B. PROPOSAL
The sponsor, Richard G. Loosmore, Jr., is requesting approval of a zone
reclassification, File No. ZE- 10 -83, Multiple Family Suburban to Residential
Office, and CUE -7 -83, Conditional Use Permit, for the purpose of developing
a Beauty Salon. The Spokane County Zoning Ordinance Sections 4.07A.140 -(g)
and 4.24.420 allow a beauty salon as a Conditional Use in the Residential
Office Zone.

2. That the Comprehensive Plan designates this area as appropriate for
Urban development.

4. That the provisions of ROW 43.21C (The State Environmental Policy Act)
have been complied with, and the Committee concurs with the Declaration
of Non- Significance.
5. That the proper legal requirements for advertisement of the Agenda item

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
2. The applicant shall develop subject property generally in
accordance within the concept presented to the Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
3. All current standards of the Residential Office Zone, as
amended, shall be complied with in the development of this
site.

4. Landscaping shall be provided for this site, in conform-

5. That the provisions of SEPA's NOTICE OF ACTION pursuant
to Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the
project applicant within thirty (30) days of final dispo-
sition of this application, and prior to any on -site
improvements, or file appropriate documents to the effect
that the NOTICE OF ACTION is waived in accordance with
Spokane County Commissioners' Resolution #82 -0458 dated
May 4, 1982.
6.• That parking spaces shall be developed in substantial
conformance with the plot plan on file with this applica-
tion. The plan shows that the required six (6) spaces
can be located in compliance with the zoning provisions.
However, staff is recommending that only four (4) spaces
be utilized until the need for the two additional spaces
arises. This recommendation is based on the fact that
development of two of the required spaces would result in
the elimination of existing shrubbery and a large Maple
tree. The need for these additional spaces shall be
determined by the Zoning Administrator.
Prior To The Issuance of A Building Permit:
1. Applicant shall dedicate 6 feet on Main Avenue for right
of way prior to any use of the property.
2. Applicant shall dedicate 6 feet on Raymond Road for right
of way and slope easements as necessary prior to any use
of the property.
3. Applicant shall dedicate a 20 foot radius on Raymond Road
and Main Avenue prior to any use of the property.
4. Applicant shall improve Main Avenue in a manner consistent
with Spokane County TYPICAL roadway section No, 1 minimum
paving width Access Standard,

6. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the
issuance of a building permit on the property, or issuance
of a Certificate of Occupancy.
7. The applicant shall submit for approval by the Spokane
County Engineer and the Spokane County Health District a
detailed combined on -site sewage system plan and surface
water disposal plan for the entire project prior. to the
issuance of any building permit on the property, or release
of Certificate of Occupancy.
8. A parking plan and traffic circulation plan shall be sub-
mitted and approved by the Spokane County Engineer prior
to the issuance of a building permit on the property. The
design, location, and arrangement of parking stalls shall
be in accordance with standard traffic engineering practices.
Paving or surfacing as approved by the County Engineer, will
be required, if parking requirements are increased as the
result of remodeling 51% or more of the existing structure.
9. The word "applicant" shall include the owner or owners of
the property, his heirs, assigns, and successors.
10. The construction of the road improvements stated herein
shall be accomplished as approved by the Spokane County
Engineer,
11. All required improvements shall conform to the current
State of Washington Standard Specifications for Road and
Bridge Construction, and other applicable County standards
and /or adopted resolutions pertaining to Road Standards
and Stormwater Management in effect at the date of con-
struction, unless otherwise approved by the County Engineer.
12. Roadway standards, typical roadway sections and drainage
plan requirements are found in Spokane Board of County
Commissioners' Resolution No. 80 - 1592, as amended.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners' Resolution
No. 80 -0418, the use of on -site sewer disposal systems is
hereby authorized. This authorization is conditioned on
compliance with all rules and regulations of the Spokane
County Health District and is further conditioned and
subject to specific application approval and issuance of
permits by the Health District.

2. The owner, his heirs or successors shall join and participate
in any petition or resolution which purpose is the formation
of a utility local improvement district (ULID) pursuant to
RCW Chapter 36.94, as amended.
3 . Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County.
d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan
shall be approved by the County Engineer and the Spokane County
Health District prior to the issuance of any building permit for
this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of
permits by the Health Officer, the use of an individual on -site
sewage system may be authorized.
4. Water service must be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public'water supply when
approved by the Regional Engineer (Spokane), State Department
of Social and Health Services.
6. Use of private wells and water systems is
prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District #l.
2. Adequate water for fire protection and distribution of such
water is required. A water plan is required to be submitted
for approval prior to any land development.

3. Reclassification of an existing building shall require an
application for change of occupancy permit, and subsequent
inspection for approval.
4. Premises Identification. Approved numbers or addresses
shall be placed on all new and existing buildings in such
a position as to be plainly visible and legible from the
street or road fronting the property. Said numbers shall
contrast with their background.
f) . WATER PURVEYOR
1. The proposal is located within the boundary of Modern
Electric Water Company, which indicated arrangements have
not been made, but that they are able to provide water
service to this site.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. That all parking areas shall be paved.
h) '208' STUDY
1. Applicant shall comply with '208' recommendations concern-
ing stormwater runoff and provide necessary landscaping
for runoff.

III. BACKGROUND /ANALYSIS
a) COMPREHENSIVE PLAN - The project lies within the Urban category
which is intended to provide the opportunity for development of
various land uses. The Plan addresses the importance of finding
that land use proposals should conform to plans, policies, and
regulations. This proposal is found to be in compliance with
County Plans.
b) SITE CONSIDERATIONS — The site is well landscaped and contains
an existing structure requiring little or no exterior modifica-
tions. Being on a corner lot, there is good access from Raymond
or Main Avenue. The area is primary multiple family and
professional offices. Residential Office zoning has been estab-

zoning has also been approved for the property directly across
Main Avenue from the project site (See File 54 -710).
c) HISTORY OF OTHER LAND USE ACTIONS - The subject property has
been zoned Multiple Family Suburban since the original zone
classification established in 1939. As noted herein, properties
to the east and south towards Sprague Avenue have received zone
approvals for Commercial in 1978 and Residential Office in 1971.
d) OTHER REQUIRED PERMITS - Pursuant to Section 4.07A.140 -(9) of
the Zoning Ordinance, Barber and Beauty Shops are permitted only
after the issuance of a Conditional Use Permit and in accordance
with minimum standards enumerated in Section 4.24.420. The
applicant's proposal is being heard jointly by the Hearing
Examiner Committee and the Zoning Adjustor.
e) CONCLUSION - The Comprehensive Plan and recent zoning trends
would support a decision to approve the zone change. Further,
with review and approval of the Conditional Use Permit by the
Zoning Adjustor, additional conditions could supplement the
conditions imposed with the approval of the zone change by the
Hearing Examiner Committee.

7. The applicant shall submit for approval by the Spokane
County Engineer and the Spokane County Health District a

issuance of any building permit on the property, or release

8. A parking plan and traffic circulation plan shall be sub-

be required, if parking requirements are increased as the
result of remodeling 51% or more of the existing structure.
9. The word "applicant" shall include the owner or owners of
the property, his heirs, assigns, and successors.
10. The construction of the road improvements stated herein
shall be accomplished as approved by the Spokane County

11. All required improvements shall conform to the current
State of Washington Standard Specifications for Road and .
Bridge Construction, and other applicable County standards

tions. Being on a corner lot, there is good access from Raymond

of the subject property (See File 89 -78C). Residential Office
zoning has also been approved for the property directly across
Main Avenue from the project site (See File 54 -71C).
c) HISTORY OF OTHER LAND USE ACTIONS - The subject property has
been zoned Multiple Family Suburban since the original zone
classification established in 1939. As noted herein, properties
to the east and south towards Sprague Avenue have received zone
approvals for Commercial in 1978 and Residential Office in 1971.
d) OTHER REQUIRED PERMITS - Pursuant to Section 4.07A.140 -(9) of
the Zoning Ordinance, Barber and Beauty Shops are permitted only
after the issuance of a Conditional Use Permit and in accordance
with minimum standards enumerated in Section 4.24.420. The
applicant's proposal is being heard jointly by the Hearing
Examiner Committee and the Zoning Adjustor.
e) CONCLUSION - The Comprehensive Plan and recent zoning trends
would support a decision to approve the zone change. Further,
with review and approval of the Conditional Use Permit by the
Zoning Adjustor, additional conditions could supplement the
conditions imposed with the approval of the zone change by the
Hearing Examiner Committee.
1. Approval by the Zoning Administrator of a specific light-
ing and signing plan for the described property prior to
the release of any building permits.
2. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing
Examiner Committee. Variatidns when approved by the
Zoning Administrator will be permitted, including, but
not limited to the following changes: Building location,
landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations
set forth in the Spokane County Zoning Ordinance. The
original intent of the development plans shall be main-
tained.
3. All current standards of the Residential Office Zone, as
amended, shall be complied with in the development of this
site.

4. Landscaping shall be provided for this site, in conform-
ance with Standards as identified in Section 4.07A.120
Landscaping.
5. That the provisions of SEPA's NOTICE OF ACTION pursuant
to Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners Resolution #77 -1392 be initiated by the
project applicant within _thirty (30) days of final dispo-
sition of this application, and prior to any on -site
improvements, or file appropriate documents to the effect
that the NOTICE OF ACTION is waived in accordance with
Spokane County Commissioners' Resolution #82 -0458 dated
May 4, 1982.
6. That parking spaces shall be developed in substantial
conformance with the plot plan on file with this applica-
tion. The plan shows that the required six (6) spaces
can be located in compliance with the zoning provisions.
However, staff is recommending that only four (4) spaces
be utilized until the need for the two additional spaces
arises. This recommendation is based on the fact that
development of two of the required spaces would result in
the elimination of existing shrubbery and a large Maple
tree. The need for these additional spaces shall be
determined by the Zoning Administrator.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance of A Building Permit:
1. Applicant shall dedicate 6 feet on Main Avenue for right
of way prior to any use of the property.
2. Applicant shall dedicate 6 feet on Raymond Road for right
of way and slope easements as necessary prior to any use
of the property.
3. Applicant shall dedicate a 20 foot radius on Raymond Road
and Main Avenue prior to any use of the property.

Recently I was contacted by Jim Mathis of Sunshine Brokers Inc. regarding the
above referenced zone change. Mr. Mathis indicated that a Mr. and Mrs. Meyer
had recently purchased the property from the zone change applicant Mr. Loosmore.
They were not advised of the "conditions of approval" on behalf of Mrs and
Mr. Meyer. After review the proposal with G. Remaly it was determined that the
RID/CRP provision would be appropriate considering the size and nature of the
proposed use and the traffic which would be generated.
It should be noted that the roadway improvements as specified in the "findings
and order" will be required if the use is expanded or there is a change in use of the
site.

13. To construct the road improvements stated herein, the applicant may, with the approval of
the County Engineer, join in and be a willing participant in any petition or resolution
which purpose is the formation of a Road Improvement District (RID) for said improvement
pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of
these improvements.
14. As an alternative method of constructing the road improvement stated herein, the appli-

being Ronald L. McVicker, Chairman, Jane E. Myers and Kenneth Kennedy.
B. PROPOSAL
The sponsor, Richard G. Loosmore, Jr., is requesting approval of a zone
reclassification, File No. ZE- 10 -83, Multiple Family Suburban to Residential
Office, and CUE -7 -83, Conditional Use Permit, for the purpose of developing
a Beauty Salon. The Spokane County Zoning Ordinance Sections 4.07A.140 -(g)
and .4.24.420 allow a beauty salon as a Conditional Use in the Residential
Office Zone.

1. Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of
any building permits.
2. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans shall
be maintained.
3. All current standards of the Residential Office Zone, as
amended, shall be complied with in the development of this
site.

project applicant within thirty (30) days of final dispo-

improvements, or file appropriate documents to the effect
that the NOTICE OF ACTION is waived in accordance with
Spokane County Commissioners' Resolution H82 -0458 dated
May 4, 1982.
6. That parking spaces shall be developed in substantial
conformance with the plot plan on file with this applica-
tion. The plan shows that the required six (6) spaces
can be located in compliance with the zoning provisions.
However, staff is recommending that only four (4) spaces
be utilized until the need for the two additional spaces
arises. This recommendation is based on the fact that
development of two of the required spaces would result in
the elimination of existing shrubbery and a large Maple
tree. The need for these additional spaces shall be
determined by the Zoning Administrator.

be in accordance with standard traffic engineering practices.
Paving or surfacing as approved by the County Engineer, will
be required, if parking requirements are increased as the
result of remodeling 51% or more of the existing structure.
9. The word "applicant" shall include the owner or owners of
the property, his heirs, assigns, and successors.
10. The construction of the road improvements stated herein
shall be accomplished as approved by the Spokane County
Engineer.
11. All required improvements shall conform to the current
State of Washington Standard Specifications for Road and

of a utility local improvement district (ULID) pursuant to
RCW Chapter 36.94, as amended. -
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County.
d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan
shall be approved by the County Engineer and the Spokane County
Health District prior to the issuance of any building permit for
this project.
2. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
3. Subject to specific application approval and issuance of
permits by the Health Officer, the use of an individual on -site
sewage system may be authorized.
4. Water service must be coordinated through the Director of
Utilities, Spokane County.
5. Water service shall be by an existing public:Water supply when
approved by the Regional Engineer (Spokane), State Department
of Social and Health Services.
6. Use of private wells and water systems is prohibited.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1. The site is located in Fire District P.
2. Adequate water for fire protection and distribution of such
water is required. A water plan is required to be submitted
for approval prior to any land development.

3. Reclassification of an existing building shall require an
application for change of occupancy permit, and subsequent
