Funds in the amount of $19,500.00 are being held in a special non - interest
bearing account in the name of W.R.S. and Associates, Inc. et ux , for the
purpose of assuring completion of installation of roadway surfacing, including
grading and gravel, storm drainage and monuments in Karma Addition p{)
in accordance with the drawings and specifications as submitted to
and approved by the County of Spokane Engineer's office on May 19, 1986
No funds will be disbursed from this account without the prior written authori..
sation of the County of Spokane Engineer.
In the event that the completion and acceptance of the above named improvements
for maintenance by the County of Spokane are not accomplished within a period of
one year from the date of this agreement, all funds remaining in the account
will be forfeited to the County of Spokane upon written request by the County of
Spokane Engineers office to Bancshares Mortgage Company . It is understood
that upon the forfeiture of the funds to the County of Spokane, that the County
of Spokane will then undertake completion of the subdivision to be accomplished
within twelve months from the date of the forfeiture of funds. It is further
understood that in the event of any shortage of funds to complete improvements,
the County of Spokane may have recourse against the original owner /developer,
but not against Bancshares Mortgage Company
It is specifically understood by the parties, that in holding funds for this
development, Bancshares Mortgage Company is not serving as guarantor, and if
at the time of forfeiture, Bancshares Mortgage Company is then the owner by
virtue of foreclosure or deed in lieu of foreclosure, then no recourse shall be
had against Bancshares Mortgage Company as the then owner for any additional
costs incurred by the County of Jpokane in the completion and acceptance of the
above named improvements.

A. INTRODUCTION
This matter having come before the Spokane County Subdivision Hearing
Examiner Committee on June 21, 1984 and the members of the Committee
present being Richard Skalstad, Chairperson, Lynn Tennican and Jerry
Williams.
B. PROPOSAL
The sponsor, Karma Dhaenens, is requesting approval of a preliminary plat
of PE- 1463 -84, KARMA ADDITION, and Zone Change ZE- 61 -84, to divide 4.33
acres into 9 lots for single - family dwellings and change the existing
zoning from Agricultural to R -1 and there being present, the following

G. Comprehensive Plan Designation: The Comprehensive Plan designates
this area as URBAN and is within
the Priority Sewer Service Area (PSSA) boundary. The proposal
complies with the Decision Guideline policies for Urban "fill -in"
development and land use compatibility.
H. Special Information:
Circulation - The proposal will use Adams Road for the two west
lots 1 and 2 and Lots 3 -9 will be served by
extension of 21st Avenue with a Cul -de -Sac.
Design - The design will provide lots with rear yards
adjacent rear yards of existing lot, except Lots
1 and 2 will abut with side yards.
Water Supply - Vera Water and Power will provide water. An
approved water Plan will be required prior to
finalizing this preliminary plat.
Sewage
Disposal - The County Utilities Department has approved
septic tanks with provisions for ULID agreements
double plumbing and dry sewer lines in 21st Avenue.
School
The proposal is in the Central Valley School
District #356, who did not respond to the notice
mailed them.
Parks - The report, "Planning for Park" (revised 1976)
indicates this proposal is located in the
neighborhood of "Airpark ", which does not call for a park at the
proposal site. A County park does exist at 24th & Evergreen.
Fire - The proposal is within Fire District #E1. The
Fire District and County Building and Safety
Department (Fire Marshal) are required to approve fire protection
provisions prior to finalizing the preliminary plat by reviewing the
Water Plan for hydrants, hydrant spacing, water flow capacity and
emergency access.
Cultural
Resources - None have been identified.

111. BACKGROUND /ANALYSIS
A. Land Use: Staff finds the proposed addition of 9 lots for
single - family dwelling on typical 14,000 square
foot lots to be compatible with the adjacent land-uses and lot
sizes.
B. Zoning: Staff finds the requested zone reclassification from
Agricultural to R -1 to be compatible with the proposed
uses and existing land uses.
C. Comprehensive Plan: Staff finds the proposal meets the purpose
and intent of the URBAN designation; as
"fill -in" development for Urban, for the Priority Sewer Service
Area (PSSA), and for the existing public services and facilities
of the near vicinity.
IV. ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and has been
reviewed by the Planning staff. No significant adverse environmental
impacts were judged to exist.
Possible slight adverse environmental impacts were identified on the
checklist in the following categories: earth, air, water, flora,
fauna, noise, light and glare, land use, population, housing,
transportation /circulation, public services, energy, utilities, and
human health.
The County Subdivision Administrator issued a "Proposed Declaration
of Non- Significance ", and it was circulated to other agencies of
jurisdication and no comments have been received as of the printing
of this report; therefore, recommends a "Final Declaration of Non -
Significance" be signed by the Hearing Examiner Committee Chairperson.
V. LEAD AGENCY RECOMMENDATION
The County Planning Department, in considering the above information
and conclusions, and further considering that forthcoming public
testimony would not identify unanticipated and unresolvable problems,
does RECOMMEND APPROVAL. This recommendation of approval is, in
part, based on the following recommended "conditions of approval ",
and therefore staff additionally recommends that the following
conditions be attached to the Hearing Examiner Committee approval, if
approval is granted.

If approval is granted, the following conditions are recommended

of record and /or attached sheets as noted.
That preliminary plat of record approval is for the property
described in the Legal Description, signed and stamped by the
sponsor's licensed land surveyor, being part of the application
for this proposal.
That the provisions of SEPA'S NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW be initiated by the project applicant
within thirty (3) days of final disposition of this application,
and prior to any on -site improvements unless the applicant(s)
/ sponsor(s) choose to file a notarized Waiver of Notice of
Action with the Spokane County Planning Department.
Pursuant to the provisions of Chapter 43.21C.RCW, the SEPA
Guidelines (WAC 197 -10) and the Spokane County Environmental
Ordinance (SEC), a proposed declaration of non - significance has
been issued at least fifteen (15) days prior to this date; the
official file, written comments and /or public testimony contain
information regarding assessment of the proposal's adverse
impacts to the physical environment; a finding is hereby made
that no probable significant adverse impacts upon the physical
environment are anticipated as a result of this project; and a
Final Declaration of Non Significance is hereby to be issued.
6. That a name be indicated before the final plat is filed; such
name to be approved by the County Assessor and the Planning
staff.
7. That appropriate road names be indicated, and approved by the
County Subdivision Administrator.

8. That appropriate utility easements be indicated on copies of the
approved preliminary plat for distribution by the sponsor to the
County Planning Department and all applicable utility
companies. Written approval of said utility easements by said
utility companies must be received with the submittal of the
"draft" final plat and prior to filing the final plat.
9. That a plan for water facilities adequate for fire protection be
approved by the water supplier, fire protection district and
Spokane County Building & Safety Department (Fire Marshal).
Said WATER PLAN must also have been approved by the appropriate
health authorities. The Health authorities, water supplier
(purveyor), fire protection district, and County Building &
Safety Department (Fire Marshal) will certify with signature on
said WATER PLAN, prior to the filing of the final plat or final
plat of each phase of the preliminary plat. Said certification
shall indicate that said plan is in conformance with their
respective needs and regulations. Said WATER PLAN and
certification will be drafted on a transparency suitable for
reproduction.
The purveyor will also certify that appropriate contractual
arrangements or agreements have been made with the plat sponsor
for construction of the water system in said final plat, in
accordance with the approved WATER PLAN and in accordance with a
time schedule. The time schedule will provide, in any case, for
completion of the water system and inspection by the appropriate
health authorities prior to application for building permits
within said final plat. The arrangements or agreements will
include a provision holding Spokane County and the purveyor
harmless from claims by any lot purchaser refused a building
permit due to the failure of the plat sponsor to satisfactorily
complete the approved water system.
The final plat dedication will contain the following statement:
the public water system, pursuant the WATER PLAN approved by
County and State Health authorities, the local fire district,
County Building & Safety Department, and water purveyor, will be
installed within this plat, and the subdivider /sponsor will
provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot and prior to
issuance of a building permit for each lot."

10. That no building permit will be issued for any lot within the
Final Plat until certified by a Washington State licensed
engineer "that the water system has been installed pursuant the
approved WATER PLAN for the Final Plat ", signed and stamped by
said engineer. The certification may be in the form of a letter
but is preferred to be certified on a copy of said WATER PLAN as
a schematic map showing the "As Built" water system.
11. That a current certificate of title be furnished the County
Planning Department prior to filing the final plat.
12. That the following statement be placed in the final plat
dedication: "no more than one dwelling be placed on any one lot,
nor shall any lot be further subdivided for the purpose of
creating additional lots or building sites without first filing
a replat."
13. Upon filing the final plat the zone change shall be finalized
and the existing Agricultural zone classification shall be
changed to R -1.
COUNTY ENGINEERING CONDITIONS
14. That conditional approval of the plat is given subject to
dedication of Right -of -Way and approval of the road system as
indicated in the preliminary plat of record, as approved by the
County Engineer.
15. That plans, profiles, and cross - sections as designed to County
standards showing proposed street centerline and curb grades be
submitted to the County Engineer for approval prior to
construction and /or the filing of each final plat; road plans to
be prepared under the direction of a licensed Professional Civil
Engineer.
16. That drainage plans and design calculations showing the
alignment of drainage facilities be submitted to the County
Engineer for approval prior to construction and /or the filing of
each final plat. Drainage plans to be prepared under the
direction of a licensed Professional Civil Engineer.

17. Construction within the proposed public streets and easements
shall be performed under the direct supervision of a licensed
engineer /surveyor, who shall furnish the County Engineer with
"As Built" plans and a certificate in writing that all

District and is further conditioned and subject to specific
application approval and issuance of permits by said Health

COUNTY HEALTH DISTRICT CONDITIONS
32. Water service shall be by an existing public water supply when
approved by the Regional Engineer (Spokane), State Department of
Social and Health Services (DSHS).
33. Prior to filing any final plat, the sponsor shall present
evidence that the plat lies within the recorded area of the
water system proposed to serve the plat. The dedicatory
language on each plat shall state: "Use of private wells and
water systems are prohibited."
34. The dedicatory language of the plat will state that: "Subject to
specific application approval and issuance of permits by the
Health Officer, the use of an individual on -site sewage system
may be authorized."
35. A combined surface water and sewage disposal detailed plan shall
be approved by the County Engineer and the Spokane County Health
District prior to the issuance of any building permit for this
project.
COUNTY BUILDING AND SAFETY DEPARTMENT CONDITIONS

property. PROVIDED, this condition shall not prohibit the Owner(s) or Successors) from objection to

Individual driveway access permits shall be required prior to issuance of a building permit for

DEDICATION
KNOW ALL MEN BY THESE PRESENTS, that Karma Dhaenens, as her separate property, and Pacific First
Federal Savings and Loan Association, a corporation organized under the laws of the State of
Washington, have caused to be platted into lots, blocks, and . streets, the land shown hereon as
"KARMA ADDITION" and described as follows:
Tract "A" of SHORT PLAT NO. 83 -239, as per plat thereof recorded in Volume 2 of Short Plats, page 65;
Situate in the County of Spokane, State of Washington.
No more than one dwelling structure shall be placed on any one lot, nor shall any lot be further
subdivided for the purpose of creating additional lots or building sites without filing a replat.
The public water system, as approved by County and State Health authorities and the local fire
district and purveyor, will be installed within this plat, and the subdivider will provide for
individual domestic water service as well as fire protection to each lot prior to sale of each lot.
Use of private wells and water systems is prohibited.
The plattor does hereby dedicate forever the streets shown hereon for public road purposes.
The Owner(s) or Successor(s) in interest agree to authorize the County to place their name(s) on a
petition for the formation of a ULID by petition method pursuant to RCW 36.94 which the petition
includes the Owner(s) property and further not to object by the signing of a protest petition against
the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the Owner(s)
property. PROVIDED, this condition shall not prohibit the Owner(s) or Successor(s) from objection to
any assessment(s) on the property as a result of the improvements called for in conjunction with the
formation of a ULID by either petition or resolution method under RCW Chapter 36.94.
Individual driveway access permits shall be required prior to issuance of a building permit for
driveway approaches to the County Road system.
Subject to specific application approval and issuance of permits by the Health Officer, the use of an
individual on -site sewage system may be authorized.
5' x 10' easements are hereby provided on the lots as shown and shall be used for utility purposes.
