ZE- 22 -76 - MULTIPLE FAMILY SUBURBAN TO TWO -FAMILY RESIDENTIAL
Staff Recommendation: Approve, subject to the following conditions:
A. CONDITIONS:
1. That the plat be designed as indicated on the preliminary plat of record
and /or attached sheets as noted. The final plat shall contain a total
of ten (10) lots with Lots 10 and 11 of the preliminary plat combined as
one and restricted to use as one duplex building site.
2. That a statement be placed in th_: dedication to the effect that no more
than one dwelling structure be ; _lh.ced on any one lot, nor shall any lot
be further subdivided for the purposes of creating additional lots or
building sites without filing a replat.
3. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company
must be received prior to the submittal of the final plat.
4. That a plan for water facilities adequate for fire pro" `ion be approved
by the water supplier and fire protection district. C d water plan must
also have been approved by the appropriate health authorities. The
health authorities, water supplier (purveyor), and `:re protection district
will certify, prior to the filing of the final plat, on `;ne pace of said water
plan that the plan is in conformance with their requirements and will
adequately satisfy their respective needs. Said water plan and certifi-
cation will be drafted on a transparency suitable for reproduction.
The water supplier (purveyor) will also certify prior to the filing of the
final plat on a copy of said water plan that appropriate contactual arrange-
ments have been made with the plat sponsor for construction of the water
system, in accordance with the approved pian, and in accordance with a
time schedule. The time schedule will provide, in any case, for completlo,
of the water system and inspection by the appropriate health authorities
prior to application for building permits within the plat. The contractual
arrangements will include a provision holding Spokane County and the
water supplier (purveyor) harmless from claims by any lot purchaser
ref used a building permit due to the failure of the plat sponsor to sat-
isfactorily complete the approved water system.

NOTE: The Spokane County Health District has determined that lots
1 -9 of the preliminary plat are suitable for on -site sewage
disposal systems to serve duplexes. According to their
memo dated March 4, 1976, Lot 10 is limited and Lot 11
is unuseable, and it is their recommendation that lots
10 and 11 be combined and used as one building si_c.
5. That a certificate of title be furnished the Planning Commission prior
to the filing of the final plat.

B. BACKGROUND:
The proposed plat was rezoned froar : :^::i,cultrar.'i to Multiple Family Suburban
on September 26, 1974. In conjuncris r. with said rezone, a specific site
plan was approved stipulating, among other things, the c.'7truc+:icn of 64
apartment units (16 units per gross acre). To date, no si.:'s:.oa: ciitentions
have been made to the site . to accommodate such a
C. ANALYSIS INCLUDING ENVIRONMENTALASSESSMENI:
The site is located on the northerly side of Mission Avenue between Adams
and Best Roads extended. It is now being proposed as ten duplex lots for
a reduction in gross density from 16dwelling units per gross acre (as per
approved multiple family site plan) to five dwelling units per gross acre.
The site gently slopes to the north with an abrupt topographical change bi-
secting the northerly portions of these lots thereby limiting actual building
placements on the westerly portion of this sit:.
NOTE: The Health District has determined that the westerly two lots of
the original preliminary submittal mutt be combined to provide a
sufficient building and sewage disposal system area for one building
complex.

The site does not require additional improvements such as roads, open
space areas, etc., hence, it is felt that the property will be adequate
for development as ten duplex lots as per the preliminary plat of record.
With respect to land use, the site is a "fill in" plat circumvented on the
west, south, and east by existing plats of single family and duplex lots
of higher densities than this plat.
The staff is of the opinion that if the preliminary plat is approved and
developed to the above - stated conditions, the proposed plat will not
have any greater effect upon the topography, geology, biologi ;:: and
botanical characteristics, atmospherlc•and aquatic condi ::`.oaca cr1 other
natural developments than residential uses established in the area.
Therefore, the staff concludes that an environmental Impact .statement is not
required in conjunction with approval of the proposed plat.
D. ZONING RECOMMENDATION:
Planning Commission Recommendation: Aoorove Best View Addition as
indicated on the.oreliminary plat of record to the Two Family Residential
(R -2) Zone classification upon filing of the final plat.

The current owners of the project desire to plat the site for duplex lots.
REASONS
1. The lots in Best View Addition have been designed to accommodate dup-
lexes, i.e., All of the lots would have at least 90 feet of frontage and

2. The plat is situated on the edge of a residential neighborhood between
Mission Avenue and Interstate 90.
3. The Two Family Residential (R -2) Zone porhlbits mobile homes, animal

Planning Commission Recommendation: Aoarove. subiect to the following
