This deed is for the purpose of securing the obligation of the Grantor herein
not to sell, convey or apply for building permits on any lot assigned herein until
the Grantor constructs all roads, drainage structures and facilities, sidewalks,
monuments, curbs and other facilities in accordance with the approved plans on file
in the Spokane County Engineer's Office. These plans are designed to meet Spokane
County Standards adopted in Resolution No. 80 -1592 as amended and conditions of
approval in the findings and der for Person Addition PE #1523 -85 and zone change
.&)11 2 E # 1 1 0'1-8 C / . The Grantor agrees to complete the above - mentioned
' mprovements by 2 -1 -89 . In the event these improvements are not completed by
the above - mentioned date, the Grantor is considered to have defaulted on the deed of
trust and Spokane County may at any time thereafter proceed as outlined hereafter.
The Spokane County Engineer's estimate for these improvements is $ 11,500.00. It is
further understood that this Deed of Trust is for the actual cost of improvements at
the time they are made, which cost may exceed the Spokane County Engineer's esti-
mate.
To protect the security of this Deed of Trust, Grantor covenants and agrees:
1. To keep the property in good condition and repair; to permit no waste there-
of; and to comply with all laws, ordinances, regulations, covenants; conditions and
restrictions affecting the property.

2. To pay before oLiinquent all lawful taxes and as__ssments�•alaTatt'the prop-
° • erty; to keep the property free and clear of all other charges, liens or encumbrances
impairing the security of this Deed of Trust.
3. To defend any action or proceeding purporting to affect the security hereof
or the rights
or powers of Beneficiary or Trustee, and to pay all costs and expenses
including costs of title search and attorney's fees in a reasonable amount in any
such action or proceeding, and in any suit brought by Beneficiary to foreclose this
Deed of Trust.
4. To pay all costs, fees and expenses in connection with this Deed of Trust
including the expenses of a Trustee incurred in forcing the obligations secured here-
by and the Trustee's and Attorney's fees actually incurred as provided by statute.
5. Should the Grantor fail to pay when due any taxes, assessments, liens,
encumbrances or other charges against the property hereinabove described, Beneficiary
may pay the same, in the amounts so paid with interest at a rate of 12 percent
shall be added to become a part of the debts secured in this Deed of Trust.
It is mutually agreed that:
1. Reconveyances.
a. Conditions for Reconveyance. Grantor shall have the right to have any
lot or lots within the subdivision reconveyed. The conditions precedent to said
reconveyance are:
1. No notice of default remains uncured;
2. Grantor shall be entitled to said reconveyance on all or a portion
of the lots within the subdivision upon:
(a) Construction by the Grantor of all roads withiln the final plat
to the standards required of the Grantor by the Beneficiary in accordance with such
final plat and acceptance of said construction by the Beneficiary; or
(b) Construction by the Grantor of a portion of the roads within
the final plat to the standards required of the Grantor by the Beneficiary in accord-
ance with such final plat and acceptance of said construction by the Beneficiary.
Provided, however, the Beneficiary retains the exclusive authority to determine
engineering design
whether or not to accept any portion of the roads based in part upon the /traffic -fhow
within the approved plat; or
(c) Submittal by the Grantor and acceptance by the Beneficiary of
acceptable guarantees to construct all or a portion of the roads within the final
plat to the standards submitted to the Grantor by the Beneficiary in accordance with

such final plat. Such guarantees may include performance bonds, loan assignments or
assignments of savings accounts. Provided, however, a submittal to the Beneficiary
of guarantees for less than all the roads in the plat must be accompanied by a writ-
ten development proposal indicating those lots within the approved plat which will be
sold as a result of a partial reconveyance. The development proposal must be ap-
proved in writing by the Beneficiary prior to the acceptance of the guarantee and
partial reconveyance;
3. Grantor shall pay for ALL costs and fees in preparation of full or
partial reconveyances.
a. Subordination to Third Party Vendees. Beneficiary agrees that in the
event of foreclosure of Grantor's interest herein, Beneficiary shall reconvey to
Vendees of the Grantor upon performance by said Vendees to Beneficiary as herein -
before stated.
2. Cooperation. Each of the parties hereto, forthwith, and on the request of
the other, shall execute and deliver such documents and take such actions as may be
reasonably required in order to carry out the intent and purposes of this Agreement.
3. Default. Upon default by the Grantors in the performance of any agreement
contained herein, all sums secured hereby shall immediately become due and payable at
the option of Beneficiary. In such event and upon written request of the Benefi-
ciary, the Trustee shall sell the trust property in accordance with the Deed of Trust
Act of the State of Washington, and public auction to the highest bidder. Any person
except Trustee may bid at the Trustee's sale. The Trustee shall apply the proceeds
of the same as follows:
a. To the expense of sale, incuding reasonably Trustees and attorney's
fees;
to.
b. To the obligations secured by this Deed of Trust;

c. The surplus if any shall be distributed to the persons entitled there-
4. Trustee shall deliver to the Purchaser at the sale, its Deed without war-
ranty, which shall convey to the Purchaser the interest in the property which Grantor
had, or had the power to convey, at the time of his execution of this Deed of Trust,
and such as he may have acquired thereafter. The Trustee's Deed shall recite the
facts shown that sale was conducted in compliance with all the requirements of law
and of this Deed of Trust, which recital shall be prima facie evidence of such com-
pliance and cuncusive evidence thereof in favor of bona fide purchasers and encum-
brances for value.
5. The power of sale concurred by this Deed of Trust and by the Deed of Trust
Act in the State of Washington is not an exclusive remedy; Beneficiary may cause this
Deed of Trust to be foreclosed as a mortgage.
6. In the event of the death, incapacity or disability or resignation of
Trustee, Beneficiary may appoint in writing a Successor Trustee, and upon the re-
cording of such appointment in the mortgage records of the county in which this Deed
of Trust is recorded, the Successor Trustee shall be vested with all powers of the
original Trustee. The Trustee is not obligated to notify any party hereto of pending
sale under any Deed of Trust or of any action or proceeding in which the Grantor,
Trustee or Beneficiary shall be a party unless such action or proceeding is brought
by Trustee.
7. This Deed of Trust applies, inures to the benefit of, and is binding not
only on the parties hereto, but their heirs, devisees, legatees, administrators,
executives, successors and assigns.

The undersigned beneficiary previously accepted that certain
Deed of Trust dated the 2nd day of February, 1987, filed for record
on March 16 1987, at Auditor's File No. 8703160272, and recorded in
Volume 884, at page 1657, from the grantor, Radiology Associates of
Spokane, P.S. Employees Profit- Sharing Plan & Trust, with
Transamerica Title Co., 720 North Argonne, Spokane, Washington
99206 as trustee, for the purpose of securing Grantor's completion
of certain roadway improvements to satisfy conditions imposed by
the Beneficiary on the plat of Person Addition, PE #1523 -85, in the
original estimated amount of $11,500.
Grantor has supplied other security suitable to Beneficiary
respecting the real property conveyed to Beneficiary in said Deed

lot or lots within the subdivision reconveyed. The conditions precedent to said
reconveyance are:
I. No notice of default remains uncured;
2. Grantor shall be entitled to said reconveyance on all or a portion
of the lots within the subdivision upon:.
(a) Construction by the Grantor of all roads withiln the final plat
to the standards required of the Grantor by the Beneficiary in accordance with such
final plat and acceptance of said construction by the Beneficiary; or
(b) Construction by the Grantor of a portion of the roads within
the final plat to the standards required of the Grantor by the Beneficiary in accord-
ance with such final plat and acceptance of said construction by the Beneficiary.
Provided, however, the Beneficiary retains the exclusive authority to determine
engineering design
whether or not to accept any portion of the roads based in part upon the /traffic -fItw
within the approved plat; or
(c) Submittal by the Grantor and acceptance by the Beneficiary of
acceptable guarantees to construct all or a portion of the roads within the final
plat to the standards submitted to the Grantor by the Beneficiary in accordance with

such final plat. Such guarantees may include performance bonds, loan assignments or
assignments of savings accounts. Provided, however, a submittal to the Beneficiary
of guarantees for less than all the roads in the plat must be accompanied by a writ-
ten development proposal indicating those lots within the approved plat which will be
sold as a result of a partial reconveyance. The development proposal must be ap-
proved in writing by the Beneficiary prior to the acceptance of the guarantee and
partial reconveyance;
3. Grantor shall pay for ALL costs and fees in preparation of full or
partial reconveyances.
a. Subordination to Third Party Vendees. Beneficiary agrees that in the
event of foreclosure of Grantor's interest herein, Beneficiary shall reconvey to
Vendees of the Grantor upon performance by said Vendees to Beneficiary as herein -
before stated.
2. Cooperation. Each of the parties hereto, forthwith, and on the request of
the other, shall execute and deliver such documents and take such actions as may be
reasonably required in order to carry out the intent and purposes of this Agreement.
3. Default. Upon default by the Grantors in the performance of any agreement
contained herein, all sums secured hereby shall immediately become due and payable at
the option of Beneficiary. In such event and upon written request of the Benefi-
ciary, the Trustee shall sell the trust property in accordance with the Deed of Trust
Act of the State of Washington, and public auction to the highest bidder. Any person
except Trustee may bid at the Trustee's sale. The Trustee shall apply the proceeds
of the same as follows:
a. To the expense of sale, incuding reasonably Trustees and attorney's
fees;
to.
b. To the obligations secured by this Deed of Trust;
c. The surplus if any shall be distributed to the persons entitled there-
4. Trustee shall deliver to the Purchaser at the sale, its Deed without war-
ranty, which shall convey to the Purchaser the interest in the property which Grantor
had, or had the power to convey, at the time of his execution of this Deed of Trust,
and such as he may have acquired thereafter. The Trustee's Deed shall recite the
facts shown that sale was conducted in compliance with all the requirements of law
and of this Deed of Trust, which recital shall be prima facie evidence of such com-

pliance and concusive evidence thereof in favor of bona fide purchasers and encum-
brances for value.
5. The power of sale concurred by this Deed of Trust and by the Deed of Trust
Act in the State of Washington is not an exclusive remedy; Beneficiary may cause this
Deed of Trust to be foreclosed as a mortgage.
6. In the event of the death, incapacity or disability or resignation of
Trustee, Beneficiary may appoint in writing a Successor Trustee, and upon the re-
cording of such appointment in the mortgage records of the county in which this Deed
of Trust is recorded, the Successor Trustee shall be vested with all powers of the
original Trustee. The Trustee is not obligated to notify any party hereto of pending
sale under any Deed of Trust or of any action or proceeding in which the Grantor,
Trustee or Beneficiary shall be a party unless such action or proceeding is brought
by Trustee.
7. This Deed of Trust applies, inures to the benefit of, and is binding not
only on the parties hereto, but their heirs, devisees, legatees, administrators,
executives, successors and assigns.

1. That the proposal is to establish B -1, retail commercial use, on Lots 1
and 2 of the preliminary plat and multiple family residential use on the
third parcel. B -1 zoning would be on approximately 1.32 acres; UR -22
zoning on approximately 3.23 acres.
2. That the proposal is located in the Spokane Valley located adjacent to and
easterly of Sullivan Road and adjacent to and south of 4th Avenue, in
Section 24, Township 25N, Range 44 E.W.M., Spokane County, Washington.
3. That the item has been properly advertised in accordance with state and
local regulations.
4. That the Committee has considered and evaluated the information and
conditions contained in the Planning Report for this proposal.
5. That the Comprehensive Plan designates this area as SUBURBAN and the
proposal appears generally consistent with the density and uses in the
area. The Committee notes the area is undergoing a change to urban
character.
6. That the Committee finds the proposal compatible with existing uses in the

CONCLUSIONS AND ORDER
The Hearing Examiner Committee pursuant to the above findings concludes that
the application of preliminary plat PE- 1523 -85 and Zone Change ZE- 107 -85 from
Multiple Family Suburban to B -1 & UR -22 be APPROVED in accordance with the
Conditions of Approval attached hereto.

approval of the above referenced matter is 30 days after the
execution of the above Findings and Order.
c. The appeal of either the approval of the above referenced matter or
any SEPA issues may be filed in the Spokane County Superior Court or

d. That decisions of the Spokane County Hearing. Examiner Committee
become "Final" unless appealed within 10 days of the Committee
written decision.
e. Decisions rendered by the Board of County Commissioners are final
when the Board signs its Findings and Order.

IN REFERENCE TO THE ATTACHED FINDINGS & ORDER THE HEARING EXAMINER COMMITTEE
ADOPTS THE FOLLOWING PLANNING REPORT CONDITIONS OF APPROVAL (SECTION A) AND
AMENDMENTS (SECTION 13) ATTACHED HERETO:
1. That the below listed conditions of all Departments and Agencies are
binding upon the applicant, owner(s) of the property, heirs, successors
or assigns.
COUNTY PLANNING DEPARTMENT
2. The preliminary plat of record approval is for the property legally
described in the application for this proposal.
3. That the Final Plat be designed substantially in conformance with the
preliminary plat of record as legally described and advertised. No
increase of density or lot number shall occur without prior approval of
the Hearing Examiner Committee.
4. The Spokane County Subdivision Administrator shall review any proposed
Final Plat to insure compliance with the Findings and Conditions of the
Spokane County Hearing Examiner Committee.
5. That the preliminary plat be given conditional approval for three (3)
years to April 1, 1989. The applicant may request an Extension of Time
by submitting a written request forty -five (45) days prior to the above
expiration date.
6. Upon filing the Final Plat the zone change of the Final Plat area shall
be finalized and the existing Multiple Family Suburban zone
classification shall be changed to B -1 & UR -22.
7. That a Final Plat name be indicated before the final plat is filed; such
name to be approved by the County Assessor and the Planning staff.
8. That appropriate utility easements be indicated on copies of the approved
preliminary plat, for distribution to the County Planning Department,
Utilities Department, Engineering Department, Health District and
applicable utility companies. Written approval of said utility easements
by said utility companies must be received with the submittal of the
final plat.
9. That a current certificate of title be furnished the County Planning
Department prior to filing the final plat.

10. That the following statement be placed in the final plat dedication: "No
lot shall be further subdivided for the purpose of creating additional
lots, ownerships, or building sites without first filing a replat."
11. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter
43.210.080 RCW be initiated by the project applicant within thirty (30)
days of final disposition of this application, and prior to any on -site
improvements unless the applicant(s) /sponsor(s) choose to file a
notarized Waiver of Notice of Action with the Spokane County Planning
Department.
12. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Subdivision Administrator
shall be submitted with a performance bond for the project prior to
release of building permits.
13. All current standards of the Urban Residential (UR -22) and B -1 zone, as
amended, shall be complied with in the development of this site.
14. That a plan for .water •facilities adequate for domestic service and fire
protection be approved by the water supplier, fire protection district,
Spokane County Building & Safety Department and County health
authorities. The agencies will certify on the WATER PLAN, prior to the
filing of the final plat or any phase of the preliminary plat that the
plan is in conformance with their respective needs and regulations. The
WATER PLAN and certification will be drafted on a transparency suitable
for reproduction. •
The purveyor will also certify that appropriate contractual arrangements
and schedule of improvements have been made with the plat sponsor for
construction of the water system in accordance with the approved WATER
PLAN. The time schedule will provide for completion of the water system
and inspection by the appropriate health authorities prior to application
for building permits within the final plat. The arrangements or
agreements will include a provision holding Spokane County and the
purveyor harmless from claims by any lot purchaser refused a building
permit due to the failure of the plat sponsor to satisfactorily complete
the approved water system.
The plat sponsor shall also sign the WATER PLAN to confirm the
contractual arrangements or agreements.
The final plat dedication will contain the following statement: "the
public water system, pursuant the WATER PLAN approved by County and State
Health authorities, the local fire district, County Building & Safety
Department, and water purveyor, will be installed within this plat, and
the subdivider /sponsor will provide for individual domestic water service
as well as fire protection to each lot prior to sale of each lot and
prior to issuance of a building permit for each lot."

County Engineer Department (Cont'd)
9. Existing County roads providing direct access to the plat shall be paved
and curbed to Spokane County standards.
10: That Public Road Standard TYPICAL Roadway Section be: Section Number 1
for 4th Avenue Minimum Paving width Access Street Standard.
11. The proposed plat shall be improved to the standards set forth in Spokane
County Board of Commissioners Resolution No. 80 -1592, as amended, which
establishes regulations for roads, approaches, drainage, and fees in new
construction.
12. The County Engineer has examined this development proposal and has
determined that the impact of this proposal upon the existing County Road
System warrants the dedication of additional right -of -way and the roadway
improvements herein specified.
13. That roadway and drainage plans for Roadway Improvements must be
completed and approved by the. County Engineer prior to recording of the
final plat.
14. That any driveway approach to parcel #2 from 4th Avenue shall 'be located
so as to eliminate the potential for traffic congestion at the
intersection of 4th Avenue and Sullivan Road.
15. Access permits for approaches to the County Road System shall be obtained
from the Spokane County Engineer.
16. The applicant shall submit for approval by the Spokane County Engineer
and the Spokane County Health District a detailed combined on -site sewage
system plan and surface water disposal plan for the entire project prior
to the issuance of any building permit on the property.
17. A parking plan and traffic circulation plan shall be submitted and
approved by the Spokane County Engineer prior to the issuance of a
building permit on the property. The design, location and arrangement of
parking stalls shall be in accordance with standard traffic engineering
practices. Paving or surfacing as approved by the County Engineer, will
be required for any portion of the project which is to be occupied or
travelled by vehicles.
18. All required improvements shall conform to the current State of
Washington Standard Specifications for Road and Bridge Construction, and
other applicable county standards and or adopted resolutions pertaining
to Road Standards and Stormwater Management in effect at the date of
construction, unless otherwise approved by the County Engineer.

County Engineer Department (Cont'd)
15. That no building permit will be issued for any lot within the Final Plat
until certified by a Washington State licensed engineer "that the water
system has been installed pursuant the approved WATER PLAN for the Final
Plat ", signed and stamped by said engineer. The certification may be in
the form of a letter but is preferred to be certified on a copy of the
WATER PLAN as a schematic map showing the "As Built" water system.
COUNTY ENGINEER DEPARTMENT
1. That conditional approval of the plat is given subject to dedication of
Right -of -Way and approval of the road system as indicated in the
preliminary plat of record.
2. That plans, profiles, and cross - sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for approval prior to construction and /or the filing of
each final plat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
3. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval
prior to construction and /or the filing of each final plat. Drainage
plans to be prepared under the direction of a licensed Professional Civil
Engineer.
4. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed engineer /surveyor,
who shall furnish the County Engineer with "As Built" plans and a
certificate in writing that all improvements were installed to the lines
and grades shown on the approved construction plans and that all
disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed
public right of way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
6. All construction within the existing or proposed public Right -of -Way is
to be completed prior to issuance of a building permit or a bond in the
amount estimated by the County Engineer to cover the cost of construction
of improvements, construction certification, "As Built" plans, and
monumenting the street centerlines shall be filed with the County
Engineer.
7. A statement must appear in the dedicatory language of the final plat:
"that individual driveway access permits be required prior to issuance of
a building permit for driveway approaches to the County road system."
8. Dedication of 5 ft. additional Right of Way along 4th Avenue (as shown on
preliminary plat).

COUNTY HEALTH DISTRICT
1. Appropriate utility easements shall be indicated on copies of the
preliminary plat of record for distribution by the Planning Department to
the utility companies, Spokane County Engineer and the Spokane County
Health District. Written approval of the easements by the utility
companies must be received prior to the submittal of the final plat.
2. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Spokane County Health District
prior to the issuance of any building permit for this project.
3. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.

and the local fire district and purveyor will be installed within this
plat, and the subdivider will provide for individual domestic water
service as well as fire protection to each lot prior to sale of each lot."
COUNTY UTILITIES DEPARTMENT
1. The dedication shall state: "The owner(s) or Successor(s) in interest
agree to authorize the County to place their name(s) on a petition for
the formation of ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94'which includes the
Owner(s) property. PROVIDED, this condition shall not prohibit the
owner(s) or successor(s) from objection to any assessment(s) on the the
property as a result of improvements called for in conjunction with the
formation of a ULID by either petition or resolution method under RCW
Chapter 36.94.
2. Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County, as amended.

County Utilities Department (Cont'd)
3. A sewer connection to the Valley Sewerage System is to be constructed.
Plans and specifications for the sewer connection are to be reviewed and
approved by the Utilities Department prior to finalizing the plat.
BUILDING & SAFETY DEPARTMENT
1. Approved numbers or addresses shall be placed on all new and existing
buildings in such a position as to be plainly visible and legible from
the street or road fronting the property. Said numbers shall constrast
with their background.
2. Trash enclosures shall not be located adjacent to combustible construc-
tion or underneath windows or nonprotected eaves.
3. Building permits will be required for each structure.
4. A plan for emergency equipment access is required to be submitted prior
to any land development as approved by Fire District #1.
5. Fire hydrants which meet the fire flow are required to be installed prior
to any construction. These hydrants shall be placed so that no'portion
of the building exterior is more than 175 feet from the hydrant. The
bottom of the lowest outlet of the hydrant shall be no less than 18
inches above grade. A water plan showing each fire hydrant (specifying
the gallons per minute for each fire hydrant) and meeting the
requirements in Chapter 10.04 of the Uniform Fire Code is required prior
to construction of the water service. All required fire protection
facilities shall be installed and made serviceable•prior to and during
the time of construction.

Enclosed are seven copies of the revised site plan which reflects
an increase of multi — family units from 70 to 85 units permitted under
your new zoning ordinance for bonus density. Additionally,
corrections have been made to the site plan on both the B -1 and UR -22
portions to reflect thrzoning standards of the new zoning ordinance.
Finally, the site plan adjustments reflect the following changes
environmentally: ••,

and is consistent with the requirements of the UFC, according to the
Spokane County Fire District #1. Per previous conversations, I will
readvertise this site for your March 20 hearing and will make the
adjustment necessary for posting to orient the sign to the Sullivan
Road exposure (an updated property ownership run will be made to
confirm current ownerships). If anything else needs to be done,
please let me know so that I may process this and prepare for this
hearing.

G. Special Information:
Circulation - Access to the site is provided by Sullivan Road and
4th Avenue. Lot 3 will front on 4th Avenue while Lots 1 and 2 will
front on Sullivan Road. Three access points are proposed along 4th
Avenue and two access points are indicated on Sullivan Road.
Design - Review of the proposed site plan indicates minor
inconsistencies with the development standards for parking,
landscaping and emergency access within the B -1 and UR -22 zones of
the Spokane County Zoning Code. Prior to release of building
permits, the sponsor shall submit a revised site plan which
demonstrates compliance with the B -1 and UR -22 zones and all Hearing
Examiner Committee conditions of approval. The proposed site plan
also illustrates that Lots 1 and 2 will be occupied by a structure
which will traverse the common lot line between Lots 1 and 2. This
design will result in a common wall structure without side yard
setbacks as provided for within the proposed B -1 zone.
Density - The existing multiple family suburban zoning in the
area, which includes the subject property, was established prior to
adoption of the Spokane County Comprehensive Plan in 1981. Approved
multiple family densities range from 14.31 to 20 units per acre.
Subsequent to adoption of the Comprehensive Plan, a zone change to
Multiple Family Suburban was approved for the parcel which adjoins
the subject property to the south (across 4th Avenue). In approving
128 units with a density of 21.6 units per acre (in the Suburban
category), the Hearing Examiner Committee found that the proposal is
compatible with existing uses in the area and that infrastructure
for urban development is available along Sullivan Road. The
proposed density of 27 units per acre exceeds the allowable density
of 22 units per acre within the UR -22 zone. However, bonus density
provisions of the Spokane County Zoning Code allow up to 27 units
per acre in the UR -22 zone provided the following criteria are
satisfied:
Three and one -half (3.5) units per acre for direct hookup to the
Sanitary Sewer prior to occupancy.
One -half (.5) unit per acre for location of development within
one - quarter (1/4) mile walking distance of available public transit.
One -half (.5) unit per acre for location of development where
off -site convenience shopping facilities are functionally accessible
within reasonable walking distance (approximately one -half (1/2)
mile).
One -half (.5) unit per acre for primary means of access to the
development is via an arterial.

In recognition of existing and proposed densities, availability of
sewer and previous land use actions, the proposed density of 27
dwelling units per acre appears comparable with adjoining properties
and the immediate area.
Drainage - Specific drainage plans shall be submitted to the
County Engineer for approval prior to construction and /or filing the
final plat.
Water Supply - Vera Irrigation District will provide water. An
approved water Plan will be required prior to finalizing this
preliminary plat.
Sewage Disposal - Development of the site is conditioned upon
connection to the Valley sewer system.
School - The proposal is in the Central Valley School District #356.
Fire Protection - The proposal is located within Fire District
#1. The Fire District and County Building and Safety Department
(Fire Marshall) are required to approve fire protection provisions
prior to finalizing the preliminary plat.
III. HISTORY /ANALYSIS
This proposal is located in an area characterized by mixed use
development, various housing types and densities, with proximity to urban
services and infrastructure. The site also borders the Urban category to
the west and the major commercial category to the north. Previous zone
changes in the area also support multi - family development at densities
exceeding 20 units per acre.
IV. ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed
by the County Planning Department staff. The review considered the
specifics of the proposal, other available information, County
ordinances, other regulations and laws and the standard Conditions of
Approval. County Planning Department has determined that "No probable
significant adverse impacts" would result from the proposal being
developed and has issued a Determination of Non - Significance ( "DNS ").
The "DNS" was circulated to 9 other agencies of jurisdiction and other
agencies /departments affected by the future development for review and
comment. The "DNS" comment period ends March 19, 1986 and was advertised
15 calendar days before said date in the newspaper, by letter to adjacent
property owners 400 feet of the proposal, by notice on a sign posted on
the proposal site and by letter to the general mailing list.
Hearing Examiner Committee may consider additional environmental related
testimony and the "DNS" at the public hearing.

V. LEAD AGENCY SUMMARY
The proposal appears compatible with existing uses in the area and
previous land use actions. The Planning Department recommends approval
subject to the recommended conditions, unless unresolved issues are
identified at the public hearing.
VI. CONDITIONS OF APPROVAL
If approval is granted, the following conditions are recommended.
1. That the below listed conditions of all Departments and Agencies are
binding upon the applicant, owner(s) of the property, heirs, successors
or assigns.
COUNTY PLANNING DEPARTMENT
2. The preliminary plat of record approval is for the property legally
described in the application for this proposal.
3. That the Final Plat be designed substantially in conformance with the
preliminary plat of record as legally described and advertised. No
increase of density or lot number shall occur without prior approval of
the Hearing Examiner Committee.
4. The Spokane County Subdivision Administrator shall review any proposed
Final Plat to insure compliance with the Findings and Conditions of the
Spokane County Hearing Examiner Committee.
5. That the preliminary plat be given conditional approval for three (3)
years to April 1, 1989. The applicant may request an Extension of Time
by submitting a written request forty -five (45) days prior to the above
expiration date.
6. Upon filing the Final Plat the zone change of the Final Plat area shall
be finalized and the existing Multiple Family Suburban zone
classification shall be changed to B -1 & UR -22.
7. That a Final Plat name be indicated before the final plat is filed; such
name to be approved by the County Assessor and the Planning staff.
8. That appropriate utility easements be indicated on copies of the approved
preliminary plat, for distribution to the County Planning Department,
Utilities Department, Engineering Department, Health District and
applicable utility companies. Written approval of said utility easements
by said utility companies must be received with the submittal of the
final plat.
9. That a current certificate of title be furnished the County Planning
Department prior to filing the final plat.

Department.
12. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Subdivision Administrator
shall be submitted with a performance bond for the project prior to
release of building permits.
13. All current standards of the Urban Residential (UR -22) zone, as amended,
shall be complied with in the development of this site.
14. That a plan for water facilities adequate for domestic service and fire
protection be approved by the water supplier, fire protection district,
Spokane County Building & Safety Department and County health
authorities. The agencies will certify on the WATER PLAN, prior to the
filing of the final plat or any phase of the preliminary plat that the
plan is in conformance with their respective needs and regulations. The
WATER PLAN and certification will be drafted on a transparency suitable
for reproduction.
The purveyor will also certify that appropriate contractual arrangements
and schedule of improvements have been made with the plat sponsor for
construction of the water system in accordance with the approved WATER
PLAN. The time schedule will provide for completion of the water system
and inspection by the appropriate health authorities prior to application
for building permits within the final plat. The arrangements or
agreements will include a provision holding Spokane County and the
purveyor harmless from claims by any lot purchaser refused a building
permit due to the failure of the plat sponsor to satisfactorily complete
the approved water system.
The plat sponsor shall also sign the WATER PLAN to confirm the
contractual arrangements or agreements.
The final plat dedication will contain the following statement: "the
public water system, pursuant the WATER PLAN approved by County and State
Health authorities, the local fire district, County Building & Safety
Department, and water purveyor, will be installed within this plat, and
the subdivider /sponsor will provide for individual domestic water service
as well as fire protection to each lot prior to sale of each lot and
prior to issuance of a building permit for each lot."

15. That no building permit will be issued for any lot within the Final Plat
until certified by a Washington State licensed engineer "that the water
system has been installed pursuant the approved WATER PLAN for the Final
Plat ", signed and stamped by said engineer. The certification may be in
the form of a letter but is preferred to be certified on a copy of the
WATER PLAN as a schematic map showing the "As Built" water system.
COUNTY ENGINEER DEPARTMENT
1. That conditional approval of the plat is given subject to dedication of
Right -of -Way and approval of the road system as indicated in the
preliminary plat of record.
2. That plans, profiles, and cross - sections as designed to County standards
showing proposed street centerline and curb grades be submitted to the
County Engineer for approval prior to construction and /or the filing of
each final plat; road plans to be prepared under the direction of a
licensed Professional Civil Engineer.
3. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval
prior to construction and /or the filing of each final plat. Drainage
plans to be prepared under the direction of a licensed Professional Civil
Engineer.
4. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed engineer /surveyor,
who shall furnish the County Engineer with "As Built" plans and a
certificate in writing that all improvements were installed to the lines
and grades shown on the approved construction plans and that all
disturbed monuments have been replaced.
5. No construction work is to be performed within the existing or proposed
public right of way until a permit has been issued by the County
Engineer. All work is subject to inspection and approval by the County
Engineer.
6. All construction within the existing or proposed public Right -of -Way is
to be completed prior to issuance of a building permit or a bond in the
amount estimated by the County Engineer to cover the cost of construction
of improvements, construction certification, "As Built" plans, and
monumenting the street centerlines shall be filed with the County
Engineer.

11. The proposed plat shall be improved to the standards set forth in Spokane

COUNTY HEALTH DISTRICT
1: Appropriate utility easements shall be indicated on copies of the
preliminary plat of record for distribution by the Planning Department to
the utility companies, Spokane County Engineer and the Spokane County
Health District. Written approval of the easements by the utility
companies must be received prior to the submittal of the final plat.
2. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Spokane County Health District
prior to the issuance of any building permit for this project.
3. Sewage disposal method shall be as authorized by the Director of
Utilities, Spokane County.
4. A statement shall be placed in the dedication to the effect that: "A
public sewer system will be made available for the plat and individual
service will be provided to each lot prior to sale. Use of individual
on -site sewage system shall not be authorized."
5. Water service shall be coordinated through the Director of Utilities,
Spokane County.
6. Water service shall be by an existing public water supply when approved
by the Regional Engineer (Spokane), State Department of Social & Health
Services.
7. Prior to filing the final plat, the sponsor shall present evidence that
the plat lies within the recorded service area of the water system
proposed to serve the plat. The dedicatory language on the plat shall
state: "Use of private wells and water systems is prohibited."
8. The plat dedication will contain a statement to the effect that: "The
public water system as approved by County and State health authorities
and the local fire district and purveyor will be installed within this
plat, and the subdivider will provide for individual domestic water
service as well as fire protection to each lot prior to sale of each lot."
COUNTY UTILITIES DEPARTMENT
1. The dedication shall state: "The owner(s) or Successor(s) in interest
agree to authorize the County to place their name(s) on a petition for
the formation of ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to object by the
signing of a protest petition against the formation of a ULID by
resolution method pursuant to RCW Chapter 36.94 which includes the
Owner(s) property. PROVIDED, this condition shall not prohibit the

2. Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County, as amended.
3. A sewer connection to the Valley Sewerage System is to be constructed.
Plans and specifications for the sewer connection are to be reviewed and
approved by the Utilities Department prior to finalizing the plat.
BUILDING & SAFETY DEPARTMENT
1. Each building constructed shall be accessible to fire department
apparatus by way of access roadway with all- weather driving surface of
not less than 20 feet of unobstructed width with adequate roadway turning
radius capable of supporting the imposed loads of fire apparatus and
having a minimum of 13 feet 6 inches of vertical clearances. All roadway
grades to be approved by fire district.
2. The development shall be provided with at least two (2) points to the
public street. The access locations shall be approximately on oposite
ends of the development.
3. Approved numbers or addresses shall be placed on all new and existing
buildings in such a position as to be plainly visible and legible from
the street or road fronting the property. Said numbers shall constrast
with their background.
4. Due to the sensitive storage requirements over the Aquifer, and this site
lies within the Waste Water Management Area, we feel that some language
should address the possible storage of flammable or critical materials
within these structures.
5. Trash enclosures shall not be located adjacent to combustible construc-
tion or underneath windows or nonprotected eaves.
6. Building permits will be required for each structure.
7. A planPfor emergency equipment access is required to be submitted prior
to any land development.
8. Fire hydrants which meet the fire flow are required to be installed prior
to any construction. These hydrants shall be placed so that no portion
of the building exterior is more than 175 feet from the hydrant. The
bottom of the lowest outlet of the hydrant shall be no less than 18
inches above grade. A water plan showing each fire hydrant (specifying
the gallons per minute for each fire hydrant) and meeting the
requirements in Chapter 10.04 of the Uniform Fire Code is required prior
to construction of the water service. All required fire protection
facilities shall be installed and made serviceable prior to and during
the time of construction.
