GENERAL INFORMATION A. History _ The preliminary plat was originally approved in February, 1978. The sponsor is now requesting an Extension of Time to April 1, 1980. The sponsor indicates that he is requesting a Time Extension because he needs to complete final arrangements with Irvin Water District for water service and connection. B. Location The proposal is located in the Central portion of the Spokane Valley on the northwest corner of Bowdish Road and Buckeye Avenue. C. Proposal ▪ 2.14 acres subdivided into 7 lots for single family use. ▪ Lot frontage = 80 feet • Lot size = 11,600 sq. ft. II. SPECIAL INFORMATION A. Vote was unanimous.) - 4 - FINDINGS PE- 1177 -78 - Fairacres Replat #3: Winner ZE- 22 -78 - Agricultural to Single Family Residential Staff findings regarding PE- 1177 -78, Fairacres Replat #3. I. GENERAL INFORMATION: A. Location Fairacres Replat #3 is located in the-north central area of Spokane Valley, west of Bowdish road and north of Buckeye Avenue, B. Proposal The applicant proposes to subdivide 2 3/2 acres into 8 lots all for Single Family Dwellings. Creating a density of about 3 units per acre with a typical lot size of 11,600 square feet per lot. C. Relationship to the Comprehensive Plan Fairacres Replat #3 is situated within an area that has been designated as being suitable for residential development by the approved map of the Comprehensive Plan. Within that Comprehensive Plan however, no density designation have yet been determined. D. Existing Land Uses II. SPECIAL INFORMATION: The site is presently vacant with no significant topographic features. The properties that generally suround this proposal have developed over the years into several residential subdivisions including: Fairacres Replat #1 and #2, Sunnyvalley Acres, Mirabeau Ranch Addition and Fairacres Mobile Homes Subdivision. E. Compatibility With Existing Land Uses The Staff finds this proposal to be compatible with recent Planning Commission decisions in the area as well as being compatible with the future intended uses for the area - higher density residential uses... Some conflicts might result however, in short term regarding the possible conflicts between larger lot uses in the area and the smaller lot subdivisions. A. Circulation The Engineer's Office has reviated this proposal and their office finds that both the plat design is acceptable to their office and that adequate County Roads are now available to serve the preliminary plat. Their office recommends however that as a condition of plat approval both paving and curbing of the roads in the proposal be required. - 1 7 - 1- PE- 1177 -78 - Fairacres Replat #3: Winner (Continued) B. Sewage Disposal The Health District has approved the use of individual on -site systems to serve this proposal The plat is however situated over the Spokane Valley Aquifer where moderate impact upon ground water quality may be expected at some future date if continued urbanization at this density continues to occur. C. Water Supply The proposed Subdivision is situated within the recorded service area of Irvin Water District. That water district indicates that it does have the ability to serve the site with both domestic and fire flows. D. Drainage The Staff finds that because of the relatively flat terrain of the site and that of the adjacent properties that no special drainage control methods would be required and standard techniques for storm water control could be employed. E. Fire Protection F. Parks The proposed subdivision is situated within the recorded service area of Fire Protection District #1 That district indicates that both mains and hydrants of sufficient size for fire protection needs should be required as a condition for plat approval. No County parks are currently available in the area and the County Parks Department has no present plan for either site acquisition or major park improvements. G. Schools The proposed subdivision is situated within the boundaries of the East Valley School District. That districts facilities are currently at capacity.levels. They, however, expect this problem to be mitigated somewhat when their current building program is completed in 2 or 3 years time. ZONING ANALYSIS The staff finds that it would appropriate to upgrade this proposal to The Single Family Residential Zone because of the use and the character of the proposal as well as the use and character of surounding area. The staff also finds that an upgrade to the Single Family Zone would be consistent with recent Planning Commission decisions. IV. ENVIRONMENTAL REVIEW The staff has reviewed the environmental checklist submitted by the applicant and we find that no significant adverse environmental impacts would likely resolve - 17 A - 0 4 PE- 1177 -78 - Fairacres Replat #3 and a proposed deblaration of nonsigni£icance should be issued. Slight adverse environmental impacts were however noted under the following questions: earth, air, water, noise, light and glare, land use, natural resources, population,. housing, transportation, public services, energy and utilities. V. CONDITIONS - 17 B - (Continued) If approval is granted, the Staff recommends the following conditions. Specific conditions applicable to this plat are referenced below and found in the attached supplement entitled, "Standard Conditions for Approval of Preliminary Plats - August, 1977 ". You will recall that I protested the charges assessed me for the above im- provements. I still hold that - it is unreasonable and unfair to assess any part of the property facing Bowdish Road to enhance the value of Mr. Goldberg's property to the north. Mr. Goldberg does not own an inch of land along the area from Grace to Buckeye. Over several years Mr. Goldberg has not, to my knowledge, paid a dime toward the upkeep (oiling) of this road. Winner, passed away last summer. My duties as administrator of his estate include to conclude any of his affairs which were left unsettled. This subdivision established Buckeye Avenue (dedicating the north 20 feet) from Bowdish to Woodward. The westerly portion of the plat - Lot 1 and part of Lot 2 - was served by an extension of Buckeye improved by private contract. As most of the staff there can attest, there was considerable dis- cussion with respect to the fence to protect the adjoining property of Mr. Quinn, the barricade, the plans and profile of the cul -de -sac, the mislocated WWP pole and, ultimately whether the improvement and obstruction bond could be released. Can you tell me whether all matters relating to this plat have been completed to your satisfaction? I am unaware of any claims by material suppliers, complaints from abutting landowners or correspondence from the County, at least to mid - January when I stopped the mail to Mr. Winner's residence. McVicker, E. 90D9 Trent, Spokane, WA.,, -� 99206. Mr. McVicker was recommended to me by another attorney, who was. not availab:l'e to me in'the time frame desired. I have been embroiled with the County Engil`neeri g Depart nt (to be known as the Bureau for easier identification). Frequent changes in specifi'ations, as well as undue delay in same, has been quite costly to me, both \financially .nd emotionally. An emergency forced the sale and replat of a portion of my property. The Board granted the change, excepting the weterly lot, later insisting that a cul-de-sac beinstalled. A neighbor to the south granted me right -of- access to the lot, asking only that I provide a barrier to keep vehicles out of his hayfield. 1 had planned to- e,good used railroad ties tied together by at least 4x8 timbers. The Bureau informed that they had secured an easement, informing me that I would have to connect a head .flo and give them a check for $350.00 for a fence. It was my firm impression that 'his fe e, built for the Bureau and donated to the neighbor, was to be the barrier. cOwas no the case. The Bureau forced me to take out a bond for paving and curbing In mor an a year, this bond was not used, and the work was not performed. I did not renew the bond, feeling that it, as well as fence, (now dilap dated) was a rip -off. I had money on deposit for the work. The by now, had 'p sented my engineer with specifications for the cul -de -sac, an added expense. I feel he Bureau should have included these specifications two years earlier in the origina Mr. McVicker called me on the phone and indicated that I should inform.oth utility company that a pole had to be moved, which I did. It was set in the cuL -d se ac right of way. Mr. McVicker's office was aware of all of these things His ad says no charge for initial consultation (except in my case). I wonder if he was °not aware that he was being con- sidered for an appointment with the County at the time. If a surgeon hands the scalpel to an intern, the surgeon is still the responsible party. Are the canons of the legal pro- fession less strict (remembering my anguish when I bought the property)? Does caveat emptor apply to the hiring of legal assistance? You will note the check (No. 209, for 3350.00, dated January 5, 1979, and cashed June 15, 1979), was for a fence and barrier built by the County as, they assert, a condition to granting clearance on a plat of land for a building permit. This same Bureau now does not accept its own work as being acceptable, and has imposed upon me, for a barricade, an additional sum. (Indicated on the enclosed). My Dear Candidate: It is my firm belief that this is either a fraud, a rip -off, or Bureau- cracy in its purest form. Which poses the question; Is the Bureau spawned and nurtured by the Board of Commissioners, or are the Commis- sioners merely tools of the Bureau? (The Bureau, by the way, took nearly two years to grant the permit, changing specifications, etc., it seems to me, about every time the moon changed, and finally running out of ideas for same.) It would be my belief that we should change Commissioners, in the hope that a new Board would take firmer control over the Bureau, if such ?is possible. What promise could you make in this direction? The compelling proposal to plat was to try to reinforce my income in order to live without going on welfare. Approval of the plat plan has been drawn out so long that I have had to borrow from life insurance policies. I cannot borrow any further. If this plat cannot be approved at this hearing, cir- cumstances compel me to ask that the application be cancelled and the land be returned to its original status -- agricultural. This will permit me to sell the entire property and move to G.regon, where my daughter had the misfortune to lose her home by fire. I would also ask that the !350.00 check written Jan. 5 • to pay the County building some fence be returned, and would ask that the ri30:00 demanded for the extension of time to this hearing be returned. !Wt..
