Multiple family use is encouraged in urban areas and will usually be a transitional use between single family residential and more intensive uses. This site is located in the interior of a single family neighborhood. Broadway even with its arterial status has single family residential on either side. Sectionsl.1.c and 1.1.3 of the Comprehensive Plan address multiple family: "When multi - family dwellings are to be located adjacent to single family areas, careful consideration must be given to the density and designs of the multiple family development so as to insure protection of the amenities of the single family area. A multi- family dwelling structure exceeding three (3) residential units or a development of such structures or manufactured homes (except those on single family lots) should: a) locate adjacent designated arterials; b) locate near existing or planned public transit routes; c) improve or maintain the consistency of adjacent single family area amenities." BACKGROUND /ANALYSIS (continued) a) COMPREHENSIVE PLAN (continued) ZONE RECLASSIFICATION NO.: ZE -17 -83 Development concepts for site plans are discussed in the Compre- hensive Plan as follows: "1.5.1 Buffering and /or landscaping will be used to mitigate the differences between proposed developments and existing uses. "1.5.e When a neighborhood experiences pressure for change in character, such change shall be permitted upon appropriate review.. "1.5.f Consider the profile, especially height, of the existing neighborhod when evaluating multi - family developments. "1.5.g In many instances, mobile home and multi - family develop- ment may be appropriate to renew residential areas. "Decision Guidelines for the above Objectives: "1.5.7 Before approving any multi - family housing or manufactured home development proposals, it should be determined that such development will enhance the residential character or aesthetics, or will improve residential values of the area. "1.5.8 When determining whether a proposal will change the existing land use character of an area, factors to consider may include: a) the structure height of the proposal in relation to structure height of nearby structures; and b) whether new structures will have a positive or negative impact upon the neighborhood's architectural character." The proposal also meets the definition of fill -in: "l.l.a Promote fill -in within established development areas and existing outlying communities where utilities, arterials, schools and community facilities have already been established. "Decision Guideline for the above Objective: "1.1.1 (Modified - 5/14/81, Res. #81- 0664). Urban development will be approved in areas having adequate power supplies, water, sanitary and storm sewers, streets, and school and fire services provided that such development meets the intent of other Objectives and Decision Guidelines of this section." The rezone is located within close proximity to Broadway, a major arterial and bus line. (contd.) • III. BACKGROUND /ANALYSIS (continued) b). CONCLUSION - The proposal is not consistent with surrounding zoning. The area has developed into a single family neighbor- hood. The approval of Multiple Family Suburban zoning would be an intrusion into the area and may set precedence for multiple - family zoning in the interior properties common to this area and so much of the Valley. The general guidance provided in the Comprehensive Plan can be interpreted several ways. The Decision Guidelines seem to indicate general support of the proposal if.provision for buffer Trhg alrohg with "th'e 'height ,and =architectura'T 'character Of. the buildings were positive to the neighborhood. IV. AGENCIES RECOMMENDED CONDITIONS, IF APPROVED al COUNTY PLANNING DEPARTMENT ZONE RECLASSIFICATION NO.: ZE -17 -83 1. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, land- scape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original in- tent of the development plans shall be maintained. 2. Such development plan shall include building elevations and architectural detail, including landscaping and 6 foot sight - obscuring fencing along the north, east, and west property lines. 3. All current standards of the Multiple Family Suburban Zone, as amended, shall be complied with in the development of this site. COUNTY ENGINEERING DEPARTMENT 1. Applicant shall dedicate 20 feet on Walnut Road for right of way prior to any use of the property. This applies to frontage affected by this zone change. 2. Access permits for approaches to the County Road System shall be obtained from the Spokane County Engineer. 4 /11 (contd.) The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detailed combined on -site sewage system plan and surface water disposal plan for the entire project prior to the issuance of any building permit on the property. 8. A parking plan and traffic circulation plan shall be sub - mitted,and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. The design, location, and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or travelled by vehicles. 9. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 10. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 11. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and /or adopted resolutions pertaining to Road Standards and Storm - water Management in effect at the date of construction, unless otherwise approved by the County Engineer. 12. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80 -1592 as amended. c) COUNTY UTILITIES DEPARTMENT ZONE RECLASSIFICATION NO.: ZE -17 -83 1. Pursuant to the Board of County Commissioners' Resolution No. 80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and sub- ject to specific application approval and issuance of permits by the Health District. 2. Water service must be coordinated through the Director of Utilities, Spokane County. 5. That the existing zoning of the property described in the application is Agricultural Suburban. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non - Significance. 5. That the proper legal requirements for advertisement of the Agenda item have been fulfilled. 6. That the land in this area is unsuitable for the proposed use, or uses within the proposed Zone classification. 1 (contd.) C. FINDINGS OF FACT (continued) 9. That the owners of adjacent lands and /or their representatives expressed predominantly disapproval of the proposed use. 10. The Hearing Examiner Committee does not find the proposed use to be in harmony with the general purpose and may be - otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner. Committee: a) The proposed development would be too great an intrusion on the single family lifestyle existing for the residents of the area. D. ORDER ZONE RECLASSIFICATION NO.: ZE -17 -83 7. That the applicant has not demonstrated that conditions have sub- stantially changed since the original zoning of this area and accordingly, the proposed rezone is not justified. 8. That the proposed use is incompatible with existing uses in the area. b) The addition of fourplexes would create increased traffic for the neighborhood. c) That the applicant may construct three duplexes on -site with the current zoning of the property which would be more compatible than the establishment of fourplexes. The Hearing Examiner Committee, pursuant to the aforementioned, finds that the application of Ralph Guthrie for a zone reclassification as described in the application should be DENIED. 2 (contd.) D.
