sufficient to pay the construction costs of grading and surfacing to the approved grades
and typical section the roadwals of said plat and the installation of drainage structures
and such other work as is incidental and necessary thereto all in accordance with those
Plat Roadway Improvement Specifications dated Oct 16, 1974 , and to the satisfaction
of the County Road Engineer; such improvements to be completed not later than Nov R 1975
unless said date be extended at the option of the County Road Engineer.
Upon failure of the PRINCIPAL to comply with the requirements stated herein within the
time authorized, the OBLIGEE shall look to the SURETY for satisfaction to the extent of
this Surety Agreement.
The obligation of this Surety.,•Agreement shall be kept in full force and effect until, in
the opinion of the OBLIGEE, the requirements herein stated have been satisfied in which
event written release will be given by the OBLIGEE, the OBLIGEE having sole right to
grant such release and the SURETY hereby waives all rights to release from the obligation

sewer system, without a permit from the County Engineer to do so. The County
Code is specific in its requirement for permits, bonds, etc. for work in
the public riZht of way.
It is requested that you cease any and all work within the County Road Right
of Way until properly authorized to do so. No inspections or approvals will
be made by this office until a permit has been issued for the work.

In answer to your request, we submit the following infor-
mation. Our 110,000 volt system tie line located on Fancher Road
between 14th and 16th Avenues is there by franchise. We have no
intention of moving this valuable transmission line now or in the
foreseeable future. There are three sets of double pole structures
located on either or both Fancher Road and 14th, 15th, and 16th
Avenues. In consideration of Fancher Road, they are within 10
feet of the abutting property line on the east side of Fancher
Road.
We expect to be asked to serve this plat with underground
electric power when final approval has been rendered by the County
Planning Commission. At such time, we will apply our filed tariff
rates. For six lots or more averaging between 7,000 and 20,000
square feet in area, our differential between overhead and under-
ground electric service amounts to $11.5 per lot. The prcl i.nci.nary

ANALYSIS:
i
The Planning Commission is recommending denial of the current plat
based upon the following criteria:
ROADS
i. Access - This proposed plat does not substantially alter the lot
orientation and block design from what was previously approved
by the Planning Commission on the preliminary plats of record
dated 10 -27 -66 and 7- 21 -72. That is, an extension of the
proposed Fancher Road from 15th Avenue to 16th Avenue is not
essential for local access to any of the above proposed lots,
within this plat, or future plats adjacent to this property.
2. Traffic Circulation - Exhibit "A" daced 10 -12 -73 shows the rela-
tionship of the plat's circulation to the adjoining land, and while
recognizing topographic limitations and ownership patterns,
prescribes a more appropriate circulation system of local and
collector streets within the area than would be provided by con-
struction of Fancher from 8th Avenue to 16th Avenue, although from
strictly an engineering standpoint, it may be possible to construct
a road in the Fancher alignment.
Based upon field observations, land -use and ownership studies,
the staff notes that the improvement to minimum county standards
of Fancher Road between [Ah Avenue and 16th Avenue would fail to
provide reasonable access to the existing inaccessible portions of
the paper plat of Bettman's Addition and other adjacent properties.
Furthermore, it would not eliminate the need for the establishment
of the North/South circulation as shown on Exhibit "A" which could
serve the purposes of Fancher Road, while eliminating its (Fancher
Road) construction and avoiding unnecessary cuts and fills which
cause disfigurement to the natura terrain and vegetation.

3. Safety Existing physical conditions hinder safe site distance
for egress from Fancher to 16th Avenue. In accordance with the
purpose of the "tate Platting, an Enabling Act (RC 'vb 58.17.010),
it would not be appropriate to either construct said intersection
under the existing conditions, or alter the conditions to eliminate
the site distance problem; since the overall purpose of Fancher Road
is neither practical nor necessary for the orderly development
of this plat.
HEALTH DEPARTMENT REQUIREMIENTS
1. The existing site has areas of rock out- croppings and shallow
soils which are unacceptable for septic tank use. The staff notes
that a comparison of lots in Block 3 of the two previous proposals
with a similar location in Block 1 of this proposal show an
increase of lots in one of the designated unacceptable areas for
septic tank use.
In summary, neither the completion of Fancher from 8th to 16th nor a
shorter completion from 15th to 16th should be encouraged for reasons
of access, circulation, and site distance. In addition, the present
plat proposal fails to recognize previously designated unacceptable:
drainfield areas by concentrating more building sites within one of
those areas.
In conclusion, the previous plat submittals were carefully analyzed and
did fully recognize and address themselves to solutions of the problems
stated above, and therefore the Staff is obliged to make the above
sited recommendation.

Planning Commission Recommendation: Approve, subject to the execution
of the "Assurance of Discontinuance" and to the conditions as contained herein
Comment: This plat appears on rile agenda at the suggestion by the
Prosecuting Attorney's Office that it be heard by the Planning Commission
only after a proper preliminary plat submittal was received by the Planning
Commission office and only after an agreement had been reached with the
sponsor and the Prosecutor's Office on an "Assurance of Discontinuance"

by the staff to provide for full width rights of way, and that the lots be
adjusted to accomplish this within this property.
3. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of creating additional lots or
building sites without filing a replat.
4. That the plat provide for right of way width for streets as indicated on
the preliminary plat of record.

5. That appropriate provision be made that the following described property
be held in trust until the continuation of the streets be dedicated or
deeded; A 1' strip at the ends or edges, of all streets that terminate or
border the plat boundary.
6. That appropriate street names be indicated.
7. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the
utility companies. Written approval of the easements by the utility
company must be received prior to the submittal of the final plat.
8. That a plan for water facilities adequate for fire protection be approved
by the water supplier and the fire protection district. The water supplier
will certify that appropriate contracfual arrangements have been made
with the plat sponsor for construction of the water system prior to filing
of the final plat.
9. That a certificate of title be furnished the Planning Commission prior to
the filing of the final plat.
10. That the preliminary plat be.given conditional approval to August 1, 1973.
11. That streets be improved to standards established by Spokane County,
or a bond to cover the cost of such improvements be furnished the
County Engineer in the amount as determined by the County Engineer.
12. That profiles of streets, proposed grades, and drainage plan of the plat
be submitted and approved by the County Engineer before the final plat
is drawn. The County Engineer may require that design of drainage
improvements for the entire plat be made by a registered civil engineer.
13. Conditional approval of the plat is given subject to dedication of the
right of way to the public and approval of the road system in the plat
by the County Engineer.
14. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor.
15. The preliminary plat identifies certain lots which may be developed with
on -site sewage disposal systems (assuming such systems are located
and constructed according to Health District requirements) and certain
lots which should not be developed until public sewers are made
available. (Additional tests may be made to demonstrate the usability
of on -site systems on certain of these lots.)

To facilitate the protection of the public interest and prospective
purchasers and existing residents, the following guarantees will be
made by appropriate legal instrument:
a) That only those lots indicated as appropriate for individual sewage
disposal be sold by the sponsor prior to the availability of public
sewers.
b) That such lots be sold subject to an agreement by the purchaser to
participate in any future assessment program by a public utility
company or public agency undertaking to sewer the property.
c) That no development be undertaken nor building permit be granted
upon lots indicated as requiring public sewers.
If the sponsor is desirous of utilizing all of the lots as proposed, then
provisions must be made in the plat for a public sewer system.
Approval of the design of said system must be given by County and
State Health authorities and the County Utilities Department prior to
filing of the final plat. A suitable guarantee will be required to cover
the cost of providing said system in the amount as determined by the
Public Works Department.
That a statement be placed in the dedication to the effect that a public
sewer system will be made available for the plat and individual service
will be provided to each lot prior to sale.
16. That a program for development of a public water system, adequate for
domestic water use and providing for service connections to each lot,
be approved by County and State Health authorities prior to filing a
final plat.

divider will provide for the installation of a public water system as
