FINDINGS
PRELIMINARY SUBDMSION, EXTENSION OF TIME
Staff findings regarding PE- 960 -74, Locust View First Addition:
1. Locust View First Addition was originally presented to the Planning
Commission in August, 1974 where it received conditional approval.
Subsequent to that, the plat has received two (2) extensions of time, the
last being to November, 1977.
2. The applicant is desirous of obtaining a third extension of time to
December, 1978. Howe ver, it would appear that no work has been
accomplished on the project in the past year, and the request should
be denied.
3. If the Planning Commission chooses to approve this extension, two adds,
tionai conditions will be required to'bring the project into compliance
with recent changes in state law. The added conditions are as follows;
a. Show that the plat lies within the recorded service area
of Modern Electric Water Company.
b. Provide for an 6n-site sewage management system that shall
be approved by the County Health District prior to filing
of the final plat.

report with revisions as presented. The report is to be used in conjunction
with other reports in the development of the Comprehensive Plan. The motion

ZONING ADJUSTOR DECISION: To approve the caaension of a storage area nithin
the A.,ricultural Zone a distance not to exceed 25 feet for the folio my reasons
and subject to the following conditions:
NOTE: The /,oning Adjustor held a second public hearing on August 5, 1974,
to consider a new plan for the site and the proposed preliminary plat.
On September 13, 1974, the Planning Commission approved an adjoin-
ing plat and duplex zoning subject to ;onditions of preliminary plat
of record and the conditions of this use permit.
A. REASONS:
1, It is the opinion of the Zoning Adjustor that sufficient public hearings
have been held and full consideration given to other surrounding
residential uses, both proposed and existing. The Goring Adjustor
has inspected the property on numerous occasions in co:irection with
these hearings and is of the opinion that the proposed extension will
not be materially deterimental to the public welfare or noarby properties.
2. The Zoning Adjustor has attached sufficient conditions to safeguard the
development in the more restricted districts to the south. Such condi-
tions include fancing of the storage area to prohibit access, realignment
of the existing fence which overextands into the A..,ricultural "Gone,
a maintained landscape strip, lighting control, curbing and paving
of Knox A•jenue .
3. It is the opinion of the koning Adjustor That the proposed extension pro-
vides suitable screening from the proposed duplex properties to the south.
4. The Zoning Adjustor has deferred his action on the expansion until the
Planning Commission considered the preliminary plat because of the
interrelationships of 4he plat and the expansion.
B. CONDITIONS:
1. The allowed storage area shall be bounded by an eight foot high solid
unpierced galvanized steel fence of a design and color similar to the
existing storage area fence to the east. The south line of the fence
and storage area s hall be so located, after survey, as to provide a
distance of 165 feet from the fence line to the south lot lines of

A. CONDITIONS:
1. That a development plan be submitted and approved by the Planning
Director prior to filing of the final plat which will indicate among
other things the precise design and location of the buildings
and landscaping and will also provide for minimum standards of
screening of the proposal from the surrounding residential uses.
The plan will also provide a satisfactory transition from the
industrial use to the north to the residential use to the south.
2. That the plat be designed to increase the depth of Lots 1 and
2 to a minimum of 115' to give the lots sufficient square feet

The water supplier will certify that appropriate contractual
arrangements have been made with the plat sponsor for construc-
tion of the water system prior to filing of the final plat.
9. That a certificate of title be furnished the Planning Commission
prior to the filinr of the final plat.
10. That the preliminary plat be given conditional approval to
September 1, 1975.
11. That streets be improved to standards established by Spokane
County, or a bond to cover the cost of such improvements be
furnished the County ngineer in the amount as determined by
the County Engineer.
12. That profiles of streets, proposed grades, and drainage plan of
the plat be submitted and approved by the County Engineer and
by the Planning staff before the final plat is drawn. The County
'Engineer may require that design of drainage improvements for the
entire plat be made by a registered civil engineer.
13. Conditional approval of the plat is given subject to dedication of
the right of way to the public and approval of the road system in
the plat by the County Lngineer.
That a name be indicated before the final plat is filed; such
name to be approved by the County Assessor and the Planning staff.
15. That percolation and /or soil classification tests be submitted as
required by the County siealtn Officer. Subdivider is not authorized
to have the final plat drawn until the County i'ealth officer
certifies in writing that lot sizes, soil porosity, and topography
are such as to reasonably expect on -site sewage systems to be
workable and not injurious to water strata used for potable water
wells or springs.
16. That a program for development of a public water system, adequate
for domestic water use and providing for service connections to
each lot, be approved by County and State Health authorities

The plat dedication will contain a statement to the effect that
the subdivider will provide for the installation of a public water
system as approved by County and State Health authorities prior
to sale of lots.
NOTE: The Spokane C'ounty Health District has determined that
the soil and terrain characteristics are suitable for
individual sewage disposal systems.
B. ENVIRONMENTAL ASSESSh
At the time of hearing of this proposed subdivision, consideration will
have been given to (1) the public use and interest proposed to be
served by the establishment of the subdivision and dedication (RCW
58.17.110) and (2) those elements necessary to determine the existence
or nonexistence of a major action with significant effects on the environ-
ment. The Planning Commission, at this time, recommends to the Board
of County Commissioners that this application as presented will have no
significant effects on the environment provided that the above conditions
attached to the preliminary plat of record are met.
ZONING RECOMMENDATION
Planning Commission Recommendation: Approve Locust View First
Addition as indicated on the preliminary plat of record to the Two Family
Residential (R -2) Zone upon filing; of the final plat.
i.EASONS:
1. The three lots in Locust View first Addition has been designed to
accommodate duplexes. Lots will be adjusted to provide appropriate
frontage and area.
2. Tne Commission is of the opinion that the duplex lots will provide
an appropriate buffer between the developed Restricted Industrial
area to the north and the single family residences to the south.
3. The Two Family Residential (R -2) Zone prohibits animal keeping
other than household pets, certain home occupations and
mobile homes.
