WHEREAS, pursuant to the provisions of the Revised
Code of Washingon Section 36.32.120(6) the Board of County
Commissioners of Spokane County has the care of County
property and the management of County funds and business;
and
WHEREAS, pursuant to the provisions of RCW Chapter
58.17, the Board of County Commissioners of Spokane County
approved the subdivisions known as Swan Acres First and
Second Additions recorded in the Spokane County Auditor's
Office in Volume 15 at page 48 and Volume 16 at page 96
respectively, which plats as a condition of approval
required that all building permits therein conform to
the provisions of the National Flood Insurance program
which program was adopted by Spokane County and codified
. in Spokane County Code Chapter 3.20; and
WHEREAS, the Spokane County Flood Control Ordinance
does not discuss shallow flood zone areas, however, the ordinance
does require a development permit to be obtained before any
construction or development may occur within properties
located within the flood hazard boundary map; and
WHEREAS, Spokane County is agreeable to issue a
building permit for a parcel of property located within the
Swan Acre Second Addition subject to the National Flood
Insurance program as a result of Conditions of Approval
attached thereto under the proviso that the owner of such
property agree to comply with certain conditions in con-
junction with building any structure on such parcel as well
as indemnify Spokane County for any flood damage which the
property upon which the structure or structures itself may
sustain;
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners of Spokane County pursuant to the
provisions of RCW Section 36.32.120(6) and RCW Chapter 58.17,
that the Board of County Commissioners of Spokane County
hereby authorizes the Chairman of the Board or a majority
of the Board to execute that document entitled "Indemnity
Agreement," pursuant to which under certain terms and condi-
tions Spokane County through the Spokane County Building
& Safety Code Department will issue a building permit on
'Lot 1, Block 1 of Swan Acres First and Second Additions
recorded in Volume 15 at page 48 and Volume 16 at page 96
in the-Spokane County Auditor's Office in consideration of
the'owner.of such property agreeing to comply with certain
conditions necessary to carry out the intent of the
National Flood Insurance program adopted by Spokane County
under Spokane County Code Chapter 3.20 as well as agreeing
to indemnify Spokane County against any and all liability,
which may occur as the result of the issuance of such

DATE: June 3, 1976
that conditional approval of the plat is given subject to dedication of Right of
Way to the public and approval of the road system in the plat by the County Engineer;
that plans, profiles, and cross sections showing proposed street centerline and curb
grades be submitted to the County Engineer for approval prior to construction and
the filing of a final plat;
that drainage plans and design calculations showing the grades and alignment of drain-
age facilities be submitted to the County Engineer for approval prior to construction
and the filing of a final plat;
construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed land surveyor, who shall be responsible
for perpetuating all evidence of the location of survey monuments which may be
disturbed during construction and who shall furnish the County Engineer with "As
Built" plans and a certificate in writing that all improvements were installed to
the lines and grades shown on the approved construction plans and that all disturbed
monuments have been replaced;
no construction work is to be performed within the Public Right of Way until a permit
has been issued by the County Engineer. All work is subject to inspection and approval
by the County Engineer;
all construction within the Public Right of Way is to be completed prior to filing
the final plat or a bond in the amount estimated by the County Engineer to cover the
cost of construction of improvements, construction certification, "As Built" plans,
and monumenting the street centerlines shall be filed with the County Engineer.

County Commissioners of Spokane County approved the subdivision known as Swan Acres
First and Second Addition, recorded in the Spokane County Auditor's Office at Volume
15 and 16, page 48 and 96, which plat, as a condition of approval, required that all
buildings therein conform to the provisions of the National Flood Insurance Program
which program was adopted by Spokane County and codified in Spokane County Code
Chapter 3.20; and
WHEREAS, the Spokane County Flood Control Ordinance, codified in Spokane
County Code Chapter 3.20 does not discus; Shallow Flood Zone areas, however, such
code chapter does require a development permit to be obtained before any construction
or development may occur within properties located within the flood hazard boundary
map; and
WHEREAS, Spokane County is willing to issue a building permit for certain
properties located within Swan Acres Virst and Second Addition governed by the

above, as well as those conditions set forth in Attachment
This Indemnity Agreement contains the entire agreement between the parties
hereto. The terms of this release are contractual and not merely recitals.
The Indemnitor states that he has carefully read the foregoing Indemnity
Agreement, knows the contents thereof, and that he has signed the same as his own
free act and deed.
The Indemnitor further states that he has been advised to contact legal
counsel prior to executing this document.
This agreement is one which shalt run with that parcel of property described
hereinabove.

This being the day set for the hearing on Spokane County Engineer's Report on the
proposed establishment of BEST ROAD and CROWN AVENUE, ESTABLISHMENT proceedings for which
were initiated by PRELIMINARY RESOLUTION NO. , and it appearing to the Board on
proof duly made that Notice of Hearing was published and posted in the manner and for the

Your December 6, 1983 memo concerning Swan Acres First Addition indicated you are
requiring the final grade over the installed drainfield to be a minimum of 12 inches
above the street curb. This is being required as a result of the plat being within a
flood area, and is in conjunction with our office's requirement that any opening in
the building, such as a door or window, be a minimum of 12 inches above the street
curb.
I would like to point out that both the City and the County were required by the
Federal Government to adopt special regulations in order that the residents of the
total county be eligible for Federal flood insurance. These regulations require that
"on —site waste disposal systems shall be located to avoid impairment to them or con—
tamination from them during flooding." We, therefore, suggest that you consider
requiring the drainfield to be constructed above the flood elevation.

We are concerned that this may cause future problems if the actual drainfields
themselves are installed below the flood elevation. If the surface water level

I. GENERAL INFORMATION
A. History
The applicant is requesting a third Extension of Tiine. The proposal was heard
and recommended for approval on June 11, 1976 by the Planning Commission.
Since that time, two Extensions of Time have been granted. The sponsor
indicates that changes in engineering requirements and paper work have created
delays. The plat is currently close to being finalized and is requesting an
Extension of Time to September 1, 1980.
B. Location
The proposal is located in the Spokane Valley south of Forker Road and about
500 feet east of Bannen Road.

4.55 acres subdivided into 8 lots for single family dwellings
- Lot frontage = 105 feet

II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has not recommended any new conditions. Only those
conditions already attached to the preliminary plat of record.
B. Sewage Disposal
The sponsor has proposed individual on -site sewage disposal systems which have
been authorized by the Health District.
C. Drainage
The County Utilities Engineer reports that the final construction plans plans
must be reviewed and approved prior to the filing of the final plat.
D. Water Supply
The proposal is located within the recorded service area of Trentwood
Irrigation District.
E. Fire Protection
The proposal is situated within the recorded service area of Fire District #l1.

Gentlemen:
On August 30, 1969, the Plat Hearing Examiner Committee met at 9:00 A.M. to
consider four Extensions of Time and seven Preliminary Plats and one Discussion
on clarification of engineering conditions for Jan's Addition. Following are the
applications in sequence and the action taken by the Committee. If not appealed,
these decisions are final 10 days after Minutes have been signed by the Hearing
Examiner Committee, which was August 31, 1979.
Hearing Examiner Committee Board members were: Eldon Thomas - Chairman, Jane
Myers and Ted McCoury.
1. PE- 1311 -79, Jan's Addition - Clarification of Engineering Conditions
- Hearing Examiner Committee generally supports the original conditions as
stated on Findings and Order dated June 28, 1979.
- .Those conditions concerning County paving policy regarding dedication, paving,
curbing and sidewalk where necessary along 16th & Progress are affirmed by
Hearing Examiner Committee.
- Condition #31 will be revised to read: "Lots 15, 16 & Tract A will remain

The Planning Commission members discussed at length the question of extensions
of time and present policy in that connection. It was decided the Policy Com-
mittee would meet and set a stricter policy as to necessary proof by the sponsor

on the face of said water plan that the plan is in conformance with
their requirements and will adequately satisfy their respective
needs. Said water plan and certification will be drafted on a
transparency suitable for reproduction.
The water supplier (purveyor) will also certify prior to the filing
of the final plat on a copy of said water plan that appropriate con-
tractual arrangements have been made with the plat sponsor for
construction of the water system, in accordance with the approved
plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for completion of the water system and
inspection by the appropriate health authorities prior to application
for building permits within the plat. The contractual arrangements
will include a provision holding Spokane County and the water
supplier (purveyor) harmless from claims by any lot purchaser
refused a building permit due to the failure of the plat sponsor to
satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the
public water system as approved by County and State Health
authorities and the local fire district and water supplier(purveyor)
will be installed within this plat, and the subdivider will provide
for individual service to each lot prior to sale of each lot.
•NOTE: The Spokane County Health District has determined that
the soil conditions in the plat are suitable for on -site sewage •
disposal systems on each lot.
• 8. That a certificate of title be furnished the Planning Commission
prior to the filing of the final plat.
That the preliminary plat be given conditional approval to
July 1, 1977.
q 10. That streets be improved to standards established by Spokane
County or a bond to cover the cost of such improvements be fur -
nished the County Engineer. The bond may also cover the cost of
"as built" plans, engineering costs, and placing of final center
line monuments.
That profiles of streets, cross sections, proposed grades, and

B. STAFF ENVIRONMENTAL REVIEW
As required in WAC 197 -10 -320, the staff of the County Planning Commissior
reviewed the environmental checklist submitted by Mr. Lawrence V. Dunsmu.
in behalf of Mr. George Swan for the Swan Acres First Addition Preliminary
Subdivision. The proposal is located approximately in the NE 1/4 of the
SW 1/4 of Section 35, Township 26N., Range 44 E.W.M., south of and
tangent to Folker Road, and about 150 feet east of Bannen Road. The Sponsor
requests to subdivide about 4.5 acres into 8 lots creating a density of
nearly 1/8 lots per gross acre. The site Es located on relatively flat terrain
which is currently being used as active agricultural land.
The staff review has identified four potential areas of environmental impacts
First, and common to all subdivisions is the increase in motor vehicle
traffic and all the effects associated therewith. These would include such
impacts as Increased air pollution, specifically suspended particulates from
unimproved streets, increased noise. and increased public safety hazards
from traffic. In this case, these are not considered sugntftcant.
A second potential environmental impact area considered was the increased
demand on public services and utilities. This would include such factors
as increased requirements for police and fire protection, provision of
additional school, par k, and recreational facilities, and additional mainten-
ance requirements on all county facilities and roads. This would also
include such Impacts as associated with extension of Utility lines (power,
natural gas, telephone) and the provision of suitable long term sewerage,
domestic water, storm water runoff, and solid waste disposal systems.
Again, these impacts are not considered significant.
A third potential impact area identified by the staff review involves the
transition of active agricultural land into residential. Existing productive
alfalfa fields will be converted to single family residential use at a density
of less than two units per gross acre. Due to the relatively small size of
this subdivision and the .fairly low dcvelopnent density, this is not consider
a significant Impact.

A final problem area involves the use of septic tank /drainfield sewerage
systems in close proximity to an existing domestic water well. The Count;
Health District has proposed to mitigate any possible contamination from
sewage effluent by recommending that all septic tank drainfields be set
back a minimum of 100 feet from the well. If this measure is employed,
no significant impact should result.
The conclusion of this environmental checklist review is that no significarn
environmental impacts will likely result from the proposal if the specified
mitigating measures are adopted. Therefore, it is recommended that a
Declaration of Non - Significance be issued and an environmental impact
statement not be required.
C. ZONING RECOMMENDATION:

Planning Commission Recommendation: Approve Swan Acres First Addition as
indicated on the preliminary plat of record to Single Family Residential (R -1)
Zone Classification upon the filing of the final plat.
REASONS:
1. The eight (8) lots in the subdivision have been designed to
accommocate single family residences; proposed density of 1.8
Lots per gross acre.
2. The Planning Commission has been routinely upgrading similar
residential plats in the Trentwood Community to the Single Family
Residential and Two - Family Residential Zones.
3. The Staff is of the opinion that none of the lots within the Subdivi-
sion have disadvantaged relationships which would warrant duplex"
zoning.
4. The Single Family Residential Zone prohibits duplexes, animal.
keeping other than household pets. mobile homes, and home
occupations
