Felice, did by letter dated March 1, 1976, request -a hearing before the Board of County Commissioners to present evidence and testimony against the recommendation of the Planning Commission to approve the above - described preliminary plat and zone change upgrading, and WHEREAS, The Board of County Commissioners did hold a- public hearing on March 25, 1976, to consider the recommendations of the Planning Commission and testimony and request of the applicant, objectors, and other interested parties, and WHEREAS, At said hearing opportunity was afforded those favoring and those opposing the above - described preliminary plat proposed and zone change upgrading, the Board of County Commissioners of Spokane County having fully considered the testimony given, the records and minutes of the Planning Commis- sion, the environmental assessment, and all other evidence presented; and having personally acquainted themselves with the site and vicinity in question does hereby find: 1) That the conclusions and conditions recommended by the Planning Commission were generally valid and sufficient, except that we find: a) The interior roads within the plat require a higher degree of improvement than normally required within subdivisions. b) A sight distance problem exists for vehicles entering the Dishman - Mica Road from 8th Avenue or 16th Avenue. We feel that needed tree clearing should be accomplished by the plattor at the same time interior streets are cleared. c) A need exists partially as a result of this plat to complete. the . street paving and drainage improvements on 8th Avenue adjacent to the proposed plat to Woodruff Road, which burden we feel should be shared by the applicant. J d) A need exists partially as a result of this plat to further improve Woodruff Road from 8th Avenue to 16th Avenue. Had the plattor followed the more normal practice of facing lots onto Woodruff, this improvement would have been routinely required. We do not feel that he should be relieved of this responsibility because of his decision to face the lots inward. NOW, THEREFORE, The Board of County Commissioners does conclude that the preliminary plat of Whispering Pines and zone classification upgrading should be and hereby is approved, subject to the conditions as contained in the Planning Commission's minutes of January 9, 1976, except that in connection with Findings 1- a,b,c,d), the Board does, therefore amend Planning Commission Condition #10 to read as follows: "10. That streets be improved to standards established by Spokane County or a bond to cover the cost of such improvements be furnished the County Engineer. The bond may also cover the cost of "as built" plans, engineering costs, and placing of final center line monuments. Specific improvements are to include: 1) XE Plat Roads All roads within the plat be constructed, curbed and paved by the developer. The developer has proposed to enter into a paving participation agreement to fulfill the requirements of this condition. 2) Dishman - Mina Road Developer to improve ' a portion of the additional twenty '(20) foot right of way strip through the proposed plat along the Dishman - Mica Road. Improvements to include the clearing of the area needed for future road widening purposes. County would construct the widened Dishman - Mica Road as proposed in the Six - Year Construction Program. 3) 8th Avenue The improvement of 8th Avenue through the proposed plat to Woodruff Road. Improvements to include curbing, the grading, drainage control and paving of the remaining strip to the edge of the existing pavement. This improvement should be coordinated with the County's widening project on Dishman - Mica and the improvement of the Disman - Mica Road - 8th Avenue intersection. 4) Woodruff Road Improvement of Woodruff Road by the developer from 8th Avenue to 16th Avenue. Improvements to include clearing c� and grubbing a twenty (20) foot strip west of the existing L� S �' 55 right of way centerline and construction of the western portion b of Woodruff Road to County standards.
