Dear Gentlemen:
I received a "notice of cancellation" dated January 25, 1985 for bond
number C015975 from Allied Fidelity Insurance Company in the amount of $6,600.
The last paragraph of this bond reads as follows:
"The obligation of this BOND shall be kept in full force and effect
until, in the opinion of the OBLIGEE, the requirements herein stated have
been satisfied in which event written release will be given by the
OBLIGEE, the OBLIGEE having sole right to grant such release and the
SURETY hereby waives all rights to release from the obligation except as
herein stated."
Since this paragraph appears on the bond and is signed by you, it is our
opinion that this bond cannot be cancelled.

SPECIFICATIONS

The following specifications shall. apply to the improvement of the roadways of the above
titled plat. No variance from these specifications will be allowed without specific
prior written approval of the Spokane County Read Engineer, hereinafter called "Engineer"
The Subdivider sh.il be solely responsible for all costs of the roadway improvements
herein specified unless otherwise specifically stated.
GRADING The roadways shall be graded and shaped to the lines and dimensions of the
typical section attached and to the grade lines approved by the Engineer and on file in
his office. The graded roadway, subgrade, shall be constructed to an elevation below
the finish grade to allow for the thickness of surfacing and future pavement courses and
the subgrade shall be crowned as shown by the typical section. Compaction of the subgrade
may be required if it is deemed necessary by the Engineer. The subgrade shall be inspect-
ed and approved by the Engineer prior to the placing of any surfacing material.
CURBING Required only when specifically noted on the typical section attached. when
required by the County or when required by the Subdivider as a condition of sale, curbing
shall conform to these specifications: Curb shall conform to County Standards available
from the Engineer's Office. Curb grades shall be those approved by the Engineer. Whether
required or not, no curb shall be installed in the roadways without a written permit from
the Engineer.
SURFACING: The types, width of courses, and compacted thickness of surfacing material
required to he placed on the roadways is shown on the typical section. The following are
specifications for the various types of ^ urfacing materials:
Pit Run Material. shall be natural. gravel, talus or shot rock from a
source approved by the Engineer. Normally the maximum particle size
shall not be greater than two - thirds of the compacted course thickness.
In order to satisfy this requirement the Engineer may require that the
natural occuring material be screened or run through a jaw crusher
before being placed on the roadway.
Ease Course Material shall be crushed rock or gravel being well graded
from ly" maximum size to dust. The material shall have sand equivalent
test value of not less than 40.
Top Course Material shall be crushed rock or gravel being well graded from
5'8" maximum size to dust. The material shall be well fractured and shall
have a sand equivalent test value of not less than 40.
All surfacing materials shall be subject to the approval of the Engineer and he shall be
notified of the sources of such materials within sufficient time to allow for inspection
prior to the placing of the materials on the roadway. Compaction of the surfacing courses
may be required if it is deemed necessary by the Engineer.
DRAINAGE County Standard catch basins, culverts and other drainage facilities shall be
installed at the locations shown on the approved drainage plan on file in the Engineer's
Office. Gravel backfill will be required for catch basins only when specifically called
for. Installation of all required drainage facilities shall be subject to the approval
of the Engineer. If a piped storm drainage system is required, detailed plans, design
calculations and maps of the system shall be submitted to the Engineer for approval and
a written permit secured prior to the actual installation of any part of the system.
PAVEMENT Required only when specifically noted on the typical section attached. Whether
required or not, any pavement placed on the roadway shall conform to the requirements of
the Washington State Highway Specifications for the type of pavement
-z-
involved, unless written modification and approval is given by the Engineer. No
pavement shall be placed on the roadways without a written permit from the Engineer.
ENGINEERING: All engineering required to satisfactorily complete the improvements
herein required, such as staking of roadway grades, curbs, etc., shall be provided
by he Subdivider at his cost.
Ca4MTION: The improvements herein required shall be completed on or prior to the
date specified on the Subdivision Roadway ImprovementBond, unless said date be
extended by the Engineer. Extension of time for completion shall in no way nullify
any of the requirements of these specifications. When the Engineer has inspected
and approved the completed improvements he will give written notice to the Subdivider
of such approval. Only such written notice will release the Subdivider of the
requirements of these specifications.

FINDINGS AND ORDER REGARDING PRELIMINARY PLAT PROPOSAL AND ZONE
CLASSIFICATION UPGRADING - PE 990 - 76, SI'S SUBDIVISION; ZE -3 -76,
AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL (R -1): BATES
WHEREAS, The Spokane County Planning Commission did, after public
hearing on January 9, 1976, forward to the Board of County Commissioners a
recommendation that the preliminary plat to be known as Si's Subdivision (File
number PE- 990 - 76) and zone classification upgrading (File number ZE - 3 - 76) be
approved, and

WHEREAS, Richard Christman, did by letter dated January 21, 1976, request
a hearing before the Board of County Commissioners to present evidence and testimony
against the recommendation of the Planning Commission to approve the above—
described preliminary plat and zone change upgrading, and
WHEREAS, The Board of County Commissioners did hold a public hearing
on February 19, 1976, to consider the recommendations of the Planning Commission
and testimony and request of the applicant, objectors, and other interested parties,
and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above — described preliminary plat proposal and zone change
upgrading, the Board of County Commissioners of Spokane County having fully
considered the testimony given, the records and minutes of the Planning Commission,
the environmental assessment, and all other evidence presented; and having per—
sonally acquainted themselves with the site and vicinity in question, does hereby
find:
1) That the conclusions and conditions recommended by the Planning
Commission were generally valid and sufficient, except that we
find:
a) A drainage problem exists in this general area which crosses
Sullivan Road from the east to the west, through Si's Sub —
division and across 24th Avenue which could have an effect
upon some of the building sites,
b) That in consideration of lot sizes in the general area, the
Board finds some of the proposed lots in the subject plat to
be too small, and that these should be increased in size to
assure greater compatibility with other lots in the general area,
NOW, THEREFORE, The Board of County Commissioners does conclude that
the preliminary plat of Si's Subdivision and zone classification upgrading should be
and hereby is approved, subject to the conditions as contained in the Planning
Commission minutes of January 9, 1976, except that in connection with Finding 1 — (b)
the Board does conclude that a condition shall be imposed on the plat to require 90
feet of frontage as a minimum for each lot in the plat, and in connection with
Finding 1 — (a) does, therefore amend Planning Commission Condition #11 to read as
follows:
" That profiles of streets, cross sections, proposed grades and drainage
plan shall be submitted and approved by the County Engineer and by the
Planning Director before the final plat is drawn. The drainage plan shall
be reviewed and approved by the Board of County Commissioners prior to
signing the final plat to insure that the seasonal drainage problems of the
area, particularly on the east and south sides, has been adequately
designed to accommodate the seasonal runoff. Prior to acceptance of the
improvements or release of bonds, a certificate by a registered civil
engineer or licensed land surveyor will be required indicating that all
improvements have been installed to the lines and grades shown on the
approved construction plans."

that because so many of the lots were still in my name I could
move through an RID rather quickly, but that the 1980 RID
funds were totally committed.
Harry Larned and I talked the situation over and it was
agreed I would proceed with the paving and the county would
participate from 1981 funds if necessary.
I am still waiting for Spokane County to reimburse me the
County's share, or 15% of the $9,206.00 cost of paving in
question, $1, 380.90.
I have been trying to collect this amount since September,
1980. All the substantiating paper work has been delivered to
the Engineer's office. First the delay was waiting for
inspection reports. They have since been taken care of. The
next hold up was County approval and acceptance. This took
until January of 81.
Please consider this letter my request for $1,380.90
reimbursement. I earnestly hope this matter will be settled
quickly and without litigation, but be assured I will take the
matter to the courts if this cannot be settled any other way.
I will be happy to meet with you and /or provide any additional
information necessary to bring this matter to a speedy conclusion.

Dear Mr. Sinclair:
We have reviewed the Si's Subdivision drainage plan submitted with your
May 4, 1982 letter, and we have also field reviewed the site. We offer the
following comments for your consideration:
1. From the grading plan submitted, it appears that Lots 4, 5 and 6,
Block 4 and Lot 10, Block 2 will be protected from stormwater drainage.
2. No drainage calculations were submitted with the proposal nor was
there any indication as to what the drainage swale encompassed, either cross
hatched or non -cross hatched. We cannot comment on these portions of the
plan without further information.
3. Lots 3, 4 and 5, Block: 3 are located adjacent to a low Spot in
Sullivan Road. Again, no drainage calculations were submitted. While the
develoment east G` Sullivan has reduced the drainarn area, a review of the
topographic maps indicates that significant areas still contribute stormwater
to the low spot. It appears that further drainage information is necessary to
evaluate these lots.
4. Once the final grading plans are approved, it will be necessary to
record a document with the following language:
An approved lot grading plan exists for Lot 10, Block 2, 3, 4, and 5,
Block 3 and Lots 4, 5 and 6, Block 4. Grading must conform to said plan

Enclosed you will find a drainage plan for Si's Subdivision. The drainage plan
was originally designed to meet FHA requirements, but was never recorded since
the project did not go FHA.
At the time when the design of the drainage plan was being done it was my
observation that ponding in the rear of lots 4, 5 and 6 of Block 4 would be
of little significance. With the development that has taken place around and
within the project site, a large majority of any past runoff is now being
intercepted by drywells.

This letter is to confirm your discussion with Norm McGill of this office.
As you know, the drainage plans for Si's Subdivision have been approved
except for the notation "the site grading and plat plans for Lots 3, 4,
and 5, Block 3; Lot 10, Block 2; and Lots 4, 5, and 6, Block 4; are to
be approved by the Spokane County Engineer's Office prior to issuing
building permits.
We believe that the construction of the proposed County Road Project No.
1679 will correct the drainage problems. Special features have been in-
cluded in the design of both Sullivan Road and 12th Avenue.
After the construction of Sullivan Road CRP 1679 is completed,.the building
permit restrictions will be removed. We are presently acquiring right of
way and slope permits for this project, but we do not yet have a definite
construction date.

Gentlemen:
On behalf of Mr. Silas Bates we are submitting for your approval, proposed
Grading and Drainage Plan for the subject project. Si's Subdivision is located
in the Spokane Valley at Sullivan Road and 12th Avenue. It was processed
through the County in 1978 and was improved to FHA minimum standards in effect
at the time but was not submitted to FHA for approval. All lots are approved
for individual septic tank and drainfield systems. Water and electrical service
to each lot is provided by Vera Water and Power. Within the subdivision, Newer
Road is paved and curbed, 13th Avenue and Century Road are curbed with a
crushed rock travel way. Outside the plat, 12th Avenue is paved and Sullivan
Road is proposed to be widened, repaved, curbed and drainage swales installed
by Spokane County in the summer of 1983. Drywells for storm drainage disposal
are installed in the travelway of Newer Road, Century Road and 13th Avenue.
Proposed drywells along Sullivan Road will be installed within the drainage Swale.
The sponsor has conducted a study to explore the feasibility of upgrading the
plat to meet current FHA standards including compliance with County '208'
stormwater disposal guidelines. He has determined that most FHA standards could
be met, but that it is not economically feasible to revise and /or reconstruct
the stormwater disposal system to remove stormwater from the street onto grass
Percolation areas.
Therefore the sponsor proposes that the following measures be taken to achieve
a high degree of compliance with '208' stormwater disposal guidelines.
1. Unpaved streets shall be paved concurrent with the construction of
FHA insured housing within the subdivision.
2. Private driveways will be crowned to divert
to adjacent turfed areas.
3. Several grading details will be employed to
the lots as is reasonably possible without
ponding situations (see Grading Plan).

retention area at the rear of lots 5 and 6. The area is designed to retain
the runoff of a 10 year storm with the runoff from more severe storms being
handled via seepage through a frost penetration device (see Grading Plan).
Assumptions and calculation for the retention area is as follows:
Area Served: Lots 1 thru 6 = 54,000 ft. 2*
Runoff Coefficient: 0.25
24 hour rainfall for 10 year storm: 2.0 inches
Total Volume of Runoff = -. (0.25): Z (54,000) = 2,250 cu.ft.
*Assumes that front yard setback distance (25 feet) will be graded to drain
Approximately 2,250 cubic feet of storage is contained in the lots 5 and 6_
retention area. With the implementation of all of the provisions outlined
above we believe the sponsor can achieve substantial conformance with the '208'
stormwater disposal guidelines. We therefore respectfully request approval of
the attached FHA Neighborhood Grading and Drainage Plan.

In accordance with our recent telephone conversations concerning the subject
plat, we have revised the drainage plan originally submitted on March 14, 1983
and are submitting the revised plan for your review and approval. The revi-
sions are as follows:
1. Special driveway details have been added for lots 4, 5, 6, and 7;
Block 4 to allow the storm drainage from the south one -half of 13th
Avenue to drain off the street onto a drainage swale.
2. A drainage swale and easement along the front lot lines of lots 4,
5, 6, and 7; Block 4 has been added to accommodate street drainage.
3. The solid cover on the existing drywell will be changed to a slotted
