iM STAFF RECOMMENDATIONS PRELIMINARY SUBDIVISION AND ZONE CLASSIFICATION UPGRADING PS- 1019 -76 -- ILLER FIRST ADDITION: MATHIS ZS- 71 -76 -- AGRICULTURAL TO AGRICULTURAL SUBURBAN Planning Staff Recommendations: Approve, subject to the followinc conditions: A. CONDITIONS: 1. That the plat be designed as indicated on the preliminary plat of record and /or attached sheets as noted, and that a statement be placed in the dedication prohibiting the issuance of a building permit for Lot 7, Block 2, until the remaining half of Van Marter Street is dedicated. The spon- sor shall work with the Planning Staff and County Engineer on the final alignment of Van Marter Street prior to drawing the final plat. Also, that Lot 1, Block 3, as shown on the revised preliminary plat of record be included in the final plat. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites without filing a replat. 3 That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 4. That appropriate provision be made that the following described property be held in trust until the continuation of the streets be dedicated or deeded: A 1' strip at the ends or edges of all streets that terminate or border the plat boundary.. (Temporary cul de sacs are required when streets terminate at the plat boundaries.) 5. That appropriate street names be indicated. 6. That appropralte utility easements be indicated on copies of the approved preliminary plat for distribution to the Planning Department and the utility companies. W ritten approval of the easements by the utility company must be received prior to the submittal of the final plat. 7. That a plan for water facilities adequate for fire protection be approved by the water supplier and fire protection district. Said water plan must also have been approved bythe appropriate health authorities. Said water plan and certification will be drafted on a transparency suitable for reproduction. The water supplier (purveyor) will also certify prior to the filing of the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan, and in accordance with a time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the . appropriate health authorities prior to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County and the water supplier (purveyor) harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire district and water supplier (purveyor) will be inktalled within this plat, and the subdivider will provide for individual service to each lot prior to sale of each lot. NOTE: The Spokane County Health District has determined that the soil conditions in the plat are suitable for on -site sewage disposal systems on each lot.. 8. That a certificate of title be furnished the Planning Commission prior to the filing of the final plat. 9. That the preliminary plat be given conditional approval to August • 1, 1977. 10. That streets be improved to standards established by Spokane County or a bond to cover the cost of such improvements be furnished the County Engineer. The bond may also cover the cost of "as built" plans, engineering costs, and placing of final center line monuments, and that Ferret Drive and Holman Road from Felts Road to the west boundary of the plat shall be opened and Improved to County standards. 11. As required in VVAC 197 -10 -320, the staff of the County Planning Commission reviewed the environmental checklist submitted by Mr. Melvin L. Mathis for the Iller First Addition Preliminary Subdivision. The proposal is located approximately in the E 1/2 of the NE 1/4 of Section 5, Township 24 N., Range 44, E.W.M. about 1/4 of a mile south of 44th Avenue just east of Feits Road. The proponent requests to subdivide 37 acres into 25 lots creating a gross density of nearly 1 acres per lot. The site is located On moderate to gently rolling terrain that is currently covered by active pasture land. The staff review has identified four potential areas of environmental impacts. First, and common to all subdivisions is the increase in motor vehicle traffic and all the effects associated therewith. These would include such impacts as increased air pollution, specifically suspended particulates from unimproved streets, increased noise, and increased public safety hazards from traffic. A second potential.environmental impact area considered was the increased demand on public services and utilities. This would include such factors as increased requirements for police and fire protection, provision of additional school, park, and recreational facilities, and additional mainten- ance requirements on all county facilities and roads. This would also. include such impacts as associated with extension of utility lines (power, natural gas, telephone) and the provision of suitable long term sewerage, domestic water, storm water runoff, and solid waste disposal systems. The third impact area involves the transition from active agricultural use to residential. Existing productive animal pasture land will be converted to single family residential use at a density of one unit In almost 1,5 acres of land. Due to the relatively low density of this subdivision, this is not . considered a signigicant impact. A final potential impact Involves hazards created by improper location of septic tank drain fields. The Spokane County Health District has identified certain lots within the subdivision in which the drainfield should be located on high ground, away from the natural drainage channels. If this measure is included as a condition of approval of the subdivision, the septic tank - drain:iold type sewerage system should operate satisfactorily and no signifi- cant adverse impacts should result. . 2 -b 1 PS- 1019 -76 ILLER FIRST ADDITION: MATHIS (Continued) The conclusion of this environmental checklist review is that no significant environmental impacts will likely result from the proposal If the specified mitigating measures are adopted. Therefore, it is recommended that a Declaration of Non - Significance be issued and an environmental impact statement not be required. C. ZONING RECOMMENDATION: Planning Staff Recommendation: Approve Ilier First Addition as indicated on the preliminary plat of record to Agricultural Suburban (A -S) Zone Classification upon the filing of the final plat 1. Most of the lots within the subdivision average one (1) acre in size and conform to the area requirements to accommodate single family residences, limited animal keeping and agricultural activities. 2. The proposed plat lies immediately east of the Iiler's Addition, and .h south of the Ponderosa developments ( one acre suburban.tracts), which are zoned Agricultural Suburban. 3. School District: Central Valley School District 2 -c FINDINGS PRELIMINARY SUBDIVISION, RECONSIDERATION OF CONDITIONS PS- 1019 -76 - ILLER FIRST ADDITION: MATHES ZS- 71 -76 - AGRICULTURAL TO AGRICULTURAL SUBURBAN Staff findings regarding PS- 1019 -76, Iller First Addition: I. GENERAL INFORMATION: Iiter First Addition was approved by the Planning Commission, July 9, 1976, and has subsequently received one extension of time to July 1, 1978. The proposal at that time called for the subdivision of about 37 acres into 24 lots, all for single family dwellings. The typical lot size for the plat at that time was one (1) acre. The applicant is before you today to request a change in the original condi- tions of approval, so as to allow the subdivision of about 33 acres into 31 lots, all for single family dwellings with a typical lot size of one (1) acre. The change in conditions would increase by seven (7) the number of lots in the original proposal. The Staff finds that approval of this request would be compatible with recent planning decisions in the area where the proposals that have been approved have been approved have a typical lot size of one (1) acre. II. SPECIAL INFORMATION: The Staff has reviewed the adequacy of public facilities and utilities and deficiencies are noted in the following areas. A. Sewage Disposal The applicant proposes the use of individual on -site sewage disposal systems. Due to excessive sloping topography, the Health District recommends that Lot 1, Block 3 either be ellininated from the prelimi- nary plat or be combined with Lot 2, Block 3 so as to create an ade- quate building site. Lots 7, 9, 10 and 11, Block 2 also have surface water drainage problems. The County Health District.wlll require approval of both the drainage plan by both the County Engineers and their office as well as submittal of site plans that shall indicate at a minimum; driveways, dralnfields and soil fills for each of the lots mentioned.
