Present plan calls for tract -type houses- -small lots, $50,000 range. This is not in keeping with the present character of the area, We are in favor of fewer homes with a higher price range and larger lots, allowing for gardens and privacy as the present area has. We wish a maximum of four homes on the 2.73 acres, 2, Present plan calls for cul -de -sac road, We feel that a T -road would be more practical. Others of the large lots bounded by Mission, Herald, Felts and Broadway might in the future wish to build hones on the extensive unimproved acreage behind the existing dwellings, or would like vehicle access to those back areas. A T -road would permit this, as it could be extended, 3. Eight dwellings. in 2,73 acres puts eight septic tanks there- -too many for the deteri- orating aquifer. The aquifer needs open areas for recharge. The soil in the center of the Spokane Valley is extremely porous—which means that the higher the population and building density, the greater the strain on the soil to filter out pollution. Open areas that have natural vegetation are important for transevaporation. Most petition signers favor sewers for the Valley *, but we need to look ahead with good future land use planning to complement that, 4. The surrounding residences value their privacy. A congested tract of such dwellings, in the approximate center of the Mission- Herald - Felts - Broadway tract, would seriously jeopardise this privacy. 5 The value of our homes would decrease. One of the values of this tract of land is the settled, relaxed, semi -rural attractiveness of the large, open -vista lots, with poten- tial for garden, aninals, unhampered working areas. It is one of the few such semi -rural residential areas in the center of the Spokane Valley. There are many fruit trees. 6. With so many additional families, traffic con "estion will be much increased, especially on Felts Road. All the homes surrounding the cul -de -sac must use Felts as their egress. In addition, only one other egress (to University, several blocks north and east) is possible for dwellings on Sharp, Balfour, Desmet, Dean, and Oberlin, and is less conve- nient for most, 7. As a result, Felts will inevitably be widened for its entire length from Broadway to g, Mission, This will increase our taxes and cut into our front lawns. 9. ]Many present residents enjoy the wild life that make their homes in the open area be- tween Felts and Herald, There are pheasant, quail, many songbirds. The pheasants and quail nest in the present undeveloped tract on which the eight dwellings will be located. Four or fewer dwellings in this tracts would have less impact on this wild life. SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINGS & ORDER DATE: DECEMBER 19, 1985 RE: PE- 1518 -85, THOMPSON ADDITION 1. That the proposal is to subdivide 2.73 acres into 8 lots for single family dwellings with an average lot size of approximately 12,500 sq.ft. 2. That the proposal is located west of and adjacent to Felts Road, approximately 700 ft. north of Broadway Avenue in Section 17, Township 25N, Range 44 E.W.M., Spokane County, Washington. 3. That the item has been properly advertised in accordance with state and local regulations. 4. That the Committee has considered and evaluated the information and conditions contained in the Planning Report for this proposal. 5. That the Comprehensive Plan designates this area as URBAN and the proposal appears generally consistent with the density and use guidelines of this category. 6. That the Committee finds the proposal compatible with existing uses in the area which include higher density housing east of Felts Road and to the west of Herald Road. 7. That the owners of adjacent and nearby properties spoke generally against the proposal. Concerns of the public dealt with density, large animal keeping, duplexes and manufactured homes. There appears to be an island of large lots between Herald & Felts and Mission and Broadway. 8. That the provisions of the State Environmental Policy Act have been complied with. 9. NOTE: Pursuant to WAC 197 -11- 680(5), Notice is hereby given that in conjunction with final approval of the above reference matter that: 1. The time limit for commencing SEPA appeal of the approval of the above referenced matter, as provided by county ordinance, is 30 calendar days from final execution of the above Findings and Order. 2. The time frame for appealing any SEPA issues with respect to the approval of the above referenced matter is 30 days after the execution of the above Findings and Order. HEARING EXAMINER COMMITTEE FINDINGS & ORDER FILE NO. PE- 1518 -85 3. The appeal of either the approval of the above referenced matter or any SEPA issues may be filed in the Spokane County Superior Court or a court of competent jurisdiction as provided by law. 4. That decisions of the Spokane County Hearing Examiner Committee become "Final" unless appealed within 10 days of the Committee written decision. 5. Decisions rendered by the Board of County Commissioners are final when the Board signs its Findings and Order. CONCLUSIONS AND ORDER The Hearing Examiner Committee pursuant to the above findings concludes that the application of preliminary plat PE- 1518 -85, THOMPSON ADDITION be APPROVED in accordance with the Conditions of Approval attached hereto. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on -site improvements unless the applicant(s) /sponsor(s) choose to file a notarized Waiver of Notice of Action with the Spokane County Planning Department. 12. That a plan for water facilities adequate for domestic service and fire protection be approved by the water supplier, fire protection district, Spokane County Building & Safety Department and County health authorities. The agencies will certify on the WATER PLAN, prior to the filing of the final plat or any phase of the preliminary plat that the plan is in conformance with their respective needs and regulations. The WATER PLAN and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved WATER PLAN. The time schedule will provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat sponsor shall also sign the WATER PLAN to confirm the contractual arrangements or agreements.
