That the proposal is not totally inconsistent with the sur- rounding and use classifications and does not grant a special privilege or rights to the applicant different than those enjoyed by adjacent property owners. 11. That the Board finds that the proposal is located within the recorded water service area of Modern Electric Water Company, and that the District indicates there is an adequate system capacity, and that they are desirous of serving the proposal for domestic, fire and irrigation purposes. 12. That the proposal is situated within the recorded fire service area of Fire District #1. 13. That the proper legal requirements for advertising of the hearing before the Board of County Commissioners of Spokane County have been met. 14. That on the 10th day of August, 1982, the Board or County Commissioners of Spokane County at a regular meeting did APPROVE the proposal subject to certain conditions. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on June 10, 1982, and the members of the Committee present being Ronald L. McVicker, Chairman, Kathleen M. Carstens and Richard L. Skalstad. B. PROPOSAL The sponsor, Pring Corporation, is requesting approval of a zone reclassifica- tion, File No. ZE- 38 -82, Residential Office to Commercial, for the purpose of developing a Retail Store. C. FINDINGS OF FACT SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINGS AND ORDER 1. That the existing land use in the area Is residential, University City and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Commercial development. 3. That the existing zoning of the property described in the application is Residential Office. 4. FINDINGS OF FACT (continued) 11. The following are additional findings of fact considered by the Hearing Examiner Committee: a) That the Residential Office zoning be retained to serve as a buffer for the residential properties to the north, with especial consideration to the existing residences along Walnut Road. b) That sufficient parking has not been provided to meet Zoning Ordi- nance standards, the proposed building exceeds site coverage over that allowed by zoning standards, and the location of the building does not comply with setback requirements of the proposed zone reclassifi- cation. c) The Zoning Adjustor continued the hearing for the advertised Variance with regard to a request for deletion of the rear yard setback and reduction of required parking spaces until June 28, 1982, at 1:15 p.m. to render a decision. This date will be the end of the appeal period after the Zoning Hearing Examiner Committee signs the Findings and Order which outlines the action taken at their public hearing. D. ORDER The Hearing Examiner Committee, pursuant to the aforementioned, finds that the application of Pring Corporation, for a zone reclassification as described in the application should be denied. B. SITE CONSIDERATIONS - The proposal is to rezone the northern 96.35 feet of the site plan to Commercial zoning in order that the site development plan can be accomplished. The site plan includes the southerly portions of the parcel to Sprague Avenue which is currently zoned Commercial. The Planning Department in reviewing this applica- tion divides this request into two major requests: 1) Should the northerly portion be rezoned to Commercial, and 2) Should development be allowed as requested on the site plan (which includes a request for a "Variance" to the Zoning Ordinance). 30 ZE -38 -82 & VE-99-82 ZONE RECLASSIFICATION NUMBER: ZE -38 -82 & VE-99-82 III. BACKGROUND /ANALYSIS (continued) B. SITE CONSIDERATIONS (continued) The first request for rezoning would be a decision of the Hearing Examiner Committee. The second would require the approval of a variance, as the site plan does not meet parking requirements, set- back requirements, or building coverage requirements of the Commercial Zone classification; and, therefore, would require approval by the Zoning Adjustor to be able to develop the site in this way. C. HISTORY OF OTHER LAND USE ACTIONS - As previously men- tioned, the property to the south of the rezone request was zoned Commercial in January, 1981. At that time the Board of County Commissioners made a specific condition that the northerly 90 feet would not be . rezoned and remain in its present zone classification until further justification for development is submitted. (ZE- 136 -80). The sponsor of the proposal is now submitting that justification now exists and wishes to develop the site into a fabric store. D. CONCLUSION - The Planning Department, based on the Comprehen- sive Plan Guidelines and existing use proposal, would recommend that the zone change be approved, subject to current standards of the Commercial Zone or contingent upon an approval of the "Variance" request by the Zoning Adjustor. IV. AGENCIES RECOMMENDED CONDITIONS, IF APPROVED a) COUNTY PLANNING DEPARTMENT 1. All current standards of the Commercial Zone, as amended, shall be complied with in the development of this site or as allowed by the Zoning Adjustor. 2. The applicant shall develop subject property generally in accord- ance within the concept presented to the Hearing Examiner Com- mittee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allow- able uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. 3. A 6 -foot sight- obscuring cyclone fence shall be provided along the northern boundary of this proposal to provide a buffer for the existing uses to the north of this site. A comparable substitute to the cyclone fencing may be approved by the Zoning Administrator. 3/ ZONE RECLASSIFICATION NUMBER: ZE -38 -82 & VE -99 -82 a) COUNTY PLANNING DEPARTMENT (continued) 4. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commissioners Resolution 477 -1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on -site improvements. 5. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guidelines (WAC 197 -10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non - significance has been issued at least fifteen (15) days prior to this date; the official file, written comments and /or public testimony contain information regarding assessment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environment are anticipated as a result of the project; and a final declaration of non - significance is hereby to be issued. b) COUNTY ENGINEERING DEPARTMENT 1. Applicant shall dedicate 5 feet on Herald Road and a 20 foot radius on Herald and Sprague for right -of -way prior to any use of the property. 2. Access permits shall be obtained from the Spokane County Engineer prior to the issuance of a building permit or any use of the property. 3. Applicant shall improve Herald Road in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width Access Standard. 4. Applicant shall submit for approval by the Spokane County Engineer road, drainage, and access plans prior to the issuance of a building permit on the property. 5. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed com- bined on -site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 6. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accord- ance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. ZONE RECLASSIFICATION NUMBER: b) COUNTY ENGINEERING DEPARTMENT (continued) 7. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 8. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 9. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construc- tion, and other applicable county standards and /or adopted reso- lutions pertaining to Road Standards and Stormwater Manage- ment in effect at the date of construction, unless otherwise approved by the County Engineer. 10. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commis- sioners Resolution No. 80 -1592 as amended. c) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district (ULID) pursuant to RCW, Chapter 36.94, as amended. The owner, his heirs and succes- sors shall further agree not to oppose or protest any legal assessments for any utility local improvement district (ULID) established pursuant to RCW Chapter 36.94, as amended. 3. Any water service for this project shall be provided in accord- ance with the Coordinated Water System Plan for Spokane County. 4. Each unit shall be double plumbed for connection to future area - wide collection system. LE -38 -82 & VE-99-82 d) COUNTY HEALTH DISTRICT ZONE RECLASSIFICATION NUMBER: ZE -38 -82 & VE -99 -82 1. The Health District has noted that a 35' x 86' area has been set aside as a "landscaping and drainfield" area. This area may be too small. Approval of this proposal will be subject to specific application for a sewage disposal permit, and the method of sewage disposal will be determined by the Spokane County Utilities Department. It is noted that the proposed septic tank and drainfield are about 200 feet apart. This could result in a problem of the drainfield being too deep. Other than specific design problems, the Health District does not object to the pro- posed zone change. e) COUNTY BUILDING AND SAFETY DEPARTMENT 1. The site is located in Fire District #1. 2. A plan for emergency equipment access is required to be sub - mitted prior to any land development. 3. Recommend approval with condition that prior to development of this property that an engineered water distribution system plan shall be submitted to the Spokane County Department of Building and Safety. This distribution plan shall include water main size, flows, locations, fire hydrant type and locations, water storage tanks size, and location and design criteria. f) WATER PURVEYOR 1.
