,Dear Mr. Clausen:
In regards to your letter of May 14, 1976, to Mrs. Leo Schmitt, I bring to your
attention that you misunderstood the portion of our recent conversation relative
to the additional 10 feet of proposed R/W to the north of the recently dedicated
30 feet right -of -way. I apparently did not adequately explain our department's
position regarding the necessary right -of -way width for the plat connection to
McDonald Road. I have previously stated to Mr. Schmitt, Mr. Adams, the Planning
Commission, and I believe to you, that of the two alternative right -of -way pro-
posals considered to date, I would prefer to obtain additional right-of-way
the south of the present 30 feet strip, than to obtain an additional'10 feet to
the north. I believe most of those involved in the matter have concurred that
would be the better of the two proposals. However, as we did discuss and did
agree that neither your client, nor the County, has any control over the prop-
erty to the south and since the present owner of that property is not in favor
of dedicating land for right -of -way purposes, the second proposal as agreed to
by Mr. Schmitt at the Planning Commission meeting on the plat, is then the re-
maining alternative and should be pursued. I believe we did agree and as you
indicated was substantiated by Mr. Adams that considering the topography and
necessary fill for the road, a 40 feet wide right -of -way would be the absolute
minimum width to obtain a travelway of acceptable width. Therefore, it will be
necessary to obtain the additional 10 feet of right -of -way prior to the con-
struction of the road connection, so that a road to the minimum county standards
may be physically constructed out to McDonald Road.
I apologize for my apparent lack of clarity in our discussions concerning the
required right -of -way width. Hopefully, the above discussion does adequately
present our position on the matter. If you have any questions, please advise.

I talked to Gary Kennaly today following my learning
from Ron Taskey, real estate agent, that the Shurtz
to Robbins sale of the parcel from which the other.
30 feet would have to come had fallen through.
I offered to try to acquire an additional 10 feet
from Leo's vendor which would allow a 40 feet total
easement.
Gary said he would rather not have the 10 feet but
rather wait hoping to acquire the 30 feet later.
I asked about the cash bond. Gary said most of it
was for improvements on the plat; that Leo should
proceed as far as you can. When he's finished re-
quired improvements on the plat itself and on the
present easement, if the other 30 feet are not then
available, his cash bond will be released.
I related this information to Dick Adams. He will
proceed. You tell Leo.

SUBJECT: Standard Plat Conditions
We recommend approval of the plat of Eva Addition PE 979 -75 ZE 6 -75
subject to the following conditions:
that conditional approval of the plat is given subject to dedication of Right of
Way to the public and approval of the road system in the plat by the County Engineer;
that plans, profiles, and cross sections showing proposed street centerline and curb
grades be submitted to the County Engineer for approval prior to construction and
the filing of a final plat;
that drainage plans and design calculations showing the grades and alignment of drain-
age facilities be submitted to the County Engineer for approval prior to construction
and the filing of a final plat;
construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed land surveyor, who shall be responsible
for perpetuating all evidence of the location of survey monuments which may be
disturbed during construction and who shall furnish the County Engineer with "As
Built" plans and a certificate in writing that all improvements were installed to
the lines and grades shown on the approved construction plans and that all disturbed
monuments have been replaced;
no cons ruction work is to be performed within the Public Right of Way until a permit
has been issued by the County Engineer. All work is subject to inspection and approval
by the County Engineer;
all construction within the Public Right of Way is to be completed prior to filing
the final plat or a bond in the amount estimated by the County Engineer to cover the
cost of construction of improvements, construction certification, "As Built" plans,
and monumenting the street centerlines shall be filed with the County Engineers
that the Developer open and improve Rich Avenue to County standards from the Westerly
plat boundary to McDonald Road.
