This setback applies with or without this replat. This zone also requires the dedication of R.O.W. and construction of sidewalks under the Road Standards. The sponsor's engineer indicates their primary concern is the increased setback which would occur if 5 feet of R.O.W. were dedicated. My response to the three points raised under the justification section is as follows: 1. The setback is required under the zoning ordinace regardless of wheth- er or not this is replatted. A variance from the zoning ordinance is required to relieve this setback, and this variance is obtained through the Zoning Adjustor. The Zoning Adjustor's decision is ap- pealable through the Board of Adjustment to the Courts. The Board of County Commissioners is not involved in this kind of appeal. This variance has not been applied for or granted. 2. R.O.W. dedication and sidewalk construction was not required on Lots 1 and 2 of Meadows End because the project site plan was originally approved prior to the adoption of the standards. ,One -half of the site plan (Lot 1) was built prior to the standards, and the remaining half was built in 1984. The R.O.W. dedication and sidewalks were not re- quired on the original site plan because it predates the standards. However, sidewalk presently exists on Mansfield (see attached map) in close proximity to this plat. 3. The Hearing Examiner Committee was not aware that the site plan they approved was not drawn in conformance with the Zoning Ordinance. This was not mentioned at the hearing. Recommendation: We could grant the deviation with the following conditions: 1. The applicant could grant an easement for the sidewalk, rather than the R.O.W. 2. Special Information: Circulation - A common private driveway and parking lot will provide access from the single access onto Houk Street. Design - The "platted" planned unit development is designed for separate ownerships of each attached single family dwelling (Townhouse). Density - The density is 17.5 lots per gross acre. The district will require a fire hydrant adjacent parking stall #1 and improved turning radius within the parking lot. Cultural Resources - None have been identified. III. BACKGROUND /ANALYSIS A. Land Use: - Staff finds the proposed addition of attached single family dwellings (townhouses) with individual lots are compatible with other adjacent multiple - family dwellings. B. Zoning: - Staff finds the requested zone reclassification from Agricultural and MFS to MFS and PUD to be compatible with the proposed uses and. existing adjacent land uses. C. Comprehensive Plan: - Staff finds the proposal meets the purpose and intent of "fill -in" development and for the Priority Sewer Service Area (PSSA),.and for the existing public services and facilities of the near vicinity. The existing MFS zoning preceded the adoption of the Commercial category. IV. ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and was reviewed by the Planning staff. The review considered the specifics of the proposal, other available information, County adopted plans and policies, County ordinances, other regulations and laws and the standard Conditions of Approval. County Planning Department has determined that "No probably significant adverse impacts" would result from the proposal being developed and has issued a Declaration of Non- Significance ( "DNS "). The "DNS" was circulated to other agencies of jurisdiction and other agencies /departments affected by the future development for review and comment. The "DNS" comment period ends November 29, 1984 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners 400 feet of the proposal, by notice on the 4ft. by 4ft. sign posted on the proposal site and by letter to the general mailing list. The hearing Examiner Committee may consider additional environmental related testimony and the "DNS" at the public hearing. - 46 - October 3, 1984 TEXT FOR HEATHER WOOD PLANNED UNIT DEVELOPMENT This request is for the preliminary approval of a preliminary replat of Lot 3 and 4, Block 2, of Meadows End Subdivision and a for a Final Planned Unit Development Plan. The southerly 30 feet of the proposal requires rezoning to the Multiple Family Suburban zone. This proposal consists of 28 attached single family structures (town houses) in 4 unit and 8 unit structures. The proposal is intended to be constructed in 1985 in one development phase. Features of the P.U.D. will include an internal private road, on -site and guest parking, fencing, landscaping, internal sidewalks, open space, play field, public water service, private community sewage system, and most of all the opportunity for affordable owner occupied housing. Each unit will be sold with the property underneath it and a small 5 to 6 foot area around it (see preliminary plat). The P.U.D. sites have been designed to accommodate affordable housing (the primary project amenity) with the necessary conveniences. Contemporary financing and marketing demands have induced the need for this type of development. The combination of a Planned Unit Development and Multiple Family Suburban zoning is the only instrument in Spokane County which affords this type of housing and density. A Homeowner's Association with by -laws and protective covenants will be developed to govern the operation of the P.U.D. LEAD AGENCY RECOMMENDATION The County Planning Department, in considering the above information and conclusions, and further considering that forthcoming public testimony would not identify unanticipated and unresolvable problems, does RECOMMEND APPROVAL of both the Preliminary Plat and the Final Development Plan. This recommendation of approval is, in part, based on the following recommended "conditions of approval ", and therefore staff additionally recommends that the following conditions be attached to the Hearing Examiner Committee approval, if approval is granted. VI. CONDITIONS OF APPROVAL If approval is granted, the following conditions are recommmended. COUNTY PLANNING DEPARTMENT CONDITIONS 1. That the plat and planned unit development be designed as indicated on the Preliminary Plat of Record Sheets 1 through 3,. the FINAL DEVELOPMENT PLAN, Sheets 2 & 3 of 3, the "Minimum Construction Schedule ", and /or attached sheets as noted. 2. The bond and bond amount or assurance will be approved by the County Subdivision Administrator and held by the County Planning Department until said landscape plan has been installed by the sponsor and approved by the County Planning Department. 8. That the Homeowners' Association document is required to be recorded with the County Auditor prior to the filing of a final plat and shall include the Operation and Maintenance of: the landscaping, sprinkler system, private road, sewer system, water system, surface drainage facilities and is to provide for funding of each to assure on -going maintenance. 9. That a Final Plat name be indicated before the final plat is filed; such name to be approved by the County Assessor and the Planning staff. 10. That appropriate utility easements be indicated on copies of the approved preliminary plat, for distribution to the County Planning Department and all applicable utility companies. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily' complete the approved water system. The plat sponsor shall also sign said WATER PLAN to conform the contractual arrangements or agreements. The final plat dedication will contain the following statement: "the public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building & Safety Department, and water purveyor, will be installed within this plat, and the subdivider /sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 12. That no building permit will be issued for any lot within the Final Plat until certified by a Washington State licensed engineer "that the water system has been installed pursuant the approved WATER PLAN for the FInal Plat ", signed and stamped by said engineer. The certification may be in the form of a letter but is preferred to be certified on a copy of said WATER PLAN as a schematic neap showing the "As Built" water plan. • 13. That a current certificate of title be furnished the County Planning Department prior to filing the final plat. 14.
