MARY'S TERRACE AN APPROVED PRELIMINARY PLAT THIS MATTER, a request for an extension of time from Harold Robinson has been received and decided upon, pursuant to Spokane County Subdivision regulation (Chapter III, Section G) and RCW 58.17.140. FINDINGS OF FACT FINDINGS OF FACT CONCLUSIONS AND DECISION 1. The individual signing below has been properly delegated the responsibility for rendering this decision by the Spokane County Director of Planning. 2. The subject preliminary plat was approved by the Board of County Commissioners on October 23, 1984. 3. If finalization of this subdivision does not occur prior to January 1, 1991, the existing zoning will be changed to the appropriate 'new zone,' of the Zoning Code which may have different standards or uses than originally requested. 4. Spokane County has established specific criteria for considering the extension of time for the expiration of preliminary subdivisions, specifically for regular subdivisions, and department policy for short subdivisions. These criteria are found in Chapter III, Section. G of the Spokane County Subdivision Ordinance and have been used as a basis for this decision. 5. The Comprehensive Plan designates this area of the preliminary plat as Urban, and the location is within the Priority Sewer Service Area. The Comprehensive Plan designation remains the same since the original preliminary plat approval. The proposal will be required to connect to the Valley Sewer. The County has adopted since the original approval an element of the Comprehensive Plan for Arterial Roads. 4th Avenue is designated a Collector Arterial on this Plan with a right of way width of 70'. 6. No additional conditions have been recommended by the various reviewing agencies and departments, including the County Engineer's Office, County Health District, County • Utilities and the Department of Building & Safety. 7. This is the second request for a time extension. The total life of the preliminary plat has been approximately six years. 8. The following fact is also relevant: a. The proposal is very close to being finalized, with final plats and water plans found in the file. CONCLUSIONS BASED UPON A REVIEW of (a) the criteria for approving an extension of time of the expiration date for a preliminary plat and (b) the above Findings of Fact, the following conclusions are made. 1. The final plat is very close to finalization. The final plat could be easily finished within a one year time frame. DECISION BASED UPON THE ABOVE Findings of Fact and Conclusions, an extension of time request for application PE- 1450 -84, St. Mary's Terrace, is hereby APPROVED until May 1, 1991. CONDITIONS OF APPROVAL 1. The following are the updated conditions of approval for PE- 1450 -84, St. Mary's Terrace. Extension of Time Findings File No. PE- 1450 -84 Page 2 2. Subsequent extension of time will only be considered upon a finding of substantial compliance with Chapter III, Section G, of the Subdivision Ordinance; otherwise the preliminary subdivision approval will become null and void. COUNTY PLANNING DEPARTMENT 1. The preliminary plat of record approval is for the property legally described in the application for this proposal. (Dated February 21, 1984, Plat of Record) 2. The final plat shall be designed substantially in conformance with the preliminary plat of record as legally described and advertised. No increase of density or lot number shall occur without a new application submittal and approval. 3. The preliminary plat is given conditional approval for one (1) year, specifically to May 1, 1991. 4. A final plat name shall be indicated before the final plat is filed, such name to be approved by the County Planning Director /designee. 5. Appropriate road name(s) shall be indicated. 6. Appropriate utility easements shall be indicated on copies of the proposed final plat. Written approval of utility easements by appropriate utility companies must be received with the submittal of the final plat. 7. The final plat map shall indicate by a clear dashed line the required yard setbacks from all private, "Tract X" or public roads. The dedication shall contain the following statement that: "Side yard and rear yard setbacks shall be determined at the time building permits are requested. The setbacks indicated on this plat may be varied from if proper zoning approvals are obtained." 8. A plan for water facilities adequate for domestic service and fire protection shall be approved by the water purveyor, appropriate fire protection district, Spokane County Building & Safety Department and Spokane County Health District. The agencies will certify on the WATER PLAN, prior to the filing of the final plat or any phase of the preliminary plat, that the plan is in conformance with their respective needs and regulations. The WATER PLAN and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 9. The purveyor shall also certify that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construction of the water system in accordance with the approved WATER PLAN. The time schedule shall provide for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the final plat. The arrangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 10. The final plat dedication shall contain the following statement: "The public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire protection district, County Building & Safety Department, and water purveyor, shall be installed within this subdivision, and the subdivider /sponsor shall provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 11. No building permit will be issued for any lot within the final plat until certified by a Washington State - licensed engineer that "the water system has been installed pursuant to the approved WATER PLAN for the final plat," signed and stamped by said engineer. The certification may be in the form of a letter, but is preferred to be certified on a copy of the WATER PLAN'as a schematic map showing the "as- built" water system. 12. Spokane County Planning Department is required to record with the County Auditor a "Title Notice," as prepared and signed by the applicant, for a future acquisition area for road right -of -way and utilities to run with the land, and the future acquisition area reservation shall not be removed without prior approval by the Spokane County Planning Department. Notice shall be recorded prior to the issuance of a building permit and shall provide the following: REV 1/90 Extension of Time Findings REV 1/90 File No. PE- 1450 -84 Page 3 a. 5 feet of future acquisition area for road right -of -way and utilities, in addition to the existing right -of -way dedication required by the County Engineer, along 4th Ave. b. Building and other setbacks required by the Spokane County Zoning Code shall be measured 25' from the north edge of the Future Acquisition Area that is reserved for road right -of -way and utilities. c. The following minimum improvements necessary to support the use within the zone classification as required by the Spokane County Zoning Code standards should not be located within the Future Acquisition Area. 1. Landscaping 2. Surface drainage 3. Drainfields 4. Parking 5. Other d. The 5' Future Acquisition Area, until acquired by Spokane County, shall be private property and may be used as allowed in the zone, except any improvements (such as landscaping, parking, surface drainage, drainfields, signs or others) shall be considered "interim" uses. The property owner shall be responsible for relocating such "interim" improvements at the time Spokane County makes roadway improvements after acquiring said Future Acquisition Area. e. This 'Title Notice" shall be signed by the owner to serve as official notice and acknowledgement of said Future Acquisition Area for road right -of -way and utilities. 13. The final plat dedication shall include: "No detached single - family dwellings or manufactured homes are allowed on any lot. That all tracts with any lot line designated Center Duplex Lot Line shall be restricted to one common wall dwelling unit (1/2 duplex), provided the duplex common wall is aligned over or with the Center Duplex Lot Line, and provided that each duplex unit (half) is totally on its side of center lot line when said lot line is extended vertically beyond the roof line." 14. The final plat map is to identify the duplex common wall lot line as. CENTER DUPLEX LOT LINE, and the line is to be drafted as a continuous "dash-dot-dash." 15. The final plat dedication shall include: "That the owners, heirs or assigns of each dwelling unit of each duplex structure do hereby agree to retain the color, texture and type of materials of the duplex exterior, and further agree that any "change" to said exterior shall have the written mutual approval of both owners of each half of the duplex prior to initiating construction of any such "change" to the exterior. Any replacement or addition to all or part of the duplex structure shall also require mutual approval. This agreement shall run with each associated lot and shall be enforced through civil court, and does exclude Spokane County from the terms and enforcement of said agreement." 16. The final plat dedication shall include: "That enforcement of the water and sewer systems agreement is a civil matter between each duplex unit owner(s) and not enforced by Spokane County." 17. Three (3) current certificates of title shall be furnished the County Planning Department prior to filing the final plat. 18. Upon filing the final plat the zone reclassification of the final plat area shall be finalized and the existing Agricultural Suburban Zone classification shall be changed to Two Family Residential (R -2) Zone, consistent with the site plan contained in the files. 19. All lots finalized will be required to meet all development standards of Spokane County Ordinances such as building setbacks, parking stalls and land use. 20. The barn on lot 8 shall be relocated to proper building setbacks prior to filing the final plat. 21. The final plat dedication shall state "Lot 2 shall be limited to a single story structure." • Extension of Time Findings File No. PE- 1450 -84 Page 4 COUNTY ENGINEER'S OFFICE 1. The conditional approval of the plat is given by the County Engineer subject to dedication of right -of -way and approval of the road system as indicated in the preliminary plat of record. 2. Plans, profiles, and cross- sections as designed to County standards showing proposed street centerline and curb grades shall be submitted to the County Engineer for approval prior to construction and/or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3. Drainage plans and design calculations showing the alignment of drainage facilities shall be submitted to the County Engineer for approval prior to construction and/or the filing of the final plat. Drainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. Construction within the proposed public streets and easements shall be performed under the direct supervision of a licensed engineer /surveyor, who shall furnish the County Engineer with "as- built" plans and a certificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 5. No construction work is to be performed within the existing or proposed public right - of -way until a permit has been issued by the County Engineer. All work is subject to inspection and approval by the County Engineer. 6. All construction within the existing or proposed public right -of -way is to be completed prior to filing each final plat, or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "as- built" plans and monumenting the street centerlines shall be filed with the County Engineer. 7. Individual driveway access permits are required prior to issuance of a building permit for driveway approaches to the county road system. 8. The proposed plat shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80 -1592, as amended, which establishes regulations for roads, approaches, drainage, and fees in new construction. 9. That the County Engineer has examined this development proposal and has determined that the impacts of this proposal upon the existing County Road System warrants the roadway improvements herein specified. 10. Dedication of 10 ft. of additional right -of -way along 4th Avenue is required. 11. Sidewalks are required along the arterial(s) on 4th Avenue. 12. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 13. Existing county roads providing direct access to the plat shall be paved and/or curbed to Spokane County standards. 14. The proposed private road(s) as shown on the preliminary plat serving 7 lots with no extension possible, is approved by the County Engineer, subject to County Engineer memo dated March 27, 1984. 15. That a property owner association be formed for the purpose of maintenance of the proposed private road. That this association be formed in a like manner to other associations formed for care and maintenance of common open spaces and grounds. The County Engineer and County Subdivision Administrator shall review and approve appropriate documents prior to recording. 16. Private road(s) shall be improved to Spokane County standard for a private mad Urban- Suburban standard serving seven lots, and are subject to approval under Section 10.207 of the Spokane County Fire Code. 17. The following statement shall be placed in the plat dedication: REV 1,90 Extension of Time Findings "WARNING: Spokane County has no responsibility to build, improve, maintain or otherwise service the private roads contained within or provide service to the property described in this plat. By accepting this plat or subsequently by allowing a building permit to be issued on property on a private road, Spokane County assumes no obligation for said private road, and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, examine, survey, construct, alter, repair, improve, maintain or provide drainage or snow removal on a private road. This requirement is and shall run with the land and shall be binding upon the owner(s), their heirs, successors or assigns, including the obligation to participate in the maintenance of the private road as provided herein." COUNTY UTILITIES DEPARTMENT 1. The dedication shall state: "The owner(s) or successor(s) in interest agree to authorize the County to place their name(s) on a petition for the formation of ULID by petition method pursuant to RCW 36.94, which the petition includes the owner(s)' property; and further not to object by the signing of a protest petition against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED this condition shall not prohibit the owner(s) or successor(s) from objecting to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94." 2. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 3. Applicant will make connection to Public Sewer System. Sewer connection permit is required. COUNTY HEALTH DISTRICT 1. Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Social & Health Services. 2. Prior to filing the final plat, the sponsor shall present evidence that the plat lies within the recorded service area of the water system proposed to serve the plat. The dedicatory language on each plat shall state: "Use of private wells and water systems are prohibited." 3. The dedicatory language of the plat will state that: "Subject to specific application approval and issuance of permits by the Health Officer, the use of (an) on -site sewage system(s) may be authorized." 4. A combined surface water and sewage disposal detailed plan shall be approved by the County Engineer and the Spokane County Health District prior to the issuance of any building permit for this project. COUNTY BUILDING AND SAFETY DEPARTMENT 1. That the WATER PLAN shall show the location of each fire hydrant of fue prevention facility and must comply with Chapter 10.03 of the Spokane County Uniform Fire code Ordinance, as amended. 2. That the WATER PLAN shall specify the gallons per minute for each fire hydrant at residual pressure of no less than 20 p.s.i. (a minimum pressure). 3. That the Water Purveyor and Fire District shall sign the WATER PLAN prior to County Building & Safety Department's review. That the appeal by the sponsor did request to have the 9 lot preliminary plat as submitted approved. 3. That the April 19, 1984 STAFF REPORT was considered. 4. That the April 19, 1984 Hearing Examiner Committee Findings and Order were considered. 5. That the file of PS- 1450 -84 was considered. 6. That the proposal is located in an area designated as URBAN on the adopted Spokane County Comprehensive Plan and is within the Priority Sewer Service Area (PSSA) where Spokane Valley sewers will be installed. 7. That the vicinity has numerous duplex structures. 8. That the east and adjacent property is an existing playground to St. Mary's School. 9. That the N 1/2 of the proposal is east and adjacent R -2 zoned lots with duplexes and the S 1/2 is east and adjacent R -1 lots with single family dwellings with rear yards adjacent the proposal. 10. That Lot 2 of the proposal should be compatible in building height to the west and adjacent single family dwellings by restricting said height to a single story. 11. That the sponsor voluntarily agreed to limit the duplex on Lot 2 to one story. 12. That Spokane County Road Standards and Zoning Ordinances provide development standards for duplexes and private roads, therefore no special "detailed site plan" review at public hearing is necessary. 13. That a property owner association should be created to assure maintenance of the private roadway and said agreement should run with the land. 14. Up to eight parcels may be served by a Private Road. The Road Stand- ards do not address parcels upon which duplex units are to be constructed. The in- tent of the ordinance appears to be met by this application since the private drive will serve only seven parcels. However, unlike a subdivision for single family lots, this division has the potential for 14 residential units on the seven parcels served by the Private Road. The approval of this division will ultimately result in the construction of duplex rental units which could be sold to nine separate owners, seven of whom would be responsible for maintenance of the Private Road. This situation would not differ from that typically found in a single family residential plat except for the poten- tial for absentee ownership of duplex units. It is the responsibility of owners of the lots to assure construction, maintenance, etc. of the Private Road. The potential for non - maintenance of the road because of the tenant - landlord relationship is greater than that which would normally be associated with single family residences. You should also note that the maintenance burden could be shifted to relatively few conscientious lot owners in the absentee owner situation. The Private Road depicted on this short plat should be designated as a "Tract X" future public right of way and should be constructed in accordance with "Tract X" Standards. However, should this proposal be approved as submitted, it is my recom- mendation that formation of a homeowner's association be required. This association would be of the type normally created for the maintenance and care of common areas in cluster housing developments and Planned Unit Developments. The proposal complies with the Decision Guideline policies for "fill -in" development and land use compatibility. H. Special Information: Circulation be served by a Engineer to be Density - 4th Avenue will provide the proposal with public street access and the 7 north lots will private road, which is recommended by the County designated "Tract -X." The County Engineer is recommending the operation and maintenance of the private road be provided for through a Homeowners Association similar to that of a Planned Unit Development (PUD), since there is a potential for duplexes with up to (7 lots x 2 units) 14 rental units with 7 separate owners. The type and dimensional shape of the duplexes may be restricted. - The lot sizes in the proposal are similar to the R -2 lots in the adjacent N 1/2 of "Silvey 1st Addition." Duplex Division - The Spokane County Zoning Ordinance under Section 4.17.150 allows for individual ownership of each unit of a duplex and each half of the duplex lot. Comprehensive Plan: Staff finds that the proposal meets the purpose and intent of the URBAN designation; as "fill -in" development for Urban, for the Priority Sewer Service Area (PSSA), and for the existing public services and facilities of the near vicinity. IV. ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and has been reviewed by the Planning staff. No significant adverse environmental impacts were judged to exist. Possible slight adverse environmental impacts were identified on the checklist in the following categories: earth, air, water, flora, fauna, noise, light and glare, land use, Natural Resources, risk of upset, population, transportation /circulation, public services, energy, and utilities. The County Subdivision Administrator issued a "Proposed Declaration of Non - Significance ", and it was circulated to other agencies or jurisdiction and no comments have been received; therefore, staff recommends a "Final Declaration of Non - Significance" be signed by the Hearing Examiner Committee chairperson. V. LEAD AGENCY RECOMMENDATION The County Planning Department, in considering the above information and conclusions, and further considering that forthcoming public testimony would not identify unanticipated and unresolvable problems, does RECOMMEND APPROVAL. This recommendation of approval is, in part, based on the followng recommended "conditions of approval ", and therefore staff additionally recommends that the following conditions be attached to the Hearing Examiner Committee approval, if approval is granted. VI. CONDITIONS OF APPROVAL If approval is granted, the following conditions are recommended. COUNTY PLANNING DEPARTMENT CONDITIONS 1. That the Final Plat be designed as indicated on the preliminary plat of record and /or attached sheets as noted. 2. If an Extension -of -Time is not requested in a timely manner or said Extension is not granted, then the preliminary plat is NULL & VOID and the approval is withdrawn. 4. That the provisions of SEPA'S NOTICE OF ACTION pursuant to Chapter 43.21C.080 RCW be initiated by the project applicant within thirty (30) days of final disposition of this application, and prior to any on -site improvements unless the applicant(s)/ sponsor(s) choose to file a notarized Waiver of Notice of Action with the Spokane County Planning Department. 5. Pursuant to the provisions of Chapter 43.21C. RCW, the SEPA Guidelines (WAC 197 -10) and the Spokane County Environmental Ordinance (SCEO), a proposed declaration of non - significance has been issued at least fifteen (15) days prior to this date; the official file, written comments and /or public testimony contain information regarding assessment of the proposal's adverse impacts to the physical environment; a finding is hereby made that no probable significant adverse impacts upon the physical environment are anticipated as a result of this project; and a Final Declaration of Non - Significance is hereby to be issued. 6. That a Final Plat name be indicated before the final plat is filed; such name to be approved by the County Assessor and the Planning staff. 7. The Health authorities, water supplier (purveyor), fire protection district, and County Building & Safety Department (fire marshall) will certify with signature on said WATER PLAN, prior to the filing of the final plat or final plat of each phase of the preliminary plat. Said certification shall indicate that said plan is in conformance with their respective needs and regulations. Said WATER PLAN and certification will be drafted on a transparency suitable for reproduction. The purveyor will also certify that appropriate contractual arrangements or agreements have been made with the plat sponsor for construction of the water system in said final plat, in accordance with the approved WATER PLAN and in accordance with a time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within said final plat. The arrangements or agreements will include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The final plat dedication will contain the following statement: "the public water system, pursuant the WATER PLAN approved by County and State Health authorities, the local fire district, County Building & Safety Department, and water purveyor, will be installed within this plat, and the subdivider /sponsor will provide for individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each lot." 10. No construction work is to be performed within the existing or proposed public right -of -way until a permit has been issued by the County Engineer.
