ADDITION AN APPROVED PRELIMINARY PLAT. FINDINGS OF FACT CONCLUSIONS AND DECISION THIS MATTER, a request for an extension of time from Victor W. Renz has been received and decided upon, pursuant to Spokane County Subdivision regulation (Chapter III, Section G) and RCW 58.17.140. FINDINGS OF FACT 1. The individual signing below has been properly delegated the responsibility for rendering this decision by the Spokane County Director of Planning. 2. The subject preliminary plat was approved by the Hearing Examiner Committee on July 27, 1979. 3. Spokane County has established specific criteria for considering the extension of time for the expiration of preliminary subdivisions, specifically for regular subdivisions, and department policy for short subdivisions. These criteria are found in Chapter III, Section G of the Spokane County Subdivision Ordinance and have been used as a basis for this decision. 4. The Comprehensive Plan designates this area of the preliminary plat as Urban, and the location is within the Priority Sewer Service Area. The Comprehensive Plan designation remains the same but, the Comprehensive Road Plan designates both Adams and 12th Avenue as arterial roads. - 5. No additional conditions have been recommended by the various reviewing agencies and departments, including the County Engineer's Office, County Health District, County Utilities and the Department of Building & Safety. 6. This is the sixth request for a time extension. The total life of the preliminary plat has been approximately 10 years. 7. The following facts are also relevant. a. That the County Planning Department file indicates nothing has been done since the last granting of a Time Extension in December of 1988. b. That the preliminary plat was approved by the Hearing Examiner Committee on July 27th, 1979. 2. That the zoning upon final plat recording be changed from Agricultural to R -1. It should be noted that Spokane County had adopted a new Zoning Code which will take effect January 1st, 1991. If the project is still approved by this time the zoning would cross over to UR -3.5 and it's standards would apply. 3. That the Comprehensive Plan is designated as Urban and is within the PSSA area. The Comprehensive Plan Landuse Designation remains the same since the original approval. 4. That since the original approval, the applicant has done very little to finalize the project over the past 10 years. The project still complies with development guidelines and regulations and has been updated and several Time Extension requests have been approved. 5. That no additional conditions have been recommended by reviewing County Departments including; County Engineer, Utilities Department, Health District and Building and Safety Department. 6. That this is the fifth request for a time extension. 7. That this is the last Time Extension to be granted unless at least a portion or phase of the preliminary plat is finalized by December 1st, 1989. 8. That in considering that no new conditions of approval have been recommended, and that the Comprehensive Plan remains the same and also considering that limited progress has been accomplished over the past 10 years a one year extension of time shall be granted to December 1st, 1989. 9. That Extension of Time requests for subdivisions are controlled based on RCW 58.17.140 and Chapter III Section G of the Spokane County Subdivision Ordinance. (C oeur Alene (509) 456- 3600 At this time many of the recommended actions for protecting the Spokane Valley/ Rathdrum Prairie Aquifer have been adopted as policy by the appropriate agency or are well on their way to full implementation. As was expected, the process of translating the recommended actions in the Water Quality Management Plan into policy statements has resulted in a few minor changes in the application of the action. Most of these changes grant the agency power to make exception to the stated requirements or provide for other alternative solutions. This may result in some problems for your agency. Unless you have the needed flexibility in your Memorandum of Understanding with the EPA, you may find it necessary to refuse financing for proposals which have received full local agency approval. The Spokane County Engineers have developed appropriate guidelines for implement- ing the recommended actions for drainage control. They recently reviewed the final plat for the H.A.V. addition. This is a small subdivision on a street with about 10% slopes. Use of grassed swales on this slope poses the risk of erosion and it may not be possible to achieve the recommended storage in a reasonable depth. Under the guidelines Spokane County has adopted for storm drainage, controls, there are provisions for granting variances to the requirements. If the FHA were not requiring that the 208 recommended actions be applied to this development, the County would approve the plat with an alternative drainage system. Having reviewed this plat it appears that the circumstances involved here require some sort of variance be allowed and that the county!s action is justified. Four requirements which could be applied for granting such variances are met by this proposal: 1) The subdivision or area served is small, 2) street and /or drainage slopes in excess of 8% cannot be avoided, 3) vacant land area at the foot of the slope is not available for use as a grassed percolation area, and 4) the proposal is consistent with the concept of fill -in development,which will make future installation of sewers more feasible. While it is not desirable to set a precedence for waiving '208' recommendations which have been adopted, practical application of the regulations requires' some flexibility. This is especially true when enforcing one regulation would dis- courage the accomplishment of another goal. Requiring full compliance with the recommendations in this development would result in a drainage system requir- ing high maintenance and little effectiveness or a proposal not economically viable. If the project is not built,a sizable portion of undeveloped ground will be surrounded by urban densities. This is not consistent with the goal of fill -in development. Please consider how this situation and others which might develop can be han- dled under your M.O.U. with the E.P.A. I will be available to assist you if necessary. ADDITION ZE- 147 -79, AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL PRELIMINARY SUBDIVISION AND ZONE RECLASSIFICATION I. GENERAL INFORMATION A. Location Located in the Spokane Valley east of and partially adjacent to Adams, west of Progress, south of 8th and north and partially adjacent to 12th. B. Proposal 5.7± acres subdivided into 16 lots for single family dwellings Typical lot frontage = 80 feet Typical lot size = 10,000 sq. ft. C. Relationship to the Comprehensive Plan The approved map of the Comprehensive Plan indicates residential usage of this area, as well as all nearby surrounding lands, with no density designation. D. Land Use Analysis: 1. Existing Land Uses The proposed site is currently vacant, with some agricultural activity occurring. The site is bounded to the north, south and west by residential developments, whereas, to the east, scattered residential uses can be found, along with the newly approved Snoopy's 1st Addition. Parcel sizes from the various developments range from 10,200 sq. ft. to 13,000 sq. ft. There is some duplex use, mainly located to the west. Adams Elementary School is located at the northeast corner of Adams and 9th which will serve this proposal, further north are multi - family and commercial uses along Sprague Avenue. 2. Compatibility with Existing Land Uses The proposal is consistent with the residential development found in the aera, and appears to be compatible with the existing uses. II. SPECIAL INFORMATION A. Circulation The County Road Engineer has examined the proposed preliminary plat and makes specific recommendation for full right -of -way access to 10th Avenue on the north. -4B - STAFF ANALYSIS - July 27 779 H.A.V. ADDIT - continued B. Sewage Disposal The applicant's engineer has prepared an analysis of alternative sewage dis- posal means; including on -site septic tank disposal, community septic tank disposal, and community package treatment plant disposal. For economic reasons, and to provide the most realistic alternative, the applicant's engi- neer feels on -site septic tanks should be utilized. The Spokane County Health District has authorized the use of individual on -site sewage systems for each lot within the plat. The plat is situated over the Spokane Valley Aquifer and the Health District in their examination of the possible impact on groundwater quality from this proposal have the following comments: Impact Discussion a. The plat sponsor has proposed 16 lots on 5.7 acres with a typical lot size of 10,000 sq. ft. Each lot is to be served by a public water system and its individual on-site sewage disposal system. This raises the question of significance of the impact on the groundwater in the area and possible alternatives for sewage disposal. b. In the course of the conduct of the Army Corps study, Dr. Todd considered typical soils, natural and sewage disposal recharge to the groundwater, and the effect of continued urban development in the Spokane River Valley upon the quality of the groundwater. In summary, he concluded that: 1. In normal precipitation years subsurface disposal of sewage treatment effluent does reach and recharge the groundwater. 2. All the dissolved salts in sewage effluent will be carried to the groundwater. However, bacteria and detergents (phosphate portion) are mostly removed by the deep soil layer above the groundwater and "minor dissolved constituents such as phosphates, which are known to react with soil particles, or nitrates, which are taken up by the plant roots," will be less than the total found in septic tank effluents. 3. The calculated results at the downstream end of groundwater flow line indicate that the maximum range of (dissolved) solids concentration expected at presnet (1975) is up to 93 mg /1 (milligrams per liter) above the natural groundwater background of 155 mg /1. The forecast year 2020 maximum incremental concentration is 101 mg /1 above the natural background. - - - The analytical results of the forecast impact of year 2020 when compared with the present impact, both measured in terms of leachate volume and dissolved solids concentration, indicate that the present impact on groundwater quality is already a substantial proportion of the ultimate level. c. Currently, results of chemical analysis show the total nitrogen content of the groundwater as in the range of 2.7 to 2.9 ppm. A projected incremental increase using Dr. Todd's expected 8.6 percent would result in a range of 2.95 to 3.1 ppm. Current Federal and State drinking water standards permit up to 10 ppm. -4C - STAFF ANALYSIS - July 27, '79 H.A.V..ADDITI'' - continued D. Water Supply d. Alternative sewage disposal methods that would not recharge the ground- water have the following general characteristics: 1. Collector and central treatment systems discharging to surface waters would require at least tertiary treatment and perhaps more to obtain a permit for the discharge from the Department of Ecology. These systems are not currently economically available for this project. 2. Sealed systems, whether individual or community, depend on evaporation for liquid removal. These systems require more land area than a conventional subsurface drainfield. Some, such as lagoons, have safety hazards associated with them and relatively poor community acceptance. Land, installation and operational cost are generally more expensive than those for septic tanks and drainfields. C. Drainage The County Utilities Engineer reports that the preliminary storm drainage plan submitted by the applicant indicates that on -site storm drainage provisions will adequately handle surface water runoff. However, final construction plans should be reviewed and approved prior to the final plat filing. The proposal is located within the recorded service area of Vera Water and Power. The District advises the staff that adequate system capacity, and a desire on their part to serve, exists for the provision of water for domestic, fire and irrigation uses. E. Fire Protection The proposal is situated within the recorded service area of Fire District #1. The Fire District staff requests that the Hearing Examiner Committee require mains and hydrants of sufficient size for fire protection as a condition of final plat approval. The District also requests that they be allowed to review and approve final water plans for fire flows. F. Schools Proposal lies within the boundaries of Central Valley School District 11356. G. Parks The report "Planning for Parks" (revised 1976) indicates that a 19 acre community park, a neighborhood shopping center, and a junior high located on 13.8 acres be provided to service the needs of the residents in the area. -4D- STAFF ANALYSIS - July 27 979 H.A.V. ZONING ANALYSIS The sponsor is requesting a zone upgrade from Agricultural to (R -1) Single Family Residential. Other residential developments have received approval for R -1 zoning, such as Eldora Addition to the south, Snoopy's 1st Addition to the east, and Tupper Addition to the north. To the west, Helstroms Addition received Agricultural Suburban zoning, and does contain single and two family uses. As presented, the staff feels the proposed zoning is consistent with other zone upgradings in the area, and that H.A.V. Addition would be an appropriate and compatible change. IV. ENVIRONMENTAL REVIEW An Environmental Checklist was submitted by the sponsor and has been reviewed by the Planning staff. No significant adverse environmental impacts were judged to exist. Slight adverse environmental impacts were identified on the checklist in the • following categories: earth; air; water; flora; noise; light and glare; land use; population; housing; transportation /circulation; public services and utilities.
