COMMERCIAL: DIVERSIFIED PLANNING AND DEVELOPMENT CONSULTANTS
WHEREAS, The Spokane County Zoning Hearing Examiner Committee did,
after public hearing on March 6, 1980, forward to the Board of County Commissioners
a recommendation that the Zoning Map be changed from the existing Agricultural
classification to the Commercial classification on property described as follows:
Block 21, Hillview Estates, Section 27, Township 25 N.,
Range 44, E.W.M., Spokane County, Washington.
and,
WHEREAS, The Board conducted its own public hearing on April 21, 1980,
at the request of Arthur Hess II, East 12409 Skyview Avenue, Spokane, WA 99216,
to present evidence and testimony in favor of this application, and
WHEREAS, The Board did consider the recommendation of the Zoning
Hearing Examiner Committee and testimony and evidence of the applicant and other
interested parties, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above - described Zoning Map proposal, and the Board of County
Commissioners of Spokane County having fully considered the testimony given, the
records and minutes of the Zoning Hearing Examiner Committee and all other
evidence presented and having personally acquainted themselves with the site and
vicinity in question, does hereby find that the Hearing Examiner Committee's
decision to approve this file is upheld, and File ZE -3 -80 is approved, subject to
the following conditions:
1) That the developers of the proposed shopping center use all grass
percolation areas possible instead of dry wells.
2) That Phase II of the development will require review by the Hearing
protection and distribution of such water shall be required for this
project. A water plan is required to be submitted for approval prior
to any land development.
4) Access permits and improvements to SR 27 must be approved by the
Washington State Department of Transportation.
5) Applicant shall construct cement concrete curb, sidewalk and pave to
existing pavement on 32nd Avenue and Clinton Street. Also pave a
minimum of 30 feet wide on unpaved section of Clinton Street.

the issuance of building permits for the project.
7)
A detailed combined on -site sewage system and surface water disposal
plan for the entire project shall be approved by the Spokane County
Engineer and the Spokane County Health District prior to the issuance
of any building permit.
8)
The design, location and arrangement of parking stalls shall be in
accordance with standard traffic engineering practices. Any portion of
the project which is to be occupied or traveled by vehicles shall be
maintained in hard surface paving.
9)
Applicant shall construct cement concrete sidewalk on Skyview Avenue.
10)
That an additional access point be established on 32nd Avenue approxi-
mately 100 feet east of Clinton Street.
11)
Purveyor is Washington Water Power, and they will supply the site with
adequate water for domestic, fire and irrigation uses.
12)
Water service shall be from Washington Water Power Company only.
13)
Sanitary plumbing shall be installed to facilitate connection to an
area -wide sewerage system.
14)
The owner, his heirs and assigns shall agree to participate in and not
protest assessments for any local improvement district for sewering
to serve this property.
15)
Connection to area -wide sewer collection system shall be made when the
system becomes available.
16)
Obtain approval of the Director of Utilities of Spokane County and the
Department of Ecology for the sewage treatment and disposal plan prior
to the issuance of any building permits.
17) That the provisions of SEPA's Notice of Action pursuant to 43.21C.080
RCW be initiated by the applicant within thirty (30) days of final
action of the responsible administrative body and be completed before
any site improvements are made.
18) Approval by the Zoning Administrator of a specific lighting and
signing plan for the described property prior to the release of any

A specific landscape plan, planting schedule and provisions for main-
tenance acceptable to the Spokane County Zoning Administrator shall
be submitted with a performance bond for the project prior to release
of building permits.
20)
The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee. Minor .
variations when approved by the Zoning Administrator will be permitted,
including, but not limited to the following changes: building location,
landscape plans, and general allowable uses of the permitted zone.
All variations must conform to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the development plans
shall be maintained.
21)
Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
22)
The signage shall comply with the regulations set forth in the Local
Business Zone.
23)
That sewage generated from the zone change area (Lot 1, Block 21,
Hillview Estates) both for initial and future uses be limited to
8,500 gallons per day or that the sewage generated from Blocks 20 and
21 of Hillview Estates be limited to a total of 16,060 gallons per day.
24)
That parking be allowed over a portion of the drainfield easement in
Block 21, Hillview Estates only under conditions stated in the letter
dated February 28, 1980, from the County Utilities Department to
Diversified Planning and Development Consultants.
25)
That landscaping or other physical boundary be placed at the edge of
the drainfield easement to prevent unrestricted travel from the com-
mercial area onto the drainfield easement area.
26)
That each building, at the time of permit application, be allocated
a portion of the 8,500 gallons per day limit. At such time as the
total 8,500 gallons per day has been allocated, no additional
buildings will be permitted.
27)
That an equivalent size leach bed be designed and constructed away
from the parking area by the developer and be subject to the approval
of the regulatory agencies and acceptance of construction by Spokane

bed. Installation and maintenance of the grass pavers and parking
area would be at the expense of the developer.
28) That inspection ports, distribution box lids and cleanouts for the
existing system be brought to grade such that Spokane County can
continue to utilize the existing leach bed after grass pavers have
been installed.
29) That detailed construction plans and specifications for any work
proposed to be done on the existing drainfield easement be approved
by the County Utilities Department and other jurisdictional agencies
prior to the beginning of any construction.
30) That any liability involved with the proposed use over the existing
leach bed area be that of the developer.
31) The design plans and specifications for a replacement leach bed would
be the responsibility of the developer as'well as obtaining construction
approvals from all jurisdictional agencies prior to Spokane County
allowing grass paver installation.
32) That construction security be provided.
33) That the replacement leach bed be constructed when directed by the
County regardless of the reasons for the existing leach beds failure.

FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on March 7, 1980,
(continued from March 6 Hearing ) and the members of the Committee present
being Jane Myers, Acting Chairman, Ted McCoury and Paul Sceva, Jr. and
having personally visited the site.
B. PROPOSAL
The sponsor, Diversified Planning & Development Consultants, is requesting
approval of a zone reclassification, ZE -3 -80, Agricultural to Commercial, for the
purpose of developing a shopping center.
C. FINDINGS OF FACT
1. That the existing' land use in the area is residential, cultivated and undevel-
oped.
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
S. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
7. That the applicant has demonstrated that conditions have substantially
changed since the original zoning of this area and accordingly, the pro-
posed rezone is justified.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed both approval and disapproval
of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
11. The following are additional findings of fact considered by the Hearing
Examiner Committee:
a) That the developers of the proposed shopping center use all grass
percolation areas possible instead of dry wells.

for approval prior to any land development.
b) COUNTY ENGINEER

The development plan indicates this site to be constructed in two phases.
The first phase consists of 80,408 sq. ft. and the second phase consists of
90,408 sq. ft. The applicant has indicated that some of the parking will
utilize grass pavers.
The Spokane County Health District has commented that this project lies
over the Spokane Aquifer; is within Critical Water Supply Service Area #3
and service area of Washington Water Power Company. Soils are suitable
for use of on -site sewage disposal systems. It lies within the 208 Study
recommended Primary Sanitary Sewer Area. Disposal of sewage effluent
beneath paved surfaces may be prohibited. Sewage disposal for this
project will require approval of the State Department of Ecology and
Director of Utilities of Spokane County.
