FINDINGS OF FACT 1. The individual signing below has been properly delegated the responsibility for rendering this decision by the Spokane County Director of Planning. 2. The Spokane County has established specific criteria for considering the extension of time for the expiration of preliminary subdivisions, specifically for regular subdivisions, and department policy for short subdivisions. Such extensions of time may be up to and including 3 -year extensions. 3. A first extension of time for 1 year upon a finding of good faith effort having been made to finalize the subdivision is provided for in RCW 58.17.140. 4. The subject preliminary plat was approved by the Hearing Examiner Committee on October 23, 1986. 5. Planning Department policy is to establish crossover zoning to "Code" zones as a substitute for "Ordinance" zones. 6. The zoning upon final plat recording will change from Agricultural to Urban Residential -7. 7. The Comprehensive Plan designates this area of the preliminary plat as Urban, and the location is within/outside the Priority Sewer Service Area. ,The Comprehensive Plan designation remains the same/has changed since the original preliminary plat approval. 8. No additional conditions have been recommended by the various reviewing agencies and departments, including the County Engineer's Office, the Spokane County Health District, County Utilities and the Department of Building and Safety. 9. This is the fast request for a time extension. The total life of the preliminary plat has been approximately 3 years. 10. As set forth in Chapter III, Section G, of the Spokane County Subdivision Ordinance, the following is relevant. a) Approval of a preliminary subdivision shall automatically expire 3 years after the preliminary approval is granted unless a time extension is sought; the preliminary plat becomes null and void in the event there is no application for an extension of time. ■ b) Approval for an extension of time for up to 3 years is discretionary, providing that at least one of the following is found to apply. i) Some portion of the existing preliminary plat has been finalized since the last extension was granted and the remaining lots would form a unified development consistent with the original approval; ii) The preliminary plat shall remain consistent with the Comprehensive Plan insofar as density and other development provisions apply AND the sponsor has taken substantial steps toward finalizing the plat, including but not limited to those items set forth in the Spokane County Subdivision Ordinance, Chapter III, Section G, a through d; or iii) When the preliminary plat approval was granted, development was conditioned upon the extension of public services which are not yet available (this provision does not apply to public utilities extension which the project sponsor would normally fund). Extension of Time Findings for Page 2 REV 9/89 11. The following facts are relevant to the above criteria. a. There is no evidence of a survey connected with this preliminary approval. b. There is no evidence that public services have been obtained for properties in the preliminary plat. c. The applicants have stated their good faith intention to file a final plat but have been limited by personal and regional economic circumstances. 12. This extension of time is granted based upon minimal progress. Most serious reexamination of progress toward finalizing should be shown or future extensions will likely not be granted. CONCLUSION BASED UPON A REVIEW of (a) the criteria for approving an extension of time of the expiration date for a preliminary plat and (b) the above findings of fact, the following conclusions are made. 1. The preliminary plat approval should be extended for one (1) year, to November 1, 1990. 2. The applicant/owner should show substantially greater progress toward complying with Chapter III, Section G, of the Subdivision Ordinance before requesting an additional extension of time. 3. Unless appropriate progress consistent with Chapter III, Section G, of the Subdivision Ordinance is demonstrated, future extensions of time cannot be granted. DECISION BASED UPON THE ABOVE Findings of Fact and Conclusions, an extension of time request for application PE- 1531 -86 is hereby APPROVED until November 1, 1990. CONDITIONS OF APPROVAL 1. A consolidated set of applicable conditions of approval is attached. 2. That the proposal is to subdivide approximately 10 acres into 9 duplex and 21 single family lots. Proposed zone change is from Agricultural to Urban Residential -7 (UR -7). 2. That the proposal is located at the southwest corner of 4th Avenue and Progress Road in the Spokane Valley in Section 23, Township 25N, Range 44 E.W.M., Spokane County, Washington. 3. That some property owners were not adequately notified of the public hearing according to state and local regulations. 4. That the Committee has considered and evaluated the information and conditions contained in the Planning Report for this proposal. 5. That the Comprehensive Plan designates this area as URBAN and the proposal appears generally consistent with the density and use guidelines of this category. 6. That the Committee finds the proposal compatible with existing uses in the area. 7. That the owners of adjacent and nearby properties spoke generally against the proposal. Concerns of the public dealt with density, traffic increases, potential property devaluation, provision of adequate access. 8. That the sewer installation supports a higher density. 9. The concerns of safety and traffic should be resolved by providing sidewalks on Progress Road and a 4 -way stop sign at 4th Avenue and Progress. 9. That the provisions of the State Environmental Policy Act have been complied with. 10. NOTE: Pursuant to WAC 197 -11- 680(5), Notice is hereby given that in conjunction with final approval of the above reference matter that: a. The time limit for commencing SEPA appeal of the approval of the above referenced matter, as provided by county ordinance, is 30 calendar days from final execution of the above Findings and Order. b. The time frame for appealing any SEPA issues with respect to the approval of the above referenced matter is 30 days after the execution of the above Findings and Order. Written approval of said utility easements by said utility companies must be received with the submittal of the final plat. 10. That a plan for water facilities adequate for domestic service and fire protection be approved by the water supplier, fire protection district, Spokane County Building & Safety Department and County health authorities. The agencies will certify on the WATER PLAN, prior to the filing of the final plat or any phase of the preliminary plat that the plan is in conformance with their respective needs and regulations. The WATER PLAN and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved WATER PLAN. The time schedule will provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat sponsor shall also sign the WATER PLAN to confirm the contractual arrangements or agreements. The final plat dedication will contain the following statement: "The public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building & Safety Department, and water purveyor, will be installed within this plat, and the subdivider /sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 13. That no building permit will be issued for any lot within the Final Plat until certified by a Washington State licensed engineer "that the water system has been installed pursuant the approved WATER PLAN for the Final Plat ", signed and stamped by said engineer. The certification may be in the form of a letter but is preferred to be certified on a copy of the WATER PLAN as a schematic map showing the "As Built" water system. COUNTY ENGINEER DEPARTMENT 1. That conditional approval of the plat is given subject to dedication of Right -of -Way and approval of the road system as indicated in the preliminary plat of record. 2. That plans, profiles, and cross - sections as designed to County standards showing proposed street centerline and curb grades be submitted to the County Engineer for approval prior to construction and /or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. That drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for approval prior to construction and /or the filing of each final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer /surveyor, who shall furnish the County Engineer with "As Built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 5. No construction work is to be performed within the existing or proposed public right of way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 6. All construction within the existing or proposed public Right -of -Way is to be completed prior to filing each final plat or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "As Built" plans, and monumenting the street centerlines shall be filed with the County Engineer. 7. That appropriate provisions be made that the following described property be held in trust until the continuation of the streets be dedicated or deeded: A 1 -ft. strip at the ends or edges of all streets that terminate or border the final plat boundary. (Temporary cul de sacs are required when streets terminate at the plat boundaries.) 8. The applicant should be advised that individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the County road system." 9. Dedication of 10 ft. additional Right of Way along 4th Avenue; 5 ft. additional Right of Way along Progress Road. 10. Existing County roads providing direct access to the plat shall be paved and curbed to Spokane County standards. 11. That all public roads within the plat be designed and constructed to Spokane County standards. 12. The County Engineer has designated Typical Roadway Section Number 2 Access Street standard for the improvement of interior streets which is to be constructed within the proposed development. This will require the installation of 36 ft. of asphalt and curb. The County Engineer has designated Typical Roadway Section Number 2 Access Street standard for the improvements of Progress Road which is adjacent to the proposed development. This will require the addition of approximately 8 to 10 ft. of asphalt sidewalk and curb along the frontage of the development. The County Engineer has designated Typical Roadway Section Number 2 Collector Street standard for the improvement of 4th Avenue which is adjacent to the proposed development. This will require the addition of approximately 10 to 12 ft. of asphalt, curb and sidewalk along the frontage of the development. 14. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended, which establishes regulations for roads, approaches, drainage, and fees in new construction. 15. The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing County Road System warrants the dedication of additional right -of -way and the roadway improvements herein specified. 16. That the applicant install a four -way stop at Progress and 4th Avenue unless such requirement by the Board of County Commissioners. COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. A statement shall be placed in the dedication to the effect that: "A public sewer system will be made available for the plat; individual service will be provided to each mentioned lot prior to sale. Use of individual on -site sewage system shall not be authorized." 3. Water service shall be coordinated through the Director of Utilities, Spokane County. 4. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social & Health Services. 5. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. The dedicatory language on the plat shall state: "Use of private wells and water systems is prohibited." 6. Prior to filing any phase of the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that the residences located on Lot 6 of Block 1 and Lots 10 and 12 of Block 2 connected to sewer and on -site sewage systems have been abandoned in accordance with Spokane County Health District regulations. ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department staff. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws and the standard Conditions of Approval. The "DNS" comment period ends September 17, 1986 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners 400 feet of the proposal, by notice on a sign posted on the proposal site and by letter to the general mailing list. Hearing Examiner Committee may consider additional environmental related testimony and the "DNS" at the public hearing. V. LEAD AGENCY SUMMARY The proposed subdivision appears consistent with adjoining land uses and the Urban Comprehensive Plan category. The Planning Department recommends approval unless unresolved issues are identified at the public hearing. VI.
