THIS MATTER, a request for an extension of time from James P. Mathis has been received and
decided upon, pursuant to Spokane County Subdivision regulation (Chapter III, Section G) and
RCW 58.17.140.
FINDINGS OF FACT
1. The individual signing below has been properly delegated the responsibility for rendering this
decision by the Spokane County Director of Planning.
2. The subject preliminary plat was approved by the Hearing Examiner Committee on February
21, 1985.
3. A first extension of time for 1 year upon a finding of good faith effort having been made to
finalize the subdivision is provided for in RCW 58.17.140. The applicant/owner was in fact
granted a two year extension of time based upon no progress in January of 1988.
4. Spokane County has established specific criteria for considering the extension of time for the
expiration of preliminary subdivisions, specifically for regular subdivisions, and department
policy for short subdivisions. These criteria are found in Chapter III, Section G of the
Spokane County Subdivision Ordinance and have been used as a basis for this decision.
5. Additional conditions have been recommended by the County Engineer's Office.
6. This is the second request for a time extension. The total life of the preliminary plat has been
approximately five years.
7. The following facts are also relevant.
a. The applicant stated no progress was made toward finalizing when an extension was
granted in 1988.
b. The applicant stated in the present extension application that no progress has been made
toward finalizing (February 1, 1990).
c. The Planning Department extended by several weeks the time line for this decision in a
cooperative effort to give the applicant additional time to show measurable progress
toward finalizing and none was shown.
BASED UPON A REVIEW of (a) the criteria for approving an extension of time of the expiration
date for a preliminary plat and (b) the above Findings of Fact, the following conclusions are made.
1. The application does not meet the criteria established for granting an extension.

We have reviewed the above referenced application. The
following comments pertain to Mission Avenue and Evergreen Road
which are arterial located adjacent to the proposed plat.
The original approval of the preliminary plat did take into
consideration the arterial designation of both of the roadways.
However the review of the preliminary plat was done without the
benefit of the Arterial Road Plan.
E61 The County Arterial Road plan identifies Mission Avenue as
a Minor Arterial. The existing right of way width of 6<>
ft. is not consistent with that specified in The Plan. In
order to implement the Arterial Road Plan it recommended
that a strip property 10 ft^ in width along . the Mission
Avenue frontage be set aside in reserve. This/ property may
be acquired by Spokane County at�the time Arterial
Improvements are made to Mission Avenue.
E61 The County Arterial Road plan identifies Evergreen Road as
a Principal Arterial. The existing right of way width of
50 ft. is not consistent with that specified in The Plan.
In order to implement the Arterial Road Plan it is
recommended that in addition to the required right of way
dedication, a strip of property 15 ft. in width along the
Evergreen Road frontage be set aside in reserve. This
property may be acquired by Spokane County at the time when
Arterial Improvements are made to Evergreen Road.

A. INTRODUCTION
This matter having come before the Spokane County Subdivision Hearing
Examiner Committee on January 31, 1985 and continued on February 21, 1985
and the members of the Committee present being Jane Myers, Chairperson,
Lynn Tennican and Rick Skalstad.
B. PROPOSAL
The sponsor, Jim Mathis is requesting approval of a preliminary plat of
PE- 1481 -84, 15Th ADDITION TO VERADALE HEIGHTS and Zone Change ZE- 127 -84,
from Agricultural to R -1ANU R -2, to divide 5.0 acres into 16 lots for
residential use. Further there being present, the following
representative:

C. FINDINGS OF FACT
1. That the original and an alternative preliminary plat and information
presented in the STAFF REPORT was considered.
2. That the Comprehensive Plan designates this area as URBAN.
3. That the site is within the Priority Sewer Service Area (PSSA)
boundary.
4. That the proposal does comply with the purpose and intent of the
Comprehensive Plan decision guidelines for "fill -in" development and
compatible land uses.
5. That the owners of adjacent lands expressed both approval and
disapproval of the alternate proposal while the original preliminary
plat was generaly disfavored.
6. That the alternate proposal appears compatible with the general
density of the area.
7. That the alternate proposal avoids the higher density of the original
proposal and lessens the internal traffic of the neighborhood.
8. That the provisions of RCW 43.21C (The State Environmental Policy
Act) have been complied with.
9. That the proper legal requirements for advertisement of Agenda Item
have been fulfilled.
1U. That the hearing Examiner Committee finds the alternate preliminary
plat proposal, as conditioned, is not detrimental to the general
purpose of the Comprehensive Plan or otherwise harmful to the public

FINDINGS & ORDER ENTERED ON FEBRUARY 26, 1985
COUNTY PLANNING DEPARTMENT
1 That the plat be designed as indicated on the preliminary plat of
record and /or attached sheets as noted.
2. That preliminary plat of record approval is for the property
described in the legal description, signed and stamped by the
sponsor's licensed land surveyor, attached to the application of this
proposal.
3. That the preliminary plat be given conditional approval for three (3)
years to February 1, 1988. The applicant may request an Extension of
Time by submitting a written request forty -five (45) days prior to
the above expiration date. Such applications should demonstrate the
progress made toward finalizing this preliminary plat. If an
Extension of Time is not requested in a timely manner or a Time
Extension is not granted, then the preliminary plat approval is NULL
& VOID.
4. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter
43.21C.U80 RCW be initiated by the project applicant within thirty
(30) days of final disposition of this application, and prior to any
on -site improvements unless the aplicant(s) /sponsor(s) chooses to
file a notarized Waiver of Notice of Action with the Spokane County
Planning Department.
5. That a Final Plat name be indicated before the final plat is filed;
such name to be approved by the County Assessor and the Planning
staff.
6. That appropriate road names be indicated and approved by the County
Subdivision Administrator.
7. That appropriate utility easements be indicated on copies of the
approved preliminary plat, for distribution to the Planning
Department and the utility companies. Written approval of the
easements by the utility company must be received prior to the
submittal of the final plat.
8. That a plan for water facilities adequate for fire protection be
approved by the water supplier, fire protection district and Spokane
County Building & Safety Department (Fire Marshal). Said WATER PLAN
must also have been approved by the appropriate health authorities.
The Health authorities, water supplier (purveyor), fire protection
district, and County Building & Safety Department (Fire Marshal) will
certify with signature on said WATER PLAN, prior to the filing of the
final plat or final plat of each phase of the preliminary plat. Said
certification shall indicate that said plan is in conformance with
their respective needs and regulations. Said WATER PLAN and
certification will be drafted on a transparency suitable for
reproduction.

The purveyor will also certify that appropriate contractual
arrangements or agreements have been made with the plat sponsor for
construction of the water system in said final plat, in accordance
with the approved WATER PLAN and in accordance with a time schedule.
The time schedule will provide, in any case, for completion of the
water system and inspection by the appropriate health authorities
prior to application for building permits within said final plat.
The arrangements or agreements will include a provision holding
Spokane County and the purveyor harmless from claims by any lot
purchaser refused a building permit due to the failure of the plat
sponsor to satisfactorily complete the approved water system.
The plat sponsor shall also sign said WATER PLAN to conform the
contractual arrangements or agreements.
the final plat dedication will contain the following statement: "the
public water system, pursuant the WATER PLAN approved by County and
State Health authorities, the local fire district, County Building &
Safety Department, and water purveyor, will be installed within this
plat, and the subdivider /sponsor will provide for individual domestic
water service as well as fire protection to each lot prior to sale of
each lot and prior to issuance of a building permit for each lot."
9. That no building permit will be issued for any lot within the Final
Plat until certified by a Washington State licensed engineer "that
the water system has been installed pursuant the approved WATER PLAN
for the Flnal Plat ", signed and stamped by said engineer. The
certification may be in the form of a letter but is preferred to be
certified on a copy of said WATER PLAN as a schematic map showing the
"As Built" water plan.
10. That a current certificate of title be furnished the County Planning
Department prior to filing the final plat.
11. That the following statement be placed in the final plat dedication:
"no more than one dwelling structure be placed on any lot, nor shall
any lot be further subdivided for the purpose of creating additional
lots, ownerships, or building sites without first filing a replat."
12. Upon filing the Final Plat the zone change of the Final Plat area
shall be finalized and the existing Agricultural zone classification
shall be changed to R -1, except Lots 1 -5 is R -2 as shown on the
"alternate" preliminary plat.
13. That the Board of County Commissioners will sign the final plat mylar
document once the County Planning Department has verified compliance
of all conditions of approval, signatures have been placed on said
document, and said document found to be complete.

14. That the zone reclassification shall be accomplished by Board of
County Commissioner resolution, being the same resolution as the
Final Plat Resolution.
15. That prior to filing the final plat all existing buildings must meet
new lotline building setbacks of the new zone classification.
Removal or relocation may be necessary.
16. Boundary Review Board approval may be required to amend the water
district service boundary prior to filing the final plat.
COUNTY ENGINEER DEPARTMENT CONDITIONS
17. Prior to finalization of the proposed plat, the applicant shall be
successful in petitioning the Board of County Commissioners in the
vacation of those rights -of -way within the plat of Sullivan Addition
which will be needed for the finalization and development of Lots 1
through 7 of the preliminary plat.
18. That conditional approval of the plat is given subject to dedication
of Right -of -Way and approval of the road system as indicated in the
preliminary plat of record, as approved by the County Engineer.
19. That plans, profiles, and cross - sections as designed to County
standards showing proposed street centerline and curb grades be
submitted to the County Engineer for approval prior to construction
and /or the filing of each final plat; road plans to be prepared under
the direction of a licensed Professional Civil Engineer.
2U. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval
prior to construction and /or the filing of each final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
21. Construction within the proposed public streets and easements shall
be performed under the direct supervision of a licensed
engineer /surveyor, who shall furnish the County Engineer with "As
Built" plans and a certificate in writing that all improvements were
installed to the lines and grades shown on the approved construction
plans and that all disturbed monuments have been replaced.
22. No construction work is to be performed within the existing or
proposed public right -of -way until a permit has been issued by the
County Engineer. All work is subject to inspection and approval by
the County Engineer.

23. All construction within the existing or proposed public Right -of -Way
is to be completed prior to filing each final plat or a bond in the
amount estimated by the County Engineer to cover the cost of
construction of improvements, construction certification, "As Built"
plans, and monumenting the street centerlines shall be filed with the
County Engineer.
24. A statement must appear in the dedicatory language of the final plat:
"that individual driveway access permits be required prior to
issuance of a building permit for driveway approaches to the County
road system.
25. Dedication of ten additional right -of -way along Evergreen Road as
depicted.
26. That all public roads within the plat be designed and constructed to
Spokane County standards.
27. That sidewalks are required along the arterial(s) on Mission Avenue
and Evergreen Road.

(1) Section Number 2 for cul -de -sac Minimum Paving width Access
standard.
(2) Section Number 2 for Evergreen Road Minimum Paving width major
arterial standard.
(3) Section Number 3 for Mission Avenue Minimum Paving width

29. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns and successors.
30. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80 -1592, as
amended, which establishes regulations for roads, approaches,
drainage, and fees in new construction.
31. The County Engineer has examined this development proposal and has
determined that the impacts of this proposal upon the existing County
Road System warrants the roadway improvements herein specified.
32. A statement shall be placed in plat dedication that no direct access
be allowed from Lots 5,6 or 16 to Evergreen Road.

33. To construct the road improvements stated herein, the applicant may,
with the approval of the County Engineer, join in and be a willing
participant in any petition or resolution which purposes is the
formation of a Road Improvement District (RID) for said improvements
pursuant to RCW 36.88, as amended. At such time as an RID is created
or any Road Improvement Project is sanctioned by Spokane County, the
Improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is
applicable for those improvements which have been specified for
Evergreen Road.
34. As an alternative method of constructing the road improvement stated
herein, the applicant may, with the approval of the County Engineer,
accomplish the road improvements stated herein by joining and
participating in a County Road project (CRP) to the extent of the
required road improvement. At such time as a RID is created or any
Road Improvement Project is sanctioned by Spokane County, the
Improvements required (curb, sidewalk, drainage control and paving to
existing pavement) will be at the sole expense of the undersigned
owner, their heirs, grantees and assigns. This provision is
applicable for those improvements which have been specified for
Evergreen Road.
35. That the following statement be placed in the plat dedication: The
owners, their heirs, grantees and assigns, agree to join in the
formation of a County Road Improvement District pursuant to RCW 36.88
at such time as a Road Improvement District is created or any Road
Improvement Project is sanctioned by Spokane County. The
improvements required (curb, sidewalk, drainage control and paving)
will be at the sole expense of the owner, their heirs, grantees and
assigns. This statement applies to Evergreen Road.
36. That the applicant shall prepare for review and approval by the
County Engineer a Driveway Access Plan for the duplex (R -2) lots
which front on Mission Avenue. Driveways shall be designed so as to
discourage vehicular backing movements onto Mission Avenue.
COUNTY UTILITIES DEPARTMENT
37. Pursuant to the Board of County Commissioners Resolution No. 80 -0418,
the use of on -site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to specific application approval and issuance
of permits by said Health District.

38. The dedication shall state "The Owner(s) or Successor(s) in interest

This matter having come before the Spokane County Subdivision Hearing
Examiner Committee on January 31, 1985 and the members of the Committee
present being Jane Myers, Chairperson, Lynn Tennican and Richard Skalstad.

A review of the above - referenced plat has been completed. As indicated in the
staff analysis of January 31, 1985, Evergreen Road is designated as a Major Arterial.
Because of this designation, the County Engineer has requested the dedication of
additional road right -of -way in order to mitigate the traffic impacts of the develop-
ment and facilitate the improvement of the roadway.
The revised preliminary plat does not propose lots which front Evergreen Road nor
is there direct access from the .lots to Evergreen. This design concept eliminates
the need for immediate improvements to Evergreen, while the lack of direct access
protects the integrity of this Major Arterial. The revised plan does, however, pro-
vide for roadway access to Evergreen whereas the previous design depicted Roadway
Access to Bolivar Road and Sinto Avenue. It is anticipated that the 11 lots which
access Evergreen from the cul -de -sac street would, at total development, genera 90
to 110 Average Weekday Vehicle Trip Ends. This amounts to an increase in traffic
volumes of less than one -half of one percent on Evergreen Road.
In addition to those conditions of approval specified in the staff analysis of
1- 31 -85, we are requesting that the conditions listed on the attached sheet be re-
quired should the proposal be approved.

authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further

of permits by said Health District.

The final plat dedication will contain the following statement: "the
public water system, pursuant the WATER PLAN approved by County and
State Health authorities, the local fire district, County Building &
Safety Department, and water purveyor, will be installed within this
plat, and the subdivider /sponsor will provide for individual domestic
water service as well as fire protection to each lot prior to sale of
each lot and prior to issuance of a building permit for each lot."
9. That no building permit will be issued for any lot within the Final
Plat until certified by a Washington State licensed engineer "that
the water system has been installed pursuant the approved WATER PLAN
for the FInal Plat ", signed and stamped by said engineer. The
certification may be in the form of a letter but is preferred to be
certified on a copy of said WATER PLAN as a schematic map showing the
"As Built" water plan.
10. That a current certificate of title be furnished the County Planning

43.21C.080 RCW be initiated by the project applicant within thirty
(30) days of final disposition of this application, and prior to any
on -site improvements unless the aplicant(s) /sponsor(s) chooses to
file a notarized Waiver of Notice of Action with the Spokane County
Planning Department.
5. That a Final Plat name be indicated before the final plat is filed;
such name to be approved by the County Assessor and the Planning
staff.
6. That appropriate road names be indicated and approved by the County
Subdivision Administrator.
7. That appropriate utility easements be indicated on copies of the
approved preliminary plat, for distribution to the Planning
Department and the utility companies. Written approval of the
easements by the utility company must be received prior to the
submittal of the'final plat.
8. That a plan for water facilities adequate for fire protection be
approved by the water supplier, fire protection district and Spokane
County Building & Safety Department (Fire Marshal). Said WATER PLAN
must also have been approved by the appropriate health authorities.
The health authorities, water supplier (purveyor), fire protection
district, and County Building & Safety Department (Fire Marshal) will
certify with signature on said WATER PLAN, prior to the filing of the
final plat or final plat of each phase of the preliminary plat. Said
certification shall indicate that said plan is in conformance with
their respective needs and regulations. Said WATER PLAN and
certification will be drafted on a transparency suitable for
reproduction.
The purveyor will also certify that appropriate contractual
arrangements or agreements have been made with the plat sponsor for
construction of the water system in said final plat, in accordance
with the approved WATER PLAN and in accordance with a time schedule.
The time schedule will provide, in any case, for completion of the
water system and inspection by the appropriate health authorities
prior to application for building permits within said final plat.
The arrangements or agreements will include a provision holding
Spokane County and the purveyor harmless from claims by any lot
purchaser refused a building permit due to the failure of the plat
sponsor to satisfactorily complete the approved water system.
The plat sponsor shall also sign said WATER PLAN to conform the
contractual arrangements or agreements.

IV. ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and was reviewed
by the County Planning Department staff. The review considered the
specifics of the proposal, other available information, County ordinances,
other regulations and laws and the standard Conditions of Approval.
County Planning Department has determined that "No probable significant
adverse impacts" would result from the proposal being developed and has
issued a Determination of Non - Significance ( "DNS ").
The "DNS" was circulated to other agencies of jurisdiction and other
agencies /departments affected by the future development for review and
comment. The "DNS" comment period ends Janauary 31, 1985 and was
advertised 15 calendar days before said date in the newspaper, by letter
to adjacent property owners 400 feet of the proposal, by notice on a sign
posted on the proposal site and by letter to the general mailing list.
The Hearing Examiner Committee may consider additional environmental
related testimony and the "DNS" at the public hearing.
The County Planning Department, in considering the above information and
conclusions, and further considering that forthcoming public testimony
would not identify unanticipated and unresolvable problems, does RECOMEND
APPROVAL. This recommendation of approval is, in part, based on the
following recommended "conditions of approval ", and therefore staff
additionally recommends that the following conditions be attached to the
Hearing Examiner Committee approval, if approval is granted.
VI. CONDITIONS OF APPROVAL
If approval is granted, the following conditions are recommmended.
COUNTY PLANNING DEPARTMENT
1. That the plat be designed as indicated on the preliminary plat of
record and /or attached sheets as noted.
2. That preliminary plat of record approval is for the property
described in the legal description, signed and stamped by the
sponsor's licensed land surveyor, attached to the application of this
proposal.
3. That the preliminary plat be given conditional approval for three (3)
years to February 1, 1988. The applicant may request an Extension of
Time by submitting a written request forty -five (45) days prior to
the above expiration date. Such applications should demonstrate the
progress made toward finalizing this preliminary plat. If an
Extension of Time is not requested in a timely manner or a Time
Extension is not granted, then the preliminary plat approval is NULL
& VOID.

Circulation - The plat design provides direct access to lots
along Mission and Evergreen. The remaining 7 lots will be served by
a new public road with cul -de -sac connecting to Sinto Avenue and
Bolivar intersection.
Density - The proposed density is 3.2 dwellings per grass
acres. The lot sizes are very similar to the existing subdivision
lots of the immediate vicinity.
Water Supply - Vera Irrigation District and partly in
Consolidated Irrigation District will provide water. An approved
water Plan will be required prior to finalizing this preliminary
plat. The sponsor may be required to get Boundary Review approval
for the water district service area.
Sewage Disposal - The County Utilities Department has approved
on -site septic tanks with provisions for ULID agreements and
requirements for dryline sewers in the new road.
School -The proposal is in the Central Valley School District #356.
Parks - The "Spokane County Parks and Recreation Comprehensive
Plan 1984" indicates this proposal is located within the Valley Park
and Recreation Service Area. The nearest park is Sullivan Park at
Sullivan and Spokane River and Valley Mission Park at Mission and
Bowdish. No park is planned for this site.
Fire - The proposal is within Fire District #1. The Fire
District and County Building and Safety Department (Fire Marshal) are
required to approve fire protection provisions prior to finalizing

hydrant spacing, water flow capacity and emergency access.
Cultural Resources - None have been identified.

COUNTY PLANNING DEPARTMENT (Cont'd)
The final plat dedication will contain the following statement: "the
public water system, pursuant the WATER PLAN approved by County and
State Health authorities, the local fire district, County Building &
Safety Department, and water purveyor, will be installed within this
plat, and the subdivider /sponsor will provide for individual domestic
water service as well as fire protection to each lot prior to sale of
each lot and prior to issuance of a building permit for each lot."
9. That no building permit will be issued for any lot within the Final
Plat until certified by a Washington State licensed engineer "that
the water system has been installed pursuant the approved WATER PLAN
for the FInal Plat ", signed and stamped by said engineer. The
certification may be in the form of a letter but is preferred to be
certified on a copy of said WATER PLAN as a schematic map showing the
"As Built" water plan.
10. That a current certificate of title be furnished the County Planning
Department prior to filing the final plat.
11. That the following statement be placed in the final plat dedication:
"no more than one dwelling structure be placed on any lot, nor shall
any lot be further subdivided for the purpose of creating additional
lots, ownerships, or building sites without first filing a replat."
12. Upon filing the Final Plat the zone change of the Final Plat area
shall be finalized and the existing Agricultural zone classification
shall be changed to R -1, except Lots 1 -9 is R -2.
13. That the Board of County Commissioners will sign the final plat mylar
document once the County Planning Department has verified compliance
of all conditions of approval, signatures have been placed on said
document, and said document found to be complete.
14. That the zone reclassification shall be accomplished by Board of
County Commissioner resolution, being the same resolution as the
Final Plat Resolution.
15. That prior to filing the final plat all existing buildings must meet
new lotline building_ setbacks of the new zone classification.
Removal or relocation may be necessary.
16. That Lot 9 will require 90 ft. between side yard lotlines at the
building face and the building setback line be drawn on the final
plat map if additional front yard setback is necessary to provide
said 90 feet.
17. Boundary Review Board approval may be required to amend the water
district service boundary prior to filing the final plat.

18. That conditional approval of the plat is given subject to dedication
of Right -of -Way and approval of the road system as indicated in the
preliminary plat of record, as approved by the County Engineer.
19. That plans, profiles, and cross - sections as designed to County
standards showing proposed street centerline and curb grades be
submitted to the County Engineer for approval prior to construction
and /or the filing of each final plat; road plans to be prepared under
the direction of a licensed Professional Civil Engineer.
20. That drainage plans and design calculations showing the alignment of
drainage facilities be submitted to the County Engineer for approval
prior to construction and /or the filing of each final plat. Drainage
plans to be prepared under the direction of a licensed Professional
Civil Engineer.
21. Construction within the proposed public streets and easements shall
be performed under the direct supervision of a licensed
engineer /surveyor, who shall furnish the County Engineer with "As
Built" plans and a certificate in writing that all improvements were
installed to the lines and grades shown on the approved construction
plans and that all disturbed monuments have been replaced.
22. No construction work is to be performed within the existing or
proposed public right - of-way until a permit has been issued by the
County Engineer. All work is subject to inspection and approval by
the County Engineer.
23. All construction within the existing or proposed public Right -of -Way
is to be completed prior to filing each final plat or a bond in the
amount estimated by the County Engineer to cover the cost of
• construction of improvements, construction certification, "As Built"
plans, and monumenting the street centerlines shall be filed with the
County Engineer.

24. A statement must appear in the dedicatory language of the final plat:
"that individual driveway access permits be required prior to
issuance of a building permit for driveway approaches to the County,

29. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns and successors.
30. The proposed plat shall be improved to the standards set forth in
Spokane County Board of Commissioners Resolution No. 80 -1592, as
amended, which establishes regulations for roads, approaches,
drainage, and fees in new construction.
31. The County Engineer has examined this development proposal and has
determined that the impacts of this proposal upon the existing County
Road System warrants the roadway improvements herein specified.
COUNTY UTILITIES DEPARTMENT
32. Pursuant to the Board of County Commissioners Resolution No. 80 -0418,
the use of on -site sewer disposal systems is hereby authorized. This
authorization is conditioned on compliance with all rules and
regulations of the Spokane County Health District and is further
conditioned and subject to specific application approval and issuance
of permits by said Health District.
33. The dedication shall state "The Owner(s) or Successor(s) in interest
agree to authorize the County to place their name(s) on a petition
for the formation of ULID by petition method pursuant to RCW 36.94
which the petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the formation of
a ULID by resolution method pursuant to RCW Chapter 36.94 which
includes the Owner(s) property. PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s) from objection to any
assessment(s) on the property as a result of improvements called for
in conjunction the formation of a ULID by either petition or
"resolution method under RCW Chapter'36.94.
34. Any water service for this project shall be provided in accordance
with the Coordinated Water System Plan for Spokane County, as amended.
35. The dedication shall state: "Each dwelling unit shall be double
plumbed for connection to future area -wide collection systems."
36. A dry sewer connection to the future area -wide Sewerage System is to
be constructed for lots 10 through 16. Plans and specifications for
the dry sewer connection are to be reviewed and approved by the
Utilities Department.

. 37. A combined surface water and sewage disposal detailed plan shall be
approved by the County Engineer and the Spokane County Health
District prior to the issuance of any building permit for this
project.
38. The dedicatory language of the final plat will state that: "Subject
to specific application approval and issuance of permits by the
Health Officer, the use of an individual on —site sewage system may be
authorized."
39. Prior to filing the final plat, the sponsor shall present evidence
that the plat lies within the recorded service area of the water
system proposed to serve the plat. The dedicatory language on the
plat shall state: "Use of private wells and water systems is
prohibited."
40. Prior to filing the final plat, the sponsor shall demonstrate to the
satisfaction of the Spokane County Health District that a suitable
site for an on —site sewage disposal systems are available on all lots
except Lot 117.
41. Prior to filing the final plat, the sponsor shall demonstrate to the
satisfaction of the Spokane County Health District that the existing
on —site sewage disposal system serving the residence located on Lot
117 is wholly located within the boundaries of the lot.
