PRELIMINARY SUBDIVISION AND ZONE RECLASSFICATIONS
PE- 1173 -78 - Ponderosa Acres 7th Addition: Phillips
ZE- 18 -78 - Agricultural to Agricultural Suburban
Staff findings regarding PE- 1173 -78, Ponderosa Acres 7th Addition.
I. GENERAL INFORMATION:
A. Location
Ponderosa Acres 7th Addition is situated in the south central area of the
Spokane Valley north of 44th Avenue and west of Woodruff Road in an area
commonly referred to as the Ponderosa.
B. Proposal
The applicant proposes to subdivide about 27 acres into 25 lots all for
Single Family Dwellings with animal keeping The proposal would create
a gross density of about 1 unit per acre typical lot size being 1 acre per
lot.
C. Relationship to Comprehensive Plan
Ponderosa Acres 7th Addition is situated within an area that has been
designated as being suitable for residential development by the approved map
of the Comprehensive Plan. Within that Comprehensive Plan however, no
residential density determinations have been made.
D. Existing Land Uses
The site is currently in active cropland vegetation with some minor
drainage problems. The properties that generally suround this
proposal to the east, southeast, and south have developed over the years
into several residential subdivisions where the typical lot size appears
to be 1 acre per lot. The properties that generally abut the proposal to the
west and to the north have not as of yet developed and are under the
ownership of the plat sponsor. The plat sponsor indicates in his plat
application that he has no intention, at this time. of developing those
properties.
E. Compatibility with Existing Land Uses
The staff finds this proposal to be compatible with the existing uses
now located to the east,southeast and south of this proposal in that
the use and character of the proposed plat is very similar to those uses
now evident in the area.
II. SPECIAL INFORMATION:
A. Circulation
The Engineer's Office has reviewed this proposal and they find that adequate
County roads are available to serve the site and that the plat design is

acceptable to their office. Their office does,however,recommend that as
a condition of plat approval all roads within the plat be paved to the
specifications of the County Engineer.
B. Sewage Disposal
The Health District has approved the use of individual on -site systems
for this proposal. The plat appears to be situated over the Spokane Valley
Aquifer where moderate impact upon the ground water quality may be expected
at some future date, if continued urbanization at this density occurs in
the area.
C. Water Supply
The proposed subdivision is situated within the recorded service area of
the Washington Water Power Company. That company indicates that it does
have the ability to serve the site with both domestic and fire flows.
D. Drainage
The staff finds that because of the relatively severe topography located
towards the north and west of the site and drainage way between the
proposed 42nd Ave. and Driftwood Dr. that special drainage control methods
may be required for storm water control within this proposal.
E. Fire Protection
G. Parks
Both mains and hydrants of sufficient size for fire protection needs
should be required as a condition of approval.
F. Schools
The proposed subdivision is situated within the boundaries of the Central
Valley School District. The districts facilities in this area are
beginning to reach capacity levels. The district believes that this problem
may be mitigated somewhat when their current building program is completed
sometime within the next 2 years.
No improved County Parks are situated within the immediate area of the
plat proposal and the Parks Dept. has no present plans for either site
acquisition or major park improvements of undeveloped sites at this time.
III. ZONING ANALYSIS:
The staff finds that a zone reclassification to the Agricultural Suburban
Zone Classification would be appropriate given the use and the character
of the area and that the existing zoning of the property surrounding this
proposal is either the Agricultural Suburban Zone Classification or the
Agricultural Zone Classification with typical lot sizes in access of 1 acre.
The plat propo once again is for the subdivision of about 27 acres and
25 lots all for Single Family Dwellings with animal koeping with typical
lot sizesof 1 acre per lot.

IV. ENVIRONMENTAL REVIEW:
The staff has reviewed the Environmental Checklist submitted by the applicant
and we find that no significant adverse Environmental impacts would likely
result and a proposed declaration of nonsignificance should be issued. Slight
adverse Environmental impacts were however noted under the following questions:
Earth, air, water, flora, noise, light and glare, land use, natural resources,
population, housing, transportation, public services, energy and utilities.
V. CONDITIONS
If approval is granted, the staff recommends the following conditions.
Specific conditions applicable to this plat are referenced below and found in the
attached supplement entitled, "Standard Conditions for approval of Preliminary Plats
August, 1977. NOTE: Any amendments to said conditions are stated separately and
listed below.
P -1, P -2, P-3, P -4, P -5, P -6, P -7, P -8, P -9 (March 1, 1 979) P -1 3, E -1, E-2, E -3, E-4,
E -5, E - A - H - H -5.
That the provisions of SEPA's NOTICE OF ACTION pursuant to 43.21c.080 RCW and the
Board of County Commissioners' Resolution No. 77 - be accomplished by the project
applicant within thirty (30) days of formal action by the Board of County Commissioners,
as instructed by the Planning Department Staff.
That all roads within the plat be paved within the specification of the County
Engineer. Existing County roads providing direct access to lots of the plat shall
be paved to standards of the County Engineer.
Upgrade all of Ponderosa Acres 7th Addition to the Agricultural Suburban Zone
Classification upon the filing of the final plat.
That prior to the filing of the final plat the drainage plan shall be approved by both
the County Engineer and the Health District.

approved and in so approving, adopts the Staff's Findings, dated February 24, 1978,
as the Planning Commission's findings of fact as well as the conditions stated in the
Staff's findings, except that the following condition ahal1 be incorporated: that
the stub road connection to the east be eliminated. (Motion by Thomas, seconded by
Byrne. Vote was 4 yes and 1 no.)

17. PE- 1174 -78, WYATT ADDITION NO. 1: WYATT, and ZE- 19 -78, AGRICULTURAL TO SINGLE FAMILY
RESIDENTIAL AND /0R TWO FAMILY RESIDENTIAL: That the preliminary be approved, and in
so approving, adopts the Staff's findings as the Planning Commission's findings of facts,
as well as, the conditions stated in the Staff's findings dated Feb. 24, 1978 except that
the plat conditions dealing with a zone reclassification be modified to read as
follows: That upon the filing of the final plat, upgrade lots 1 - 5 Block 2, to the
Two Family Residential Zone Classification, and the balance of the plat known as
Wyatt Addition No. 1, to the Single Family Zone Reclassification. (Motion by Main,
seconded by Rawlings. Vote was unanimous.)
18. PE- 1175 -78, WAGGONER ADDITION: WAGGONER, and ZE- 20 -78, AGRICULTURAL TO SINGLE
FAMILY RESIDENTIAL AND TWO FAMILY RESIDENTIAL: That the preliminary plat known
as Waggoner Addition be approved, and in so approving, adopts the Staff's Findings
as the Planning Commission's findings of facts, as well as, the conditions stated
in the Staff's Findings dated February 24, 1978. (Motion by Thomas, seconded by
Byrne. Vote was unanimous.)
19. PE- 1176 -78, VAN HESS ADDITION: VAN REFS, and ZE- 21 -78, AGRICULTURAL TO SINGLE
FAMILY RESIDENTIAL: That the preliminary plat be approved, and in so approving,
adopts the Staff's findings as the Planning Commissions findings of facts as well
as, the conditions stated in the Staff's Findings dated February 24, 1978, except
that the following condition of approval shad also be imposed* That individual lot
access shall be prohibited to 12th Street. (Motion by Byrne, seconded by Main.
Vote was unanimous )
20. PE- 1177 -78, FAIRACRES REPLAT #3: WINNER, and ZE- 22 -78, AGRICULTURAL TO SINGLE
FAMILY RESIDENTIAL: That the preliminary plat be approved, and in so approving,
adopts the Staff's findings as the Planning Commission's findings of facts as well
as, the conditions stated in the Staff's Findings dated February 24, 1978, except
that the condition of the zone reclassification to the Single Family Residential
Zone be deleted and the following condition is hereby imposed: That a statement
be placed in the plat dedication that animal keeping by the sponsor be allowed
until the last building permit is issued in the plat. (Motion by Rawlings, seconded
by Thomas. Vote was unanimous.)

Way to the public and approval of the road system in the plat by the County Engineer;
that plans, profiles, and cross sections showing proposed street centerline and curb
grades be submitted to the County Engineer for approval prior to construction and
the filing of a final plat;

age facilities be submitted to the County Engineer for approval prior to construction
and the filing of a final plat;
construction within the proposed public streets and easements shall be performed
under tha direct supervision of a licensed land surveyor, who shall be responsible
for perpetuating all evidence of the location of survey monuments which may be
disturbed during construction and who shall furnish the County Engineer with "As
.Built" plans and a certificate in writing that all improvements were installed to
the lines and grades shown on the approved construction plans and that all disturbed

The Grantor(s) Henry Lloyd Phillips, as Executor of the estate of Elizabeth

of Washington, for and in consideration of Mutual Benefits, the receipt of which is
hereby acknowledged, grants to Spokane County, a political subdivision of the State
of Washington, an Easement over, under, upon and across the hereinafter described
lands situated in the County of Spokane, State of Washington:

EWA described as follows:
Begin at the Sr! corner of Lot 5 Block 2 PONDEROSA FIFTH ADDITION,
as recorded in Volume 16 of Plats, page 21; thence N 27 °24'23 "4,
along the Westerly line of said Lot 5, a distance of 70.97 feet;
thence S G0 °47 "W a distance of 130.00 feet to the True Point
of Beginning; thence continuing S 60 °47'04 "W a distance of 59.14
feet to a point radial to a curve concave to the Southwest with a
radius of 623.46 feet and a radial bearing of N 60 °47'04 "E;
thence Southeasterly, through a central angle of 2 °50'56 ", an arc
distance of 32.45 feet to the beginning of a compound curve
concave to the West with a radius of 15.00 feat and a radial

DRAINAGE EASEMENTS, as shown hereinabove are for the purpose of installing,
operating and maintaining drainage swales and drainage facilities to dispose of
runoff, are hereby granted. The County of Spokane is hereby granted the right of
ingress and egress to all drainage easements adjacent to the public right of way.
The property owner shall maintain the drainage swale with a permanent live cover of
dryland type grasses acceptable to the Spokane County Engineers, with optional
shrubbery and /or trees, which do not obstruct the flow and percolation of storm
drainage water in the drainage swale as indicated by the approved plans.
The Grantor(s) hereby releases Spokane County, and all its officers, employees, and
agents from any responsibility or liability for any damage whatsoever including
inverse condemnation by or to any and all persons or property arising out of or in
any way incident to or attributable to the storm drainage within said Easement
The Easement described hereinabove is to and shall run with the land. No
modification of the boundaries of said Easement can be made without the prior
approval of Spokane County.

not inconsistent with the full use and enjoyment of the Grantee.
The Grantor hereby releases Spokane County, and all its officers,
employees and agents from any responsibility or liability for any
damage whatsoever to the hereinabove described lands and adjacent
lands as a result of the installation, operation, maintenance, repair,
and all other uses or purposes which are or may be related to the storm
drainage facility and easement.

No more than one dwelling structure shall be placed on any one lot, nor shall any lot be
further subdivided for the purpose of creating additional lots or building sites without
filing a replat.
A public water system as approved by County and State Health Authorities, the local
fire district, and the water supplier (purveyor) will be installed within this plat,
and the subdivider will provide for individual service to each lot prior to sale of
each lot.
The plattor does hereby dedicate forever the streets shown hereon for public road purposes.
Lots 6, 7, 8 and 9, Block - - - 3, as shown hereon, are hereby dedicated to Spokane County to be deeded for road purposes
forever at such time as adjacent property is platted.
30 foot wide easements are hereby provided on the lots as shown and shall be used for utility purposes.
The owners of Lots 1, 2, 3, 4, 5, 6, 9 AND 10, BLOCK 2 AND LOTS I, 2 AND 3, BLOCK 3
shall be held responsible for obstructing, artificially collecting or discharging, the natural drainage flow across or
adjacent to their property, and shall assume full responsibility for damage to their or any other property as a result
of their obstructing, artificially collecting or discharging, the drainage flow. The subdivider shall inform each
purchaser of the responsibility imposed on each property owner for obstructing, artificially collecting or discharging,
the drainage flow. By permitting the 12 foot wide drainage easement to be platted as shown hereon, Spokane County
does not accept the responsibility of maintaining the drainage course nor the responsibility for any damage whatsoever
including but not limited to inverse condemnation to any properties due to the drainage flow.
