AGRICULTURAL TO TWO - FAMILY RESIDENTIAL: That the request for an extension
of time be denied. (Mrs. Rawlings moved, Mrs. Byrne seconded. Vote was
unanimous.)
15. Mrs. Rawlings moved and Mr. Main seconded that we approve the Capability
report with revisions as presented. The report is to be used in conjunction
with other reports in the development of the Comprehensive Plan. The motion
would exclude a disclaimer clause. (Motion passed unanimously.)

RESIDENTIAL
Staff Findings regarding PE- 1151 -77, Castle Court:
I. GENERAL INFORMATION:
A. Location
Castle Court Is located in the south central area of the Spokane Valley
at the northwest corner of 12th Avenue and Sullivan Road.
B. Proposal
The applicant proposes to subdivide approximately 3.3 acres into 10
lots, nine (9) of which would be for duplexes, thereby creating a gross
density of about six (6) units per acres with a typical lot size of
about 111250 8qu'are .feat.
C. Relationship to the Comprehensive Plan
Castle Court is located within an area that has been designated as suit-
able for residential development by the Spokane County Comprehensive
Plan.
D. D. Existing Land Uses
The site Is presently vacant with no significant topographic features.
The properties to the east, south, and west have developed recently
into several residential subdivisions including, Rotchford Acres,
Si's Subdivision, Sullivan Way, Cherry Blossom and Craig Subdivision.
The properties that are generally to the north are primarily of the larger
lot rural category.
E. Compatibility with the Surrounding Land Uses
The proposal appears to be compatible with the recent subdivision acti-
vity to the area and appears to be compatible with the future intended
land use for the area - higher density residential uses.
II . SPECIAL INFORMATION:
A. Circulation
Adequate county roads appear to be available to serve the proposed
subdivision. - 9 -

B. Sewage Disposal
C. Water
The Spokane County Health District has approved the site for on -site
sewage disposal. However, the proposed subdivision lies over the
Spokane Valley Aquifer. The District believes that approval of this sub-
division will have a negligible immediate impact upon the water quality,
but continued urbanization at this density can be expected to have at
least moderate impact upon the water quality.
Vera Irrigation District has stated 1.1 has the ability to serve the proposed
subdivision with both domestic and fireflows.
D. Schools
Central Valley School District believes that approval of this subdivision
should have a negligible impact upon their districtis facilities.
E. Parks
IV. CONDITIONS:
No county parks are currently available in the area and the County Parks
Department has no present plan for either site acquisition or major
park improvements.
F. Fire Protection
Both mains and hydrants need to be installed to provide for adequate
fire protection.
III. ENVIRONMENTAL REVIEW:
The Staff of the Planning Department has reviewed the checklist as submitted
by the applicant and the Staff recommends that a declaration of Non- Signift -:
cance be issued.
If approval is granted the Staff recommends the following conditions:
Specific conditions applicable to this plat are referenced below and found in
the attached supplement entitled, "Standard Conditions for Approval of Prelimi-
nary Plats - August, 1977." NOTE: Any amendments to said conditions are
stated separately and listed below.

the lines and grades shown on the approved construction plans and that all disturbed
monuments have been replaced;
E 5 -no construction work is to be performed within the Public Right of Way until a permit
has bean issued by the County Engineer. All work is subject to inspection and approval
by the County Engineer;
E 6 -all construction within the Public Right of Way is to be completed prior to filing
the final plat or a bond in tha amount estimated by the County Engineer to cover the.
cost of construction of improvements, construction certification, "As Built" plans,
and mo nu_-aenting the street centerlines shall be'filed with the County Engineer_
E 7 -no direct access from lots to 1/2 right of ways until such time as additional right of
ways are dedicated and roads are established as County Roads.

E 8 - direct access from lots to Stub Road connections until such roads are constructed
to County Standards and established as County Roads.
E 9 -road design, rough grading construction, and drainage control for 1/2 rights of ways
and Stub Road connections are the responsibility of the Developer.
E 10 -that the Sponsor shall prepare and submit to the County Engineer a design proposal accept-
able to the State Highway Department of the proposed State Highway- County Road inter-
section. State Highway Department approval of the proposed design must be received prior
to the filing of the final plat. Improvements to the State Highway are to be the respon-
sibility of the Sponsor and may either be constructed or a bond to cover the cost of such
improvements furnished to the County Engineer in the amount as determined by the County
Engineer and the State highway Department.

WHEREAS, the Spokane County Planning Commission did, after public hearing on
November 16, 1977, forward to the Board of County •Commissioners a recommendation that
the preliminary plat be known as Castle Court (File #PE-1151-77) and zone reclass-
ification to the Single Family Residential zone (File #ZE-181-77) be approved, and
WHEREAS, Edwin Joe Engalls did . by letter
Board of County Commissioners to present evidence and testimony against the recom-
mendation of the Planning Commission to approve the above described preliminary plat
and zone reclassification, and
WHEREAS, the.Board of County Commissioners did hold a public hearing on January 5,
1978 to consider the recommendations of the P
