The request was originally scheduled for the October 18, 1979 hearing. It
was continued until several environmental concerns were answered. The
concerns were traffic generation, sewage disposal, and storm water.
At the writing of this report only the traffic question had been addressed.
The other two concerns have yet to be resolved between the applicants
and the appropriate agencies.
IV. AGENCIES CONSULTED /COMMENTS RECEIVED

2. Mains and hydrants need to be installed in the above areas.
Access plans for firefighting equipment around the building shall
be approved prior to building permit issuance.
3. Adequate water for fire protection and distribution of water is
required for the following zone changes. A water plan is
required to be submitted prior to any development or use of
subject lands.
b) COUNTY ENGINEER
1. Applicant shall dedicate 5 feet on Herald Road for right -of -way.
2. Applicant shall dedicate 10 feet on Main Avenue for right -of-
way.

Sprague and Felts Road Extension shall be completed by the
developer in cooperation with and as directed by the Spokane
County Engineer.
9. Appropriate on and off -site drainage and access plans shall be
approved by the Spokane County Engineer's Office prior to the
issuance of building permits for the project.
10. The design, location and arrangement of parking stalls shall be
in accordance with standard traffic engineering practices. Any
portion of the project which is to be occupied or traveled by
automobiles shall be maintained in hard surface paving.
c) WATER PURVEYOR
1. Purveyor is Modern Electric Water Company and they are able to
supply the site with adequate water for domestic fire and
irrigation uses.
d) COUNTY HEALTH DISTRICT
1. No comments received.
e) SEPA
1. That the provisions of SEPA's Notice of Action pursuant to
43.21C.080 RCW be initiated by the applicant within thirty (30)
days of final action of the Responsible Administrative Body and
be completed before any site improvements are made.

2. The request has proven to be environmentally non - significant.
Therefore, a final declaration of non - significance shall be signed
by the Chairman of the Hearing Examiner Committee.
1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
2. A specific landscape plan, planting schedule and provisions
for maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond
for the project prior to release of building permits. The
maintenance shall include an irrigation system for the land-
scaping.
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Minor variations when approved by the Zoning
Administrator will be permitted, including, but not limited to the
following changes: Building location, landscape plans, and
general allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall be
maintained.
4. Prior to issuance of building permits the applicant shall work
with the Health Department and 208 staff to resolve. The
concerns of sewage disposal and ,storm water treatment and
disposal.

C. Discussion of impacts identified above: Project is largest single site shoppir
area in Spokane County in recent history, excepting Valley Mall and Hanson
shopping center proposals. Site design indicates parking for 500 autos with
only ingress and egress from and onto Sprague Avenue's westbound curbside
traffic lane (a barrier exists to eastbound travel). Most of traffic is
stated to be associated with shopping locations existing on south side of
Sprague. The potential for traffic congestions and hazards is great.
Project sponsor has to date not provided details sufficient to mitigate staff
concerns. Applicant has not to date responded to "Additional Information"
pursuant to WAC 197 -20 -330. (continued on attached page)

Staff has two major on -site concerns with present proposal. No
provision has apparently been made to dispose of stormwater in
a manner which will minimize addition of substantial pollutants
to the aquifer. No details are available for disposal of sewage
in a manner consistent with minimizing impact on the aquifer.
The applicant has not to date responded to staff requests for
additional information pursuant to WAC 197 -10 -330. Lacking such
information, the staff must operate on information available to
date,and recommend to the Hearing Examiner Committee, pursuant to
WAC 197 -10 -060 and 360, that the impacts of the proposal, both
direct and indirect, are still in doubt, and there exists a
reasonable belief that the proposal could have a significant
adverse impact on the physical environment. Consequently, a
Declaration of Significance and an E.I.S. are recommended to the
Hearing Examiner Committee.

Deed for a right of way for County Road purposes over property described in said deed has been
delivered to Right of Way Agent, as escrow agent, with instructions to
deliver said deed to the County Engineering Department. On delivery to the Spokane County
Engineering Department, a copy of this agreement properly executed by the duly authorized re-
presentative will be returned to the undersigned grantor.
In Consideration of the foregoing and.other considerations hereinafter set forth, it is mutually
agreed by the parties hereto as follows:
1. Said right of way is granted free and clear of all liens and encumbrances and partial
releases for said right of way shall be furnished to the Spokane County Engineering Department,
and the total amount in cash settlement shall be paid to the grantor except such portion thereof
as the grantor may assign to a lien holder in obtaining the partial release.
2. All work done under this agreement shall conform to all applicable building, fire, and
sanitary laws, ordinances and regulations relating to such work, and shall be done in a good
and workmanlike manner.
3. All structures, improvements, or other facilities when removed and relocated or reconstruct-
ed by the Department, shall be left in as good a condition as found.
4. No work, improvements, alteration or maintenance by the Department, will be done or made
other than that provided for in this agreement.
5. The parties have here set out the whole of their agreement. The performance of this agree-
ment constitutes the entire consideration for the grant of said right of way and shall relieve
the Department of further obligations or claims on that account, or on account of the location,
grade and construction of the proposed highway.
6. If and when possession of the right of way hereinafter referred to is acquired by Spokane
County, the Grantor agrees to allow Spokane County, its contractors and assigns to perform the
following work outside of the county right of way as necessary:

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on December 13
having been continued from the November 15, 1979 meeting,
1919, /and the members of the Committee present being Eldon Thomas,
Chairman, Jane Myers and xRauhxSeexawxxx Ted McCoury
and there being the following persons present who wish to request approval of a
Zone Change; Pat Harper, representing the applicant, for a Zone
Reclassification, Residential Office and Multiple Fam. Suburban to Com'l for the
purpose of retail establishments.
B. FINDINGS OF FACT
1. That the existing land use in the area is residential, fire station, park and
commercial.
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the application is
Residential Office and Multiple Family Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with as Of December 13, 1979.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal beVis not in conflict with the provisions of adopted
regulation.
