PE-980-75ti MINUTES OCTOBER 10, 1975 PRELIMINARY SUBDIVIS AND ZONE CL IF ICATION UPGRADING PE- 980 -75 - LEHI SUBDIVISION: INAGSTAPF ZE- 5 9- 75 - AGRICULTURAL TO SINGLE - FAMILY RESIDENTIAL AND /OR TWO -_ FAMILY RESIDENTIAL Planning Commission Recommendation: Approve, subject to the following conditions. Mr. Schadegg abstained from voting as he was not present during testimony. A. CONDITIONS: 1. That the plat be designed as indicated on the preliminary plat of record and /or attached sheets as noted. Lot 1, Block 1, and Lot 1, Block 3, are recommended for Two - Family Residential (R -2) zoning. Their frontage size on Bolivar should be increased slightly. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites without filing a replat. 3. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 4. That appropriate provision be made that the following described property be-held in trust until the continuation of the streets be dedicated or deeded: A 1' strip at the ends or et'gec, of all streets that terminate or border the plat boundary. (Temporary cul de sacs are required when streets terminate at the plat boundaries.; 5. That appropriate street names be indicated. 6. That appropriate utility easements be indicated on copies of the approved preliminary plat for distribution to the Planning Department and the utility companies. Written approval of the easements by the utility company must be received prior to the submittal of the final plat. 7. That a plan for water facilities adequate for fire protection be approved by the water supplier and fire protection district. Said water plan must also have been approved by the appropriate health authorities. The health authorities, water supplier, (purveyc=) and fire protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health authorities prior to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County and the water supplier (purveyor) harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire district and water supplier (purveyor) will be installed within this plat, and the subdivider will provide for individual service to each lot prior to sale of each lot. NOTE: The Spokane County Health District has determined that the soil and terrain characteristics are suitable to provide a work- able individual sewage disposal system site on each lot. 8. That a certificate of title be furnished the Planning Commission prior to the filing of the final plat. 9. That the preliminary plat be given conditional approval to November 1, 197. 10. That streets be improved to standards established by Spokane County or a bond to cover the cost of such improvements be furnished the County Engineer in the amount as determinou by the County Engineer. ENVIRONMENTAL ASSESSMENT At the time of the hearing of this proposed subdivision, consideration will have been given to (1) the public use and interest proposed to be served by the establishment of the subdivision and dedication (RCW 58.17.110) and (2) those elements necessary to determine the existence or non - existence of a major action with significant effects on the environment. The Planning Commission, at this time, recommends to the Board of County Commissioners, that this application as presented will have no significant effects on the environment provided that the above conditions to the preliminary plat of record are met. ZONING RECOMMENDATION Planning Commission Recommendation: Approve Lot 1, Block 1, and Lot 1, Block 3, Lehi Subdivision, as indicated on the preliminary plat of record to the Two - Family Residential (R -2) Zone Classification upon filing of the final plat. The lots in Lehi Subdivision have been designed to accommodate Single Family residences, i.e., All of the lots would have at least 90 feet of frontage and 10, 000 square feet of lot area. The two lots along 16th Avenue have been designed to accommodate duplex structures and would have at least 90 feet of frontage and D. 000 square feet of area. 2. The plat is situated in Veradale community. The Commission has been upgrading similar subdivisions in the area to the Single - Family Residential and Two - Family Residential Classifications. 3. The Single - Family Residential Zone prohibits duplexes, animal keeping other than household pets, mobile homes, and home occupations. The Two - Family Residential Zone prohibits mobile homes, animal keeping other than household pets, and certain home occupations. 4. The Staff is of the opinion that the two corner lots fronting on 16th Avenue are appropriate for duplexes because of their orientation to 16th Avenue, a secondary arterial.
