Proposal The applicant proposes subdivide about 19 acres into l4 lots. Of those 447 lots, 8 are planned for Multi - family wellings, and 2 are planned for duplexes. The applicant proposes to place a four -plex structure on each of the lots proposed for Multi - family uses. The plat proposal presented by the sponsor, would create a subdivision with a density of about 4, units_ner acre, with a typical lot size of about 10,0�_4>>are feet per lot. C. Relationship to the Comprehensive Plan D. Existing Land Uses Mica Park is situated within an area that has been designated as being suitable for residential development by the approved map of the Compre- hensive Plan. Within that Comprehensive Plan, however, no residential density . determinations have yet been made. The site is heavily tree covered with some minor drainage problems being evidenthe properties that abut this proposal to the west and nort ._ ve devel , ears into several . lats all for cpobile home uses. To the south of the grnnosal and the southwest of the proposal, properties are primarily undeveloped. To the east of this proposal is the Dishman Mica Highway, as well as, the Union Pacific R_1r�nad Further to the east, is the Sherwood Forest Subdivision, a recently approved subdivision. E. Compatibility with Existing Land Uses The staff finds this proposal to be compatible with existing uses now lo fod within the immediate area. In that, generally speaking, ..the ' use and character of the pro osed plat is very similar to those uses now evident in the area. A. Circulation 6 B. Sewage Disposal FINDINGS - March 30, 1978 PE- 1172 -78 - Mica Park Addition (Continued) The Engineer's Office has reviewed this proposal, and their office finds that ode. - - • • -ds are .•• . - • erve the site, and that the plat design is acceptable to their office. Their office does, however, recommend that as a condition of plat approval, all roads within the plat should be paved and curbed to the specifications of the County Engineer. They also recommend that the plat be designed so as to eliminate any direct lot access to lots from 16th avenue extended. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. In summary, he concluded that: (a) In normal precipitation years subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. (b) All dissolved salts in sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate por- tion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phos- phates, which are known to react with soil particles, or nitrates, which are taken up by plant roots" will be less than the total found in septic tank effluents. (c) "The calculated results at the downstream end of groundwater flow line indicate that the maximum range of. (dissolved) solids concentration expected at present (1975) is up to 93 mg /1 (milligrams per liter) above the natural groundwater back- ground of 155 mg /l. The forecast year 2020 maximum incremental concentration is 101 mg /1 above the natural background. " -- - "The analytical results of the forecast impact of year 2020 when com- pared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, indicate that the present impact on groundwater quality is already a substantial proportion of the ultimate level." 2. Currently, results of chemical analysis show the total nitrogen content of the groundwater as in the range of 1.49 to 1.67 ppm. A projected incre- mental increase using Dr. Todd's expected 8.6 percent would result in ranges of 1.61 ppm. to 1.81 ppm. Current Federal and State drinking water standards permit up to 10 ppm. Alternative sewage disposal methods that would not recharge the ground- water have the following general characteristics: (a) Collector and central treatment systems discharging to surface waters would require at least tertiary treatment and perhaps more to obbiin a permit for the discharge from the Department of Ecology. These systems are not currently economically available for this project. (b) Sealed systems, whether individual or community, depend on evaporation for liquid. removal. Some, such as lagoons, have safety hazards associated with than and relatively poor commun- ity acceptance. The Health District further notes that a portion of the proposed plat is situated within an area that has been designated as a "flood hazard area - zon Because of this designation the Health District recommends that as a condition of plat approval entry Teval elevations should be established to determine the extent of the flood hazard area. Water Supply The proposed subdivision is situated within the recorded service area of the Washington Water Power Company. Drainage The staff finds that a portion of the proposed plat has been identified as being in a flood hazard area. Because of this designation, special drainage control methods will be required by the plat sponsor so as to eliminate any possible flood hazard problems. E. Fire Protection The proposed subdivision is within the recorded service area of Fire Protection District #1. Schools G. Parks III. ZONING ANALYSIS The staff finds that a zone reclassification to the Multiple. Family Suburban Zone Classification for those lots proposed by the plat sponsor, would be appropriate, given the use and character of the immediate area surrounding those lots. Secondly, the staff finds that for those lots proposed for duplexes by the plat sponsor, that two - family residential zoning would be appropriate. The staff also finds that the balance of Mica Park Addition should receive a zone reclassification to the Single Family Residential Zone Classification upon the filing of the fi p a IV. ENVIRONMENTAL REVIEW The proposed subdivision is situated within the boundaries of the Central .Valley School District. The districts facilities in this area are beginning to reach capacity levels. The district believes that this problem may be mitigated somewhat when their current building program is completed sometime within the next two years. No improved County Parks are situated within the immediate area of the plat proposal and the Parks. Department has no present plans for either site acquisition or major park improvements of undeveloped sites at this time. The staff has reviewed the environmental checklist submitted by the plat ' sponsor and we find that no significant adverse environmental impacts would likely result from this proposal, and a proposed declaration of non - significance should be issued. Slight adverse environmental impacts were however noted under the following questions: earth, air, water, flora, fauna, noise, light and glare, land use, population, housing, natural resources, transportation, public services, energy, and utilities. You will see that we are requesting to extend the driveway approach out approximately 30' from the garage which appears to necessitate a minor amount of filling to achieve the proper grade out into the garage. In contrast Gary, it also appears that there will be perhaps a small amount of earth removal at the upper end of the driveway ramp where it approaches the garage. The net result of this activity would not appear to significantly alter the future potential flood waters flow calculations. T RST /GN /set cc: Stu Deysenroth n OFFICE OF COUNTY ENGINEER SPOKANE COUNTY, WASHINGTON Alanning Department I County Engineer August 21, 1980 SUBJECT: Replat of Lots 1 - 6, Block 1, PE 1172 Mica Park Addition I have been advised by my staff that you are presently considering a replat of Lots 1 - 6, Block 1, of PE 1172 Mica Park Addition. We have reviewed your letter of August 5, 1980 to Mr. Grant Pearson concerning the proposed changes to the plat. The Spokane County Subdivision Ordinance General Provision Section A (10) refers to RCW 58.17.210 for exemptions. RCW 58.17 establishes procedures for replatting previously platted property. RCW 58.17.210 allows the County to issue a building permit on a lot created in violation of RCW 58.17 provided the general public health, safety and welfare are not adversely affected. This process does not re- quire the signature of the County Engineer. RCW 58.17 establishes a sequential process for a plat or replat. The statute re- quires County Departmental Review as a part of this process. It also calls for the signature of the County Engineer on the final plat. Based on our understanding of the proposal, I recommend that the procedures estab- lished by RCW 58.17 be followed. This would allow for complete review by affected agencies and a public hearing should also be held as provided for in RCW 58.17. This would allow the residents and property owners of the plat who purchased prop- erty in "good faith" to be heard and would afford them the due process to which they are entitled. The proposal also lies within a class "A" flood hazard zone. We have been informed by Stu Deysenroth that since the filing of the final plat, additional data con- cerning the flood hazard zone has become available. Any proposed construction or topographic alterations within the flood hazard zone are subject to review by this agency under the provisions of the National Flood Insurance Program. Any proposal affecting the flood plain should, in all fairness to the property owners in the area, be presented at public hearing for their scrutiny. Pursuant to our discussion on August 11, 1980, regarding the proposed replat and the possible need for sidewalks, we have now assumed that the Spokane County Engineers Department is not interested in requiring any further improvements within this replat. We have made this assumption based on the fact that we were to hear from you by August 12, 1980 if sidewalks, or other improvements should be required. As you may recall, it would seem inappropriate to install sidewalks along Bluff Drive for several reasons: 1. The new County road improvement standards were adopted by resolution on February 16, 1978, where as the final plat of MICA PARK ADDITION was approved by the Board of County Commissioners on June 22, 1978, and recorded on October 23, 1978. If the County would have felt the need for sidewalks, or other improvements, _th would have required them at the time the preliminary plat was being processed. 2. Bluff Drive is a local access street and sidewalks would not be used by the residents, primarily due to their unrelated location to the building sites, because of distance (112 feet), and by being separated by the flood plain. 3. The proposed replat is partially within a Federal Flood Plain (see final plat of MICA PARK ADDITION). The flood channel, as shown on the final plat, was designed by calculating the volume of runoff it would have to hold for a 100 year flood, determining the width of the channel necessary to accomodate the runoff volume (using actual cross sections of the channel to make the calculations) NORTH 2206 PINES RD. • SPOKANE, WA 99206 • (509) 92B -5750 Page 2 August 13, 1980 Bob McCann and establishing the 100 year flood elevation for the 6 lots. If this flood channel, which extends from the building pads easterly to the existing west curb of Bluff Drive, were to be encroached upon by the future construction of sidewalks the flood channel would no longer accomodate the calculated amount of runoff as required by Spokane County and HUD. Thus, all 6 building sites would be eliminated, due to a lack of building space, violation of the established flood channel design, and possible revocation of approved drainage plans. Because of the above, it would be impractical, as well as unreasonable to require sidewalks in the replat. Should the County Engineers Department disagree with our assumption, please notify me by August 15,.1980:'. Since the building sites will remain on the already determined building pads (see final plan), and will not change, increase, or alter the amount or placement of storm water runoff, we are also anticipating that no change in the drainage plans will be necessary. The final replat format was approved by Jerry Simms, on August 7, 1980. Hopefully, I have adequately apprised you of how we are proceeding with this replat, and under what assumptions. We have reviewed your letter of August 5, 1980 to Mr. Grant Pearson concerning the proposed changes to the plat. — The Spokane County Subdivision Ordinance General Provision Section A (10) refers to RCW 58.17.210 for exemptions. RCW 58.17 establishes procedures for replatting previously platted property. RCW 58.17.210 allows the County to issue a building permit on a lot created in violation of RCW 58.17 provided the general public health, safety and welfare are not adversely affected. This process does not re- quire the signature of the County Engineer. RCW 58.17 establishes a sequential process for a plat or replat. The statute re- quires County Departmental Review as a part of this process. It also calls for the signature of the County Engineer on the final plat. Based on our understanding of the proposal, I recommend that the procedures estab- lished by RCW 58.17 be followed. This would allow for complete review by affected agencies and a public hearing should also be held as provided for in RCW 58.17. This would allow the residents and property owners of the plat who purchased prop- erty in "good faith" to be heard and would afford them the due process to which they are entitled. The proposal also lies within a class "A" flood hazard zone. We have been informed by Stu Deysenroth that since the filing of the final plat, additional data con- cerning the flood hazard zone has become available. Any proposed construction or topographic alterations within the flood hazard zone are subject to review by this agency under the provisions of the National Flood Insurance Program. Any proposal affecting the flood plain should, in all fairness to the property owners in the area, be presented at public hearing for their scrutiny. The drainage approval is therefore rescinded for the south and southwest portions of the plat incompassing Lots 1 through 6, Block 1 and Lots 1 through 7, Block 2 including the adjacent streets and we request that a solution be proposed by means of a revised drainage plan submission. According to the drainage plan submitted by you, the natural flow previously flowed from the ditch at the railroad R/W west along the old road (extension of 16th Rd) to the low area indicated as "flood plain" on the plat map. Our investigations have revealed that the flow has crossed 16th at two locations: 1. At the west side of the railroad tracks via a culvert, then northeast across the edge of the present plat. 2. West of the railroad R/W at the low spot just east of the rock outcropping from there it flowed northeast to a low spot comprising present Lots 2, 3, 4,Block 2. -From both of these locations, water then flowed through Lots 3, 4, 5 & 6 of Block 1. Since the development is damming these flowlines at two points where they crossed the present 16th Ave. and Greenbluff Drive, much of the percolation area is being removed and water is being diverted to the west to the dip in the access road at the Hatch and Presta properties. The result will be an illegal diversion and ponding of flow on the upstream properties. Grant Person Dec. 6, 1978 Page 2 To relieve any chance of damage in the immediate future, we request that an 18" culvert be placed across 16th Ave at the railroad right of way to reopen that El.'wline and that 2 -18" culverts be placed at the dip in the Hatch - Presta access road and the road be returned to an acceptable grade with 3" of rushed road surfacing. This is considered an interim solution until a flew design on this portion of the drainage plan can be approved and cons ructed. We trust that you will implement this interim solution immeditaely as the existing situatioi, is not acceptable to any of the parties concerned. We would hope that you would cooperate in halting lot sales or building permit applications for lots located on the south and southwest portions of the plat until you have a revised drainage plan approved by this department. A revised drainage plan is to be submitted within 30 days for the area in question.
