The purpose of the meeting was to discuss the above - referenced lawsuit and the conditions of approval in conjunction with the approval of 14th Addition to Veradale Heights on September 10, 1976, in particular, the improvements made on "Bests' Road. At that meeting, I, on behalf of Spokane County, advised that it was the County's position that Mr. McKinley had the obligation to improve a 30 foot strip on Best Road, as well as curb the plat side of the roadway only. Mr. McKinley suggested that he felt it was his obligation to improve only a 20 foot strip, the length of Best Road as well as curb the plat side of the roadway. As a result of our discussion, I requested that the Spokane County Engineering Office provide me with an estimate of the cost, including engineering and inspection fees, associated with the improvements of Best Road. The Spokane County Engineering Department advises as follows: 1. For the curbing of the west side only and pavement of a 20 foot strip of Best Road the cost would be approximately $16,500. For the pavement of Best Road in its entirety, a 40 foot strip and curbing of both sides, the cost would" be approximately $30,000. The Spokane County Engineering Office indicated that the estimated prices are somewhat higher than what was discussed in our May 2, 1983 meeting. This is due to the present construction season. In reviewing my notes of our May 2, 1983 meeting, I note that Mr. McKinley offered to do the following: 1. Give Spokane County $10,000 to be used to meet his obligations in conjunction with the construction of Best Road pursuant to the plat approval; or 2. Assume the assessment on all lots within the 14th Addition to Veradale Heights Plat which front on Best Road; or 3. Immediately curb and pave to the center line of Best Road. As a result of discussions with the Spokane County Engineering Office, Spokane County proposes in settlement of the above referenced lawsuit, that Mr. McKinley agree one of the following options: 1. Give to Spokane County $12,000, which money will be kept in a special account and used to construct a 30 foot right -of -way along Best Road and curb the plat side of the 14th Addition to Veradale Heights. Under this option, Spokane County would execute appropriate documents indicating Mr. McKinley's compliance with the road condition within the plat; or 2. Mr. McKinley immediately proceed to curb the west side and pave a 30,foot strip on Best Road. Mr. McKinley indicates to me that he is still willing and capable of completing the paving requirements as were originally approved when the plat was filed. He believes that that requirement was to pave Best Road only to the center line and to curb on the plat side only. It is my understanding that the Engineer's department of the County wants Mr. McKinley to pave nearly the entire road for the benefit of people not residing within the plat. Brent McKinley, 14th Addition to Veradale Heights I have recently received correspondence from Mr. McKinley and subsequently had a telephone conference with him, where he is in full agreement that he will complete the improvements re- quired on Best Road, as provided in the subject plat. The problem that we still have is that Mr. McKinley be- lieves that he is only responsible to curb the West side of Best Road and pave only to the center of the Road. If Spokane County is in agreement that this is the condition that Mr. McKinley is to comply with, he will immediately contract for the paving and curbing, which curbing will be only on the plat side, or the West side of Best Road, and which paving will only extend to the center of the road. B. STAFF ENVIRONMENTAL REVIEW: As required in WAC 197 -10 -320, the staff of the County Planning Department reviewed the environmental checklist submitted by V. Eugene Cameron In behalf of Mr, Jerome F. Ruddy for a preliminary subdivision called " 14th Addition to Veradale Heights ". The proposal is located approximately in the NE 1/4 of the SW 1/4 of the NW 1/4 of Section 14, Township 25 N., Range 44 E.W.M., adjacent and south of Boone Avenue, adjacent and west of Best Road, and adjacent and north of Cataldo Avenue. The proponent is requesting to sub- divide 9.3 acres into 28 single family residential lots creating a gross density of 3.0 units per acre. The site is located on flat and vacant terrain. The staff review has identified three potential areas of environmental impacts. First, and common to all subdivisi ons is the increase in motor vehicle traffic and all the effects associated therewith. These would include such factors as increased requirements for police and fire protection, provision of additional school, park, and recreational facilities, and additional maintenance requirements on all county facilities and roads. This would also include such impacts as associated with extension of utility lines (power, natural gas, telephone) and the provision of suitable long term sewerage, domestic water, storm water runoff, and solid waste disposal systems. A second potential environmental impact area considered was the increased demand on public services and utilities. This would include such factors as increased requirements for police and fire protection, provision of additional school, park, and recreational facilities, and additional maintenance requirements on all county facilites and roads. This would also Include such impacts as associated with extension of utility lines (power, natural gas, tele- phone) and the provision of suitable long term sewerage, domestic water runoff, and solid waste disposal systems. - 7b- vN/rs aims PE- 1042 -76 -- 14TH. ADDITION TO VERAILE HEIGHTS (Continued) A third potential environmental impact revealed by the staff evaluation involves the subsurface injection of sewage effluent and storm water runoff. This waste water placed at a depth will percolate downward toward the aquifer rather than evaporating back into the atmosphere as under natural conditions. A portion of the contaminants will likely be filtered out of this waste water, but the resulting quality has not been determined yet. About 6.9 acre feet of waste water will be introduced beneath the soil surface, 4.2 acre feet of which will be septic tank effluent. The conclusion of this environmental checklist review is that no signi- ficant environmental impacts will likely result from the proposal if the specified mitigating measures are adopted. Therefore, it is recommended that a Declaration on Non - Significance be issued and an environmental impact statement not be required. C. ZONING RECOMMENDATION: Planning Commission Recommendation: Approve the 14th Addition to Veradale Heights as indicated on the preliminary plat of record to the Single Family (R -1) Zone classification upon filing of the final plat. REASONS: 1. The lots in the 14th Addition to Veradale Heights have been designed to accommodate single family residences; i.e „all of the lots are to have at least 80 feet of frontage and 10, 000 square feet of area; proposed density of 3.0 lots per gross acre. 2. The Planning Commission has been routinely upgrading similar residential plats in the Veradale Community to the Single Family Residential Zone. 3. The Single Family Residential Zone prohibits duplexes, animal keeping other than household pets, mobile homes, and home occupations. 4. The staff is of the opinion that none of the lots within the plat are sufficiently disadvantaged to warrant duplex zoning. The staff notes that the character of the surrounding area has been established for single family residences. Ruddy for a preliminary subdivision called " 14th Addition to Veradale Heights ". The proposal is located approximately in the NE 1/4 of the SW 1/4 of the NW 1/4 of Section 14, Township 25 N., Range 44 E.W.M., adjacent and south of Boone Avenue, adjacent and west of Best Road, and adjacent and north of Cataldo Avenue. The proponent is requesting to sub- divide 9.3 acres into 28 single family residential lots creating a gross density of 3.0 units per acre. The site is located on flat and vacant terrain. The staff review has identified three potential areas of environmental impacts. First, and common to all subdivisions is the increase to motor vehicle traffic and all the effects associated therewith. These would include such factors as increased requirements for police and fire protection, provision of additional school, park, and recreational facilities, and additional maintenance requirements on all county facilities and roads. This would also include such Impacts as associated with extension of utility lines (power, natural gas, telephone) and the provision of suitable long term sewerage, domestic water, storm water runoff, and solid waste disposal systems. A second potential environmental impact area considered was the increased demand on public services and utilities. A third potential environmental impact revealed by the staff evaluation involves the subsurface injection of sewage effluent and storm water runoff. This waste water placed at a depth will percolate downward toward the aquifer rather than evaporating back into the atmosphere as under natural conditions. A portion of the contaminants will likely be filtered out of this waste water, but the resulting quality has not been determined yet. About 6.9 acre feet of waste water will be in`roduced beneath the soil surface, 4.2 acre feet of which will be septic tank effluent. The conclusion of this environmental checklist review is that no signi- ficant environmental impacts will likely result from the proposal if the specified mitigating measures are adopted. Therefore, it is recommended that a Declaration on Non- Significance be issued and an environmental impact statement not be required. C, ZONING RECOMMENDATION: Planning Commission Recommendation: Approve the 14th Addition to Veradale _Heights as indicated on thepreliminary plat of record to the Single Family (R -1) Zona classification upon filing of the final plat. - REASONS: 1. Ths lots in the 14th Addition to Veradale Heights have been designed to accommodate single family residences; i.e., all of the lots are to have at least 80 feat of frontage and 10, 000 square feet of area; proposed density of 3,0 lots per gross acre, 2.
