PE-1126-77 (2)MINUTES JULY 22, 11'77 PRELIMINARY SUBDIVISION AND ZONE CLASSIFICATION UIGRADING PE- 1126 -77 - WINDY ADDITION: MC KINLEY ZE- 122 -77 - AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL Planning Commission Recommendation: Approve, subject to the Revised Prelimi- nary plat with the following conditions: (Vote was unanimou,$). I. GENERAL INFORMATION: A. Location Windy Addition is Located in the east central area of the Spokane Valley east of Greenacres Road and north of 4th Avenue. B. Proposal The applicant proposes to subdivide approximately 2..1 acres into eight (8) lots for single family dwellings with a typical lot size of 78.5 feet of frontage with a depth of 117.5 feet or approximately 9224 square feet per lot. The Staff's proposal would have :. six (6) lots with a typical frontage of 105 feet and an arEa of approximately 12, 300 square feet per lot. The Staff's prc posal would meet the required minimum specified by the Zoning Ordinance in regards to the Single Family Residential Zone Classiflcatiot The applicant's proposal would not meet these minimums. C. Existing Land Uses The site is currently used as a pasture with no significant topographi- cal features. The properties that generally surround it are typi; ally larger lot agricultural uses with typical lot size in excess of 1 1/2 acres. Further to the west and north several residential subdivisions are also located. Included among these are Moen addition, Pinkerton Park and Hubbard Addition. D. Compatibility with Existing Land Uses The proposal appears to be compatible with the development that has occured further to the north and west, but may be somewhat incongrous with the immediate area. The proposal is also compatible with the future intended uses for the area - residential uses. E. Relationship to the Comprehensive Plan The proposed subdivision is located within an area that has been designated as suitable for residential development by the Spokane County Comprehensive Nan. - 12 - PE- 1126 -77 - WINDY ADDITION (Continued) II. SPECIAL INFORMATION: A. Circulation Adequate county roads appear to be available to serve the proposed subdivision B. Water Consolidated Water District ha s stated it has the ability to serve the proposed subdivision with both domestic and flreflows. C. Fire Protection Both mains and hydrants need to be installed to provide for adequate fire protection. D. Sewage Disposal The Spokane County Health District has approved the site for on -site sewage disposal. However, the proposed subdivision lies over the Spokane Valley Aquifer. The District believes that approval of this subdivision will have a negligible immediate impact upon the water quality, but continued urbanization at this density can be expected to have at least moderate impact upon the water quality. E. Schools F. Parks Central Valley School District believes that approval of this subdivision would have a negligible impact upon their district's facilities. No county parks are currently available in the area and the County Parks Department has no present plan for either site acquisition or major park improvements. III. ENVIRONMENTAL REVIEW: The Staff of the Planning Department has reviewed the checklist as submitted by the applicant and the Staff recommends that a declaration of Non - Significance be Lssued. - 12A - PE- 1126 -77 - WINDY ADDITION (Continued) IV. CONDITIONS: Specific conditions applicable to this plat are referenced below and found in the attached supplement entitled, "Standard Conditions for Approval of Preliminary Plats - May, 1977 ". NOTE: Any amendments to said conditions are stated separately and listed below. P -1 (revised), P -2, P -3, P -4, P -5, P -6, P -7, P -8, P -9 (August 1, 1978; P -13, E -1, E -2, E -3, E -4, E -5, E -6, A -1, H -1. That a statement be placed in the dedication prohibiting individual lot access to Greenacres Road. FINDINGS ANI I'I R REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE CLASSIFICATION UP- GRADING: E1126 7 WINDY ADDITION ZE12277 AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL. and WHEREAS, the Spokane County Planning Commission did after public hearing on July 22, 1977 forward to the Board of County Commissioners a recommendation that the preliminary plat be known as Windy Addition (File #PE112677) and zone classification upgrading to the Single Family Residential classification (File #ZE12277) be approved, WHEREAS, J. Brent McKinley did by letter request a special hearing before the Board of County Commissioners to present evidence and testimony against the recommen- dation of the Planning Commission to approve the above described preliminary plat and zone change and zone classification upgrading, and WHEREAS, the Board of County Commissioners did hold a public hearing on September 29, 1977 to consider the recommendations of the Planning Commission and testimony and request of the applicant objectors and other interested parties, and WHEREAS, at said hearing opportunity was afforded those favoring and those opposing the above described preliminary plat proposal and zone reclassification, the Board of County Commissioners of Spokane County having fully considered the testimony given, the records and minutes of the Planning Commission, the environ- mental assessment and all other evidence presented and having personally acquainted themselves with the sight and vicinity in question does hereby find that the con- clusions of the Planning Commission were generally valid and sufficient in that the preliminary plat proposal recommended for approval by the Planning Commission con- tained six laws, all of which met the minimum standards as required in the Spokane County Zoning Code for lots within the Single Family Residential Zone classification; and that the eight lots as proposed by the plat sponsor did not meet the minimum standards of the Single Family Residential Zone classification.
