A., FINDINGS
MINUTES
APRIL 15, 1977
1. The proposal as submitted is located within the Spokane Metropolitan
Area. Specifically, the proposal is located in the south central area
of the Spokane Valley, north and east of the community of Chester.
2. Guthrie's Valley View 10th Addition is located within an area designa-
ted as suitable for residential development by the approved map of
the Park and Recreation element of the Spokane County Comprehensive
Plan and its accompanying text.
3. The applicant requests preliminary approval for the subdivision of
approximately 21 acres for 58 single family dwellings (gross density
of 3 units /acre) .
4. The applicant controls approximately 50 acres of additional property
that is located to the east of the proposed development. The propo-
nent states in his preliminary plat application that he wishes to deve-
lop this land at some future date.
5. At the time of this publication, no development plan has been submitt-
ed for the remainder of the property controlled by the applicant. This
information is necessary so that the appropriate county department
might review the impact of the entire anticipated development upon
such items as traffic circulation, drainage control, fire protection,
adequate water supplies, sewage disposal, etc.
6. There appears to be a problem with seasonal flooding within the area.
The Spokane County Health District has stated "individual on -site
sewage disposal systems will be accepted for sewage disposal in the
plat only where the surface area of the drainfield is at or above 2008
feet elevation or such other elevation as the County Engineer shall
establish is 'minimum entry elevation' for the structures in the plat."
(This affects approximately 1/2 of the proposal.)

7. The Planning Commission in April, 1976, approved a proposal
directly to the north of this proposed subdivision. It appears that
the two designs have not been properly coordinated to allow for
proper traffic circulation in the area
8. Due to the circumstances of Numbers 6 and 7 above, there is not
sufficient information available to make a determination of the envir-
onmental significance of the proposal (WAC 197 -10 -320). Conse-
quently, as per SCEO 11.15.330, additional information gathering
techniques shall be applied to gain more data to adequately assess
the environmental impacts. Such additional studies from the appli-
cant and reports from the appropriate agencies shall be requested.
9. Sponsor has not had sufficient time prepare the above described in-
formation necessary for the staff to both assess the possible environ-
mental impacts and to adequately examine the proposed design.

1. At the time of this publication, no development plan has been submitted for
the remainder of the property controlled by the applicant. This information
is necessary so that the appropriate county departments might review the im-
pact of the entire anticipated development upon such items as traffic circu-
lation, drainage control, fire protection, adequate water supplies, sewage
disposal, etc.
2. There appears to be a problem with seasonal flooding within the area. The
Spokane County Health District has stated "individual on -site sewage dis-

WHEREAS, Mrs. Frank Gerimonte, did by letters dated March 30, 1978 and
April 7, 1978, request a special public hearing before the Board of County
Commissioners for the purpose of presenting evidence and testimony against the
Board's issuance of a proposed declaration of non - significance with regard to
the change of condition for Malloy's Addition to fill an area for approximately
62 homes, creating an 11 acre barrow sump and permitting septic tanks rather
than a sewage collection system; and,
WHEREAS, the Planning Director did advise the Board of County Commissioners
by memorandum dated April 17, 1978 to schedule a hearing for the reconsider-
ing of the proposed declaration of non - significance, and consequently the plat
proposal itself; and,
WHEREAS, the Board of County Commissioner did hold a public hearing on
the reconsideration of the proposed declaration of non - significance and to take
testimony of the plat sponsor, objectors, and other interested parties; and,
WHEREAS, at said hearing opportunity was afforded those favoring and
those opposing the above described proposed declaration of non - significance
and change of condition to the preliminary plat and zone change, the. Board of
County Commissioners of Spokane County having fully considered the testimony
given, the records and minutes of the Planning Commission, the Planning Depart-
ment staff's recommended conditions to which the change of conditions for
Malloy's Addition would be subject, the environmental review, and all other
evidence presented, and further having previously personally acquainted them-
selves with the site and vicinity in question, does hereby find that sufficent
data was presented to raise serious questions with regard to the project's
impact on the physical environment particularly in light of the recent Appellate
and Supreme Court environmental decisions.
NOW, THEREFORE, the Board of County Commissioners does conclude that a
declaration of significance should be and hereby is issued by the Chairman for
the preliminary plat known as Malloy's Addition, PE- 1086 -77 and zone reclass-
ification to Single Family Residential; and any and all previously issued pro-
posed or final negative threshold determinations are hereby rescinded.
FURTHERMORE, the subject plat is to be remanded to the Planning Commission
for a public hearing with a final Environmental Impact Statement, at such time as
one becomes available, and after legal notification of the hearing as per standard
Planning Department procedures for a proposed preliminary plat.

STAFF FINDINGS REGARDING PE- 1053 -76 and P O1 86 -5, OW KNOWN AS
MALLOY'S ADDITION.
I. HISTORY:
A. Guthrie's Valley View 8th Addition. PE- 1053 -76„ was conditionally
approved by the Board of County Commissioners in late 1976. A
condition of approval authorized the use of individual on -site sewage
systems for each lot. Subsequent to that approval, the Health
District revoked their approval of such systems as the area in which
the plat is located is new designated as a flood hazard area.
B. Guthrie's Valley View 1'Oth Addition. PE- 1086 -77.. was conditionally
approved, on an appeal basis, by the Board of County Commissioners
in mid -1977. A condition of approval required that the property be
diked in a manner acceptable to the appropriate departments, as well
as requiring a public sewer system to serve the proposal. Other condi-
tions of approval were developed to meet the requirements of the
National Flood Insurance Program.
II. PROPOSAL:
The applicant is now requesting a change in conditions from the above
referenced conditions. He now proposes to subdivide the 25 acres into
about 66 lots all for single family dwellings -- using individual on -site
sewage systems. He further proposes to "fill" the property so as to bring
the proposal in compliance with the National Flood Insurance Program.
III. STAFF OPINION:
Comments have been received from the County Health District and the County
Engineer's Office regarding this new proposal. Both offices are to agreement
that, in concept, the proposal would meet the needs of the flood insurance
method; and, secondly, that with the appropriate conditions this could be
a viable solution.
IV. ENVIRONMENTAL REVIEW:
The Staff of the Planning Department has reviewed tie environmental checklist
and slight adverse impacts are noted under the following questions: earth,
air, water, flora, fauna, noise, light and glare, land use, natural resources,
population, housing, transportation, - public services, and utilities. It is the
opinion of the Staff that with proper conditions no significant adverse impacts
would tesult from this proposal and a proposed declaration of Non - Significance
should be issued.

V. CONDITIONS:
The Staff recommends the following conditions of approval of the change
is granted:
P -2, P -3, P -4, P -5, P -6, P -7, P -8, P -9 (March 1, 1979), P -13,
E -1, E -2, E -3, E -4, E -5, E -6, E -7, E -8, E -9, A -1, H -5.
Upgrade all of Malloy's Addition to the Single Family Residential Zone
Classification.
Prior to the filing of the final plat, the revised plat design shall be reviewed
and approved by all appropriate departments.
That the property be filled in a manner acceptable to the County Engineer and
County Health District to protect the proposed development from flooding.
That the fill material be approved by both the Health District and the County
Engineer.
That assurances be given in a form acceptable to the Spokane County
Engineer so as to:
a) guarantee that excavation be made to replace the sump volume

WHEREAS, the Spokane County Planning Commission did, after public hearing
on May 13, 1977, forward to the Board of County Commissioners a recommendation
that the preliminary plat to be known as Guthrle's Valley View 10th Addition
(file number PE- 1086 -77) and Zone Upgrade to the Single Family Residential Zone
Classification (file number ZE- 46 -77) be denied and
WHEREAS, Ralph Guthrie, did by letter dated May 25, 1977, request a special
hearing before the Board of County Commissioners to present eveldence and testimony
against the recommendations of the Planning Commission to deny the above described
preliminary plat and zone change upgrading, and
WHEREAS, the Board of County Commissioners did hold a public hearing on
June 16, 1977 to consider the recommendations of the Planning Commission and
testimony and request of the applicant, objectors and other interested parties, and
WHEREAS, at said hearing opportunity was afforded those favoring and those
opposing the above described preliminary plat proposal and zone change upgrading,
the Board of County Commissioners of Spokane County having fully considered the
testimony given, the records and minutes of the Planning Commission, the environ-
mental assessment, and all other evidence presented and having personally
acquainted themselves with the site and vicinity in question, does hereby find that
the conclusions of the Planning Commission were not generally valid and sufficient,
in that the below referenced conditions will adequately mitigate any flood hazard
problems:
1. That the property be diked in a manner acceptable to the County
Engineer to protect the proposed development from flooding, The
minimum design frequency to be used shall be a 50 year design for
sizing of local storm - drainage facilities.

A. FINDINGS
1. The applicant requests repliminary approval for the subdivision of appro-
ximately 22 acres into 56 lots for single family dwelling with a gross
density created of about 3 units per acre.
2. The proposed subdivision lies within the Plouf Creek Drainage Basin
and has been designated as a flood hazard area.
3. Pursuant to the regulations of the National Flood Insurance Program, the
Spokane County Health District will not accept those areas below 2008
contour elevation for on -site sewage disposal. The Flood Insurance
program also states that no structure permits for habitable use shall
be issued. This affects approximately 1/2 of the proposal.
4. The applicant proposes the following methods to mitigate the potential
flooding problem:
a) A public sewer system to serve the proposal.
b) A dike to protect the area.
5. In connection with the public sewer system, the applicant proposes a
treatment plant that woul d be located in the northwest corner of the plat
with drainfield sites along rear lot lines. The Spokane County Engineers'
office expressed concern over the proposed method for the following rea-
sons:
a) The Engineers' office has not been approached as to who will
have the responsibility of maintenance of the system, and
b) The Engineers office would recommend that entire lots be set
aside for drainfield sites rather than portions thereof. Mainten-
ance problems would be minimized using this approach.
6. In connection with the above mentioned dike, concern has been expressed
over the pure practicables of the method as well as the possible legal
implications that might arise. As far as the practical aspect is concern-
ed, the creation of a dike would probably be quite unsightly and special
landscaping requirements would be necessary.

The applicant proposes to move dirt from the east and south of the proposal
to create the dike. This ';Borrow" method might also create a rather un-
sightly condition and once again, special landscaping would probably be
required. The question also arises as to who would actually own the dike
and have the responsibility for its maintenance. Spokane County would
probably not wish to assume that responsibility. Concerning the legal
aspects of the dike, the proposed method might, in fact, alleviate the
potential of the proposal flooding but the dike would•create an artificial
barrier to flood waters and may, in fact, create a potential flood problem
in an area that has not been currently designated as such.
7. The staff of the Planning Department has reviewed the environmental check-
list as submitted by the applicant, and the staff recommends that a
Declaration of Non- Significance be issued.
8. The Planning Commission will consider a redesign of the proposal, if
the proposal only includes that area not susceptible to flooding.

One of the requirements set forth by the Spokane County Planning Commission in
consideration of the preliminary plat of Myron Estates r8, involved the construction
of a new crossing of the Union Pacific Railroad, located in the immediate vicinity
of the preliminary plat proposal. The requirement was contained in the Planning,
Commission Minutes of November 19, 1976, as Condition Number 12, (copy attached).

the improvement of the new crossing and connection road would be $15,000. The
negotiations and resulting $15,000 cost sharing figure did consider the amount
of developable area proposed in Myron Estates !P8 relative to both the remaining
developable area which would be served by the new crossing and the presently
developed area of the Myron Estates, which would also use the new crossing.
Generally speaking, the County's share would be for the presently developed area
and the connection from the tracks out to the Dishman -Mica Road, with the remaining
cost of the crossing improvement prorated and shared between the Myron Estates #8
proposal and future developments, located within the area served by the new crossing.
Since it most likely will take sometime to deal with both the Union Pacific Rail-
road and the Washington State Utilities and Transportation Commission in regards
to the actual approval, location, and construction of the crossing, we would
recommend bonding for this condition by a savings account assignment established
by your bank specifically for this purpose. A savings account assignment form
is attached for your use.. The assignment form properly executed by your bank
and returned to this office will be required prior to the filing of the final
plat for Myron Estates P8.
