I FINDINGS PRELIMINARY SUBDIVISION AND ZONE CLASSIFICATION UPGRADING APE- 1152 -77 - MOEN FIRST ADDITION: SCHULTZ ZE- 182 -77 - AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL and /or TWO- FAMILY RESIDENTIAL Staff findings regarding PE- 1152 -77, Moen First Addition. I. GENERAL INFORMATION: A. Location Moen First Addition is located In the east central area of the Spokane Valley, north of Fourth Avenue and west of Barker Road. B. Proposal The applicant proposes to subdivide about 3.7 acres into ten (10) lots, . all for duplexes creating a typical lot size of about 12, 500 square feet and a gross density of about six (6) units per acre. C. Relationship to the Comprehensive Plan Moen First Addition is located within an area that has been designated as suitable for residential development by the Spokane County Compre- hensive Plan. D. Existing Land Uses The site Is presently vacant with no significant topographic features. To the west is the proposed Fourth and Long elementary school site. The properties to the south are primarily of the larger lot rural category while the properties to the north, northwest, and northeast have develop- ed over the years, into several residential subdivisions. Directly to the north is Moen Addition, where the commission recently approved a request for 12 duplexes on nearly five (5) acres. E. Compatibility with Existing Land Uses The Staff finds this proposal to be compatible with the recent develop- ment requests in the area, as well as the future Intended uses in the nelghtborhood, which appear to be the smaller lot residential type. II. SPECIAL INFORMATION: A. Circulation Adequate county roads appear to be available to serve the proposed subdivision. - 10 - PE-1152 -77 - MOEN FIRST ADDITION: SCHULTZ (Continued) B.. Sewage Disposal The Spokane County Health District has approved the site for on -site sewage disposal. However, the proposed subdivision Iles over the " Spokane Valley Aquifer.. The District believes that approval of this subdivision will have a negligible immediate impact upon the water quality. • C. Water Supply Consolidated Irrigation District has stated it has the ability to serve the proposed subdivision with both domestic and fireflows. D. Fire Protection F. Parks Both mains and hydrants need to be installed to provide for adequate fire protection. E. Schools Central. Valley School District believes that approval of this subdivision would have a negligible impact upon their distrlet's facilities. No county parks are currently available in the area and the County Parks Department has no present plan for either site acquisition or major park improvements. III. ENVIRONMENTAL REVIEW: The Staff of the Planning Department has reviewed the checklist as submitted by the applicant and the Staff recommends that a declaration of non - significant be issued. IV. CONDITIONS: If approval is granted the Staff recommends the following conditions: Specific conditions applicable to this plat are referenced below and found in the attached supplement entitled,, "Standard Conditions for approval for Preliminary Plats - August, 1977." Defendants FIRST GUARANTY MORTGAGE COMPANY, BANCSHARES MORTGAGE COMPANY, COMMERCE MORTGAGE COMPANY, and PACIFI NATIONAL BANK OF WASHINGTON, are all mortgage companies doing busi ess in Spokane County, Washington, through which all Plaintiffs obtain -d federally assisted financing for the transactions herein. NATURE OF CIVIL RIGHTS VIOLATIONS 5.1 The Plaintiffs reallege paragraph four (4) above, and by this. reference incorporates said paragraph herein. 5.2 That the Defendants DON W. BROWN, JOHN McBRIDE, ROBERT S. TURNER, JERRY C. KOPET, and KARL B. EMERY, in their official capac ties as representatives of 'Spokane County, Washington, either acte and /or failed to act in accordance with actual or constructive knowledge in regard to the cost of domestic water hook up in the residential subdivision known as Moab Meadows, Spokane Valley, Spokane County, Washington. 5.3 That the Defendants described in paragraph 5.1 herein, a1 = had actual or constructive knowledge in regard to the cost of dome tic water hook up in the residential subdivision known as Moab Meadows, Spokane Valley, Spokane County, Washington, said Defendants also acting or failing to act in accordance with said actual or contructive knowledge. 5.4 That the acts or failures to act of the Defendants descri•ed in this paragraph deprived Plaintiffs of rights guaranteed by the aws and Constitutions of the United States and the State of Washington. For the purposes of thi- Complaint, the residential subdivision referred to herein shall be referred to as "MOAB MEADOWS FIRST ADDITION, according to plat recorded in Volume 13 of Plats, at page 9, in Spokane Washington." Located within Moab Meadows is a water system which purpose is to provide domestic water to the homes in the subdivision. This system was installed by Defendant SYKES in the course of the development of the subdivision. Said water system supplies the entire subdivision with domestic water and, specifically, supplies the Plaintiffs' domestic water. 6.3 in the plat of the subdivision filed with Spokane County, Defendant SYKES covenanted with the County of Spokane that "a public water system as approved by county and state health authorities and the local fire district and water supplier OPERATIVE FACTS 6.1 The Plaintiffs reallege paragraphs one (1) through five (5) herein, and by, this reference incorporate said paragraphs herein. (purveryor) will be installed within this plat and the subdivider II will provide for individual service to each lot prior to sale of each lot." [See Exhibit "A" attached hereto, and by this reference incorporated herein]. Plaintiffs were the intended beneficiaries of the covenant between Defendant SYKES and Spokane County. 6.4 The Defendant SYKES, McCONNACHIE, and others who held. title to the real property described in paragraph 3.2 herein, petitioned the Board of Directors for the Moab Irrigation District No. 20, said petition seeking, a change of boundaries of the Irrigation District in order to annex MOAB MEADOWS FIRST ADDITION to the Irrigation District. [See Exhibit "B" attached hereto, and •y this reference incorporated herein]. That in•said petition, Exhibit "B" attached hereto, petitioners agreed "to pay such'amounts to place lands on a basis of equality with lands already in the district as may be fixed by the board of directors of the district at the time of t hearing of this petition." This amount is known as the equalizin amount. 6.5 That, as a result of the recording of the original documents, copies of which are attached hereto as Exhibits "A" a "B," all Defendants named herein had actual or constructive notic of the contents of said documents. 6.6 That in truth and fact, neither Defendant SYKES unde the covenants contained in Exhibit "A," nor the Defendant petitio era under Exhibit "B," said Exhibits being attached hereto, provided for indvidual service to the Plaintiffs'lots, nor did said Defendants pay the equalizing amount as agreed by them in the petition attac ed hereto as Exhibit "B." 6.7 That, instead, on or about December 22, 1978, Plaint ffs received from the Defendant Moab Irrigation District No. 20, a demand from said District for the Plaintiffs to pay the equalizin amount described in paragraph 6.4 herein [See Exhibit "C" attache hereto, and by this reference incorporated herein]. That each suc demand was for an amount not less than $308.00. 6.8 That, subsequently, with actual or constructive knowledge of the foregoing, all of the Defendants described in par MOAB.C6 COMPLAINT - 6 graph 5.2 herein, caused or allowed the amount described in paragraph 6.7 above, to be placed as an assessment and lien against the respective properties of the Plaintiffs. "A" and "8." That, as a result of said failure to disclose and /or adequately explain, Plaintiffs were completely unaware of the assessment subsequetly placed as a lien against th =ir respective properties, until either upon receipt of a Moab Irrigation Water Bill [an example of which. is attached hereto as Exhibit "D," and incorporated herein by this reference], or a "Notice" dated December 22, 1978'demanding payment [See Exhibit " MOAB.C7 COMPLAINT - 7 FIRST CAUSE OF ACTION BY ALL PLAINTIFFS AGAINST DEFENDANT SYKES 7.1 Plaintiffs reallege paragraphs one.(1) through six (6) above, and by this reference incorporate said paragraphs herein. 7.2 The covenants made by the Defendant SYKES to Spokane County, and to Moab Irrigation District No. 20 were the actions of one engaged in a commercial enterprise and inured to the benefit of the general consuming public, particularly Plaintiffs, who are members of the consuming public who purchased homes in MOAB MEADOWS FIRST ADDTION. 7.3 By failing to provide for'individual service, after obtaining plat approval conditioned upon the provision of such, and by failing to pay the equalizing amount, Defendant SYKES has engaged in conduct which constitutes unfair and deceptive acts or practices in trade or commerce in violation of RCW 19.86. Defendant SYKE., individually or in concert with other Defendants named herein, directly or indirectly, by causing or allowing the Plaintiffs to pa a debt not owed by the Plaintiffs, thereby deprived Plaintiffs of their rights, privileges and immunities as said are guaranteed and/ r created by the Constitutions and laws of the United States of America and the State of Washington, in violation of 42'USCS §§ 198 , 1985 and 1986.
