Mathis has been received and decided upon, pursuant to Spokane County Subdivision regulation (Chapter III, Section G) and RCW 58.17.140. FINDINGS OF FACT 1. The individual signing below has been properly delegated the responsibility for rendering this decision by the Spokane County Director of Planning. 2. The subject preliminary plat was approved by the Hearing Examiner Committee on February 21, 1985. 3. A first extension of time for 1 year upon a finding of good faith effort having been made to finalize the subdivision is provided for in RCW 58.17.140. The applicant/owner was in fact granted a two year extension of time based upon no progress in January of 1988. 4. Spokane County has established specific criteria for considering the extension of time for the expiration of preliminary subdivisions, specifically for regular subdivisions, and department policy for short subdivisions. These criteria are found in Chapter III, Section G of the Spokane County Subdivision Ordinance and have been used as a basis for this decision. 5. Additional conditions have been recommended by the County Engineer's Office. 6. This is the second request for a time extension. The total life of the preliminary plat has been approximately five years. 7. The following facts are also relevant. a. The applicant stated no progress was made toward finalizing when an extension was granted in 1988. b. The applicant stated in the present extension application that no progress has been made toward finalizing (February 1, 1990). c. The Planning Department extended by several weeks the time line for this decision in a cooperative effort to give the applicant additional time to show measurable progress toward finalizing and none was shown. BASED UPON A REVIEW of (a) the criteria for approving an extension of time of the expiration date for a preliminary plat and (b) the above Findings of Fact, the following conclusions are made. 1. However the review of the preliminary plat was done without the benefit of the Arterial Road Plan. E61 The County Arterial Road plan identifies Mission Avenue as a Minor Arterial. In order to implement the Arterial Road Plan it recommended that a strip property 10 ft^ in width along . the Mission Avenue frontage be set aside in reserve. That the proposal does comply with the purpose and intent of the Comprehensive Plan decision guidelines for "fill -in" development and compatible land uses. 5. That the owners of adjacent lands expressed both approval and disapproval of the alternate proposal while the original preliminary plat was generaly disfavored. 6. That the alternate proposal appears compatible with the general density of the area. 7. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within said final plat. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat sponsor shall also sign said WATER PLAN to conform the contractual arrangements or agreements. the final plat dedication will contain the following statement: "the public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building & Safety Department, and water purveyor, will be installed within this plat, and the subdivider /sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 9. That no building permit will be issued for any lot within the Final Plat until certified by a Washington State licensed engineer "that the water system has been installed pursuant the approved WATER PLAN for the Flnal Plat ", signed and stamped by said engineer. The certification may be in the form of a letter but is preferred to be certified on a copy of said WATER PLAN as a schematic map showing the "As Built" water plan. 10. That a current certificate of title be furnished the County Planning Department prior to filing the final plat. 11. That the following statement be placed in the final plat dedication: "no more than one dwelling structure be placed on any lot, nor shall any lot be further subdivided for the purpose of creating additional lots, ownerships, or building sites without first filing a replat." 12. Upon filing the Final Plat the zone change of the Final Plat area shall be finalized and the existing Agricultural zone classification shall be changed to R -1, except Lots 1 -5 is R -2 as shown on the "alternate" preliminary plat. 13. That the Board of County Commissioners will sign the final plat mylar document once the County Planning Department has verified compliance of all conditions of approval, signatures have been placed on said document, and said document found to be complete. That the zone reclassification shall be accomplished by Board of County Commissioner resolution, being the same resolution as the Final Plat Resolution. 15. That prior to filing the final plat all existing buildings must meet new lotline building setbacks of the new zone classification. Removal or relocation may be necessary. 16. Boundary Review Board approval may be required to amend the water district service boundary prior to filing the final plat. COUNTY ENGINEER DEPARTMENT CONDITIONS 17. Prior to finalization of the proposed plat, the applicant shall be successful in petitioning the Board of County Commissioners in the vacation of those rights -of -way within the plat of Sullivan Addition which will be needed for the finalization and development of Lots 1 through 7 of the preliminary plat. 18. That conditional approval of the plat is given subject to dedication of Right -of -Way and approval of the road system as indicated in the preliminary plat of record, as approved by the County Engineer. 19. That plans, profiles, and cross - sections as designed to County standards showing proposed street centerline and curb grades be submitted to the County Engineer for approval prior to construction and /or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 2U. That drainage plans and design calculations showing the alignment of drainage facilities be submitted to the County Engineer for approval prior to construction and /or the filing of each final plat. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer /surveyor, who shall furnish the County Engineer with "As Built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 22. No construction work is to be performed within the existing or proposed public right -of -way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. All construction within the existing or proposed public Right -of -Way is to be completed prior to filing each final plat or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "As Built" plans, and monumenting the street centerlines shall be filed with the County Engineer. 24. A statement must appear in the dedicatory language of the final plat: "that individual driveway access permits be required prior to issuance of a building permit for driveway approaches to the County road system. 25. Dedication of ten additional right -of -way along Evergreen Road as depicted. 26. That all public roads within the plat be designed and constructed to Spokane County standards. 27. That sidewalks are required along the arterial(s) on Mission Avenue and Evergreen Road. 28. Public Road Standard TYPICAL Roadway section (1) Section Number 2 for cul -de -sac Minimum Paving width Access standard. (2) Section Number 2 for Evergreen Road Minimum Paving width major arterial standard. (3) Section Number 3 for Mission Avenue Minimum Paving width Secondary arterial standard. 29. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 30. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended, which establishes regulations for roads, approaches, drainage, and fees in new construction. 31. The County Engineer has examined this development proposal and has determined that the impacts of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 32. A statement shall be placed in plat dedication that no direct access be allowed from Lots 5,6 or 16 to Evergreen Road. CONDITIONS OF APPROVAL BY HEARING EXAMINER, February 26, 1985 PE- 1481 -84 15TH AUDITION TO VERADALE HEIGHTS County Engineering Department (Cont'd) 33. To construct the road improvements stated herein, the applicant may, with the approval of the County Engineer, join in and be a willing participant in any petition or resolution which purposes is the formation of a Road Improvement District (RID) for said improvements pursuant to RCW 36.88, as amended. At such time as an RID is created or any Road Improvement Project is sanctioned by Spokane County, the Improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable for those improvements which have been specified for Evergreen Road. 34. As an alternative method of constructing the road improvement stated herein, the applicant may, with the approval of the County Engineer, accomplish the road improvements stated herein by joining and participating in a County Road project (CRP) to the extent of the required road improvement. At such time as a RID is created or any Road Improvement Project is sanctioned by Spokane County, the Improvements required (curb, sidewalk, drainage control and paving to existing pavement) will be at the sole expense of the undersigned owner, their heirs, grantees and assigns. This provision is applicable for those improvements which have been specified for Evergreen Road. 35. That the following statement be placed in the plat dedication: The owners, their heirs, grantees and assigns, agree to join in the formation of a County Road Improvement District pursuant to RCW 36.88 at such time as a Road Improvement District is created or any Road Improvement Project is sanctioned by Spokane County. The improvements required (curb, sidewalk, drainage control and paving) will be at the sole expense of the owner, their heirs, grantees and assigns. This statement applies to Evergreen Road. 36. That the applicant shall prepare for review and approval by the County Engineer a Driveway Access Plan for the duplex (R -2) lots which front on Mission Avenue. Driveways shall be designed so as to discourage vehicular backing movements onto Mission Avenue. COUNTY UTILITIES DEPARTMENT 37. Pursuant to the Board of County Commissioners Resolution No. 80 -0418, the use of on -site sewer disposal systems is hereby authorized. This authorization is conditioned on compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of permits by said Health District. CONDITIONS OF APPROVAL BY HEARING EXAMINER, February 26, 1985 PE- 1481 -84 15TH ADDITION TO VERADALE HEIGHTS County Utilities Department (Cont'd) 38. The dedication shall state "The Owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94 which the petition includes ithe Owner(s) property and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94. 39. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 40. The dedication shall state: "Each dwelling unit shall be double plumbed for connection to future area -wide collection systems." 41. A dry sewer connection to the future area -wide Sewerage System is to be constructed for lots 6 through 16. Plans and specifications for the dry sewer connection are to be reviewed and approved by the Utilities Department. COUNTY HEALTH DISTRICT 42.
