ZE- 20 -76 - AGRICULTURAL TO SINGLE FAMILY RESIDENTIAL (R -1)
Staff Recommendation: Aoorove. subiect to the following conditions:
A. ANALYSIS AND BACKGROUND:
In September, 1971, the subject property was submitted as a preliminary
plat together with 34, 200 square feet of property adjacent to the west. Six
lots were approved, at that time, subject to the sponsor obtaining sufficient
property to increase their frontage to 80 feet. Subsequent to this plat
expiring in 1973, three segregations were created on the west half of the
subject property. All three segregations have 76 feet of frontage and 151
feet of depth. Duplexes were constructed on all three lots. At that time
duplexes were allowed on segregations containing 70 feet of frontage and
7, 800 square feet of land area. The present plat sponsor is requesting three
lots to be approved, each with 76 feet of frontage and 151 feet of depth
and all for single - family homes.
The staff feels that a conflict in land uses exists in this area and must be
addressed in determining the frontage requirements. The general character
of the section is that of acreage -type segregations, of which most are one
acre to ten acres in size. The land uses consist primarily of pasture land,
orchards, truck farming, and animal keeping. In contrast to this more rural
type of lot size and land uses, there have been two subdivisions filed in
this section consisting of 49 lots which average 10, 000 to 15, 000 square
feet of area. In 1969, Friske Subdivision was approved with 25 lots, of
which seven have 75 feet of frontage.
Therefore, the staff recommends approval of the plat with three lots if the
Planning Commission feels that Friske Subdivision has set an acceptable
precedent to be further allowed in the area.
If the Planning Commission feels that the lots having less than 80 feet of
frontage in Friske Addition are to be considered as the exception and not
to be further allowed in the area, then the staff would recommend approval
of two lots, each one having 114 feet of frontage and 151 feet of depth.

B. CONDITIONS:
1. That the plat be designed as indicated on the preliminary plat of record
and /or attached sheets as noted. If the plat is approved for three lots,
the sponsor shall submit appropriate documents to the Zoning Adjustor
to seek approval of variances in order to obtain building permits prior'
to filing the final plat.
2. That a statement be placed in the dedication to the effect that no more
than one dwelling structure be placed on any one lot, nor shall any lot
be further subdivided for the purposes of creating additional lots or
building sites without filing a replat.
3. That the plat provide for right of way width for streets as indicated on
the preliminary plat of record.
4. That appropriate street names be indicated.
S. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company
must be received prior to the submittal of the final plat.
6. That a plan for water facilities adequate for fire protection be approved
by the water supplier and fire protection, district. Said water plan must
also have been approved by the appropriate health authorities. The
health authorities, water supplier (purveyor), and fire protection district
will certify, prior to the-filing of the final plat, on the face of said
water plan that the plan is in conformance with their requirements and
will adequately satisfy their respective needs. Said water plan and
certification will be drafted on a transparency suitable for reproduction.

The water supplier (purveyor) will also certify prior to the filing of the
final plat on a copy of said water plan that appropriate contractual
arrangements have been made with the plat sponsor for construction
of the water system, in accordance with the approved plan, and in
accordance with a time schedule. The.time schedule will provide, in
any case, for completion of the 'water system and inspection by the
appropriate health authorities prior to application for building permits
within the plat'. The contractual arrangements will include a provision
holding Spokane County and the water supplier (purveyor) harmless from
claims by any lot purchaser refused a building permit due to the failure
of the plat sponsor to satisfactorily complete the approved water system.

developed to the above - stated conditions that the proposed plat would not
have any greater effect upon the topography, geology, biological and botanical
characteristics, atmospheric and aquatic conditions and other natural develop-
ment than similar residential uses established in the area. Therefore, the
staff concludes that an environmental impact statement is not required in
conjunction with approval of the proposed plat.
D. ZONING RECOMMENDATION:
Planning Commission Recommendation: ADDrove Tohn Henry Subdivision as
indicated on the Dreliminary Dlat of record to the Single Family Residential Zone
classification upon filing of the final Dlat.
ANALYSIS
1. The lots in John Henry Subdivision have been designed to accommodate
single family residences, ie., all of the lots would have at least
76 feet of frontage and 10, 000 square feet of area, and would require
variances in order to meet the single family standards in the Single
Family (R -1) Residential Zone. The staff does not anticipate that the
narrower lots would reduce their utilization for single family home sites.
2. The plat is situated within the Vera Community. The Commission has
been upgrading similar sized lot developments in the area to the Single
Family Residential (R -1) classification.
3. The Single Family Residential Zone prohibits duplexes, animal keeping
other than household pets, mobile homes, and home occupations.

The plat dedication will contain a statementto the effect that the
public water system as approved by County and State Health authorities
and the local fire district and water supplier (purveyor) will be installed
within this plat, and the subdivider will provide for individual service
to each lot prior to sale of each lot.
NOTE: The Spokane County Health District has determined that the
soil conditions in the plat are suitable for on -site sewage
disposal systems on each lot.
7. That a certificate of title be furnished the Planning Commission prior'
to the filing of the final plat.
B. That the preliminary plat be given conditional approval to April 1, 1977.
9. That streets be improved to standards established by Spokane County
or a bond to cover the cost of such improvements be furnished the
County Engineer. The bond may also cover the cost of "as built" plans,
engineering costs, and placing of final center line monuments.
10. That profiles of streets, cross sections, proposed grades, and drainage
plan of the plat be submitted and approved by the County Engineer and
by the Planning Director before the final plat is drawn. Prior to accept-
ance of the improvements or release of bonds, a certificate by a registered
civil engineer or licensed land surveyor will be required indicating that
all improvements have been installed to the lines and grades shown on
the approved construction plans.
11, Conditional approval of the plat is given subject to the dedication of the

C. ENVIRONMENTAL ASSESSMENT:
The proposed plat is located on the south side of Broadway Avenue between
Sullivan Road and Conklin Road. The plat consists of three lots on .90 acres.
The site is generally flat in nature and is presently vacant. No additional
right -of -way dedication is necessary to provide access to adjacent ownership.
The staff is of the opinion that if the preliminary plat were approved and

SUBJECT: Standard Plat Conditions
We recommend approval of the plat of John Henry Subdivision PE 995 -76
subject to the following conditions:
that conditional approval of the plat is given subject to dedication of Right of
*day to the public and approval of the road system in the plat by the County Engineer;
that plans, profiles, and cross sections showing proposed street centerline and curb
grades be submitted to the County Engineer for approval prior to construction and
the filing of a final plat;
that drainage plans and design calculations showing the grades and alignment of drain-
age facilities be submitted to the County Engineer for approval prior to construction
and the filing of a final plat; -
construction within the proposed public streets and easements shall be performed
under the direct supervision of a licensed land surveyor, who shall be responsible
for perpetuating all evidence of the location of survey monuments which may be
disturbed during construction and who shall furnish the County Engineer with "As
Built" plans and a certificate in writing that all improvements were installed to
the lines and grades shown on the approved construction plans and that all disturbed
monuments have been replaced;
no construction work is to be performed within the Public Right of Way until a permit
has been issued by the County Engineer. All work is subject to inspection and approval
by the County Engineer;
all construction within the Public Right of Way is to be completed prior to filing
the final plat or a bond in the amount estimated by the County Engineer to cover the
cost of construction of improvements, construction certification, "As Built" plans,
and monumenting the street centerlines shall be filed with the County Engineer.

KNOW ALL MEN BY THESE PRESENTS, that Bolin Bros., Inc: a corporation organized under the laws of the State
of Washington and Louie Rizzuto and Shirine D. Rizzuto husband and wife have caused to be platted into
lots, blocks, and streets the land shown hereon as " JOHN HENRY SUBDIVISION " and described as follows:
The North Half of the North Half of Tract 17, Vera., according to plat recorded in Volume " 0 of Plats,
Page 3'j, in Spokane County, Washington, in Section 13, Township 25 N., Range 44 E.W.M.
EXCEPT the West 22.9.00 feet and
