County ownership has precluded any development. In order to estimate the present market value of the land County records were examined to determine recent sales. Real estate salesmen and others were also consulted. A total of eighteen sales were investigated. These were vacant at the time of sales most of them now occupied with new homes. Lot location rather than size seem to be the factor determining the price, it was therefore, felt that an average reflecting all sales would be more indicative of the cost per square foot. It is my opinion that the market value of County property adjacent to 23rd Avenue should be S.25 per square foot. Our office has recently met with the developer and we are in the process of setting up another meeting with him, and the Board of County Commissioners to hopefully resolve this matter. As I understand you are asking what you need to do to get started on a Road Improvement District to improve 23rd Avenue. I wrote you a letter on June 26, 1974, a copy of which is attached, which was intended to answer that question. To repeat: This Department will issue you an R.I.D. potition for improvement of 23rd Avenue when you present to Spokane County written assurance, in a form acceptable to the Prosecuting Attorney, that the County will not be obligated to pay any portion of the cost of said improvements. This is in accordance with the agreement between yourself and Spokane County. I have discussed this matter with Jerry Neal of the Prosecuting Attorney's Office and as I understand, a letter from you to the Board of County Comoissioners stating the manner in which you have arranged for the coat of the improvements to be borne other than by the County would suffice. The R.I.D. method of improvement takes a considerable length of time to process because of the various methods, notices, hearing, etc., required by law. An R.I.D. petition presented at this time could not be constructed until 1975. In fact, the action would need to have been started some months ago to even have the preliminary hearing by the Board prior to the deadline set in the agreement. I would suggest that you make contact with Jerry Neal, Chief Civil Deputy of the Prosecuting Attorney's Office (4% -3633) regarding your intentions to fulfill the requirements of the Agreement. It is my understanding that Mr. Dixon was advised by Mr. Sam Anqrove, of the City Park Department, that the entire paving of 23rd Avenue adjoining this addition, would be payable on an P..I.D., and on this basis Mr. Dixon agreed that he would so pave the street, to standards, and that all of this was in consideration of a small tract of land being given over to Mr. Dixon in order to straighten out 23rd Avenue with the adjoining streets. Now Mr. Dixon has been advised that that half of 23rd Avenue adjoining the park cannot be financed under an R.I.D. assessment, which imposes a financial burden upon Mr. Dixon which he is not willing nor able to assume. Therefore, he feels that one of the substantial and material conditions for the entire agreement has now failed, to his detriment. Therefore, I propose, on behalf of Mr. Dixon, that the prior agreement be abandoned in favor of the following proposal: Mr. Dixon pay to the City Park Department the appraised value for the tract of land being given to the subdivision, which our records indicate would be the amount of $350.00; that the requirements that 23rd Avenue be paved be withdrawn, and that the road, which has presently been finished to grade, be accepted "as is." Mr. Dixon proceeded to work on the County property prior to aq opeeasat with the Board regarding the property. when he was stopped be aspeoached the Board on a crisis basis asking special action by the Board to solve his problem. An agreement was drafted by which Mr. Dixon agreed to do certain work in exchange for the County property. The Board went out of its way to meet with Mr. Dimon and arrange for the deeding of property to him. Mr. Dixon and Mr. Angove were involved in the preparation of the agreement and Kr. Dlaan willingly agreed to the terms. I suggest you secure a copy of said agreement and of the other documents relating to the matter. Mr. Dixon has asked that the improvement of 23rd Avenue be accomplished by the Road Improvement District method. This is a valid request and upon Mr. Dixon submitting the necessary petition, the creation of such a district will be processed in the normal manner. Spokane County will not participate in the cost of any improvements which Mr. Dixon may have contracted to provide. This letter is to point out a serious problem in relation-to the area located in the Spokane Valley, east of Pines Road, known as "Gails Park Estates ". I live at .12417 E. 24th, the subject area, on the lower side of the hill down from 23rd. The problem centers around the lack of proper drainage on 23rd causing excessive amounts of water to run down the hill onto my lot carrying with it dirt, gravel, and other. My lot was landscaped last year and the above condition is causing damage to my property. The way I view the situation is that to provide proper drainage from 23rd the only one affected. Lots on both well as the homes and lots above. the County is responsible by failing avenue. My house and property is not sides of mine are being eroded, as Unless this condition is corrected promptly I, as well as my neighbors, will have no alternative but to plan legal action against the County. I hope this is not the course of action we will have to take.
