Seipp Simpson Engineers S. 717 Pines Road N. 909 Argonne Road Spokane, WA 99206 Spokane, WA 99212 Location: The proposal is located on Augusta Avenue and Augusta Court and Nora Court in the Spokane Valley in Section 9, Township 25N, Range 44 E.W.M., Spokane County, Washington. Proposal: To subdivide 20 existing duplexes to create 40 lots, each with half a duplex - division of existing duplex to allow separate ownership of duplex half with separate lot. A. Site Size: 5.95 acres; Overall Density: 8.08 units per acre B. Comprehensive Plan: URBAN, within the Priority Sewer Service Area (PSSA) boundary. C. Site Characteristics: The site is already developed with 20 duplexes. D. _Neighborhood Characteristics: The area has developed with single family residences and a large number of duplexes, several of which have been approved for division of duplexes via the short plat process. SITE PLAN INFORMATION (Cont'd) G. Special Information: The division of existing duplexes proposed here is governed by the requirements contained in Section 4.17.150 - Duplex Division of the Spokane County Zoning Ordinance. The landuse issues concerning use or zoning have previously been decided. The request here is essentially to allow separate ownership of each duplex dwelling unit and each associated portion of the duplex lot. The proposed lot lines for the divided duplexes are consistent with the design criteria in that the lots are divided to create nearly as possible equal lot sizes and road frontages and has direct access to each unit and associated yard. Other development standards for Divided Duplexes are included as "Conditions of Approval" being required by Section 4.17.150 (d) of the Zoning Code. This generally includes provisions for separate utility and residential systems, fire wall between duplex living units and provisions for common maintenance of structures such as repairs and upkeep. Density - Remains unchanged, lot sizes are reduced in half. III. HISTORY /ANALYSIS Mission Ridge First Addition was originally approved by the Hearing Examiner Committee in June of 1978 for duplexes and R -2 zoning and the project was final platted in July of 1979. Division of duplexes have occurred on specific lots with Mission Ridge 1st Addition; Lots 5, 17, 18, 19 and 20 of Block 2 have been approved by Short Plat #s SP -84 -328 through 332. This request would replat Lots 7 through 13, Block 1 and Lots 3, 4 and 6 through 16, Block 2 all in Mission Ridge First Addition. IV. ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department staff. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws and the standard Conditions of Approval. County Planning Department has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determination of Non - Significance ( "DNS "). The "DNS" was circulated to 6 other agencies of jurisdiction and other agencies /departments affected by the future development for review and comment. The "DNS" comment period ends July 23, 1986 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners 400 feet of the proposal, by notice on a sign posted on the proposal site and by letter to the general mailing list. Hearing Examiner Committee may consider additional environmental related testimony and the "DNS" at the public hearing. - 15 - PLANNING REPORT, July 24, 1986 PE- 1529 -86, PORTION OF REPLAT OF MISSION RIDGE 1ST ADDITION V. LEAD AGENCY SUMMARY Division of existing duplexes within Mission Ridge First Addition has occurred in the past through the short plat process. The Planning Department envisions no problems with the approval of Divided Duplexes for the rest of the lots in this Subdivision as long as the approval is contingent to the development standards included as Condition of Approval. VI. CONDITIONS OF APPROVAL If approval is granted, the following conditions are recommended. COUNTY PLANNING DEPARTMENT 1. That the preliminary plat be given conditional approval for three (3) years to August 1, 1989. The applicant may request an Extension of Time by submitting a written request forty -five (45) days prior to the above expiration date. 2. That a current certificate of title be furnished the County Planning Department prior to filing the final plat. 3. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on -site improvements unless the applicant(s) /sponsor(s) choose to file a notarized Waiver of Notice of Action with the Spokane County Planning Department. 4. That the plat be designed as indicated on the preliminary plat of record and /or attached sheets as noted. 5. That the final plat dedication include: "No detached single - family dwellings or manufactured homes are allowed. That all tracts with any lot line designated Center Duplex Lot Line shall be restricted to one common wall dwelling unit (1/2 Duplex); provided, the duplex common wall is aligned over or with the Center Duplex Lot Line; and provided that each duplex unit (half) is totally on its side of said center lot line when said lot line is extended vertically beyond the roofline." 6. That the Final Plat map is to identify the duplex common wall lot line as: CENTER DUPLEX LOT LINE and the line is to be drafted as a continuous "dash- dot - dash." 7. That the plat dedication is to include: "No lot shall be further subdivided for the purpose of creating additional lots or building sites without first filing a replat." - 16 - PLANNING REPORT, JUIy 24, 1986 PE- 1529 -86, PORTION OF REPLAT OF MISSION RIDGE 1ST ADDITION VI. CONDITIONS OF APPROVAL (Cont'd) Planning Department (Cont'd) 8. That the final plat dedication include: "That the owners, heirs, or assigns of each dwelling unit of each duplex structure do hereby agree to retain the color, texture and type materials of the duplex exterior and further agree that any "change" to said exterior shall have the written mutual approval of both owners of each half of the duplex prior to initiating construction of any such "change" to the exterior. Any replacement or addition to all or part of the duplex structure shall also require mutual approval. This agreement shall run with each associated lot and shall be enforced through civil court and does exclude Spokane County from the terms and enforcement of said agreement." 9. That the final plat dedication include: "That the owners, heirs or assigns do hereby agree to equally share the responsibility and cost of maintaining and operating that portion of the septic tank and drainfield system that is jointly shared until each duplex unit (half) is separately connected to a public sewer system." 10. That the final plat dedication include: "That enforcement of the water and sewer systems agreement is a civil matter between each duplex unit owner(s) and not enforced by Spokane County." 11. That appropriate utility easements be indicated on copies of the approved preliminary plat, for distribution to the County Planning Department and the utility companies. Written approval of said utility easements by said utility companies must be received prior to the submittal of the final plat. 12. That a survey be required prior to the filing of a final plat with assurance that the "Center Duplex Lot Line" align with the existing common wall of the duplex structure. COUNTY HEALTH DISTRICT 1. Appropriate utility easements shall be indicated on copies of the preliminary plat of record for distribution by the Planning Department to the utility companies, Spokane County Engineer and the Spokane County Health District. Written approval of the easements by the utility companies shall be received prior to the submittal of the final plat. COUNTY UTILITIES DEPARTMENT 1. Pursuant to the Board of County Commissioners Resolution No.80 -0418, the use of on -site sewer disposal systems is hereby authorized. The dedication shall state: "The owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94 which the petition includes the Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 3. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. County Engineers Department has no new conditions at this time.
