(Postponed from June 25, 1971, to allow applicant to submit a revised
development plan.)
Planning Commission Recommendation: Approve as advertised, subiect to the
following conditions:
A. Conditions:
1. Dedication of the West 5' of the advertised property along Raymond
Road for R/W. (Such dedication will provide a 25' R/W from the west
line of the subject property to the established centerline of Raymond
Road.)
2. Installation to Spokane County standards of curb, sidewalk, and
paving to existing oil along Raymond Road. (The applicant shall
make provision either to vacate the excess R/W along Raymond Road
or to obt ain encroachment permits from the County Engineer's Office
for landscaping as required in the Residential Office Zone.)
3. The property advertised for Local Business zoning shall be developed
in accordance with Sections 4.07A.110 and 4.07A.120 of the Spokane
County Zoning Ordinance. (R -O standards.) The front yard area shall
be completely and permanently landscaped in accordance with
Section 4.07A.120. Parking shall be limited to side and rear yards;
i.e., no parking in the front yard area of the existing building.
Signing shall conform to Section 4.07A.130.
4. The applicant shall install a screen six (6) feet in height along the
north property line of the advertised property for the length of the
adjoining apartment projects. Such screen shall be constructed of
ornamental masonry. The Planning Director may approve a planted
screen or ornamental fence in lieu of said masonry wall.
5. Access driveways shall be confined to the southerly side of the
project. Traffic circulation along the north side shall be minimized.
The submitted development plan contemplates a planter area between
the proposed office buildings and the existing apartments to eliminate
traffic along the north side of the project.
6. The Planning Commission reserves the right to readvertise the Local
Business property to Residential Office within five (5) years.

B. Reasons:
1. The Residential Office uses would provide an appropriate buffer
between the Sprague Avenue commercial frontages and the Main
Avenue apartment projects. (Multiple Family Suburban zoning
extends north to Valley Way.)

2. The uses permitted in the Residential Office Zone are compatible
with surrounding land uses which include: A 28 -unit apartment
complex and proposed office to the north, offices and apartments to
the east, a boat sales lot and a shoe store to the south, and a
church to the west.
3. The Commission recently approved a Residential Office proposal on
the southeast corner of Main Avenue and Raymond Avenue which
adjoins the advertised area.
4. The Planning Commission has required that the Local Business proposal
be developed to Residential Office standards to insure compatibility
with adjoining land uses. The Commission also reserves the right to
readvertise the Local Business property to Residential Office within
five (5) years.

Deed for a right of way for County Road purposes over property described in said deed has been
delivered to Right of Way Agent, as escrow agent, with instructions to
deliver said deed to the County Engineering Department. On delivery to the Spokane County
Engineering Department, a copy of this agreement properly executed by the duly authorized re-
presentative will be returned to the undersigned grantor.
In Consideration of the foregoing and other considerations hereinafter set forth, it is mutually
agreed by the parties hereto as follows: .
1. Said right of way is granted free and clear of all liens and encumbrances and partial
releases for said right of way shall be furnished to the Spokane County Engineering Department,
and the total amount in cash settlement shall be paid to the grantor except such portion thereof
as the grantor may assign to a lien holder in obtaining the partial release.
2. All work done under this agreement shall conform to all applicable building, fire, and
sanitary laws, ordinances and regulations relating to such work, and shall be done in a good '
and workmanlike manner.
3. All structures, improvements, or other facilities when removed and relocated or reconstruct-
ed by the Department, shall be left in as good a condition as found.
4. No work, improvements, alteration or maintenance by the Department, will be done or made
other than that provided for in this agreement.
5. The parties have here set out the whole of their agreement. The performande of this agree-
ment constitutes the entire consideration for the grant of said right of way and shall relieve
the Department of further obligations or claims on that account, or on account of the location,
grade and construction of the proposed highway. -
6. If and when possession of the right of way hereinafter referred to is acquired by Spokane
County, the Grantor agrees to allow Spokane County, its contractors and assigns to perform the
following work outside of the county right of way as necessary:
