The applicant is requesting an area wide rezone with no new construction
proposed at this time. When units are converted to office uses all
requirements of the Residential office zone shall be complied with. Should
multiple lot development occur, involving the removal of existing
residences, the applicant will be required to come before the Hearing
Examiner Committee for development approval prior to issuance of building
permits. Individual lot development will require approval of a specific
development plan by the Zoning Administrator prior to issuance of building
permits. The western property lines of all lots under construction shall
contain a sight obscuring fence and/ or landscaping upon conversion to
office use.
The area is in a transition to residential offices uses along Pines Road.
The staff recognize this area as appropriate for office development to
serve a a buffer for the residential uses to the west. When units are
converted to office uses all requirements of the Residential Office Zone
shall be complied with.
IV. AGENCIES RECOMMENDED CONDITIONS
a) COUNTY FIRE MARSHAL
1. The site is located in Fire District #1.
2. Adequate water for fire protection and distribution of such water
shall be required. A plot plan showing water distribution and
emergency vehicle access is required for approval prior to any
land development or use.

e) SEPA
1. That the provisions of SEPA's Notice of Action pursuant to
43.21C.080 RCW be accomplished by the applicant within thirty
(30) days of formal action by the Zoning Hearing Examiner
Committee as instructed by the Planning Department staff.
2. The request has proven to be environmentally non - significant.
Therefore, a final declaration of non- significance shall be signed
by the Chairman of the Hearing Examiner Committee.
f) ZONING
1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
2. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for the
project prior to release of building permits.
3. Multiple lot development involving removal of existing residences
will require a specific development plan be submitted to _ the
Hearing Examiner Committee for review and approval prior to ,
issuance of building • permits.
4. A site obscuring fence and/ or landscaping along the West
property lines shall be required for each site upon conversion to
an office use.
5. Individual lot development will require the Zoning Administrators
approval of a specific development prior to issuance of building
permits.
6. Direct light from any exterior area lighting fixture shall not
extend over the property boundary.
g) Utilities
(1) An on -site sewage system be allowed under the rules and
regulations of the Spokane County Health District and subject to
specific application approval and issuance of permits by the
Health Officer.
(2) The owner, his heirs and successors shall agree not to protest
legal assessments for any utility local improvement district to
provide central sewerage service to this property.
(3) Water service shall be provided by Modern Electric Company in
accordance with the Coordinated Water System Plan for Spokane
County.

SUBJECT: Zoning Hearing Examiner Committee Actions of June 12, 1980.
On June 12, 1980, the Zoning Hearing Examiner Committee met at 9:00 A.M. to consider
eleven new zone reclassification applications and one reconsideration of conditions
applications. Members present: Mr. Culler, Chairman; Mr. Kennedy and Mr. Sceva, Jr.
Following are the applications in sequence and the action taken by the Committee.
If not appealed, these decisions will become final on June 27, 1980.
1) ZE- 30 -80, Change of Conditions - Commercial Zone: Redlin
Location: Generally located on the north side of Appleway Avenue, 290 feet
northeast of Corbin Road. Section 18- 25 -45.
Proposal: Construct a Four -Bay Self- Service Car Wash Facility.

A. INTRODUCTION
This matter having come before the Examiner Committee on June 12,1980, and the
members of the Committee present being John Culler, Chairman, Kenneth
Kennedy and Paul Sceva, Jr. and having personally visited the site.
B. PROPOSAL
C. FINDINGS OF FACT
SPOKANE COUNTY
HEARING EXAMINER COMMITTEE
FINDINGS AND ORDER
The sponsor, William Horn, is requesting approval of a zone reclassification, File
No. ZE-41 -80 Agricultural Suburban to Residential Office, for the purpose of
developing professional offices (medical and dental clinics).
1. That the existing land use in the area is residential, commercial, and un-
developed.
2. That the Comprehensive Plan designates this area as appropriate for resi-
dential development.
3. That the existing zoning of the property described in the application is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor dis-
approval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1
a) COUNTY FIRE MARSHAL
1. The site is located in Fire District #1.
2. Adequate water for fire protection and distribution of such water
shall be required. A plot plan showing water distribution and
emergency vehicle access is required for approval prior to any
land development or use.
b) COUNTY ENGINEER
1. Applicant shall dedicate a 20 foot radius on N.W. corner of 10th
Ave. and SR -27.
2. Access permits and improvements to SR-27 (Pines Road) must be
approved by the Washington State Department of Transportation.
3. Applicant shall construct cement concrete curb, sidewalk and
pave to existing pavement on 9th, 10th and 12th Ave.
4. An appropriate off -site drainage disposal system and access
plans shall be approved by the Spokane County Engineer's Office
prior to the issuance of building permits for the project.
5. A detailed combined on -site sewage system and surface water
disposal plan for the entire project shall be approved by the
Spokane County Engineer and the Spokane County Health
District prior to the issuance of any building permit.
6. The design, location and arrangement of parking stalls shall be
in accordance with standard traffic engineering practices. Any
portion of the project which is to be occupied or traveled by
vehicles shall be maintained in hard surface paving.
c) WATER PURVEYOR
1. Purveyor is Modern Electric Water Company and they are able to
supply the site with adequate water for domestic fire and
irrigation uses. Future construction or alterations will have to
be reviewed for adequate service.
d) COUNTY HEALTH DISTRICT
1. Findings:
a. This project lies over the Spokane Aquifer.
b. It is within Critical Water Supply Service Area No. 3 and
within the service area of Modern Electric Company.
Groundwater resources appear adequate to support
development at this density.
c. The project is inside the 201 Sewer Study Area Zone 3 and
inside the Primary Sanitary Sewer Area recommended in the
"208" Study. The method of sewage disposal is subject to
approval of the Director of Utilities pursuant to County
Resolution 80 -0418 adopted March 24, 1980. The
topography and soils in the area are generally suitable for
use of individual on -site sewage systems. The lots are not
of the proper dimensions to permit use of both an individual
well and sewage system.

Recommendations:
a. Subject to specific application approval and issuance of
permits by the Health Officer, the use of individual on -site
sewage disposal systems may be authorized.
b. A combined surface water and sewage disposal detailed plan
shall be approved by the County Engineer and the Health
Officer prior to the issuance of any building permit for this
lot.
h) The Department of Transportation requested:
I. That all access to the proposed property (the two lots
which remain undeveloped) be made on 10th Ave., and
that all County setbacks be observed from property lines
for future buildings.
E. ORDER
The Department of Ecology recommends:
That when additional paved parking areas are constructed,
thay must not be over the existing drainfields. The new
drainfields constructed on the two now vacant lots also
must be left uncovered by impervious paving.
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of William Horn for a zone reclassification as described in the
application should be approved.
