The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate heaith authorities prior to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County and the water supplier (purveyor) harmless from claims by any lot purchaser re- fused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire district and water supplier (purveyor) will be installed within this plat, and the subdivider will provide for individual service to each lot prior to sale of each lot. NOTE: The Spokane County Health District has determined that the soil conditions in the plat are suitable for on -site sewage disposal systems on each lot. 8. Also that 10 feet of right of way be dedicated on the east side of the plat for McDonald Road. 13. That a name be indicated before the final plat is filed; such name to be approved by the County Assessor and the Planning staff. B. STAFF ENVIRONMENTAL REVIEW: As required in WAC 157 -10 -220, the staff of the County Planning Com- mi av,on reviewed the environmental checklist submitted by Mr. Gordon 1AT. Curry for a preliminary subdivision of Curry Two. The proposal is located approximately in the E 1/2 of SW 1/4 of Section 34, Township 26 N., Range 44, E.W.M., just west of and fronting McDonald Road, about 1200 feet north of Wellesley Avenue. The proponent requests to subdivide about 8.7 acres of land into 24 lots -for single family (22 lots) and duplex (2 lots) lots- creating a gross unit density of about 3 units per acre. The site is located on a relatively flat to moderately steep (11% slope) terrain currently covered by productive pasture vegetation. The staff review has identified four potential areas of environmental im- pacts. First, and common to all subdivisions, is the increase in motor vehicle traffic and all the effects associated therewith. These would include such impacts as increased air pollution, specifically suspended particulates from unimproved streets, increased noise, and increased public safety hazards from traffic. A second potential environmental impact area considered was the increas- ed demand on public services and utilities. This would include such factors as increased requirements for police and fire protection, provi- sion of additional school, park, and recreational facilities, and addition- al maintenance requirements on all county facilities and roads. This would also include such impacts as associated with extension of utility lines (power, natural gas, telephone) and the provision of suitable long term sewerage, domestic water, storm water runoff, and solid waste disposal systems . A third potential environmental impact revealed by the staff evaluation involves the subsurface injection of sewage efflu t and storm water runoff. This waste water placed at a depth will percolate downward toward the aquifer rather than evaporating back into the atmosphere as under natural conditions. A portion of the contaminants will likely be filtered out of this waste water, but the resulting quality has not been determined yet. A total of about 6 acre feet per year of waste water will be generated by this proposal, 4 acre -feet of which will likely be sewage effluent. (Cent' d) -5B- PE- 1023 -76, CURRY TWO (Coned) The final potential area of environmental impact is the transition of land from an active agricultural use to suburban residential. The 8.7 acre site is currently used as pasture grazing land but the proposal will change this to single family and two family residential use at a gross density of three (3) units per acre. The conclusion of this environmental checklist review is that no signifi- cant environmental impacts will likely result from the proposal. There- fore, it is recommended that a Declaration of Non - Significance be issued 1 and an environmental impact statement not be required. C. ZONING RECOMMENDATION: Planning Commission Recommendation: Approve Curry Two as indicated on the preliminary plat of record to Single Family Residential (R -1) Zone Classification upon filing of the final plat. REASONS: 1. The staff is of the opinion that the site is not sufficiently disadvan- taged to warrant duplex development. The plat does not join a major or secondary arterial nor is it situated on the of a resi- dential neighborhood. 2. The Planning Commission has been routinely upgrading similar residential plats in the Valley to the Single Family Residential (R -1) Zone. 3. The Single Family Residential Zone prohibits duplexes, animal keep- ing other than household pets, mobile homes, and home occupations. D. GENERAL DATA: 1. That acre or larger tracts would be a more appropriate lifestyle. B. BACKGROUND Curry Two Subdivision was originally heard by the Planning Commission on July 9, 1976. The proposal at that time called for the subdivision of about 8.7 acres of land into 24 lots for single family (22 lots) and duplex (2 lots) use creating a gross density of about three (3) units per acre. Planning Commission decision was for denial. Reasons given for denial by the Planning Commission were as follows: a. "The residential density proposed by the sponsor is considerably higher than that of the existing density in the surrounding area. b. It was felt by the Planning Commission that the updating of the Comprehensive Plan would more appropriately determine the density for the area." ' It should be noted, however, that the Planning•Commission. decision expressed no .policy guidelines for the staff to follow; i.e ., what would be an appropriate density. The sponsor, Gordon W. Curry, subsequently appealed the Planning Commis- sion decision to the Board of County Commissioners. The Board conducted a special hearing on the proposal August 12, 1976. The Commissioners decision of August 26, 1976, upheld the Planning Commission recommendation of July 9, 1976.
