This being the day set for the hearing on Spokane County Engineer's Report on the
proposed establishment of STREETS IN PINES WEST AND PINES WEST FIRST ADDITIONS, ESTABLISH-
MENT proceedings for which were initiated by PRELIMINARY RESOLUTION 80 -0137, and it ap-
pearing to the Board on proof duly made that Notice of Hearing was published and posted in
the manner and for the time required by law ; the Board after examining the report and
maps of the Spokane County Engineer and all claims and papers on file and after hearing
all other evidence adduced at the hearing; and
IT FURTHER APPEARING That the rights of way have been dedicated as public roads, 50
feet wide and that said roads are a public necessity and the same should be opened and
established as County roads.
THEREFORE, BE IT RESOLVED By the Board of County Commissioners of Spokane County,
Washington, that the hereinafter described roads as reported by the Spokane County
Engineer on the 25TH day of FEBRUARY, 1980, being more particularly described as follows:
RAILROAD AVENUE - from the North right of way line of Frederick Avenue
Northeast; thence, curving Southeast and East to Railroad
Circle.
RAILROAD CIRCLE - from the Northeast right of way line
to and including cul de sac; thence,

FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE RECLASSIFICATION,
PE- 1140 -77, PINES WEST; ZE- 16 0 -77• AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL AND /OR
TWO FAMILY RESIDENTIAL
WHEREAS, the Spokane County Planning Commission did, after public hearing
on NOVEMBER 16, 1977, at which a quorum vote did not occur, forward to the Board
of County Commissioners a request that the Board set a special hearing date
(File Number PE- 1140 -77) the preliminary plat to be known as PINES WEST; and,
WHEREAS, the Ralph Guthrie Company did by letter dated NOVEMBER 30, 1977,
request a special hearing before the Board of County Commissioners to present
evidence and testimony in lieu of no recommendation from the Planning Commission
with regard to the above described preliminary plat and zone reclassification; and,
WHEREAS, the Board of County Commissioner did hold a public hearing on
DECEMBER 29, 1977, to consider the preliminary plat known as PINES WEST, the 're-
quest of the plat sponsor and comments of the objectors and other interested
parties; and.
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spokane County, having fully considered the •
testimony given, the records and minutes of the Planning Commission, the staff
findings of NOVEMBER 16, 1977, the environmental checklist, and all other evidence
presented, and further having personally acquainted themselves with the site and
vicinity in question, does hereby find that the conditions contained in the staff
findings were generally valid and sufficient; and,
WHEREAS, the Chairman•of the Board did issue on JANUARY 31, 1978 a pro-
posed negative threshold determination, which was duly circulated with the environ-
mental checklist and staff review to other agencies of jurisdiction; and,
WHEREAS, Grant L. Kimer, did by letter dated FEBRUARY 13, 1978, challenge
the issuance of a proposed declaration of non - significance, pointing out numerous
alleged potential problems associated with existing railroad related noises, as
well as possible mitigating measures; and,
viral-mks, the Board and various County staff members did confer with regard
to Mr. Kimer's letter, noted the issues raised,_reconaidered the proposed declaration
of non - significance; and,
WHEREAS, the Chairman did issue a final negative threshold determination on
FEBRUARY 17, 1978;
NOW, THEREFORE, the Board of .County Commissioners does conclude that
the proposed preliminary plat to be known as PINES WEST and zone reclassification
to Single Family Residential and Two Family Residential should be and hereby is
approved subject to the Planning Staff findings of NOVEMBER 16, 1977, EXCEPT that
the following additional conditions shall also be imposed; '
1) That duplexes within the plat be limited to the area east
of Bowdiah Road.
2) That the sponsor provide for a 6 foot security fence along
the north plat boundary so as to provide a clearly divided
separation from the railroad tracks.
3) That a statement be placed in the plat dedication that unusually
high noise levels may exist in the area during certain periods
of the day.
4) That the plat sponsor make every effort through special eon -.
struction methods and landscaping to mitigate any possible
noise problem that might exist. The plat sponsor is directed
to'work with the Building Codes Department and the Planning
Staff to develop these methods.

In meetings with Idr. Steve Smitherman and Art Noll, of our organization;
it has been determined that the Spokane County Engineers can accept the streets
within Pines West and Pines hest First Additions for maintenance if you are in
possession of a letter from us accepting responsibility for the completion of
the following:
1. Replacement of a section of curb on Wilbur Court.
2. Asphalt patching on Railroad Circle where a fire hydrant has
been installed.
3. Aionumentation of both sub- divisions.
h. Removal of broken curb pieces on property at the SIT corner of
Bowdish and Railroad.
5. Instl3J ation of fencing along the northern plat boundries.
6. Clean-un of roadway of dirt and debris caused by excavations
in the spring.
It is also understood that this letter will enable you to commence maintenance
of these streets upon final establishment of these additions and that except for
the aforementioned six (6) items all on -site improvements have been completed and
are acceptable.

As the Planning Commission may recall, this Item was continued to t his hearing
In order that the applicant might further work with the Staffs of the Engineer's
Office and Planning Department to minimize circulation problems In the area.
The applicant has met with the Staffs and it has been determined that the proposed
plat should be redesigned to connect the proposed cul -de -sacs Located neat the
east property line of the plat.
I. GENERAL INFORMATION:
Location
B. Proposal
Pines West is located In the north central area of the Spokane Valley,
south of Trent Avenue and west of Pines Road.
The applicant proposes to subdivide approximately 14 acres into 63
lots, 31 of which are planned for duplexes. The proposal would create
a gross density of about 3.9 units /acre with a typical lot size of about
10,200 square feet.
C. Relationship to the Comprehensive Plan
Pines West is located within an area that has been designated as
suitable for residential development by the Spokane County Comprehen-
sive Plan.
D. Existing Land Uses
The site Ls presently vacant with minor drainage problems. The proper-
ties to the south have developed over the years Into several residen-
tial subdivisions. To the east is the Trent Elementary School, while
to the north is Trent Avenue and several railroad tracks.
E. Compatibility with Existing Land Uses
The Staff believes that this proposal would be compatible with the
existing development to the south and that the duplexes would form:.
an appropriate buffer from the several railroad tracks to the north.

As was mentioned above with tho redesign as suggested the plat
design would be acceptable to the Engineer's Office.
The Spokane County Health District has approved the site for on -site
sewage disposal. However, the proposed subdivision lies over the
Spokane Valley Aquifer. 'The District believes that approval of this
subdivision will have a negligible immediate impact upon the water
quality, but continued urbanization at this density can be expected
to have at least moderate impact upon the water quality.
Irvin ',d ater District has stated it has the ability to serve the proposed
subdivision with both deornestic and f.reflows.
D. Fire Protection
Both mains and hydrants need to be installed to provide for adequate
fireprotection .
The proposal is situated within the boundaries of the East Valley School
District where the District facilities are at capacity levels. The Dis-
trrct expects this problem to be. mitigated somewhat when their
current building program is completed in two or three yea s time.
No county parks are currently available in the area and the County
Parks Department has no present plan for either site acquisition of
major park improvements.

111. ENVIRONMENTAL REVIEW:
The Staff of the Planning Department has reviewed the checklist as submitted
by the applicant and the Staff recommends that a declaration of Non - significance
be issued.
III. CONDITIONS:
If approval is granted, the Staff recommends the following conditions:

That all roads within the plat be curbed and /or paved to the specifications of the
County Engineer; existing County roads providing direct access to lots of the plat
shall be paved and /or curbed to standards of the County Engineer.
That the plat be redesigned to connect the presently proposed dead -end cul -de -sacs
located near the east property line.
That the sponsor provide for walkway connections to the school site to the east in
locations acceptable to the county engineer. Improvements shall include a paved
pathway and fencing of walkway connections.
That prior to filing of the final plat, the drainage ptan shall be approved by the
County Health District.
No on -site sewage disposal systems shall be located on lots 10, 11, 12, Block 2.
That all lots proposed for duplexes have a minimum of 90 feet of frontage and
11,000 square feat of lot area.
Upgrade all of Block 1, lots 1 - 8, Block 2, lots 1- 4,7,8,13 -16, Block 3 and lots 1 -9,
Block 4 to Two- Family Residential the remainder to Single Family Residential.
That the proposed intersection of Bowdish Road and the proposed northeasterly -

WHEREAS, the Spokane County Planning Commission did hold a public
meeting on November 16, 1977 to consider the testimony and requests of several
applicants, objectors and other interested parties concerning the below referenced
subdivisions, zone classification upgradings, extens.lons of time and other items
of business, and
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing all items of business, and
WHEREAS, Mr: McCoury, Mrs. Byrne, Mrs. Rawlings, Mr. Main and Mr.
Thomas were Ln attendance and constituted a quorum, and
WHEREAS, the Spokane County Planning Commission fully considered the
testimony given, the environmental review, and all other evidence presented,
recommends to the Board of County Commissioners the following:
1. PN- 1124 -77, ROBERTSON ADDITION: ROBERTSON. That the preliminary
subdivision to be known as Robert son Addition (File Number PN- 1124 -77)
be approved subject to the conditions as contained in the Planning
Staff's findings, dated November 16, 1977, and that the following
conditions be imposed: That the following statement be placed in the

requesting this as the applicant has tried to comply with the various
recommendations and changes that the Planning Commission has made

FAMILY RESIDENTIAL
Staff findings regarding PE- 1140 -77, Pines West.
As the Planning Commission may recall, this Item was continued to t his hearing
in order that the applicant might further work with the Staffs of the Engineer's
Office and Planning Department to minimize circulation problems In the area.
The appltcant has met with the Staffs and It has been determined-that the proposed .
plat should be redesigned to connect the proposed cul -de -sacs located near the
east property line of the plat.
I. GENERAL INFORMATION:
A. Location .
B. Proposal
Pines West is located in the north central area of the Spokane Valley,
south of Trent Avenue and west of Pines Road.
The applicant proposes to subdivide approximately 14 acres into 63
lots, 31 of which are planned for duplexes. The proposal would create
a gross density of about 3.9 units /acre with a typical lot size of about
10,200 square feet.
C. Relationship to the Comprehensive Plan
Pines West is located within an area that has been designated as
suitable for residential development by the Spokane County Comprehen-
sive Plan.
D. Existing Land Uses
The site Ls presently vacant with minor drainage problems. The proper-
ties to the south have developed over the years into several reslden-
tial subdivisions. To the east is the Trent Elementary School, while
to the north is Trent Avenue and several railroad tracks.
E. Compatibility with Existing Land Uses
The Staff believes that this proposal would be compatible with the
existing development to the south and that the duplexes would form•
an appropriate buffer from the several railroad tracks to the north.

A. Circulacion

As was mentioned above with the redesign as suggested the plat
design would be; acceptable to the Engineer's Office.
B. Sewage Disposal
The Spokane County Health District has approved the site for on -seta
sewage disposal. However, the proposed subdivision lies over the
Spokane Valley Aquifer. The District believes that approval of this
subdivision will have a negligible immediate impact upon the water
quality, but continued urbanization at this density can ba expected
to have at least moderate impact upon the water quality.
Irvin Seater District has stated it has the ability to serve the proposed
subdivision with both deornestic and fireflows.
D. Fire Protection
Both mains and hydrants need to be installed to provide for adequate
nieprotection.
E. Schools
The proposal is situated within the boundaries of the East Valley School
District where the District iac.I_itiuJ aro at capacity levels. The Dis-
trict expects this problem to be mitigated somewhat when their
current building •program is completed in two or three yea s time.
No county parks, are currently available in the area and the County
Parks Department has no present plan for either site acquisition of
major park improvements.

111. ENVIRONMENTAL REVIEW:
The Staff of the Planning Department has reviewed the checklist as submitted
by the applicant and the Staff recommends that o declaration of Non- significance
be issued.
Iv. CONDITIONS:
If approval is granted, the Staff recommends the following conditions:
Spc:fic conditions applicable to this plat are referenced below and found in ,
the attached supplement entitled, "Standard Conditions for Approval of Prelimi-
nary Plats - August, 1977. NOTE: Any amendments to said conditins are
stated seperately and listed below.

That all roads within the plat be curbed and /or paved to the specifications of the
County Engineer; existing County roads providing direct access to lots of the plat
shall be paved and /or curbed to standards of the County Engineer.
That the plat be redesigned to connect the presently proposed dead -end cul -de -sacs
located near the east property line.
That the sponsor provide for walkway connections to'the schcol site to the east in
locations acceptable to the county engineer. Improvements shall include a paved
pathway and fencing of walkway connections.
That prior to filing of the final plat, the drainage plan shall be approved by the

of time be denied. (Mrs. RawLings moved, Mrs. Byrne seconded. Vote was

15. Mrs. Rawlings moved and Mr. Main seconded that we approve the Capability
report with revisions as presented. The report is to be used In conjunction
with other reports in the development of the Comprehensive Plan. The motion
would exclude: a disclaimer clause. (Motion passed unanimously..)
16,. Tom Mosher of the Planning Department's Staff reported on:
1. The recently completed contract with National Heritage, Inc., Pullman,
Washington, which pulled together existing information on the historical and
archaeologlcal resources of the County.
2. The Historical Preservation Committee of the Junior League where City
and county progress were discussed. An additlonaltopic of discussion was an
upcoming proposal to the City and County governments to work toward
establishment of a City- County Landmarks Commission.
3. A currently developing proposal to seek, with a cooperative agreement
with the City of Spokane, A 50 -50 matching grant from the State's Office of
Archaeology and Historic Preservation to Hire a Preservation Planner and
subsequently expand the preservation activities within the County.
17. Mr. Fred Dayharsh, Director of Planning., brought to the Planning Commission':
':tentlon a need to set ahead the filing date for preliminary plats and zone changes. An
amendment to the Zoning Ordinance and a resolution by the County Commisslore
will be needed tomake this change in policy. A motion was made to direct the
staff to recommend amendments as to the cut -off date for zone changes and
plats, also all field work is to be done prior to the filing of the preliminary
zone changes and plats in the Planning Department Office. (Motion by Mrs.
Rawlings, seconded by Mr. Thomas. Vote was unanimous.)
18. The members of the Planning Commission discussed the review period of the
Five -Mlle Draft EIS. A motion was made by Mrs. Rawlings and seconded by
Mrs. Byrne that an extension of time of the comment period of the Draft EIS
for Five -Mile be extended to December 1, 1977. The Staff was directed to
write a letter to the City to that effect. It was requested that a City Staff
member be present at further dlscusslon. Mrs. Rawlings was concerned about
not getting recommendations up from the Coordinating Committee. It was sugges
ted that on Friday's Planning Commission hearing that Staff and Planning
Commission member could have some observation on that item. Mr. McCoury
agreed that It could be done. ..
Mr. Main excused himself from discussion and voting on Items No. 8 and 11, due
to a possible conflict of interest.
Mrs. Byrne excused herself from dlscusslon and voting on Item No. 13, due to the

COMMISSIONERS' DECISION
This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
Hodges, Inc., East 12715 Mission Avenue, Spokane, Washington 99206 for the
above captioned preliminary subdivision and zone classification upgrading;
and
The Board having received no recommendation from the Spokane County Planning
Commission because of the lack . of a quorum vote on said application, as
set forth in the Commission's minutes of November 16, 1977; and
The Board having conducted its own public hearing on December 29, 1977,
at the request of Ralph Guthrie Company, East 12721 Sprague Avenue,
Spokane, Washington, and after visiting the site and reviewing the
testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board and consideration of the environmental review, to approve
this preliminary plat application subject to the conditions as contained
in the Planning Staff Findings, EXCEPT that the following additional
conditions shall also be imposed:
1) That duplexes within the plat be limited to the areaeast
of Bowdish Road.
2) That the sponsor provide for a 6 foot security fence along
the north plat boundary so as to provide as clearly divided
separation from the railroad tracks.
3) That a statement be placed in the plat dedication that unusually
high noise levels may exist in the area during cerain periods
of the day.
4) That the plat sponsor make every effort through special con-
struction methods: and landscaping to mitigate any possible
noise problem that might exist. The plat sponsor is directed
to work with the Building Codes Department and the Planning
Staff to develop these methods.
The Board authorized the Chairman to sign a final declaration of non -
significance.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

with regard to the above described preliminary plat and zone reolaesifieation; and,
WHEREAS, the Board of County Commissioner did.'hold a public) hearing on
DECEMBER 29, 1977, to consider the preliminary plat known as PINES WEST, the re-
quest of the plat sponsor and comments of the objectors and other interested
parties; and.
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spokane County, having fully considered the
testimony given, the records and minutes of the Planning Commission, the staff
findings of NOVEMBER 16, 1977, the environmental checklist, and all other evidence
presented, and further having personally acquainted themselves with the site and
vicinity in question, does hereby find that the conditions contained in the staff
findings were generally valid and sufficient; and,
, the Chairman of the Board did issue on JANUARY 31, 1978 a pro-
posed negative threshold determination, which was duly circulated with the environ-
mental checklist and staff review to other agencies of jurisdiction; and,
WHEREAS, Grant L. Kimer, did by letter dated FEBRUARY 13,'1978, challenge
the issuance of a proposed declaration of non - significance, pointing out numerous
alleged potential problems associated with existing railroad related noises, as
well as possible mitigating measures; and,
WHEREAS, the Board and various County staff members did confer with regard
to Mr. Kimer's letter, noted the issues raised, reconsidered the proposed declaration
of non - significance; and,
WHEREAS, the Chairman did issue a final negative threshold determination on
FEBRUARY 17, 1978;

NOW, THEREFORE, the Board of County Commissioners does conclude that
the proposed preliminary plat to be known as PINES WEST and zone reclassification :'
to Single Family Residential and Two Family Residential should be. and hereby ie
approved subject to the Planning Staff findings of NOVEMBER 16, 1977, EXCEPT that
the following additional conditions shall also be imposed;
1) That duplexes within the plat be limited to the area'eaet
of Bowdish Road.'
2) That the sponsor provide for a 6 foot security fence along
the north plat boundary so as to provide a .clearly divided
separation from the railroad tracka.
3) That a statement be placed in the plat dedication that unusually
high noise levels may exist in the area during certain periods
of the day.
4) That the plat sponsor make every effort through apeolal conk'°
struction methods and landscaping to mitigate any possible
noise problem that might exist. The plat sponsor is directed.
to work with the Building Codes Department and the Planning
Staff to develop these methods.
