On August 4, 1983, the Zoning Hearing Examiner Committee met at 9:00 A.M. to con-
sider four new zone reclassification applications and one change of conditions
application. Members present: Mr. Skalstad, Chairman; Mrs. Myers and
Mr. Williams.
Following are the applications in sequence and the action taken by the Committee.
If not appealed, these decisions will become final on August 22, 1983. All Findings
and Order for this hearing were signed on August 11, 1983.
1) ZE - 29 -83, Multiple Family Suburban to Commercial
and
WVE- 27 -83, Waiver of Violation to Allow a Continued Five Foot Rear
Setback: Balch
Location: Generally located at the northwest corner of Harrington Avenue
and Hutchinson Street in Section 18- 25 -44.
Proposal: Warehouse and Office Complex
Action: Approval to Commercial Zone. (Vote: 3 - 0)
The Zoning Adjustor's decision was for Approval for the Waiver
of Violation to allow an existing five foot rear yard setback

This matter having come before the Zoning Hearing Examiner Committee
on August 4, 1983, and the members of the Committee present being
Richard L. Skalstad, Chairman, Jane E. Myers and Jerry Williams.
B. PROPOSAL
The sponsor, Darl Wheeler, is requesting approval of a zone reclassifica-
tion, File No. ZE- 32 -83, Agricultural to Local Business, for the purpose
of continuation of an existing Multi- Service Fruit Stand.
C. FINDINGS OF FACT

1. That the existing land use in the area is residential, commercial,
agricultural, Trent Road, Railroad tracks, and industrial uses.
2. That the Comprehensive Plan designates this area as appropriate for
Semi - Rural development.
3. That the existing zoning of the property described in the application
is Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non - Significance.
5. That the proper legal requirements for advertisement of the Agenda
item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses
within the proposed Zone classification.

7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the
proposed rezone is justified.
8. That the proposed use is not totally incompatible with existing uses
in the area..
9. That the owners of adjacent lands and /or their representatives
expressed neither approval nor disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise detrimental
to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Zoning Hearing Examiner Committee:
a) That the requested zone change is necessary, at a minimum, to
legalize the existing operation from the standpoint of zoning
regulations. It was felt that conditions requiring public
hearing review of any physical expansion or change in use
would adequately protect the area from incompatible uses.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
1. All current standards of the Local Business Zone, as amended,
shall be complied with in the development of this site.
2. Signs for this project shall conform to standards as set forth
in Section 4.09.125 Signs. Compliance with this condition
must be accomplished within six (6) months of rezone finali-
zation.

3. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (MAC 197 -10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non - significance
has been issued at least fifteen (15) days prior to this date;
the official file, written comments and /or public testimony
contain information regarding assessment of the proposal's
adverse impacts to the physical environment; a finding is
hereby made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of
the project; and a final declaration of non - significance is
hereby to be issued.
4. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.210.080 RCW and the Board of Spokane County Commis-
sioners' Resolution #77 -1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on -site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION
is waived in accordance with Spokane County Commissioners'
Resolution #82 -0458 dated May 4, 1982.
5. Any division of land for the purpose of sale, lease, or
transfer shall comply with RCW 58 -17 and the Spokane County
Platting Ordinances prior to issuance of building permits.
The following Planning Conditions shall also be complied with at
the time that building permits are requested to expand existing
buildings, add buildings to the site, or change the existing use:
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumina-
tion to the area with full consideration to adjacent properties.)
2. Approval by the Zoning Administrator of a specific lighting
and signing plan for the described property prior to the
release of any building permits.
3. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Administrator
shall be submitted with a performance bond for the project prior
to release of building permits.
4. Direct light from any exterior area lighting fixture shall not
extend over the property boundary.

5. The specific development plan will be submitted for public
hearing review and approval prior to issuance of building
permits.
6. A 6 -foot sight- obscuring cyclone fence and landscape screen
shall be provided along the west, north and east boundaries
of this proposal to provide a buffer for the existing uses lo-
cated immediately adjacent to this site. A comparable substi-
tute to the cyclone fencing may be approved by the Zoning
Administrator.
7. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for run-
off.
8. Applicant shall comply with all agency's regulations as amended
prior to issuance of building permits.
b) COUNTY ENGINEERING DEPARTMENT
1. Access permits and improvements to Trent Road - SR 290 must be
approved by the Washington Department of Transportation.
2. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on -site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any build-
ing permit on the property.
3. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in accord-
ance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required
for any portion of the project which is to be occupied or
traveled by vehicles.
4. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
5. Applicant shall construct a paved and delineated access
approach(s) to meet the existing pavement on SR 290.
6. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane Board of County Commissioners'
Resolution No. 80 -1592, as amended.

c) COUNTY HEALTH DISTRICT
1. Appropriate utility easements shall be indicated,
2. A combined surface water and sewage disposal detailed plan
shall be approved by the County Engineer and the Health District
prior to the issuance of any building permit for this project.
3. Sewage disposal method shall be as authorized by the Director
of Utilities, Spokane County,
4. Subject to specific application approval and issuance of
permits by the Health Officer, project is authorized the use
of an individual on -site sewage system.
5. Water service shall be coordinated through the Director of

COUNTY BUILDING AND SAFETY DEPARTMENT

3. Reclassification of an existing building shall require an
application for change of occupancy permit, and subsequent

g) COUNTY UTILITIES DEPARTMENT
1. Pursuant to the Board of County Commissioners' Resolution
No. 80 -0418, the use of on -site sewer disposal systems is
hereby authorized. This authorization is conditioned on
compliance with all rules and regulations of the Spokane
County Health District and is further conditioned and
subject to specific application approval and issuance of
permits by the Health District.
2. The Owner(s) or Successor(s) in interest agree to authorize
the County to place their name(s) on a petition for the
formation of a ULID by petition method pursuant to RCW 36.94
which the petition includes the Owner(s) property and further
not to object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW
Chapter 36.94 which includes the Owner(s) property. PROVIDED,
this condition shall not prohibit the Owner(s) or Successor(s)
from objection to any assessment(s) on the property as a result
of improvements called for in conjunction with the formation
of a ULID by either petition or resolution method under RCW
Chapter 36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System Plan for Spokane
County, as amended.

SITE CHARACTERISTICS: The site is currently vacant and relatively
flat. Mullan Road, adjoining on the west, is paved with three lanes,
curbing, and sidewalks. Main Avenue is on the north with paving and
curbs, and Willow Road to the east is only paved. Mullan Road is a
major arterial, while Main Avenue and Willow Road are local access
roads serving residential areas to the east of the Argonne /Mullan
Road corridor.
NEIGHBORHOOD CHARACTER: Areas to the north and south, along
the Argonne /Mullan Road corridor, have systematically changed from
residential uses to office and retail uses. Very few residential
uses continue to exist along the corridor. Generally to the east
of Willow Road, the use is predominately single family residential.
There are some areas, to the southeast of this site, that have been
reclassified and currently exist as multi - family properties.

III. BACKGROUND /ANALYSIS
al COMPREHENSIVE PLAN - The site is definitely within a
transition area as defined by the Spokane County Comprehensive
Plan; the West 2/3 within Commercial and the East 1/3 within
Urban. The sponsor's proposal to rezone as Local Business
and Residential Office proportionately follows the Compre-
hensive Plan designations. The Local Business rezone would be
consistent with the Commercial designation of the Comprehensive
Plan. The Residential Office portion of the rezone, while
somewhat at odds with the existing Urban designation, would
logically and physically serve as a buffer in the transition
area.
SITE CONSIDERATIONS - As proposed, the more intense uses
possible under Local Business would be adjacent to heavily
traveled Mullan Road, A buffering effect, between Mullan
Road and residential uses to the east, would be accomplished
through the Residential Office zoning and its permitted uses.
In short, it's a good transitional plan for this site and is
mirrored by the site directly to the north.
Special considerations related to access points and physical
landscape buffering should be implemented to protect resi-
dential areas to the east, along Willow Road, and to the
south. Landscape screens, consisting of fencing and /or dense
planting, should be located along the east and south property
lines. Access to the site, from Willow Road, should be
prohibited due to the existing single family uses in the area.
HISTORY OF OTHER LAND USE ACTIONS - The site has been zoned
as Agricultural since 1948, as were other sites along the
Argonne /Mullan Roads corridor. Starting in the mid -70's,
most of the properties in the corridor have been up -zoned to
Residential Office, Local Business, and Commercial. Most
areas to the northeast, east, and southeast have remained
Two - Family Residential (R -2) since 1972. A rezone to
Multiple Family Suburban, to the southeast along Willow Road,
was approved in June, 1983.

d) CONCLUSION - The proposal is consistent with past land use
actions along the Argonne /Mullan Roads corridor. In keeping
with the Comprehensive Plan designations, it has been
proposed as a transitional development plan. If conditioned
to protect existing uses, it can be compatible with the area.
IV. AGENCIES RECOMMENDED CONDITIONS, IF APPROVED
a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific
exterior lighting plan for the approved area prior to
installation of such lighting. (Such plan shall attempt
to confine illumination to the area with full considera-
tion to adjacent properties.)
2. Approval by the Zoning Administrator of a specific
lighting and signing plan for the described property
prior to the release of any building permits.
3. A specific landscape plan, planting schedule and
provisions for maintenance acceptable to the Spokane
County Zoning Administrator shall be submitted with a
performance bond for the project prior to release of

4. The applicant shall develop subject property generally
in accordance within the concept presented to the
Hearing Examiner Committee. Variations when approved
by the Zoning Administrator will be permitted, including,
but not limited to the following changes: Building
location, landscape plans, and general allowable uses of
the permitted zone. All variations must conform to
regulations set forth in the Spokane County Zoning
Ordinance. The original intent of the development plans
shall be maintained.
5. Direct light from any exterior area lighting fixture
shall not extend over the property boundary.
6. The specific development plan will be submitted for
Planning Department review and approval prior to issuance
of building permits.
7. All current standards of the Local Business and Resi-
dential Office Zones, as amended, shall be complied with
in the development of this site as follows:

1. Regulations require that dust be controlled during all

No. 80 -0418, the use of on -site sewer disposal systems is

This matter having come before the Zoning Hearing Examiner Committee
on August 4, 1983, and the members of the Committee present being
Richard L. Skalstad, Chairman, Jane E. Myers and Jerry Williams.
The sponsor, Prokey Arger, is requesting approval of a zone reclassifica-
tion, File No. ZE- 57 -83, Agricultural and Two - Family Residential (R -2) to
Local Business and Residential Office for the purpose of developing Office
Buildings.
1. That the existing land use in the area is residential, commercial,
offices, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Commercial and Urban development.
3. That the existing zoning of the property described in the applica-
tion is Agricultural and Two - Family Residential (R -2).
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non- Significance.
5. That the proper legal requirements for advertisement of the Agenda
items have been fulfilled.
6. That the ,land in this area is suitable for the proposed use, or uses
within the proposed Zone classification.

7. That the applicant has demonstrated that conditions have substan-
tially changed since the original zoning of this area and accord-
ingly, the proposed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands and /or their representatives
expressed neither approval nor disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise detri-
mental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Zoning Hearing Examiner Committee:
a) That the applicant expressed his willingness to construct a
sidewalk in cooperation with the County Engineer's required
condition.
D. 'CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumina-
tion to the area with full consideration to adjacent
properties.)
2. Approval by the Zoning Administrator of a specific lighting
and signing plan for the described property prior to the
release of any building permits.
3. A specific landscape plan, planting schedule and provisions
for maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for
the project prior to release of building permits.

4. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing
Examiner Committee. Variations when approved by the Zoning
Administrator will be permitted, including, but not limited
to the following changes: Building location, landscape plans,
and general allowable uses of the permitted zone. All varia-
tions must conform to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the develop-
ment plans shall be maintained.
5. Direct light from any exterior area lighting fixture shall not
extend over the property boundary.
6. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
7. All current standards of the Local Business and Residential
Office Zones, as amended, shall be complied with in the develop-
ment of this site as follows:
Local Business Zone over_the South 200 feet of the East 1/2 of
Block 140, Opportunity EXCEPT the East 100 feet; and Residential
Office Zone over the South 200 feet of the East 1/2 of Block 140,
Opportunity EXCEPT the West 190 feet.
8. Landscaping shall be provided for this site, in conformance
with Standards as identified in Section 4.07A.120 Landscaping.
9. A suitable dense landscaping screen shall be provided along the
east and south property lines of this proposal to provide a
buffer for the existing uses located immediately east and south
of this site.
10. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
11. Any division of land for the purpose of sale, lease, or trans-
fer shall comply with RCW 58 -17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
12. Applicant shall comply with all agency's regulations as amended
prior to issuance of building permits.

appropriate documents to the effect that the NOTICE OF ACTION
is waived in accordance with Spokane County Commissioners'
Resolution #82 -0458 dated May 4, 1982.
14. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAC 197 -10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non - significance
has been issued at least fifteen (15) days prior to this date;
the official file, written comments and /or public testimony
contain information regarding assessment of the proposal's
adverse impacts to the physical environment; a finding is
hereby made that no potentially significant adverse impacts upon
the physical environment are anticipated as a result of the
project; and a final declaration of non - significance is hereby

15. That the design of the rear parking area and access onto Willow
Road be made in such a way to minimize the traffic flow onto

4. Subject to specific application approval and issuance of permits
by the Health Officer, the proposal is authorized the use of
an individual on -site sewage system.

sider four new zone reclassification applications and one change of conditions
application. Members present: Mr. Skalstad, Chairman; Mrs. Myers and
Mr. Williams.
Following are the applications in sequence and the action taken by the Committee.
If not appealed, these decisions will become final on August 22, 1983. All Findings
and Order for this hearing were signed on August 11 - , 1983.
1) ZE - 29 -83, Multiple Family Suburban to Commercial
and
WVE- 27 -83, Waiver of Violation to Allow a Continued Five Foot Rear Yard

Location: Generally located at the northwest corner of Harrington Avenue

B. PROPOSAL

2. That the Comprehensive Plan designates this area as appropriate for
Commercial and Urban development.
3. That the existing zoning of the property described in the applica-
tion is Agricultural and Two - Family Residential (R -2).
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Declaration of Non - Significance.
5. That the proper legal requirements for advertisement of the Agenda
items have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses
within the proposed Zone classification.

7. That the applicant has demonstrated that conditions have substan-
tially changed since the original zoning of this area and accord-
ingly, the proposed rezone is justified.

expressed neither approval nor disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise detri-
mental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Zoning Hearing Examiner Committee:
a) That the applicant expressed his willingness to construct a
sidewalk in cooperation with the County Engineer's required
condition.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a). COUNTY PLANNING DEPARTMENT
1. The Zoning Administrator shall approve a specific exterior
lighting plan for the approved area prior to installation of
such lighting. (Such plan shall attempt to confine illumina-
tion to the area with full consideration to adjacent
properties.)
2. Approval by the Zoning Administrator of a specific lighting
and signing plan for the described property prior to the
release of any building permits.
3. A specific landscape plan, planting schedule and provisions
for maintenance acceptable to the Spokane County Zoning
Administrator shall be submitted with a performance bond for
the project prior to release of building permits.

4. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing
Examiner Committee. Variations when approved by the Zoning
Administrator will be permitted, including, but not limited
to the following changes: Building location, landscape plans,
and general allowable uses of the permitted zone. All varia-
tions must conform to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the develop-
ment plans shall be maintained.
5. Direct light from any exterior area lighting fixture shall not
extend over the property boundary.
6. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
7. All current standards of the Local Business and Residential
Office Zones, as amended, shall be complied with in the develop-
ment of this site as follows:
Local Business Zone over the South 200 feet of the East 1/2 of
Block 140, Opportunity EXCEPT the East 100 feet; and Residential
Office Zone over the South 200 feet of the East 1/2 of Block 140,
Opportunity EXCEPT the West 190 feet.
8. Landscaping shall be provided for this site, in conformance
with Standards as identified in Section 4.07A.120 Landscaping.
9. A suitable dense landscaping screen shall be provided along the
east and south property lines of this proposal to provide a
buffer for the existing uses located immediately east and south
of this site.
10. Applicant shall comply with '208' recommendations concerning
stormwater runoff and provide necessary landscaping for runoff.
11. Any division of land for the purpose of sale, lease, or trans-
fer shall comply with RCW 58 -17 and the Spokane County Platting
Ordinances prior to issuance of building permits.
12. Applicant shall comply with all agency's regulations as amended
prior to issuance of building permits.

13. That the provisions of SEPA 's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Commissioners' Resolution #77 -1392 be initiated by the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on -site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION
is waived in accordance with Spokane County Commissioners'
Resolution #82 -0458 dated May 4, 1982.
14. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA
Guidelines (WAG 197 -10) and the Spokane County Environmental
Ordinance (SCEO), a proposed declaration of non - significance
has been issued at least fifteen (15) days prior to this date;
the official file, written comments and /or public testimony
contain information regarding assessment of the proposal's
adverse impacts to the physical environment; a finding is
hereby made that no potentially significant adverse impacts upon
the physical environment are anticipated as a result of the
project; and a final declaration of non - significance is hereby
to be issued.
15. That the design of the rear parking area and access onto Willow
Road be made in such a way to minimize the traffic flow onto
Willow. Compliance shall be determined by the Zoning Adminis-
trator at site plan review prior to release of building permits.
b) COUNTY ENGINEERING DEPARTMENT
1. Applicant shall dedicate 10 feet on Willow Road for right of way
prior to any use of the property.
2. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
3. Applicant shall improve Willow Road in a manner consistent with

width Access Standard.

This matter having come before the Zoning Hearing Examiner Committee on
February 6, 1986, and the members of the Committee present being
Kathleen M. Carstens, Chairperson, Jane E. Myers and Ron Odell.
B. PROPOSAL
The sponsor, Prokey G. Arger, is requesting approval of a zone
reclassification, File No. ZE- 103 -85, Agricultural and Two - Family
Residential (R -2) to Local Business and Residential Office, for the
purpose of developing an office building.
A Change of Conditions request, ZE- 57A -83, in existing Local Business and
Residential Office Zones for the purpose of reviewing a new site
development plan.
Also, a Variance request, VE- 164 -85, to allow an off - street parking area
to be within 5 -feet of the east property line, whereas the Spokane County
Zoning Ordinance, Section 4.07A.110 -(a) requires a 20 -foot front yard
landscaped setback.
C. FINDINGS OF FACT
1. That the existing land use in the area is residential, office
complex, and vacant.
2. That the Comprehensive Plan designates this area as appropriate for
Major Commercial and Urban development.
3. That the existing zoning of the property described in the application
is Agricultural and Two - Family Residential (R -2).
4. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with, and the Committee concurs with the
Determination of Non - Significance.
5. That the proper legal requirements for advertisement of the Agenda
Item have been fulfilled.
6. That the land in this area is suitable for the proposed use, or
uses within the proposed Zone Classification.

parking situations and safety, and that the applicant has agreed to
provide as many parking spaces as can be made available.
10. The Hearing Examiner Committee finds the proposed use to be in
harmony with the general purpose and will not be otherwise
detrimental to the public health, safety, and welfare.
11. The following are additional findings of fact considered by the
Hearing Examiner Committee:
a) That the Variance request to allow an off - street parking area to
within 5 -feet of the required front yard is hereby Approved.
b) That the proposed Variance is not detrimental to and is
compatible with the public health, safety and welfare.
c) That a planted screen along the east and south property lines
will provide a buffering between the proposed office and
residential uses.
d) That the requested Variance is necessary to provide the maximum
number of parking spaces within the site and should help to
resolve street parking within the area.
e) That all three requests are consistent with past actions within
this immediate area, and if properly buffered to the residences
to the east, the proposal can be consistent with the
Comprehensive Plan.
D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
(All Conditions imposed by the Zoning Hearing Examiner Committee shall be
binding on the "Applicant ", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
1. Add Engineering Department Condition #10 as follows:
"That the applicant shall dedicate 5 -feet on Willow Ropad for right

3. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
iwill.be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning
Ordinance, The original intent of the development plans shall
be maintained.
4. The specific development plan will be submitted for Planning
Department review and approval prior to issuance of building
permits.
5. All current standards of the Local Business and Residential
Office Zones, as amended, shall be complied with in the
development of this site.
Legal descriptions of the proposed zones are as follows:
Residential Office: The East 94 feet of Lot 1, Block 141,
Opportunity in Section 17- 25 -44.
Local Business: The West 186.5 feet of Lot 1, Block 141,

6. That the project is subject to Section 4.16A.050, the Aquifer
Sensitive Area Overlay Zone of the Spokane County Zoning
Ordinance, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.

applicant within thirty (30) days of final disposition of this
application, and prior to any on -site improvements.
b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Building Permit:
1. Access permits for approaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. Applicant shall improve Willow Road in a manner consistent with
Spokane County TYPICAL roadway section No. 1 minimum paving
width Access Standard.
3. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the issuance
of a building permit on the property.
4. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined pn -site sewage system plan and surface water disposal
plan for the entire project prior to the issuance of any
building permit on the property.
5. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer prior to the
issuance of a building permit on the property. The design,
location, and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which is to be occupied
or traveled by vehicles.
6. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
7. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.

existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
3. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
4. Building permits will be required for each structure.
5. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of
the hydrant shall be no less than 18 inches above grade. A
water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.

irrigation uses, but satisfactory arrangements have not been
made to serve this proposal.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.

3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will likely result during the
construction phase of the project and from motor vehicles using

5. All air pollution regulations must be met.
6. Additional Comments. National Emission Standards must be
followed for handling and removal of asbestos.
The Zoning Hearing Examiner Committee, pursuant to the aforementioned,
finds that the application of Prokey G. Arger for a zone reclassification
as described in the:application should be APPROVED to the LOCAL BUSINESS
and RESIDENTIAL OFFICE ZONES. Also, that the Change of Conditions request
as described and the Variance request to allow an off -street parking area

IV. SEPA ENVIRONMENTAL REVIEW

VARIANCE NO. VE- 164 -85
An Environmental Checklist was submitted by the sponsor and was
reviewed by the County Planning Department. The review considered
the specifics of the proposal, other available information, County
ordinances, other regulations and laws, possible standard Conditions
of Approval, the Generalized Comprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "No probable significant adverse impacts" would result from the
proposal being developed and has issued a Determination of
Non- Significance ( "DNS ").
The "DNS" was circulated to eight other agencies of jurisdiction and
other agencies /departments affected by the future development for
review and comment. The "DNS" comment period ends February 5, 1986,
and was advertised 15 calendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner Committee may consider additional environmental
related testimony and the "DNS" at the public hearing.
V. VARIANCE REQUEST
The sponsor is requesting a 15 -foot Variance which would allow the
parking area to be within 5 -feet of the east property line for that
portion of the site seeking the Residential Office zone change. A
Variance to allow the parking area to be within 5 -feet of the west
property line has already been granted for that portion of the site
requesting the Change of Condition on a new site plan. Also, the
same type Variance request was approved for the property located at
the northwest corner of Main and Willow.
The need for the Variance is due to the design and number of parking
spaces being provided which, if approved, will add more parking
spaces and should reduce parking on Willow Road.
VI. PLANNING SUMMARY
All three requests are consistent with the past actions within this
immediate area, and if properly buffered to the residences to the
east, the proposal can be consistent with the Comprehensive Plan.

VI. CONDITIONS OF APPROVAL

2. A specific landscape plan, planting schedule and provisions for

project prior to release of building permits. Landscaping shall
be installed and maintained such that sight distance at access
points is not obscured or impaired.
3. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Committee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: Building location, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the Spokane County Zoning

1. The site is located in Fire District # 1.
2. Approved numbers or addresses shall be placed on all new and
existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast with their background.
3. Trash enclosures shall not be located adjacent to combustible
construction or underneath windows or nonprotected eaves.
4. Building permits will be required for each structure.
5. Fire hydrants which meet the fire flow are required to be
installed prior to any construction. These hydrants shall be
placed so that no portion of the building exterior is more than
175 feet from the hydrant. The bottom of the lowest outlet of

water plan showing each fire hydrant (specifying the gallons per
minute for each fire hydrant) and meeting the requirements in
Chapter 10.04 of the Uniform Fire Code is required prior to
construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and
during the time of construction.
f) WATER PURVEYOR
1. Water Purveyor is Modern Electric Water Company, and they will
supply the site with adequate water for domestic, fire and
irrigation uses, but satisfactory arrangements have not been
made to serve this proposal.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprinklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dirt and mud
from unpaved surfaces onto paved- surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
immediately to clean these surfaces.

I. VARIANCES The County Zoning Ordinance, Section 4.03.020 (64), clarifies
that variance is an adjustment made to a "dimensional" regulation.
Websters New Collegiate Dictionary (1979) defines "dimension" as a
measure in one direction (and therefore includes "area ").
State Law (36.70.020 (.14) RCW)... Is the subject property deprived of
privileges commonly enjoyed by other properties in same vicinity and zone and
does the variance remedy the difference in privileges? If so, what privileges?
This facility is an expansion of an existing building which is utilizing the
same variances previously granted as requested herein. This variance is compatible
with all other variances granted within immediate area. The variance would allow
for a better designed parking area utilizing more off street parking while
providing a safety driveline for fire protection.

into existing 200 Mullen Building, the land area behind building is restricted
in size creating a necessity to utilize the 20' setback area to facilitate the
driveway area around building. Without variance, the parking area and drive -
through would be seriously restricted.
6 Will granting of the variance be materially detrimental to public welfare OR
injurious to property or improvements in the vicinity and zone in which the
subject property is located?
No, it will enhance neighborhood by increasing the off street parking while
providing a driveway around the building allowing for better exiting and fire
protection. The driveway area will be densely buffered with landscaping along
Willow Road minimizing impact from cars.
