Since the preliminary plat is to be filed in phases the sponsor must receive approval from the Planning Director of the shape and configuration of all final plats. c. Work with the water district, appropriate hehlth authorities and fire district in determining the need for an additional well site. 2. That a statement be placed in the dedication to the effect that no more than one dwelling structure be placed on any one lot, nor shall any lot be further subdivided for the purposes of creating additional lots or building sites without filing a replat. 3. That the plat provide for right of way width for streets as indicated on the preliminary plat of record. 4. That appropriate provision be made that the following described property be held in trust until the continuation of the streets be dedicated or deeded: A 1' strip at the ends or edges of all streets that terminate or border the plat boundary. That a plan for water facilities adequate for fire protection be approved by the water supplier and fire protection district. Said water plan must also have been approved by the appropriate health authorities. The health authorities, water supplier (purveyor), and fire protection district will certify, prior to the filing of the final plat, on the face of said water plan that the plan is in conformance with their requirements and will adequately satisfy their respective needs. Said water plan and certification will be drafted on a transparency suitable for reproduction. The water supplier (purveyor) will also certify prior to the filing of the final plat on a copy of said water plan that appropriate contractual arrangements have been made with the plat sponsor for construction of the water system, in accordance with the approved plan, and in accordance with a time schedule. The time schedule will provide, in any case, for completion of the water system and inspection by the appropriate health author- ities prior to application for building permits within the plat. The contractual arrangements will include a provision holding Spokane County and the water supplier (purveyor) harmless from claims by any lot purchaser refused a building permit due to the failure of the plat sponsor to satisfactorily complete the approved water system. The plat dedication will contain a statement to the effect that the public water system as approved by County and State Health authorities and the local fire district and water supplier (purveyor) will be installed within this plat, and the subdivider will provide for individual service to each lot prior to sale of each lot. If the well on lot 9 block 8 should be utilized as a future water source, several lots may need to be deleted to provide a sufficiently sized well site. If the well is not utilized then prior to filing the final plat containing the well site, the sponsor shall seal off the well subject to approval by the appropriate health authorities. NOTE: The Spokane County 1 r.!:th District has determined that the soil conditions in the pia': ire suitable for on -site sewage disposal systems on each lot. That the preliminary plat be given conditional approval to May 1, 1977. 10. That streets be improved to standards established by Spokane County or a bond to cover the cost of such improvements be furnished the County Engineer. The bond may also cover the ' cost of "as build" plans, engineering costs, and placing of final center lino monuments. 11. That profiles of streets, cross sections, proposed grades, and drainage plan of the plat be submitted and approved by the County Engineer and by the Planning Director before the final plat is drawn. Prior to acceptance of the improvements or release of bonds, a certificate by a registered civil engineer or licensed land surveyor will be required indicating that all improvements have been installed to the lines and grades shown on the approved construction plans. 12. Conditional approval of the plat is given subject to the dedication of the right of way to the public and approval of the road system in the plat by the County Engineer. The sponsor must provide full width right of way for 40th Avenue, Pines Road, and 32nd Avenue. If the sponsor cannot obtain 30 feet of right of way for 40th Avenue from the adjacent property owner to the south, the plat shall be altered slightly to accomodate 60 feet for 40th Avenue within the proposal. The dedication shall contain a statement prohibiting individual tot access to 32nd Avenue. 13. That a name be indicated before the final plat is filed; such name to be approved by the County Assessor and the Planning staff. B. ANALYSIS INCLUDING ENVIRONMENTAL ASSESSMENT: The proposed plat Is located south of 32nd Avenue and bounded by Bowdish Road and Pines Road in Lao southern urbanizing portion of the Spokane Valley. The proposed plat consists of 432 lots on 160 acres for a gross density of 2.7 dwelling units per acre. The lots average approximately 12, 500 square i.i.it of area which is 2,500 square feet more than the required minimu 1 :ot size of 10, 000 square feet. - 21 - (Cont'd) PE- 1002 -76 - CHESTER ADDITION - TOMLINSON (Cont'd) The property is currently being utilized as farmland and is without any structures. The topography is generally flat in nature and the drainage should be adequately handled by the street drainage system. Proper consideration has been given to the existing well site. If the well site is to be utilized it shall receive proper review and approval from the appropriate health authorities, water supplier and fire district. If it is not utilized it shall be required to be seated off to protect the water source from pollution. The proposed water supplier is confident that an adequate system can be developed for the plat. The County Health District has approved septic tanks for all 432 lets since the soils and topography are suitable for drainficld sites. The neighborhood has developed similarly to the proposed plat to the north, and the west. These lots outside of the plat range in size from a minimum of 10, 000- square feet tc approximately 13, 500 square feet. The new Chester Elementary School is located directly across Pines Road east of the plat. The Central Valley School District controls 50 acres of property in this immediate area which includes a future site for a senior high school. The School District has control of approximately a 12 acre site south of 44th Avenue and east of Sands Road. It is felt by the staff that since the plat will be filed in phases, very possibly taking 5 - 10 years or more to finalize the entire prelim- inary plat, that there will be sufficient time for the school district to prepare for additional students from this development. The Park Department has indicated adequate park facilities with the school site across Pines and a new 8 acre park site on the northeast corner of 32nd Avenue and Pines Road. The staff has worked extensively with the sponsor on the design of the proposed plat. The plat provides for an east -west connector from Bowdish Road to Pines Road which can eventually serve as a link In the total connector from the Dishman- Mica Road to State Highway 27. It should be mentioned that at the present time the County Zoning Adjustor is considering an application for a conditional use permit and a variance to allow an 80 acre cometary site on the southwest corner of 32nd Avenue and State Highway 27. The plan calls for a right of way on the south edge which would be another link in the east -west connector be tween the Dishman -Mica Road and State Highway 27. The plat provides good circulation throughout and especially to the elementary school. All Lots will have excellent access frnn the streets to the building sites since the topography is fairly flat. Lets were double fronted on 32nd Avenue since it is classified as a secondary arterial. Therefore, eliminating dangerous driveway approaches from individual lots onto the heavily used street. - 22 - ( Cont'd) PE- 1002 -76 - CHESTER ADDITION - TOMLINSON (Cont'd) Planning Commission Recommendation: ADorove Chester Addition as indicated on the preliminary plat of record to the single Family Residential (R -1) Zone classification upon the filing of the final plat. REASONS: The staff is of the opinion that if the preliminary plat were approved and developed to the above stated conditions, the proposed plat would not have any greater effect upon the topography, geology, biological and botanical characteristics, atmospheric and aquatic conditions and othc natural development than similar residential uses established in the area. The fact that the proposed plat is scheduled to take up to 10 years and possible more to develop is a significant factor in knowing there will be time for the necessities and amenities to be developed for this plat and the surrounding neighborhood. Therefore, the staff concludes that an environmental impact statement is not required in conjunction with approval of the proposed plat. 1. The lots in Chester Addition have been designed to accommodate single family residences; i.e., all of the lots would have at least 80' of frontage and 10, 400 square feet of lot area. 2. The plat is situated in the Opportunity Community. The Commission has been upgrading similar sized lot development in the area to the single Family Residential (R -1) classification. 3. Page 12. Plat Design Map: No areas are indicated for drainfields. The map indicates house lots, however, 6.5 or 10 acres of drain - field is required (based on 6 4 gallon per linear foot, respect- ively, for drainfield design). Page 57, Water; Runoff /Absorption: Sections 2 and 3 are both mis- leading. They are true for the design storm (10 years) but not true for any size storm other than that, be it a one year or one hundred year storm. Page 102. Transportation /Circulation: State Highway S.R. 27 (State highway portion of Pines Road from 16th Avenue north to Interstate 90 (S.R. 90)) should also be listed as a primary north -south traffic carrier connecting to S.R. 90. In both cases a full 60' wide right -of -way plus full improvements will be required prior to processing a final plat proposal for those two specific areas. Also, on a portion of the property located immediately south of this proposal a preliminary plat PE 1086, Malloy Addition, has been reviewed by the County Commissioners. I find both to be somewhat outdated and confused. This office has offered Haworth & Anderson any data we have at our disposal yet the Environmental Impact Statement only includes data accumulated during the dry season of the year. More specif- ically, my review comments are as follows: Page 72, first paragraph r This entire paragraph needs to be updated. For example: we can verify recharge and the '208' and USGS data are not conflicting. Page 77, entire page and tables on pp. 78 and 79 This information only includes (I presume) data from USGS files. There are other data which illustrates that other constituents are in excess of drinking water standards. Page 81, item 2 The tabulation in Appendix B does not include all available chemical data. The '208' field data is not less reliable than other data. Comparisons can be made by a correlated amount. The correlation coefficient between the results from 208 and WSU is greater than 0.99 which indicates comparable reliability. Page 81, item 3 I don't agree with the first sentence. Page 86, third paragraph The author has confused the '208' depth selective sampling with the USGS sampling program. The USGS attempted only one experiment in depth selective sampling. This ended in failure. Any other depth selective sampling was done by the '208' field crew. Pages 86, fourth paragraph and top of page 91 This information is erroneous and out of date. With so many agencies having a piece of the action it's almost impossible to acquire data without devoting full time, The following questions were written randomly and most pertain directly to the Midilome Subdivision and more specifically to the possible approved installation of a 170,000 gpd package treatment plant. 1. What is the soil classification in the drainfield area? Any pert tests? Are soils excessively permeable? 2. Nowhere in the Flan Commission file is the severe drainage problem in the SW corner mentioned. What is the cause? How and where will water be diverted? 3, What data does the County have to support the installation of such a plant as an upgrading? Is anything available on depth of infiltration in relation to such volumes? 4. What percentage of the 170,000 gpd will be unremoved chemicals such as nitrates? 5. Where was the sewage collection system installed in relation to the drinking water. lines? 6. Did anyone determine the adequacy for existing customers before approving an additional 72 homes on a water supply system already overtaxed? Kermit Rudolf, Sec. for Model Irrigation, stated at an annexation hearing en April 14, 1971, that the district is developing by stages and would not add any service area which might jeopardize the primary duty of serving those already in the district. Cur pressure is already nil on peak days so his '71 statement must be inoperative. Also, Model is a Class I district with no Comprehensive Plan as required since 1 973. 7. What is the procedure (if any) for initiating rehearings when modifications to conditions are contemplated? There appears to be no uniform plan as some go to rehearing and some don't. 8. Since both the County Engineers and the Health District were aware of the plan, what steps should they have taken? Anything in writing? 9. Why doesn't the dedication on the final plat even mention sewage disposal? 10. How can the drainfield design problem between the Co. Eng and the Health Dist. be resolved? 11, Have Vera Irrigation and others been made aware of the fact that the County is willing to assume the M_<0 on plants and lagoons? 12. What is the present itemized dollar amount that we taxpayers are already subsidizing plants and lagoons we don't even use? We know the $5,50 /month utility fee to the individual doesn't begin to touch the actual cost. What we need is a thorough cost /benefit analysis that would include possible danger to the aquifer, major repairs, liability and depreciation write -offs among other things. 13. Since the drainfield in Aloha has already been replaced twice, where do we go from here? Are the new leach bed; at Hillview solving the drainage problem? How can the new Fainted Hills plant ever work when it's in a natural drainageway and the pipe to divert water flowing down the hill is already two - thirds full of debris? 14. If you insist on installation of this plant (Eidilome) w;11 you require compliance with RCW 90.48 by the DOE prior to further construction? 15. Will future conditions identify a responsible agency by name rather than vague references to "appropriate" agencies? 16, What specific steps will be taken to stop the common practice of construction prior to approval? Does the County presently have the legal authority to issue injunctions in such cases? QUESTIONS Pg. 2 17. Since we're talking the largest plant the County Engineers have operated, it would seem an EIS is in order. Many in this neighborhood are still on private wells and would not be thrilled with recharge from the 170,000 gpd of effluent, Is Chester in the major flow area of the aquifer? 'What is actually known about direction and rate of flow here and static water levels? Several years ago the water table in this area was dwindling rapidly, 18. How much sludge will this plant produce annually and where will it be dumped? 19. Since'I am `uidamentally opposed to children playing around the treatment plants, what can be done to make them more safe? I would suggest that any who consider such concerns'of no consequence make a trip to view the size and depth of this half finished plant, 20. Since the permit for the drainfield is illegible, can someone find out what the final capacity will actually be and what the permit cost? 21. Why doesn't the proposed i•i't0 call for upkeep of the grounds surrounding the plant? 'Won't it be a firetrap if allowed to dry out and doesn't the plant manufacture methane as a waste product? if so, how x ll the methane be disposed of and will it cause an odor problem? 22. I have not even icon able to 'set a figure on total land set aside for the plant, drain °field and (Ihope) buffers. 23.Is any of the "208" study being done in areas with high volume discharges of effluent? Wouldn't this be the most appropriate place for sensing devices? 24. What will be the projected energy use for Midilome? Any lirt stations? Chlorination? I would hope to meet with your staff to discuss the answers to each of the above as they are all legitimate questions deserving of a response, Please mail your written response to - -- Joan Honican S. 3904 Bowdish Rd, Spokane, WA, 99206 1 BACKGROUND ON PROBLEM AREAS IV SPOKANE COUNTY WITH REGARD TO SEWAGE DISPOSAL Submitted Sept, 8, 1977 to Spokane County Commissioners by Joan Honican 1) According to Soil Conservation Service naps, most of Spokane County has serious limiting factors for drainfield disposal, Much of the Valley floor has the opposite problem in that it is too permeable and presents little or no protection for our priceless, sole- source aquifer. 2) "The vertical distance from contaminating point to the water table has no great significance in the case of chemical contaminants, especially when large quantities of flushing water are involved." (i ; svelt- Saxton Report, Dec, '64) 3) Two documented instances of well contamination were from salts not bacteria. One well (the Great Northern in iiillyard) supposedly had 130 feet of protection from its .source of contamination, Once polluted, even people two miles north in Morgan Acres complained of the taste of their. water. Kaiser Trentwood's well was also contaminated by chlorides. The salts traveled vertically to the water table and then about 1,000 feet to the well, Since the Kaiser well is in an area of greater aquifer flow it is once again usable but, the Hillyard well, outside the area of major flow is still shut down, The wells were contaminated 23 years ago. 4) So- called Secondary Package Plants do not remove chemicals. They are only glorified septic tanks discharging to a single drainfield and, since the Dept, of Ecology refuses to issue Waste Discharge Permits, no testing is being done on quantity and quality of effluent from these plants. We therefore have no basis for comparison to support such plants as an improvement over individual septic tanks. I have been unable to find any tangible data on volume of discharge in relation to depth of penetration in extremely permeable soil. I have heard that some tests of local wells have turned up- :,..:u high nitrate counts thus supporting my contention that contamination of an underground water supply is an insidious thing. Most of. the testing is for conform bacteria but it appears the greatest danger lies in the cumulative effect of chemicals which do not dissipate like the bacteria. 5) There are no "Standards" for groundwater, With all the national emphasis on protection of surface waters there is a clear message to those who don't want to be hassled by DOE and EPA to discharge to drainfields. They will not have to get permits or do any testing and, as a result, no one will have the hard data needed to determine the extent of our disposal problems, Proof of this attitude is the flak the City receives for the mess at Long Lake while the County remains on the sidelines unscathed, The County even adds to the City's problems by using the City treatment plant as a drop for some of the millions of gallons of sludge pumped annually from County septic tanks and cess pools, The rest is dumped at strategic locations all around the County where it oozes to the surface despite any efforts to cover it. The County should be named a party to any legal action instituted by regulatory agencies for refusing to assume its responsibilities to provide adequate disposal outside the City limits, If the Valley incorporates, it will be at least the 5th largest city in the state and yet, it's rotten a free ride all these years on the back of the City. If the City should opt for subsurface disposal would our problems be over? P 2 6) The plans for the North Star Package Plant in head went through four agencies and the plant didn't last even a year. Over 200 calls were received in one day about the stench from a sparsely populated area. I don't need to tell you what will happen if the proposed 170,000 gpd plant goes belly up in this densely populated area. SCAFCA has received 33 complaints on odors from plants and la- goons since '74 and we all know that's just the tip of the iceberg, Many would call the Health District or other agencies or not even bother. ' The Dept. Ecology refuses to assume its mandated responsibilities under RCW 0 0.48. I wrote John Arnquist several months ago regarding the illegal con- struction at Hidilome and, to date, have received no reply. °C'.; 90.43.110 states, "Al). plans and specifications for the construction of new sewerage systems, sewage treatment or disposal plants or. systems, ,,, and the proposed method future operation and maintenance of said facility or facilities, shall be sub- mitted to and be approved by the commission, before construction thereof may begin." (Emphasis supplied) In addition, RCW 90,48,162 states, "..Any county or any municipal or public corporation operating or proposing to operate a sewerage system, including any system which collects only domestic sewerage, which results in the disposal or waste material into the waters of the state shall procure a (E permit from the department of ecology before so disposing of such materials," mphasis. supplied) :8) There is a major disagreement between the two state agencies DOE and DSHS as to who is responsible Cor approving plans for package plants like Hidilome, Tom Justus of DSHS maintains that WAC 248.96 was never meant to apply to mechanical plants of this magnitude and he can obviously not do a job with only three people on his staff to cover all of Eastern 'Washington and his responsibil- ities for drinking water supplies, A close reading of the Definitions section of WAC 248.96.020 would seem to support Tom's interpretation thus giving DOE primary responsibility for approving plans. Phis must be resolved, 9) There is another fundamental disagreement between the County Engineers and the Health District regarding drainfield design. health District regulations allow twice the ROD loading that the County Engineers will accept for m &o. It is obvious that responsibility is so fractured for approval of package plants that it will require a major effort on the part of everyone concerned to straighten things out, 10) No one can provide me with data on the actual deficit the County is presently running on the eight plants and lagoons it operates and yet, they are planning to assume three more this year, Also, most people are unaware of the fact that the County Park Dept, has made a commitment to maintain the grounds around ten sewage plants. They are presently maintaining three in return for $28,000 in equipment given them by the County Engineers, What we have is a Mickey douse sewage system coming in through the back door with all kinds of hidden subsidies, We even have small irrigation districts such as Vera operating package plants and lagoons at a loss to their customers, but few attend board meetings to learn they are picking up this loss with their electrical rates, You also put Vera in the position of having to approve plants without the expertise to do so. If the County Engineers aren't going to operate a facility they don't approve the plans. This opens up the possibility that Vera might accept a plant with the Health District's higher loading design and therefore compound their red ink when the drainfield has to be replaced, The question remains as to why they continue tb accept plants rather than giving them to the County Engineers for operation; Pg. 3 11) The grounds around some plants are actually. called mini -parks and children are encouraged to play in the only open space in a subdivision, There is a potential "attractive nuisance" problem in the event that a child would be in- jured or drowned in one of these facilities. Reprovable grates or screening are not required and liability is not clear since the County cannot actually own the plants since it has no Comprehensive Sewer Plan. The Midilome plant will be fenced but fences have never stopped curious children attracted by churning water and the hum of pumps and we are discussing a plant larger than many swimming pools with 10 to 12 feet of muck, So far we've been lucky and have only had rocks thrown into the sewage and pumps unplugged, We'd like to know if such installations are even insurable? 12) There is no clearcut responsibility or centralized data on such operations and, since permits and testing are nil, it is impossible to make any kind of rational decisions regarding their efficacy. To take the position that having a collection system in the ground supercedes all other concerns it irresponsible. There are other more important considerations than the dubious chance that you might at some future date be able to pick up some of these systems. The long -range costs of numerous lift stations and excessive energy use could outweigh the nebulous benefits. Not the least of our concerns should be-- -Are we creating a greater, potential for contamination by consolidating the wastes from over 400 homes in one small area? The attabhed data from a book in the County library called, "Urban Planning Aspects of 'dater Pollution Control" by Sigurd Grava helps put the package plant dilemma into uerspective, 13) There is a major breakdown in the planning process right here at the local level when a major modification to conditions and to a final plat can be initiated and constructed with no opportunity for adjacent property owners to be informed about an installation that could have an extremely negative devaluation effect_. Conditions are vague. Responsibility is not clear, And we've been advised by several people that construction prior to approval is commonplace. At least one - third of all projects go in this way and we are told that no one has the authority to do anything about it. We are no longer naive enough to assume regulatory agencies are doing their job in fact, we've become cynical' to the extreme, 14) When I requested a list of all package plants and lagoons in Spokane County from the Health District, several weeks ago, I was told they didn't have one, Since they must approve all the drainfields shouldn't they also have some records? We have also found that not only does DOE refuse to put domestic systems on permit they also refuse to require testing of commercial installations such as - -- Valley General Hospital, Red Lion, University City, etc, Doesn't anyone care what a hospital is discharging to our aquifer? 15) RC'd 58,1 ?.160 (Platting Law) requires that each and every plat or replat of any property filed for record shall - -- "(1) Contain a. statement of approval from the city, town or county licensed road engineer...as to the survey data, layout of streets, alleys and other rights of way, design of bridges, sewage and water systems and other structures," (Emphasis supplied) The dedication on the final plat contains no reference to approved sewage disposal, l�.i:"_Ar." -.
