MINUTES January 12, 1973 PRELIMINARY SUBDIVISION AND ZONE CLASSIFICATION UPGRADING PE- 6 86 -73 - SHELLEY ACRES: BASCETTA ZE- 18 -73 - AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL ZONE (R -1) Planning Commission Recommendation: Approve, subject to the following conditions A. Conditions: 1. That the plat be designed as indicated on the preliminary plat of record anc)/or attached sheets as noted and that the staff be allowed to work with the sponsor to make minor adjustments in the design as detailed final plats demonstrate necessity for changes. Direct access from individual lots will not be permitted on Sullivan Road. Duplex lots will be designated on the final plat. No onsita grading or removal of overburden will be permitted before approval of road profiles. Certain lots will be regraded to facilitate workable septic tank systems. After re- grading, additional tests may be.roquired by the Health District to determine feasibility of on -site sewer systems. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites without filing a replat. 3. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 41. That appropriate provision be made that the following described property be held in trust until the continuation of the streets be dedicated or deeded: A 1' strip at the ends or edges of all str:;ets that terminate or border the plat boundary. (Temporary cul de sacs are required when streets terminate at the plat boundaries.) 5. That appropriate street names be indicated. 6. That appropriate utility easements be indicated on copies of the approved preliminary plat for distribution to the Planning Depart- ment and the utility companies. That a plan for water facilities adequate for fire protection be approved by the water supplier and the fire protection district.. The water supplier will certify that appropriate contractual arrangements have been made with the plat sponsor for con- struction of the water system prior to filing of the final plat. B. That a certificate of title be furnished the Planning Commission prior to the filing of the final plat. 9. That the preliminary plat be given conditional approval to February 1, 197 -_. 10. That streets be improved to standards established by Spokane County, or a bond to cover the cost of such improvements be furnished the County Engineer in the amount as determined by the County Engineer. 11. That profiles of streets, proposed grades, and drainage plan of the plat be submitted and approved by the County Engineer before the final plat is drawn. The County Engineer may require that design of drainage improvements for the entire plat be made by a registered civil engineer. 12. Conditional approval of the plat is given subject to dedication of the right of way to the public and approval of the road system in the plat by the County Engineer. 13. That the name of Shelley Lake #1 be proposed for the first final plat addition and number sequance additions of the same name will follow to lessen confusion and reduce filing complications. 14. That percolation and /or soil classification tests be submitted as required by the County Health Officer. Subdivider is not authorized to have the final plat drawn until the County Health Officer certifies in writing that lot sizes, soil porosity and topography ra such as to reasonably expect on -site sewage systems to be workable and not injurious to water strata used for potable water wells or springs. 15. That a program for development of a public water system, adequate for domestic water use and providing for service connections to each lot, be approved by County and State Health authorities prior to;filing a final plat. ZONING RECOMMENDATION Planning Commission Recommendation: Approve lots 8 -18, Block 2 1 Block 1, and 1 -6, Block 3 as ind on the preliminary plat of record to Two - Family Residential Zone upon the filing of the final plat Approve the balance of the plat to the Single Family Residential Zone upon filing of the find plat B. Reasons: 1. The designated single family lots in Shelley Acres have been designed to accommodate single family residences; i.e., all of the lots have at least 80' of frontage and 125' of depth. The designated duplex lots have been designed to accommodate single family residences and duplaxes„ i.e., all of the lots have at least 90' of frontage and 125' of depth. 2. The Planning Commission has been routinely upgrading similar residential plats in the Vera and Opportunity communities to the Singly family Residential Zon.;. The Planning Commission is of the opinion that the designated lots along 11th Avenue would be appropriate for duplexes because of their proximity to the storage and workshop buildings of Central Valley High School. 3. The Single Family Residential Zone prohibits duplexes, animal keeping other than household pats, mobile homes, and home occupations.
