Your questions concerned several of the conditions of the approval for this zone change. These questions can be grouped into the following three categories: (1) You requested that we vacate rights -of -way south of 24th Avenue which were acquired in deed number 7307020016. (2) You requested certain information concerning the 100 year flood elevation. (3) You asked for a clarification as to the improvements necessary for 24th Avenue. The following is intended to answer your questions concerning the three items listed above. (1) The right -of -way you requested to be vacated was acquired in order to realign the 24th Avenue railroad crossing. This is still necessary when and if there should be any major development on the west side of the railroad tracks. Therefore, we have decided to continue our ownership of this right -of -way. (2) The 100 year flood elevation for the site in question has been established as elevation 2002. You indicated that your site plan intended to have the lowest habit- able floor elevated to or above elevation 2002. If this was done your project would be in compliance with the Federal Insurance Program. (3) Your client could sign an RID agreement to satis the construction require- ments for 24th Avenue. However, it would be necessary for your client to construct a driveway approach north from your property line to 24th Avenue, and then east to the Dishman Mica Road in the 24th Avenue right -of -way. We assume that this approach would be paved as your parking lot is also paved. It would be necessary for your client to submit some type of plan of this driveway construction to insure that the finished driveway would not interfere with any future construction which might occur in the 24th Avenue alignment. We have no problem with this, so we are asking your staff to proceed on a vacation of the excess J �-- -:> rights-of-way acquired in deed 17307020016. (See attached Exhibit B & C of deed and map). As a matter of review, I am submitting a letter from your file dated 11/22/76 which substantially explains the potential of establishing 24th Avenue as a public road. Since a major P.U.D. has been withdrawn and a subsequent use implemented together with the formal establishment of a flood plain on the P.U.D. site, it is unlikely that you will be obtaining any other assistance in building 24th Avenue. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and particpating in a County Road Project (CRP) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. This applies to improvements designated for Dishman -Mica Road. 10. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 11. Structures constructed within the proposed project shall adhere to a 35 ft. setback from the property line after the right -of -way dedication as herein specified. This is to facilitate future right - of -way aquisition should the right -of -way be needed for the upgrading of the Dishman -Mica Road. 75, That the alignment of 24th Avenue as depicted on the proposed site plan is not consistent with the existing alignment of 24th Avenue and the existing railroad crossing. The applicant will be required to improve 24th Avenue in the present alignment and construct an access drive to the proposed Zone Change. This access shall be constructed from 24th Avenue to the proposal. E. 9100 - 27th Avenue, Spokane, Wa. 99206 Subject: Establishment of 24th Ave. Dear Sir: Some time ago you and the other property owners who use 24th Avenue vest of the Dishma:. -Mica Road as access to your properties requested that Spokane County establish, construct, and take over for maintenance that section of 24th Avenue. You have been most patient in awaiting an answer to your request but I believe it is time that you had a more complete explanation of the situation as it exists for establishment' of the road. The principle difficulty of establishing this road concerns the grade crossing of 24th Avenue with the Union Pacific Railroad. The present crossing is private and in order for 24th Avenue to become a County road. a public crossing would have to be established. This involves a petition by the County to the 'Washington State Utilities and Transportation Commission asking that a new public crossing be created at this location. If the Railroad Company dose not concur in the action a public hearing on the matter is required. At this hearing it is neceseary to establish the public need for such crossing. With the mall amount of present public use it is questionable that the Commission would order the opening of the new public crossing. In any event, even if they do not oppose a new public crossing, the Railroad Company would ask that the Commission require that the new crossing be constructed at the total expense of the petitioner, that is Spokane County. The Railroad Company has already indicated that they would also ask that the crossing be protected by automatic signals and gates. The current estimate of costa for such an inOtallation is approximately $60,000.00. Spokane County has numerous public railroad crossings now in existence that are unsignalised and so is in no position to be paying such a cost for a new crossing. I would not suppose that the property owners requesting the road to be opened and established would be able to bear any significant portion of the total cost of the railroad crossing improvements required. It would not appear with the current situation that the road is likely to be established as a County road soon. Alr. Jaale6 u. E. 97W - 27th Avenue, Spokane, 'da. 99206 Subject: Establiehnent of 24th Avenue I am sure that you are aware that there was a development proposal presented to the ypokane County }'lanning Commission sometime ago, which contemplated the use of 24th Avenue as its principle access. One of the conditions attached to the approval of that propusal was that-the developer be responsible for the cost of opening and improving the railroad crossing on 24th Avenue. At the time this development proposal was reviewed, a change in alignment of 24th Avenue was proposed to improve the road and the crossing. The necessary right of way for this change in road alignment has been secured but, of course, the improvements have not been made, as the development proposal has never been implemented. Although we do not have any current assurance that this development proposal will proceed, it still would appear that this is the best possibility for having 24th Avenue, and its grade crossing improved and eet"lished as a County Road. I hope that this gives you an understanding of the situation, but if you find that you do have further questions, I would suggest that you contact (buy Kennaly our Planning and Traffic Engineer. However, we now know that the ground elevation in question is beyond the 100 year flood plain and that existing ground elevations are approximately 2001 elevation at the lowest area of our approved site plan. As I mentioned to you the other day, simple guidelines for developing within a designated flood zone are not available. In my review of the regulations and discus- sions with staff, it became apparent that only a few and very general "guidelines" are common between different proposals. I suppose this is because of the highly technical engineering analysis which is required to determine the theoretical flood plain eleva- tion which would result if a proposal is constructed and a flood actually occurs. Typically, specific project criteria become the controlling factors in the analysis and a proposal which may appear appropriate at one site may totally fail with the different hydraulic conditions found at another site. The common items needed to determine if a proposal is physically feasible which have been identified to date are: 1. A topography map of the site showing existing ground elevations and the existing designated flood plain area. 2. A backwater hydraulic profile of the existing backwater area using existing ground elevations. (This was just completed by the County for Plouf Creek.) 3. A topography map of the site showing the proposed ground elevations. 4. A new backwater hydraulic profile using the ground elevations from the proposed plan. After the above engineering information has been reviewed, these general guide- lines are used to determine if the proposal is consistent with the regulations and can be approved. 1. The proposal does not result in diverting water into areas not previously flooded. 2. The proposal does not result in injecting flood waters into the aquifer. 3. 'COMPREHENSIVE PLAN - The property is located within the Urban Category. The Semi -Rural Category is adjacent to the west, with Railroad right of way being the boundary. Therefore, the site is located within a transitional area. The transition of land uses from Urban to Semi -Rural could be handled by use transition through zoning or through spatial separation of uses through use of clustering and integration of open areas within the specific site plan. The Comprehensive Plan Decision Guideline 1.4.1 addresses "Develop- ment shall not occur on lands identified as being a 100 year flood plain, unless the developer constructs mechanisms: accepted by the financing institution and by the County Engineer as capable of pro- tecting life and property from flood damage; and which do not increase or change water flows which may damage other property." If approved, conditions are included to meet this goal. Transition areas within the Comprehensive Plan are delicate areas as several factors should be considered. One of the most important considera- tions would be, does existing land use and zoning indicate what type of transition should be required? Because of lack of development west of Dishman -Mica Road in this vicinity any number of transitional uses and development concepts could be used to provide compatibility with future Semi -Rural land uses and fit the general guidelines of the Urban category. 0 ZONE RECLASSIFICATION NUMBER: ZE -37 -82 III. BACKGROUND /ANALYSIS (continued) B. SITE CONSIDERATIONS - The site is provided access by Dishman- Mica Road which is a major arterial and west of that is a railroad track. The site is long and slender and has flooding problems as mentioned before. The site does not lend itself toward residential development but does seem to lend itself to office type uses. However, at this time no Commercial, Local Business or Residential Office zoning exists on the Dishman -Mica Road between 7th Avenue and 32nd Avenue. C. HISTORY OF OTHER LAND USE ACTIONS . - The immediate area has had no recent zone change. The property west of Dishman -Mica Road has remained undeveloped, largely because of access, flood, and land use debate. The most recent zone changes west of Dishman -Mica Road are located approximately 1/2 mile north to Residential Manufactured Home, Single Family Residential, Two - Family Residential and Multiple, Family Suburban zoning in the late 1 70's. D. CONCLUSION - The rezoning of this parcel at this time appears premature. Currently the vicinity is surrounded by Agricultural zoning, and most of the property to the west is undeveloped and used for large lot residential. The Comprehensive Plan does not provide any specific decision guidelines that give direction to decision makers on rezones of this type. If approved, a more specific plan should be submitted detailing building elevations, light- ing, signing, and landscaping plans. IV. AGENCIES RECOMMENDED CONDITIONS, IF APPROVED a) COUNTY PLANNING DEPARTMENT 1. All current standards of the Residential Office Zone, as amended, shall be complied with in the development of this site. 2. The applicant shall develop subject property generally in accord- ance within the, concept presented to the Hearing Examiner Com- mittee. Variations when approved by the Zoning Administrator will be permitted, including, but not limited to the following changes: Building location, landscape plans, and general allowable uses of the permitted zone. All variations must conform to regulations set forth in the Spokane County Zoning Ordinance. The original intent of the development plans shall be maintained. 3. That a specific development plan shall be submitted for Planning Department review and approval. 4. Specific plans for landscaping and maintenance, lighting and signing shall be required prior to building permit release. 11 ZONE RECLASSIFICATION NUMBER: ZE- 37 -82' a) COUNTY PLANNING DEPARTMENT (continued) Applicant shall comply with 1 208' recommendations concerning stormwater runoff and provide necessary landscaping for runoff. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer prior to the issuance of a building permit on the property. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road Project (CRe) to the extent of the required road improvement. Spokane County will not participate in the cost of these improvements. Applies to Dishman- Mica Road. 11. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 12. All- required improvements shall conform to the current State of Washington Standard Specifications for Road and Bridge Construc- tion, and other applicable county standards and /or adopted reso- lutions pertaining to Road Standards and Stormwater Management in effect at the date of construction, unless otherwise approved by the County Engineer. 13. Applicant shall construct a paved and delineated access approach(s) to meet the existing pavement on Dishman -Mica Road. 14. Roadway standards, typical roadway sections and drainage plan requirements are found in Spokane Board of County Commissioners Resolution No. 80 -1592 as amended. 15. That the regulations of the National Flood Insurance Program be observed since the proposed zone change is affected by a Flood Hazard Zone. 16. Structures constructed within the proposed project shall adhere to a 35 foot setback from the property line after the right of way dedication as herein specified. This is to facilitate future right of way acquisition should it be needed when the Dishman -Mica Road is upgraded. 1.9 ZONE RECLASSIFICATION NUMBER: ZE- 37 -82' C) COUNTY UTILITIES DEPARTMENT 1. Pursuant to Board of County Commissioners Resolution No. 80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by the Health District. 2. The owner, his heirs or successors shall join and participate in any petition or resolution which purpose is the formation of a utility local improvement district (ULID) pursuant to RCW, Chapter 36.94, as amended.
