ANALYSIS AND BACKGROUND: In September, 1971, the subject property was submitted as a preliminary plat together with 34, 200 square feet of property adjacent to the west. Six lots were approved, at that time, subject to the sponsor obtaining sufficient property to increase their frontage to 80 feet. Subsequent to this plat expiring in 1973, three segregations were created on the west half of the subject property. All three segregations have 76 feet of frontage and 151 feet of depth. Duplexes were constructed on all three lots. At that time duplexes were allowed on segregations containing 70 feet of frontage and 7, 800 square feet of land area. The present plat sponsor is requesting three lots to be approved, each with 76 feet of frontage and 151 feet of depth and all for single - family homes. The staff feels that a conflict in land uses exists in this area and must be addressed in determining the frontage requirements. The general character of the section is that of acreage -type segregations, of which most are one acre to ten acres in size. The land uses consist primarily of pasture land, orchards, truck farming, and animal keeping. In contrast to this more rural type of lot size and land uses, there have been two subdivisions filed in this section consisting of 49 lots which average 10, 000 to 15, 000 square feet of area. In 1969, Friske Subdivision was approved with 25 lots, of which seven have 75 feet of frontage. Therefore, the staff recommends approval of the plat with three lots if the Planning Commission feels that Friske Subdivision has set an acceptable precedent to be further allowed in the area. If the Planning Commission feels that the lots having less than 80 feet of frontage in Friske Addition are to be considered as the exception and not to be further allowed in the area, then the staff would recommend approval of two lots, each one having 114 feet of frontage and 151 feet of depth. If the plat is approved for three lots, the sponsor shall submit appropriate documents to the Zoning Adjustor to seek approval of variances in order to obtain building permits prior' to filing the final plat. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites without filing a replat. 3. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 4. That appropriate street names be indicated. S. That appropriate utility easements be indicated on copies of the approved preliminary plat for distribution to the Planning Department and the utility companies. Written approval of the easements by the utility company must be received prior to the submittal of the final plat. 6. That a plan for water facilities adequate for fire protection be approved by the water supplier and fire protection, district. Said water plan must also have been approved by the appropriate health authorities. The health authorities, water supplier (purveyor), and fire protection district will certify, prior to the-filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. i The water supplier (purveyor) will also certify prior to the filing of the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan, and in accordance with a time schedule. The.time schedule will provide, in any case, for completion of the 'water system and inspection by the appropriate health authorities prior to application for building permits within the plat'. The contractual arrangements will include a provision holding Spokane County and the water supplier (purveyor) harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. Therefore, the staff concludes that an environmental impact statement is not required in conjunction with approval of the proposed plat. D. ZONING RECOMMENDATION: Planning Commission Recommendation: ADDrove Tohn Henry Subdivision as indicated on the Dreliminary Dlat of record to the Single Family Residential Zone classification upon filing of the final Dlat. ANALYSIS 1. The lots in John Henry Subdivision have been designed to accommodate single family residences, ie., all of the lots would have at least 76 feet of frontage and 10, 000 square feet of area, and would require variances in order to meet the single family standards in the Single Family (R -1) Residential Zone. The staff does not anticipate that the narrower lots would reduce their utilization for single family home sites. 2. The plat is situated within the Vera Community. The Commission has been upgrading similar sized lot developments in the area to the Single Family Residential (R -1) classification. 3. NOTE: The Spokane County Health District has determined that the soil conditions in the plat are suitable for on -site sewage disposal systems on each lot. 7. That a certificate of title be furnished the Planning Commission prior' to the filing of the final plat. B. That the preliminary plat be given conditional approval to April 1, 1977. 9.
