INTRODUCTION This matter having come before the Zoning Hearing Examiner Committee on December 8, 1983, and the members of the Committee present being Richard L. Skalstad, Chairman, Jane E. Myers and Jerry Williams. B. PROPOSAL The sponsor, William W. Erickson, is requesting approval of a zone reclassification, File No. ZE- 78 -83, Local Business to Commercial, for the purpose of developing retail uses (No Specific Site Plan). C. FINDINGS OF FACT ZONE RECLASSIFICATION NO.: ZE -78 -83 SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINGS AND ORDER 1. That the existing land use in the area is residential, apartments, commercial, offices and vacant. 2. That the Comprehensive Plan designates this area as appropriate for Major Commercial development. 3. That the existing zoning of the property described in the application is Local Business. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with, and the Committee concurs with the Declaration of Non - Significance. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 7. That the applicant has demonstrated that conditions have substantially changed since the original zoning of this area and accordingly, the proposed rezone is justified. 8. That the proposed use is compatible with existing uses in the area. C. FINDINGS OF FACT (continued) r 9. That the owners of adjacent lands expressed disapproval of the proposed use. 10. The Hearing Examiner Comittee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public health, safety, and welfare. 11. The following are additional findings of fact considered by the Hearing Examiner Committee: a) That the site should be developed with adequate landscaping treatment around the proposed building, adjoining the County roads, with special emphasis along the north property line adjoining the multi - family development. However, the site has limitations related to size, location, and other County requirements (such as '208' designs, drainfield location, and access points), that prohibit the advanced planning of landscape areas prior to preparation of a detailed site plan. It is felt that the applicant should coordinate with the Planning Department staff and other County departments to combine all design standards into a detailed site plan that will provide as much green space and deciduous, trees as feasible on the site. b) That development of the site should protect the adjoining multi - family development to the north from adverse impacts. Buffering of the site, along the north property line, should include fencing, landscaping, and restrictions on vehicle access to the northerly end of the site. Review of the buffering techniques should be administrative. D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL a) COUNTY PLANNING DEPARTMENT ZONE RECLASSIFICATION NO.: ZE -78 -83 1. 'ENVIRONMENTAL CHECKLIST FILE #: ZE -78 -83 SEC /TWN /RNG: 17/25/44 Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires all state and local governmental agencies to consider environmental values both for their own actions and when licensing private proposals. The Act also requires that an Environmental Impact Statement be prepared for all major actions significantly (and "adversely ", as per WAC 197 -10) affecting the quality of the physical environment. The purpose of this checklist is to help the agencies involved determine whether Or not a proposal is such a major action. Please answer the following questions as completely as you can with the information presently available to you. Please answer questions as "yes" or "maybe" if, in your opinion, even only slight impacts will result. The reviewers of the checklist will be aware of and concern themselves with the degree of impact, asking you for more information, if necessary. Where explanations of your answers are required, or where you believe an explanation would be helpful to government decision- makers, include your explanation in the space provided, or use additional pages, if necessary. You should include references to any reports or studies of which you are aware and which are relevant to the answers you provide. Complete answers to these questions now will help all agencies involved with your proposal to undertake the required environmental review without unnec- essary delay. The following questions apply to your total proposal, not just to the license for which you are currently applying or the proposal for which approval is sought. Your answers should include the impacts which' will be caused by your proposal when it is completed, even though completion may not occur until sometime in the future. This will allow all of the agencies which will be involved to complete their environmental review now, without duplicating paperwork in the future. No application shall be processed until the checklist has been completed and returned to the appropriate County department. State law requires explanations for every "yes" and "maybe" answer on the checklist. The person completing the form may be required to provide explanation for "no" answers, and in some cases, more detailed information to aid in a threshold determination. NOTE: This is a standard form being used by all state and local agencies in the State of Washington for various types of proposals. Many of the questions may not apply to your proposal. If a question does not apply, just answer it "no" and continue on to the next question. I. BACKGROUND ENVIRONMENTAL CHECKLIST FORM 1. Name of Proponent: AMERICAN WEST REALTY, INC. DATE: TO: FROM: SUBJECT: DECEMBER 8, 1983 I. GENERAL INFORMATION APPLICANT: AMERICAN WEST REALTY, INC. c/o Denny Horlacher PROPERTY OWNER: William W. Erickson REQUESTED ZONING: Commercial EXISTING ZONING: Local Business (established in 1974) PROPOSED USE: No Specific Site Plan EXISTING USE: Vacant SITE SIZE: Approximately 24,300 Square Feet COMPREHENSIVE PLAN DESIGNATION: Major Commercial PRIORITY SEWER SERVICE AREA: Yes AQUIFER SENSITIVE AREA: Yes PROJECT LOCATION: This site is generally located at the northeast corner of Sprague Avenue and Sunderland Road in Section 17- 25 -44. II. BACKGROUND ANALYSIS STAFF REPORT HEARING EXAMINER COMMITTEE PLANNING DEPARTMENT STAFF ZONE RECLASSIFICATION NUMBER: ZE -78 -83 1) COMPREHENSIVE PLAN: This site as well as both sides of Sprague Avenue, in a 1,000 foot wide band, are designated as Major Commercial. A rezone to Commercial would be in keeping with this designation. /0 ZONE RECLASSIFICATION NO.: ZE -78 -83 II. BACKGROUND ANALYSIS (continued) 2) ZONING: North Multiple Family Suburban, Est. 1939 & 1969 East Local Business, Established, 1975 West Residential Office, Established, 1969 South Commercial, Established, 1957 3) LAND USE: Site Vacant North Apartments, Duplexes, and Single Family East Retail South Offices and Restaurant West Offices 4) HISTORY OF LAND USE ACTIONS: Most rezone activity along the south side of Sprague Avenue occurred in the 1940's and 50's. On the north side, the activity has been relatively recent; mainly during the 1970's. The rezones to the east and west of this site have been primarily to Residential Office and Local Business. The site itself was zoned from Residential Office to Local Business in 1974. Conditions of approval at that time are similar to these that would be imposed today. One unusual condition called for a 6 -foot high grape stake fence with an 8 -foot gate along the north property line. Easement access was to be granted over the site'to the adjoining north property owner. Apparently the condition was imposed at the urging of both the rezone applicant and the adjoining property owner. 5) NEIGHBORHOOD CONSIDERATIONS: Sprague Avenue is currently four lanes with optional turning lane. Sidewalks exist along the site on Sprague Avenue. Sunderland Road is two lanes, paved, without further improvements along the site boundary. Sunderland serves residential uses generally north of the retail and office uses along Sprague Avenue. 1/ III. SITE ANALYSIS 1) SITE CHARACTERISTICS AND CONSIDERATIONS: The site is flat and undeveloped. It has possible access to both Sprague Avenue and Sunderland Road. Existing multi - family uses adjoin the site on the; north. 2) AGRICULTURAL SUMMARY: The Major Commercial designation of the Comprehensive Plan is not intended to preserve productive agricultural land. 3) SITE PLAN INFORMATION: No Specific Site Plan IV. CONCLUSIONS ZONE RECLASSIFICATION NO.: ZE -78 -83 BUFFERING TECHNIQUES: At a minimum, landscape treatments should be required along Sprague Avenue, Sunderland Road, and the future building. Additional landscaping may be required at administrative, site plan review, depending on development specifics. Buffering along the north property line would be appropriate as protection to the existing multi- family property adjoining the site. Suggested is a 10 -foot wide landscape screen with a 6 -foot high sight- obscuring fence. This is considerably more than required in the 1974 Local Business rezone due primarily to the wider selection of high intensity uses that would be permitted on a Commercially zoned site. OTHER SITE PLAN CONSIDERATIONS: Specific access points should be reviewed and approved by Engineering and Planning at the administrative level. The Commercial rezone of the site is consistent with the Comprehensive Plan and follows the trend of similar rezones along Sprague Avenue. Compliance with Commercial Zone standards and all recommended conditions should insure appropriate site development. Detailed site plan review should be performed at the administrative level. !ct ZONE RECLASSIFICATION NO.: ZE -78 -83 V. RECOMMENDED AGENCY CONDITIONS, IF APPROVED: a) COUNTY PLANNING DEPARTMENT 1.
