Staff findings for PE- 1143 -77, Rainbow Estates:
I. HISTORY:
As the Commission may recall this Item was originally reviewed November 16,
1977 with a recommendation to the developer that before this item was to be
acted upon by the Commission that a commuhlty meeting be held with the area
residents to review both the proposal and the plat density. That meeting has now
been held and we are ready to proceed with the proposal.
II. GENERAL INFORMATICN:
A. Location
Rainbow Estates is situated in the east central area of the Spokane Vatley,
south of Broadway Avenue, west of Flora Road and east of Conklin Road.
B. Proposal
The applicant proposes to subdivide five (5) acres Into 13 lots, all for
duplexes .• . The proposal would create a gross density of
about five units per acre, with a typical lot size in excess of 11,000
square feet per lot.
C. Relationship to the Comprehensive Plan
Rainbow Estates is situated within an area that has been designated as
being suitable for residential development by the approved map Of the
Comprehensive Plan.
D. Existing Land Uses
The site is presently vacant with no significant topographic features. The
properties that generally surround this proposal have a .typical lot size in
excess of one (1) acre.
E. Compatibility with Existing Land Uses
As was previously mentioned, the typical lot size in the area appears to
be one acre, with a typical use being single family dwellings. The appli-
cant proposes a plat density of about three Lots per acre, all for duplexes.
The staff finds this proposal to be incompatible with the given existing use:
in the area but Lf future commercial development occurs to the northwest
as has been proposed, then this proposal may be somewhat more compatible

III. SPECIAL INFORMATION:
A. Circulation
The Engineer's Office has reviewed this proposal and fir.ds that both adequal
county roads are available to serve the proposal and tha.: the: plat design
is acceptable to their office.
B. Sewage Disposal
The Health District has approved the use of Individual systems for this
proposal. The plat is however, situated offer the Spokane '!alley Aquifer
where moderate impact upon water quality may be expecte 1 at some
future date. If approval were granted for duplexes at ‘the density proposed
by the developer, then a sewage management system would .le required as
a condttlona of approval.
C. Water Supply
Vera Irrigation District indicates that It has the ability to serve the site
with both domestic and fire flows.
D. Drainage
E. Fire Protection

. G. Parks
The STaff finds that because of the relatively flat t errata of the site and
adjacent properties, that no special drainage control methods would be
required and standard techniques for storm water control could be used.
Both mains and hydrants of sufficient size for fire protection facilities
would be required as a condition of approval.
The proposed subdivision is situated with in the boundaries of the Central
Valley School District, where the district's facilities in this area are at
capacity levels. The District believes that this problem may be mitigated
somewhat when their current building is completed sometime within the
next year.
There are no improved county parks situated within the area and the Parks
Department has no present plan fersither site aquisltion or major park
improvements at this time.

The Staff finds that a rezone to the Two - Family Residential Zone Cla
would be inappropriate given the use and character of the area in that the existing
zontng of the property surrounding this proposal is the Agricultural Classification
with a typical lot sizes in excess of one acre. The Staff further finds that a
rezone to the Agricultural Suburban Zone Classification would be more appropriate
given the existing use and character of the area.

V. ENVIRONMENTAL REVIEW:
The Staff has reviewed the environmental checklist submitted by the applicant
and the Staff finds that no significant adverse environmental impacts would likely
result and a proposed declaration of Non - Significance should be issued.

by the project applicant within thirty (30) days of formal action by the Board of
County Commissioners, as instructed by the Planning Department Staff.
That all roads within the plat be curbed and paved to the specifications of the
County Engineer. Existing county roads providing direct access to lots of the
plat shall be paved and curbed to standards of the County Engineer.

FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE CLASSIFICATION
UPGRADING PE- 1143 -77 RAINBOW ESTATES ZE- 163 -77 AGRICULTURAL TO TWO FAMILY RESI-
DENTIAL.
WHEREAS, the Spokane County Planning Commission did, after public hearing
on January 20, 1978, forward to the Board of County Commissioners a recommendation
that the preliminary plat to be known as Rainbow Estates (File #PE- 1143 -77) and
zone reclassification to the Two Family Residential zone classification (File #ZE- 163 -77)
be denied, and
WHEREAS, Robert D. Waldo did request a special hearing before the Board
of County Commissioners to present evidence and testimony against the recommendation
of the Planning Commission to deny the above described preliminary plat and zone
reclassification, and
WHEREAS, the Board of County Commissioners did hold a public hearing on
March 2, 1978 to consider the recommendations of the Planning Commission, the
testimony and requests of'the applicant, objectors, and other interested parties,
and
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone reclassification,
the Board of County Commissioners of Spokane County having fully considered the
testimony given, the records and minutes of the Planning Commission, the environ-
mental review, and all other evidence presented, and having personally acquainted
themselves with the site and vicinity in question does hereby find that the con-
clusions of the Planning Commission were generally valid and sufficient, and that
the area is in fact inappropriate for duplexes at this time, and that a lot size
of at least 1 acre per lot would be more appropriate. Now, therefore the Board of
County Commissioners does conclude that the preliminary plat known as Rainbow Estates
(File #PE- 1143 -77) and zone classification upgrading to the Two Family Residential
zone classification (File #ZE- 163 -77) should be, and hereby is, denied.

County, Washington, will hold a public hearing at 3:00 P. M., on December
8, 1977 to consider the Planning Commission's recommendation that the
above application be continued to its November hearing.
NOTICE IS FURTHER GIVEN that any person interested may appear at said

Staff findings regarding PE- 1143 -77, Rainbow Estates.
I. GENERAL INFORMATION:
A. Location
Rainbow Estates is located in the east central area of the Spokane Valley,
south of Broadway Avenue and west of Flora Road.
B. Proposal
The applicant proposes to subdivide approximately 4.8 acres into 13 lots
for duplexes, creating a gross density of about five units per acre with
a typical lot size of about 13, 000 square feet.
C. Relationship to the Comprehensive Plan
Rainbow Estates is located within an area that has been designated as
suitable for residential development by the Spokane County Comprehensive
Plan.
D. Existing Land Uses
The proposed site Is presently vacant with no significant topographic
features. The properties that generally surround the project are primarily
of the larger lot rural category. However, duplexes are scattered
throughout the area and a church is located to the north.
E. Compatibility with Existing Land Uses
The proposal appears to be somewhat incompatible with the existing land
uses in the area, but Ls, however, located on the edge of a neighborhood,
does abut an arterial and is located southeast of a proposed major shop-
ping center. The proposal is also compatible with the future intended use
for the area - residential uses.
II. SPECIAL INFORMATION:
A. Circulation
Adequate county roads appear to be available to serve the proposed sub-
division.

B. Sewage Disposal
The site has been approved for the use of on -site, sewage disposal systems
to serve the proposal by the Health District. The proposal, if approved
for duplexes, would have to be approved by the Health District. The
proposal is also situated over the Spokane Valley Aquifer. The Health
District believes that the use of on -site systems for this proposal would
have a negligible Immediate impact upon the ground waterquality, but
continued urbanization in the area can be expected to have at least a
moderate impact upon ground water quality.
C. Water
D. Fire Protection
E. Parks
Vera Irrigation has stated it has the ability to serve the proposed sub-
division with both domestic and fireflows.
Both mains and hydrants need to be installed to provide for adequate fire
protection.
No county parks are currently available in the area and the County Parks
Department has no present plan for either site acquisition or major park
improvements.
F. Schools
Central Valley School District believes that approval of this subdivision
would have a negligible impact upon their district's facilities.
III. ENVIRONMENTAL REVIEW:
The Staff of the Planning Department has reviewed the checklist as submitted
by the applicant and the Staff recommends that a declaration of Non - Significance
be issued.
IV. CONDITIONS:
If approval Is granted, the Staff recommends the following conditions.
Specific conditions applicable to this plat are referenced below and found in
the attached supplement entitled, "Standard Conditions for Approval of Prelimi-
nary Plats - August, 1977."

the plat shall be paved and /or curbed to standards of the County Engineer.
That a statement be placed in the dedication prhibiting individual lot access to
Broadway Avenue.
That the sponsor provide for ten (10) feet of additional right of way along
Broadway Avenue as indicated on the preliminary plat of record.
