PE- 1168 -78, MIDILOME FIRST ADDITION: MIDILOME, INC., and ZE- 13 -78, AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL: That an extension of time be granted to the next Planning Commission hearing of plats. (Motion by Thomas, seconded by Main. Vote was unanimous.) - 4 - FINDINGS PE- 1171 -78 - CHESTER FIELD ADDITION 2E- 15 -78 - AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL AND /OR TWO FAMILY RESIDENTIAL Staff findings regarding PE- 1171 -78, Chester Field Addition. I. GENERAL INFORMATION: A. Location Chesterfield Addition is situated in the south central area of the Spokane Valley west of Bowdish Road and south of 37th. Avenue. B. Proposal The applicant proposes to subdivide about 11 duplexes. The proposal would create a gross acre with a typical lot size of about 11,500 C. Relationship to the Comprehensive Plan Chesterfield Addition is situated within an area that has been designated as being suitable for residential development. Within that Comprehensive Plan neither lot sizes nor higher density residential uses are as of yet indicated. D. Existing Land Uses The site is presently vacant with no significant topographic features. The properties to the north and east have developed over the years into several single family residential subdivisions including Aloha Sacond Addition, Joey Marie Addition, Joey Marie 1st Addition, Joey Marie 2nd Addition and Midilome Addition. The properties to the south and southeast include several scattered commercial uses. E. Compatibility With Existing Land Uses The staff finds the proposal presented by the plat sponsor to be incom- patible with recent Planning Commission decisions in the area =s well as being incompatible with the existing development in the area. Located to the north and northeast once again are several residential subdivisions including Aloha 2nd Addition, Joey Marie Additions 1 through 3 and Midilome Addition all of which are Single Family Residential subdivisions. The staff recommends that lots 1,14 and 15 of Block 1 and lots 5. 6, 7, 8, 9 and 10 of Block 2 be designated as duplex lots and the balance of the Chesterfield Addition be reserved for Single Family Uses. The duplexe lots as indicated by the staff would provide an appropriate buffer from the commercial uses located to the aouth and the balance of the plat being designated as Single Family would be consistent with recent Planning Commission decisions in the area. II. SPECIAL INFORMATION: A. Circulation z acres into 33 lots all for density of about 6 units per square feet per lot. PE- 1171 -78 - Chester Field Addition (Continued) The Engineer's Office has reviewed this proposal and their office finds that the plat design is acceptable to their office and that adequate County roads are available to serve the site. Their office further recommends that all roads within the plat be paved and curbed to the specifications of the County Engineer as a condition of plat approval and that a connection to the Dishman ?Mica Highway located to the west of the plat be obtained prior to the filing of the final plat, if at all possible. B. Sewage Disposal The Health District has approved the use of individual on -site systems to serve this proposal. The plat is however situated over the Spokane Valley Aquifer where a moderate impact upon ground water quality may be expected at some 'future date if continued urbanization occurs in the area. If approval were granted at the plat density proposed by the sponsor a sewage management system would be required as a condition of plat approval. The Health District further recommends the existing well located on lot 5:, Block 2 be abandoned and filled in accordance with present approved procedures prior to the filing of the final plat. C. Water Supply The applicant proposes the use of water from Model Irrigation District. The proposed subdivision is at this time not located within the recorded service area of that purveyor. The staff recommends that if approval here to be granted that prior to the filing of the final plat, annexation to that water purveyor be accomplished. D Drainage The staff finds that because of the relatively flat terrain of the site and that of the adjacent properties that no special drainage control methods would be required and standard techniques for storm water control could be used. E. Fire Protection The proposed subdivision is situated within the recorded service area of Fire Protection District #1. That district indicates that as a condition of plat approval both mains and hydrants of sufficient size for fire protection needs should be required. F. Parks No County parks Ere currently available in the area and the County Parks Department has no present plan for either site acquisition or major park improvements. G. Schools The proposed subdivision is situated within the boundaries of the Central Valley School District. The districts facilities in this area are currently at capacity levels. The district indicates however when there current building program is completed in about 3 years time that their district - 11 A- PE- 1171 -78 - Chester Field Addition (Continued) expects no particular problem in serving this plat proposal. • III. ZONING ANALYSIS The staff finds that it would be appropriate to upgrade lots 1, 14 and 15 of Block 1 and lots 5 through 10 of Block 2 to the Two Family Residential Zone Classification upon the filing of the final plat and at the same time upgrading the balance of Chesterfield Addition to the Single Family Residential Zone Classification. The staff finds that these zone reclassifications would be consistent with recent Planning Commission decisions in-the area and that those lots as indicated by the staff for duplexes would provide an appropriate buffer from the commercial located to the south of the site. IV. ENVIRONME'iTTAL REVIEW The staff has reviewed the environmental checklist submitted by the applicant and we find that no significant adverse environmental impacts would likely result from this proposal and a proposed declaration of nonsignificance should be issued. Slight adverse environmental impacts were however noted under the following questions- Earth, air, water, flora, fauna, noise, light and glare, natural resources, population, housing„ transportation, public services, energy and utilities. V. CONDITIONS: If approval is granted, the Staff recommends the following conditions. Specific conditions applicable to this plat are referenced below and found in the attached supplement entitled, "Standard Conditions for Approval of Preliminary Plats - Sugust, 1977 ". NOTE: Any amendments to said conditions are stated separately and listed below. P -1, P -2, P -3, P -4, P -5, P -6, P - P - P - (March 1, 1979) P - E-1, E-2, E-3, E -4, E -5, E -6, A -1, H - H -5, H -6. That all roads within the plat be curbed and paved to the specifications of the County Engineer. Existing County roads providing direct access to lots of the plat shall be paved and curbed to standards of the County Engineer. Upon the filing of the final plat upgrade lots 1, 14, and 15 of Block 1, and lots 5 through 10 of Block 2 to the Two Family Residential Zone Classification. Upgrade the balance of Chesterfield Addition to the Single Family Residential Zone Classification upon the filing of the final plat. FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE RECLASSIFICATION PE- 1171 -78 CHESTER FIELD ADDITION ZE -16 -78 AGRICULTURAL TO SINGLE FAMILY RESIDEN- TIAL AND /OR TWO FAMILY RESIDENTIAL. WHEREAS, the Spokane County Planning Commission did, after public hearing on February 24, 1978 forward a recommendation to the Board of County Commissioners that the preliminary plat to be known as Chester Field Addition (File #PE- 1171 -78) and zone reclassification to both the Single Family Residential and Two Family Residential zone classification (File #ZE- 16 -78) be approved, and WHEREAS, Robert Bonuccelli did request a special hearing before the Board of County Commissioners to present evidence and testimony concerning the recommen- dation of the Planning Commission approving the above described preliminary plat and zone reclassification, and WHEREAS, the Board of County Commissioners did hold a public hearing on March 23, 1978 to consider the action of the Planning Commission and the testimony and requests of the applicant, objectors, and other interested parties, and WHEREAS, at said hearing opportunity was afforded those favoring and those opposing the above described preliminary plat proposal and zone reclassification, the Board of County Commissioners of Spokane County having fully considered the testimony given, the records and minutes of the Planning Commission, the environ- mental assessment, and all other evidence presented, and having personally acquain- ted themselves with the site and vicinity in question does hereby find that duplexes would be appropriate for that area lying approximately 250 feet north of the proposed 40th Avenue in that that area would provide an-appropriate buffer from the future commercial uses proposed to be located to the south of the site; that the plat should be redesigned so as to provide for adequate circulation in the area and should include a stub road connection to both Pierce and Skipworth roads; that a connection to the Dishman -Mica highway should be required, and that improvements to that connection should be limited to the property under control by the plat sponsor at this time if a satisfactory arrangement cannot be worked out between the County Engineer and the adjacent property owners. Le rued, Chairman Board of County Commissioners Spokane County Court House Spokane, Washington 99201 Deer Sir: April 7, 1978 RECEIVED APR 121978 COUNTY COMMISSIONERS This afternoon my brother and 1 met with Bonucelli, promoter of the Chester Field Ad ition, and Swale of the County nn,ineer's Office, relative to the proposed intersection of 40th Avenue and the ':.ice— Dishman Road. This meetin_ was at Bonucelli's telephoned request to me early this week. The meeting place was also designated by him. . Soon after entering the County Engineer's Office conference room we were'told that the Chester Field plat•had been approved, presumbly by the County Commissioners, and that this included, as I recall, 12 or more lot's for duplexes. We were also told that the 4Oth and Mica — Tishman intersection hed been approved as shown on Bonucelli's Chester Field plot, or that if this was impossible, it was approved that 40th Avenue be run directly into the Mica— L`ishman Road without any rounding of corners. My first reaction was: If this is so, why is Bonucelli here? My second was: What has happened to the design criteria, of which the Engineer's Office has spoken so often, that 4Oth had to come into • the Mica— Dishman Road at 90 de;. + 15: deg. Later my brother said he had the same thoughts. In fact, my brother asked Swale :.'bout the 90 deg. specification. He said that he would like that I should donate sufficient ground so that the curve as shown on the Bonucelli plat could be built. My brother showed them two of his alternate designs, and then asked Swale if the Engineer's Office had made any designs. He said "no ". We pointed out that there could be alternate designs which would better equalize the ground•taken from the properties north end south of 40th. 7.e then asked what would happen if I did not donate the property. He said that he would have to report, presum— ably to the Commissioners, that I was uncooperative. M y brother then asked him if. his definition of cooperation was that this job had to be done exactly as he and Bonucelli wanted it done. Swale also said that if I did not do as they wanted, thet if I ever wanted e building permit, that I would then be required to donate whatever the Engineer's Office wanted. He said that this kind of blackmail had been repeatedly sanctioned by the courts. We asked that he back up his assertions with references to court decisions, State law, or anything else to support his position. We got nowhere. . About this time we h•:d had enough of apparent collusion and attelpted Coercion, so we told Scale that the room hed an odor, anc that we had hhd it. We left. We believe that this was not an impartial discussion today. In fact, we believe that the result was pre — decided and that I was called in merely to be bludgeoned into accepting the terms. . The kind of smu_,; arrogance that Smale exhibited today had to come from somewhere. Did he have prior approval of the Co- smissionersy or is he basing his actions on Engineer's Office policy? As we informed Smale, we would like written reference to the authority that the Engineer's Office uses us a substitute for eminent domain. Yours truly, Ben Peters and ... G. Peters P.S. I would like to remind the Commissioners that sometime in the past a • 50 -toot strip has been taken from this property zinc dedicated for road purposes (40th Avenue). This strip is immediately south of the east —west centerline of Section 55. Now, it is proposed that a. 20 — foot strip be dedicated for road purposes north of this east —west line by Bonucelli and others. - However, it appears from Bonucelli's plat that the property owner directly opposite my property, at the intersection, will have very little, • if any, ground loss. But, I am expected to donate considerable ; ,round in addition to what has already been taken.
