(See 4.24.420 of the Zoning Ordinance for the Conditional Standards.) note: This application requires two actions by the County; the first is a zone change to Residential Office to be heard by the Zoning Hearing Examiner Committee. The second is a Conditional Use Permit to be heard by the Zoning Adjustor. In order for the barber or beauty shop to be located on this site, both requests need to be approved. PROPOSED USE: Beauty Salon EXISTING USE: Single Family Residence SITE SIZE: Approximately 11,220 Square Feet COMPREHENSIVE PLAN DESIGNATION: URBAN CONDITIONAL USE PERMIT: STAFF REPORT RICHARD VIGIL RESIDENTIAL OFFICE and CONDITIONAL USE PERMIT PRIORITY SEWER SERVICE AREA: Yes AQUIFER SENSITIVE AREA: Yes PROJECT LOCATION: This site is generally located in the Spokane Valley, more specifically at the northwest corner of University and Valley Way in Section 17- 25 -44. 3 II. BACKGROUND ANALYSIS ZONE RECLASSIFICATION NO.: ZE -35 -83 CONDITIONAL USE PERMIT NO.: CUE -11 -83 1) COMPREHENSIVE PLAN: The proposed zone change lies within the Urban category of the Comprehensive Plan, as well as all nearby surrounding areas. This category suggests that neighborhood commercial type uses will be located near the heavily traveled streets. Also, the Text states that due to the variety and mix of land uses and activities found in this category, screening or other performance standards may be necessary to make them compatible with one another. Staff suggests special consideration be given to the location of the parking area of this project. 2) ZONING: North Agricultural Suburban, Established, 1958 East Agricultural Suburban, Established, 1958 West Agricultural Suburban, Established, 1958 South Multiple Family Suburban, Est., 1939 Agricultural Suburban, Established, 1947 3) LAND USE: Site Single Family Residential North Single Family Residential East Single Family Residential South Single Family Residential and Apartments West Single Family Residential 4) HISTORY OF LAND USE ACTIONS: There have been no zone changes in this immediate area since 1958. Although some 600 feet south along University has experienced activity to the Residential Office, Local Business, and some Commercial zoning at and south of Main Avenue. 5) NEIGHBORHOOD CONSIDERATIONS: This immediate area has remained single family residential, although some of the housing stock has started to show its age. III. SITE ANALYSIS 1) SITE CHARACTERISTICS AND CONSIDERATIONS: The site contains a residence with a detached garage and circular drive in the front yard. The circular drive has been indicated on the site plan to be used for customer parking. The Zoning Ordinance requires a minimum of six off - street parking spaces, and that the parking areas not be within the front twenty (20) feet of the required front yard. In addition, the Ordinance further requires that parking areas exceeding a six car capacity shall provide an ornamental masonry fence 42 inches in height along the periphery of the parking area. The Planning Director may approve a planted screen or ornamental fence in lieu of said masonry wall. Staff, at this point, is concerned as to whether the site plan as submitted complies with the above requirements. A more detailed plan and review by the Zoning Administrator is required prior to issuance of Occupancy Permits for a barber or beauty shop. 2) AGRICULTURAL SUMMARY: This area has been committed to "URBAN' type uses by the Soil Conservation Service, U. S. Department of Agriculture. 3) SITE PLAN INFORMATION: SITE SIZE: EXISTING BUILDINGS: PROPOSED BUILDINGS: Total Floor Area: Structure Height: PARKING AREA: Parking Required: 6 Spaces - Minimum Parking Provided: ZONE RECLASSIFICATION NO.: ZE -35 -83 CONDITIONAL USE PERMIT NO.: CUE -11 -83 Approximately 11,110 Square Feet (2) Residence with Detached Garage Existing Residence to be Remodeled Approximately 1,000 Square Feet Existing 20 Feet Unknown III. SITE ANALYSIS (continued) BUFFERING TECHNIQUES: The existing residence contains some landscaping with a 5 foot fence along the north and west property lines. Customer parking and entrance to the facility along with advertising signs would be the major impact to adjacent properties. If properly located and screened, this project would have less effect to those properties. OTHER SITE PLAN CONSIDERATIONS: The County Engineer has required an additional 15 feet right of way for Valley Way and an additional 10 feet right of way for University Road. This condition would have a direct effect on the parking lot location with regards to not being allowed in the front twenty (20) feet of the front yard. A detailed site plan is necessary to determine how this issue is impacted. Relocation to the rear yard or a Variance to this requirement appear to be alternatives available to the sponsor. However, the Variance is a discretionary decision which could be denied, if applied for by the applicant. V. RECOMMENDED AGENCY CONDITIONS, IF APPROVED: a) COUNTY PLANNING DEPARTMENT 1. The Zoning Administrator shall approve a specific exterior lighting plan for the approved area prior to installation of such lighting. (Such plan shall attempt to confine illumination to the area with full consideration to adjacent properties). 2. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Spokane County Zoning Administrator shall be submitted with a performance bond for the project prior to release of building permits. 3. The applicant - shall develop subject property generally in accordance within the concept presented to the Hearing Examiner Committee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. The specific development plan will be submitted for Planning Department review and approval prior to issuance of building permits. 5. All current standards of the Residential Office Zone, as amended, shall be complied with in the development of this site. 6. Signs for the project shall conform to standards as set forth in Section 4.07A.130 of the Spokane County Zoning Ordinance. 7. Landscaping shall be provided for this site, in conformance with Standards as identified in Section 4.07A.120 Landscaping. 8. Applicant shall comply with '208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. 9. The applicant shall comply with RCW 58 -17 and the Spokane County Platting Ordinances prior to issuance of building permits. 10. That the provisions of SEPA's NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW and the Board of Spokane County Commissioners Resolution #77 -1392 be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on -site improvements, or file appropriate documents to the effect that the NOTICE OF ACTION is waived in accordance with Spokane County Commissioners' Resolution #82 -0458 dated May 4, 1982. 11. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guidelines (WAC 197 -10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non - significance has been issued at least fifteen (15) days prior to this date; the official file, written comments and /or public testimony contain information regarding assessment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no potentially significant adverse impacts upon the physical environ ment are anticipated as a result of the project; and a final declaration of non - significance is hereby to be issued. 12. That a detailed site plan be submitted for review and approval by the Zoning Administrator, indicating compliance with the provisions of the Residential Office Zone with specific regard to the number of parking spaces required, the location of the parking area, and the masonry fence requirement. 7 ZONE RECLASSIFICATION NO.: ZE -35 -83 CONDITIONAL USE PERMIT NO.: CUE -11 -83 b) COUNTY ENGINEERING DEPARTMENT Prior To The Issuance Of A Building Permit: 1. Applicant shall dedicate 15 feet on Valley Way for right -of -way prior to any use of the property. 2. Applicant shall dedicate 10 feet on University Road for right -of -way. 3. Applicant shall dedicate a 20 foot radius on Valley Way and University prior to any use of the property. 4. Applicant shall improve Valley Way in a manner consistent with Spokane County TYPICAL roadway section No. 1 minimum paving width Access Standard. 5. Applicant shall improve University Road in a manner consistent with Spokane TYPICAL roadway section No. 1 minimum paving width Major Arterial Standard. 6. The word "applicant" shall include the owner or owners of the property, his heirs, assigns, and successors. 7. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purpose is the formation of a Road Improvement District (RID) for said improvement pursuant to RCW 36.88, as amended. Spokane County will not participate in the cost of these improvements. 8. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. 9. All required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construction, and other applicable County standards and /or adopted resolutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 10. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners'Resolution No. 80 -1592 as amended. c) COUNTY UTILITIES DEPARTMENT d) COUNTY HEALTH DISTRICT ZONE RECLASSIFICATION NO.: ZE -35 -83 CONDITIONAL USE PERMIT NO.: CUE -11 -83 1. Pursuant to Board of County Commissioners Resolution No. 80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 4. On November 16, 1983, the Zoning Hearing Examiner Committee met at 9:00 A.M., to con- sider six new zone reclassification applications. This date was a postponement from the original date set as November 3, 1983, due to errors in legal notification to property owners of the proposed zoning reclassifications. Members present: Mr. Skalstad, Chairman; Mrs. Myers, aid Mr. Williams. Following are the applications in sequence and the action taken by the Committee. If not appealed, these decisions will become final on November 28, 1983. All Findings and Order for this hearing were signed on November 17, 1983. 1) ZE- 35 -83, Agricultural Suburban to Residential Office and CUE-11-83, Conditional Use Permit for a Beauty Shop in the Residential Office Zone: Vigil Location: Generally located at the northwest corner of University Road and Valley Way in Section 17- 25 -44. Proposal: Beauty Shop Action: Denial. (Vote: 3 - 0) The Hearing Examiner Committee felt the proposed rezone would not preserve the residential character of the neighborhood and was not in the best interest of the general public. As a result of the denial of the zoning reclassification, the Zoning Adjustor did not have adequate zoning to allow consideration of the Con- ditional Use Permit request; therefore, stayed any action on the proposed request, pending a potential appeal to the Board of County Commissioners of the zone reclassification. (contd.) A. INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on November 16, 1983, and the members of the Committee present being Richard L. That the existing land use in the area is single family residential and apartment uses. 2. That the Comprehensive Plan designates this area as appropriate for Urban development. 3. That the existing zoning of the property described in the application is Agricultural Suburban. 4. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 5. That the land in this area is unsuitable for the proposed use, or uses within the proposed Zone Classification. 6. That the applicant has not demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is not justified. The following are additional findings of fact considered by the Hearing Examiner Committee: a) That the proposed rezone is not in the best interest of the general public. b) That the existing violation of a beauty salon is not sufficient reason to grant the requested rezone classification. c) That the character of the residential neighborhood should be preserved by the denial of this application. d) That the required parking facilities and drainfield requirement could not be accomplished without creating a serious alteration in appearance to the site, which would then be considered "spot" zoning. e) That the Zoning Adjustor cannot divest the Hearing Examiner Committee of its power to pass the zone change which was presented for their action with regard to the Conditional Use Permit and needed Variance for parking area setbacks. 2 D. The circular drive has been indicated on the site plan to be used for customer parking. The Zoning Ordinance requires a minimum of six off - street parking spaces, and that the parking areas not be within the front twenty (20) feet of the required front yard. In addition, the Ordinance further requires that parking areas exceeding a six car capacity shall provide an ornamental masonry fence 42 inches in height along the periphery of the parking area. The Planning Director may approve a planted screen or ornamental fence in lieu of said masonry wall. Staff, at this point, is concerned as to whether the site plan as submitted complies with the above requirements. A more detailed plan and review by the Zoning Administrator is required prior to issuance of Occupancy Permits for a barber or beauty shop. 2) AGRICULTURAL SUMMARY: This area has been committed to "URBAN' type uses by the Soil Conservation Service, U. S. Department of Agriculture. Approximately 11,110 Square Feet (2) Residence with Detached Garage Existing Residence to be Remodeled Approximately 1,000 Square Feet Existing 20 Feet 6 Spaces - Minimum Unknown III. SITE ANALYSIS (continued) BUFFERING TECHNIQUES: The existing residence contains some landscaping with a 5 foot fence along the north and west property lines. Customer parking and entrance to the facility along with advertising signs would be the major impact to adjacent properties. If properly located and screened, this project would have less effect to those properties. OTHER SITE PLAN CONSIDERATIONS: The County Engineer has required an additional 15 feet right of way for Valley Way and an additional 10 feet right of way for University Road. This condition would have a direct effect on the parking lot location with regards to not being allowed in the front twenty (20) feet of the front yard. A detailed site plan is necessary to determine how this issue is impacted. Relocation to the rear yard or a Variance to this requirement appear to be alternatives available to the sponsor. However, the Variance is a discretionary decision which could be denied, if applied for by the applicant. V. That the proposal is generally located in the Spokane Valley, more specifically at the northwest corner of University Road and Valley Way. 2. That the proposal consists of an approximately 11,220 square foot lot with existing single family dwelling proposed to be converted to a Beauty /Barber Shop. 3. That the adopted Spokane County Generalized Comprehensive Land Use Plan indicates Urban usage of the area encompassed by the proposal. 4. That the provisions of RCW Chapter 43.21C, (State Environmental Policy Act) have been met. Inasmuch as the Board denied the proposal, the Board does not enter any finding on the SEPA or issue any final declaration. 5. That the Spokane County Hearing Examiner Committee held a public hearing on November 16, 1983, concerning the proposal, subsequent to which by Findings of Fact, Decision and Order dated November 17, 1983, they unanimously Denied the proposal. 6. That the existing land uses in the area of proposal include single family residential and apartment uses. 7. That the proposal is not compatible at this point in time with existing uses in the area. 8. That the proposal is detrimental or otherwise harmful to the public health, safety and welfare. In particular, it would generate increased traffic and would conflict with the residential nature of the neighborhood. 9. That the applicant has not demonstrated sufficient or substantial changes in the area since the original zoning of the parcel to Agricultural Suburban in 1958 to warrant the proposed zone change to Residential Office. RECEIVED MAR 2 1 1984 SPOKANE COUNTY ENGINEER THIS MATTER, Being the consideration by the Board of County Commissioners of Spokane County, hereinafter referred to as the "Board" of an appeal of Spokane County Zoning Hearing Examiner Committee Decision of November 17, 1983, unanimously Denying the zone reclassification (ZE- 35 -83), Agricultural Suburban to Residential Office for the purpose of developing a Beauty /Barber Shop, hereinafter referred to as the "Proposal ", and the Board of County Commissioners of Spokane County having held a public hearing on January 10, 1984, and having fully considered all testimony presented thereat, and further having individually visited with the site and vicinity in question, and having rendered a decision on the 24th day of January, 1984, DENYING said proposal, does hereby make the following: It 84 0236 FINDINGS OF FACT, DECISION AND CONDITIONS - ZE -35 -83 Page #2 10. That the proposal at the present time is inconsistent with the surrounding land use classifications and would grant a special privilege or rights to the applicant different than those enjoyed by adjacent property owners. At the present time there is no non - residential land uses or Local Business and Residential Office Zones in the immediate vicinity of the proposal. However, some Local Business and Residential Office Zones exist along University Road to the south from Main Avenue. 11. That although evidence was presented at the public hearing indicating an increase in traffic along University Road, the increased traffic is not substantial enough to warrant a rezone to Residential Office for a non - residential use of the property. 12. That the proper legal requirements for advertising of the hearing before the Board of County Commissioners of Spokane County have been met. 13. That on the 24th day of January, 1984, the Board of County Commissioners of Spokane County at a regular meeting did DENY the proposal. From the foregoing Findings, a review of the Planning Department Staff Report dated November 16, 1983, and the Staff presentation of File No. ZE- 35 -83, the Board hereby DENIES the proposal.
