Culler, Chairman, Kathleen Carstens, and Jane Myers. The sponsor, Earl Crawford, is requesting approval of a zone reclassification, File No. ZE- 96 -81, Agricultural Suburban and Multiple Family Suburban, for the purpose of continuing the use of the existing auto body repair shop. 1. That the existing land use in the area is residential, commercial and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Urban /Commercial development. 3. That the existing zoning of the property described in the application is Agricultural Suburban and Multiple Family Suburban. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of . Non - Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the pro- posed rezone is justified. 8. That the proposed use is compatible with existing uses in the area. 9. That the owners of adjacent lands expressed neither approval nor dis- approval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 1 C. The following are additional findings of fact considered by the Hearing Examiner Committee: a) That the proposed zoning is compatible with the designated areas of the Comprehensive Plan. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL a) COUNTY PLANNING DEPARTMENT 1. The specific development plan will be submitted for Planning Depart- ment review and approval prior to issuance of building permits. 2. A 6 -foot sight- obscuring barrier shall be provided along any boundary of this proposal approved for Commercial zoning which abuts residen- tial zoning to the east and south prior to issuance of building permits to provide a buffer. 3. Applicant shall comply with '208' recommendations concerning storm - water runoff and provide necessary landscaping for runoff. 4. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide- lines (WAC 197 -10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non - significance has been issued at least fifteen (15) days prior to this date; the official file, written comments and /or public testimony contain information regarding assess- ment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environment are anticipated as a result of the project; and a final declaration of non - significance is hereby to be issued. 5. That, pursuant to WAC 197 -10 -040 (2)(a) and (20), WAC 197 -10 -155 and SCEO 11.00.055, the rezone is an action subject to SEPA, but insufficient detail concerning the proposal is available to permit mean- ingful environmental analysis at the rezone level, consequently a detailed site plan, subject to full compliance with Chapter 43.21C RCW, shall be submitted for consideration to the Hearing Examiner Committee at a later date. Furthermore, it is hereby stipulated that, because of project details not now available, the Committee may require additional information pursuant to WAC 197 -10 -330 and may deny or condition the approval of said project at the site plan review stage, pursuant to Chapter 43.21C.060 RCW. .b) COUNTY ENGINEERING DEPARTMENT 1. The owner, his heirs and successors shall further agree not to oppose or protest any legal assessments for any utility local improve- ment district (ULID) established pursuant to RCW Chapter 36.94, as amended. 3 ;le No. ZE -96 -81 c) COUNTY UTILITIES DEPARTMENT (continued) 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County. 4. Each new unit shall be double plumbed for connection to future areawide collection system. d) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site is located in Fire District #1. 2. Installation of fire hydrants to be in accordance with the requirements of the Spokane County Department of Building and Safety. 3. That prior to development of this property that an engineered water distribution system plan shall be submitted to the Spokane County Department of Building and Safety. This distribution plan shall include water main size, flows, locations, fire hydrant type and locations, water storage tanks size, and location and design criteria. e) SPOKANE VALLEY FIRE DEPARTMENT 1. Mains and hydrants need to be installed in the area. Access plans for firefighting equipment around the building shall be approved prior to building permit issuance. f) COUNTY HEALTH DISTRICT 1. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Health District prior to the issuance of any building permit for this project. 2. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 3. Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on -site sewage system may be authorized. 4. Water service must be coordinated through the Director of Utilities, Spokane County. 5. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social and Health Services. 6. Use of private wells and water systems is prohibited. 7. Disposal of sewage effluent beneath paved surfaces is currently prohibited. 4 g) WATER PURVEYOR 1. Modern Electric Water Company indicates that arrangements have not been made to serve this proposal, but that they are able to provide adequate water to this site. E. BACKGROUND /ANALYSIS The Comprehensive Plan designates the property fronting on MuIlan Road to a depth of approximately 200 feet as Commercial, while the remainder of this proposal is located in the Urban category. A review of the existing zoning along MuIlan shows that area to be in transition to Local Business and Residential Office Zones. Freeway Commercial and Commercial zoning are found at the intersection of Argonne Road and Mission Avenue. The existing zoning along Mission Avenue east of MuIlan is predominately Agricultural and Agricultural Suburban. There is Residential Office zon- ing for the first 200 feet east of MuIlan Road on the north side of Mission Avenue. It appears that the applicants have provided very few reasons for approval of this zone change to Commercial other than legalizing the auto body repair shop improperly established on a portion of this site earlier this year. Complaints were made about the zoning violation which apparently led to the submittal of this rezone request. IV. AGENCIES RECOMMENDED CONDITIONS. IF APPROVED a) COUNTY PLANNING DEPARTMENT 1. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. 2.
