FINDINGS OF FACT SPOKANE COUNTY HEARING EXAMINER COMMITTEE FINDINGS AND ORDER DWIGHT HUME This matter having come before the Spokane County Subdivision Hearing Examiner Committee on July 19, 1984 and the members of the Committee present being Jerry Williams, Chairperson, Kathy Carstens and Ron McVicers. The sponsor, Early Dawn Dairy, is requesting approval of a preliminary plat of PE- 1469 -84, DAY -BREAK ESTATES, and Zone Change 7F-R .-- Agricultural to R -1, to divide 74.5 acres into 174 lots for single - family dwellings and there being present, the following applicant or representative: 1. That the proposal and information presented in the STAFF REPORT was considered. 2. That the Comprehensive Plan designates this area as SUBURBAN at "Urban Transition ". 3. That the south and east portion of the proposal should make improved "transition" with 1/2 -acre or larger lots of Best Road and at 32nd Avenue to 17,000 sq. ft. or larger to 14,000 sq.ft. or larger to 10,000 sq.ft. or larger. 4. That the proposed road design is appropriate to assure no "through" traffic and thereby create a safer residential area for this site. 5. That safety of pedestrian traffic to the Elementary School site at 24th and Adams as well as the swimming pool and park near 24th and Evergreen does warrant sidewalks along Best, Evergreen, 32nd Avenue and 24th Avenue. 6. That the proposal is within the Priority Sewer Service Area (PSSA) boundary. 7. That the size of the project does warrant assurance for protection of the aquifer by requiring connection to the Spokane Valley interceptor at Skyview and Clinton Road (3,200± ft. west of the proposal); provided, the sponsor is made part of a reimbursement agreement for sewer line installation costs from the preliminary plat to said interceptor. That connection to that interceptor should not be required until two- thirds of the preliminary plat lots have been recorded as filed Final Plat(s) and the interceptor is available at said intersection or near vicinity. NOTE: The reimbursement agreement will be part of the Spokane County reimbursement program being developed to implement the Valley Sewer System. HEARING EXAMINER COMMITTEE FINDINGS AND ORDER FILE: PE- 1469 -84 8. That as indicated by the County Utility Department the purpose and intent of the Water Quality Management Plan and the ASA Overlay Zone could be met with said condition for connection to said sewer interceptor instead of requiring an on -site "interim" public sewer treatment facility. 9. That the proposal does comply with the purpose and intent of the Comprehensive Plan decision guidelines of Urban transition for "fill -in" development and compatible land uses as conditioned. 10. That one owner of adjacent lands expressed disapproval of this proposed use, as the easterly lots should be larger than 1/2 -acre to improve the compatability of existing ownerships to the east and that traffic on Best Road would increase. 11. That 3 phase development over a 3 year period will assure reduced impacts of the public services and facilities. 12. That condition #52 by Spokane County Air Pollution Control Authority serves to put the sponsors on notice of a change in their "exempt" status for operation of the dairy and is not a condition of approval. 13. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with. 14. That the proper legal requirements for advertisement of Agenda Item have been fulfilled. 15. That the elimination of the existing dairy operation when that portion of the plat is filed will improve the public welfare by eliminating the related odors, flies, and noises that currently cause problems to the residential neighborhoods to the north and west. 16. That the Hearing Examiner Committee finds the proposal as conditioned is not detrimental to the general purpose or otherwise harmful to the public health, safety, and welfare. D. SPECIAL CONDITIONS OR CONTINGENCIES APPLICABLE TO THIS DECISION Those conditions as listed in the July 19, 1984 STAFF REPORT, as amended below: HEARING EXAMINER COMMITTEE FINDINGS AND ORDER County Planning Conditions: 2. (Amend to read): That the preliminary plat be redesigned by the sponsor to provide improved lot size "Transition" from 32nd Avenue and Best Road northward and westward, respectively. That the lots along 32nd and Best shall be 1/2 -acre "net" or larger (except Lots . 8 -11 Block 1 and Lots 38 -40, 52 Block 9) and the adjacent lots shall make transition as follows: 1/2 -acre or larger to 17,000 sq. ft. or larger to 14,000 sq. ft or larger to 10,000 sq. ft. or larger. For clarification of the intent -- see colored map entitled - "Staff Recommended transition" dated July 19, 1984. Note - -this redesign is for the purpose of changing the lot sizes and not the general road design; however, the position of each road may shift to allow for lot size changes. The redesign is to be submitted to the County Subdivision Administrator as soon as possible for his approval of compliance with this condition or require a "change -of- condition" hearing for the preliminary plat if the redesign does not substantially conform to the intent of this condition. 15. (Amend to read): That the preliminary plat be filed in at least 3 parts and, at a minimum, over a three (3) year period, as approved by the County Subdivision Administrator. The intent is to assure that no more than one -third of the proposal is filed each year over a 3 -year period, but could be filed in more phases and over a longer period of time. County Utilities Department. FILE• PE- 1469 -84 42. (Amend to read): Within six months after the sewer interceptor is available as indicated in the CWMP within 3,200 feet of the edge of the prliminary plat of Day -Break Estates, construction shall be commenced to connect Day -Break Estates and subsequent phases to the general sewerage system. All costs related to such construction shall be borne by the Developer and a bond to insure such construction shall be provided at the time of final plat approval; provided two - thirds of the 174 lots (116 lots) have been filed as a final plat and subject to the County Utility Department developing a reimbursement program/agreement for this preliminary plat. County Health Department Condition: 48. (Amend to read): Prior to filing the final plat, the sponsor shall demonstrate to the satisfaction of the Spokane County Health District that the existing on -site sewage disposal systems serving the residences located at S. 2409 Evergreen Road, S. 2615 Evergreen Road,S. 2720 Best Road, and S. 2724 Best Road are wholly located outside the boundaries of the plat, as applicable per each phase.
