On October 18, 1979, the Zoning Hearing Examiner Committee met at 9:00 A.M. to
consider eleven new zone reclassification applications and two reconsideration
of conditions applications. Members present: Mr. McCoury, Acting Chairman,
Mrs. Myers, and Mr. Sceva, Jr.
Following are the applications in sequence and the action taken by the Committee.
If not appealed, these decisions will be final on October 29, 1979.
1) ZN- 50 -79, Agricultural to Residential Mobile Home: Houghtaling
Location: Hamilton Road and Highway #395.
Proposal: Mobile Home Park and Mini - Storage.
Action: Continued to the November 15, 1979 Hearing to allow the sponsor
time to redesign the proposal with consideration to provisions
of additional parking for each site, define the exact location
of the drainfield, and further information on the water table as

This matter having come before the Examiner Committee on October 22, 1979, and
the members of the Committee present being Ted McCoury, Acting Chairman,
Jane Myers, and Paul Sceva, Jr., and there being the following persons present
who wish to request approval of a Zone Change; NONE for a Zone Reclassification,
Residential Office and Multiple Family Suburban to Commercial for the purpose of
retail uses.
B. FINDINGS OF FACT
1. That the existing zoning of the property described in the application is

A. INTRODUCTION
This matter having come before the Examiner Committee on October 18, 1979, and
the members of the Committee present being Ted McCoury, Acting Chairman,
Jane Myers, and Paul Sceva, Jr. and there being the following persons present
who wish to request approval of a Zone Change; Bill Erickson for a Zone
Reclassiftation, Change of Conditions on a previously approved application for
the purpose of ammending the approved condtion to allow a 1 -story structure, to
permit a 2 -story structure to be constructed with 17,600 square feet whereas the
original building plans were for 7,300 square feet.
B. FINDINGS OF FACT
1. That the existing land use in the area is Commercial, multi - family and
undeveloped..
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3: That the existing zoning of the property described In the application is
Local Business.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal os not in conflict with the provisions of adopted regula-
tion.

C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Marvels Colonial Shop (William Erickson) for a Change of Conditions
as described in the application should be approved.

1. The site is located in Fire District #1.
2. That mains and hydrants be installed and that access plans for fire

III. BACKGROUND /ANALYSIS
On September 13, 1974, Delbert Corporation requested a zone change from
Residential Office to Local Business for this site. The zone reclassification
was finalized on August 6, 1979 by the County Board of Commissioners,
with one of the conditions being; the structure built, be 7,300 sq. ft. and
1 story as presented. The applicant is requesting this condition be
changed to a two story structure, the first level - 6,400 sq. ft. and the
second level - 5,200 sq. ft. The basement - 6,000 sq. ft. will be used
for storage.
1. Access permits shall be obtained from the Spokane County
Engineer's Office prior to issuance of building permits.

Planning Commission Recommendation: Approve to Local Business Zone,
subject to the following conditions: (Vote was unanimous.)
1. Installation to Spokane County standards of sidewalk along Sunderland
Road.
2. A.:cess permits for the advertised property shall be obtained prior to release
of building permits.
3. The advertised property shall be developed in substantial conformance to
the submitted development plan and elevation sketches; i.e., a 7,300
square foot one story : olonial style structure abuting the east property
line with parking along the west and north perimeters of the project.
_. Approval of a specific landscape plan for the project. Such plan shall
indicate the type of jround cover contemplated, the species, variety
and distribution of plantings and an automatic sprinkler system . The areas

mitted plan. A 6" curb may be installed along the north property line within
the Sunderland setback area to delineate the ownership. An easement shall
be provided to allow access by the property owner to the north across the
advertised property through the described gate. (Condition requested by
applicant and property owner to the north.)
G. The delineated driveways, parking and loading areas shall be maintained in
hard surface paving. The parking lot shall be unlighted except that walkways
and driveways may be illuminated by !ow intensity lighting on standards not
exceeding eight (8) feet in height. The final design, location, and arrange-
ment of parking stalls and driveways shall be in accordance with standard
traffic engineering practices.

7. Approval of sewage disposal facilities by the Spokane County Health
District.
REASONS INCLUDING ENVIRONIviENTAL ASSESSMENT:
1. The proposed use, namely a specialty furniture store, is a low traffic
generator and will be designed to be compatible with office and multiple
family developments in the area. Extensive architectural design and
landscaping has been employed to reduce the retail appearance of the
operation.
2. The site is situated between a developed duplex area to the north and
intensive commercial centers to the south. Although the staff notes
that the site was zoned Residential Office in 1953, we note that the
character of the area north of Sprague Avenue has changed appreciably in
the last five years. Surrounding land uses include commercial development
to the south of Sprague Avenue, medical offices to the west, three duplexes
to the north, and residential properties zoned Residential Office to the
east.
3. The Commission notes that the Board of County Commissioners recently
approved an innovative commercial and office project along the north
side of Sprague Avenue between Herald and Felts Road. The Planning
Commission is of the opinion that certain retail uses can be allowed along
certain positions of the north side of Sprague Avenue if innovative archi-
tectural design, landscaping and traffic control can be incorporated into
the projects.
The site is situated within an urbanizing area. The zone change would
not 'nave any greater effect upon the topography, geology, biological and
botanical characteristics, atmospheric and aquatic conditions and other
natural development than similar uses established along Sprague Avenue.
In addition, the proposal is compatible with adjoining land uses, trans-
portation and utility services. The Commission, therefore, concludes that
an environmental impact statement is not required for the project.
