat number shall be indicated before the final plat is filed, such number to be approved by the County Planning Director /designee. l 7: Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies must be received with the submittal of the final plat. 8 Three (3) current certificates of title shall be furnished the County Planning Department prior to filing the final plat. 9: The following statement shall be placed in the final plat dedication: No more than one (1) dwelling structure shall be placed on any lot, nor shall any lot be further subdivided for the purpose of creating additional lots, ownerships or building sites without first filing and receiving approval of a replat." The final plat map shall indicate by a clear dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement that: "Side yard and rear yard setbacks shall be determined at the time building permits are requested. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." I '11. No water plan is required and a simple tap is needed at the time of building permit -.. release. 12 A survey is required prior to the filing of a final plat. 13. Spokane County Planning Department is required to record with the County Auditor a • "Title Notice," as prepared and signed by the applicant, for a future acquisition area for road right -of -way and utilities to run with the land, and the future acquisition area reservation shall not be removed without prior approval by the Spokane County Planning Department. Notice shall be recorded prior to the issuance of a building permit and shall provide the following: a. 5 feet of future acquisition area for road right -of -way and utilities, in addition to the existing right -of -way dedication required by the County Engineer, along 4th Avenue. Appropriate road name(s) shall be indicated. b. Building and other setbacks required by the Spokane County Zoning Code shall be measured 25 ft. from the northern edge of the Future Acquisition Area that is resgrved for road right -of -way and utilities along 4th Avenue. c. The %5 ft. Future Acquisition Area, until acquired by Spokane County, shall be private property and may be used as allowed in the zone, except any improvements (such as landscaping, parking, surface drainage, drainfields, signs or others) shall be considered "interim" uses. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said Future Acquisition Area. d. This "Title Notice" shall be signed by the applicant to serve as official notice and acknowledgement of said Future Acquisition Area for road right -of -way and utilities. SP- 636 -90 3 COUNTY ENGINEER'S DEPARTMENT CONDITIONS t,1.4, The conditional approval of the plat is given by the County Engineer subject to .. dedication of right -of -way and approval of the road system as indicated in the preliminary plat of record. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the county mad system. :3.: Dedication of 10 ft. of additional right -of -way alon /l4th Avenue is required. (4' Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 5. Sidewalks are required along the arterial on /4th Avenue. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvements, pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This is applicable to 4th Avenue. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This is applicable to 4th Avenue. The following statement be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to r 3: „At 4 , 6` {12. SP- 636 -90 4 Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s). This is applicable to 4th Avenue. The County Engineer has designated Typical Roadway Section Number Two, Collector Arterial standard for the improvement of 4th Avenue, which is adjacent to the proposed development. This will require the addition of approximately 10 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right -of -way and the roadway improvements herein specified. The County Arterial Road Plan identifies 4th Avenue as a Collector arterial. The existing right -of -way width of 40 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right -of -way dedication, a strip of property 5 feet in width along the 4th Avenue frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to 4th Avenue Applicant must demonstrate, per short plat 63 90, that 60 ft. of dedicated right -of -way exists on the 3rd Avenue frontage of the plat. There appears to be a 20 ft. discrepancy between the County Engineers map and the designed short plat which would leave lot I of the short plat without frontage on 3rd Avenue. Applicant shall dedicate the additional 20 ft. of property to provide for a 60 ft. right of way along the frontage of 3rd Avenue. COUNTY HEALTH DISTRICT CONDITIONS (17, Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Department to the utility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Spokane County Health District prior to the issuance of any building permit for this project. Sewage disposal method shall be as authorized by (the Director of Utilities, Spokane County. Water service shall be coordinated through the Director of Utilities Spokane County. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. Disposal of sewage effluent beneath paved surfaces is currently prohibited. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that a suitable site for on -site sewage disposal system are available on tract 1. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that the existing on -site sewage disposal system serving the residence located on tracts 2 & 3 are wholly located within the boundaries of the tract. '10.\ Subject to specific application approval and issuance of permits by the health officer, the use of individual on -site sewage disposal systems may be authorized. The plat dedication will contain a statement to the effect that: "The public water system, as approved by County and state health authorities and the local fire district and purveyor, will be installed within this plat, and the subdivider will provide for individual domestic water service, as well as fire protection, to each tract prior to sale of each tract." COUNTY UTILITIES DEPARTMENT CONDITIONS a . Pursuant to the Board of County Commissioners Resolution No. 80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2.' • The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which the petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. No one in the area commented on the proposal. 9. The width of improved roadway along the frontage of 3rd Avenue is 40 ft. of asphalt from curb to curb and a sidewalk is constructed. The functional classification of 3rd Avenue is Local Access, and is improved beyond local access requirements. 10. As an alternative method of constructing the road improvements stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvements. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns. This is applicable to 4th Avenue. 9. The following statement be placed in the plat dedication: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)' property, and further not to object, by the signing of a ballot, to the formation of an RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owner(s)' property. If an RID is formed by either the petition or resolution method as provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree: (a) that the improvement(s) or construction contemplated within the proposed RID is feasible; (b) that the benefits to be derived from the formation of the RID by the property included therein, together with the amount of any County participation, exceed the cost and expense of formation of the RID; and (c) that the property within the proposed RID is sufficiently developed. Provided further that the owner(s) or successor(s) shall retain the right, as authorized under RCW 36.88.090, to object to any assessment(s) on the property as a result of the improvements called for in conjunction with the formation of an RID by either petition or resolution method under Chapter 36.88 RCW, and to appeal to the Superior Court the decision of the Board of County Commissioners affirming the final assessment roll. It is further agreed that at such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the undersigned owner(s), their heirs, grantees and assigns without participation by Spokane County. The RID waiver contained in this agreement shall expire after ten (10) years from the date of execution below. However, the owner(s) or successor(s) agree that if said RID waiver expires without construction of the required improvements, the owner(s) or successor(s) agree to construct the required improvements at their own expense, pay to SP- 636 -90 4 Spokane County the then estimated cost of the required improvements to enable the County to complete the same, or furnish a bond or other secure method suitable to the County (which may include the execution of another RID waiver agreement) providing for or securing to the County the actual construction of the improvements. All of the requirements of this agreement shall run with the land and shall be binding upon the owner(s), their successor(s) or assign(s). This is applicable to 4th Avenue. 10. The County Engineer has designated Typical Roadway Section Number Two, Collector Arterial standard for the improvement of 4th Avenue, which is adjacent to the proposed development. This will require the addition of approximately 10 feet of asphalt along the frontage of the development. The construction of curbing and sidewalk is also required. 11. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. 12. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of additional right -of -way and the roadway improvements herein specified. 13. The County Arterial Road Plan identifies 4th Avenue as a Collector arterial. The existing right -of -way width of 40 feet is not consistent with that specified in the Plan. In order to implement the Arterial Road Plan, in addition to the required right -of -way dedication, a strip of property 5 feet in width along the 4th Avenue frontage shall be set aside in reserve. This property may be acquired by Spokane County at the time when arterial improvements are made to 4th Avenue. 14. Applicant must demonstrate, per short plat 63390, that 60 ft. of dedicated right -of -way exists on the 3rd Avenue frontage of the plat. There appears to be a 20 ft. discrepancy between the County Engineers map and the designed short plat which would leave lot 1 of the short plat without frontage on 3rd Avenue. Applicant shall dedicate the additional 20 ft. of property to provide for a 60 ft. right of way along the frontage of 3rd Avenue. COUNTY HEALTH DISTRICT CONDITIONS 1. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Department to the utility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies must be received prior to the submittal of the final plat. 2. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Spokane County Health District prior to the issuance of any building permit for this project. 3. Sewage disposal method shall be as authorized by (the Director of Utilities, Spokane County. 4. Water service shall be coordinated through the Director of Utilities Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. 6. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 8. Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that a suitable site for on -site sewage disposal system are available on tract 1. 9.
