Planning Commission Recommendation: Approve to Freeway Co mmercial
Zone, subject to the following conditions
1) Approval of access points by the State Highway Department (a copy of
the access permit shall be submitted prior to approval of the final
"Development and Traffic Control Plan ").
2) Submittal by the applicant and approval by the Board of County
Commissioners of a final" Development and Traffic Control Plan ".
Such plan shall be substantially in conformance with the previously
submitted plan on file and shall adhere to the provisions of Chapter
4.08A of the Spokane County Zoning Ordinance.
A. Reasons
1. The Planning Commission is of the opinion that the proposed site
is appropriate for Freeway Commercial development because it
meets the criteria contained in the text portion of the Comprehensive
Plan. The criteria relate to the following objectives for determin-
ing the best locations for Freeway Commercial zoning.
a) To provide the highest degree of usefulness and convenience
to Freeway users. The proposed site is visible from the
Freeway and the Barker Interchange affords convenient access
to the site.
b) To create a minimum of traffic congestion or hazards on the
limited access highway, its access and egress ramps, and
connecting County roads. (The State Highway Department has
withdrawn their previous concern of the Freeway Commercial
development.)
c) To create a minimum of adverse effect upon property developed
or planned for development for residential use. (The Commis-
sion is of the opinion that the subject property is not
appropriate for residential uses because of its proximity to the
Freeway Interchange to the south and the railroad tracks to the
north.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on November 17, 1978,
and the members of the Committee present being Eldon Thomas, Chairman, Jane
Myers, and John Culler and there being the following persons present who wish
to request approval of a Change in conditions on a previously approved
application; Mr. Gene Werner for a change in conditions which were approved for
the advertised property to be developed in substantial conformance with the
submitted development
plan for the

of amending the conditions so

B. FINDINGS OF FACT
1. That the existing land use in the area is a box company, campground,
Freeway, and vacancies.
2. That the Comprehensive Plan designates this area as appropriate .for
residential development.

existing pavement.
2. An appropriate on -site drainage disposal system shall be approved by
the Spokane County Engineer's Office prior to the release of

The applicant shall comply with rules and regulations of the Health
District in providing for adequate sewage disposal. All necessary Health
District permits shall be obtained prior to building permit issuance.
On -site drainage plans to be approved prior to issuance of building
permits regarding oil separation.
C. County Fire Marshal's Office: Fire District #1
Mains and hydrants to be installed, in accordinace with the Spokane
County Fire Marshal's requirements.

III. CONDITIONS
If the Planning Commission approves this request, the following conditions
should be considered:
a. Compliance with all requests stated under Reviewing Agency Comments

b. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee. Minor
variations when approved by the Zoning Administrator will be permitted,
including, but not limited to the following changes: Building location,
building materials, landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations set forth in
the Spokane County Zoning Ordinance. The original intent of the
development plans shall be maintained.
C. A landscape plan showing specific detail and accompanied by a performance

Subject Design Deviation Request Werner ZE IOIC -70
ZE 101 -70 egg to Freeway Commercial was heard by the Planning Commission December
11, 1970. Applicant was James Boatwright (Texaco). Conditions of Approval required
submittal of a final "Development and Traffic Control Plan" which was to be approved by
the Board of County Commissioners. A site plan depicting the location of the proposed
service station and restaurant site is attached and marked "A ".
A second site .plan was signed by Mr. Turner July 22, 1971 which approved the loca—
tion of the proposed restaurant (marked "B "). A third site plan approving the service
station layout was approved by Mr. Turner September 21, 1971 (marked as "C ").
In November of 1978, Mr. Gene Werner requested a change of condition which would
permit him to construct a truck stop facility instead of the approved restaurant. This
request was approved. This decision was appealed to the Board of County Commissioners
and a public hearng held January 15, 1979. The Commissioners upheld the decision of
the Hearing Examiner Committee subject to certain "Findings and Conditions ":
1. Applicant shall construct paved and delineated approaches to meet existing pave—
ment.
2. An appropriate on —site drainage disposal system shall be approved by the Spokane
County Engineer's Office prior to release of building permits for the project.
3. Access permits for the advertised property shall be obtained from the Spokane
County Engineer's Office prior to release of building permits.
4. Barker and Cataldo intersection to be revised for truck turns if necessary.
In June of 1984, Mr. Werner requested a "Change of Condition Hearing" before the
County Zoning Adjustor. He was proposing a restaurant addition to the existing service
station.
A review of our records disclosed that approach permits had not been obtained nor
was a drainage plan approved as per the 1 -15 -79 approval. A field inspection was
conducted and the following observed.
1. Access to the service station site is not controlled and, therefore, access can
occur anywhere along the property frontage.
2. Approaches have been paved but they have not been delineated.
3. It appears as if paving has been in place in the road right —of —way along appli—
cant's frontage. This construction apparently was accomplished without approval of
the County.

County maintenance has had problems in the past with drainage from the site. These
problems were primarily due to failure of drywells on —site and the consequential
pooling of water. Drywell failure may be primarily the result of using the drywell for
disposal of oil and other petroleum products.

On May 6, 1983, a zone change (ZE 11 -83) was heard for a two —story commercial
building on the West side of Cataldo directly across the street from Mr. Werner's truck
stop. Attached is a copy of the "Conditions of Approval" for that action. I have also
attached a copy of the "Findings and Order" which are applicable to the Werner applica—
tion.
The conditions which were required for the Werner application are the same as those
required for ZE 11 -83. The construction of the improvements is warranted in both in—
stances by the traffic each use will generate and the need to control access along
Cataldo. Cataldo presently serves industrial uses East of Barker Road and the Werner
site. It is anticipated in the future that Cataldo will extend Easterly toward Harvard
Road. It will serve properties which are presently industrially zoned and other
properties in the area. The Comprehensive Plan has designated the area Industrial.
Unless the improvements are made by Mr. Werner at this time, the County could face
a severe traffic control problem in the future as traffic volumes increase along
Cataldo. The requirements for the Werner property are consistent with County Engi—
neer's policies and Spokane County Road standards.
It is my recommendation that the request be denied. ACP behind curbing could
suffice for PCC sidewalk.
